00:00The arrest is the pivotal moment in any investigation.
00:07If you get it wrong, then it's game over.
00:13Police officer with a taser.
00:18Taser, taser, taser!
00:21Taser, taser, taser!
00:39Everything they're doing is on body warm video.
00:42Police!
00:44Everything they're doing would be examined by defence lawyers.
00:49They can't make any mistakes.
00:51I haven't done anything wrong!
01:11You see a man walking to the front of the car park.
01:16He sits on the floor and then a family cycling by see him and stop and that's when the emergency services are called.
01:27The cyclists who have found him sat on the floor in the car park, emotional, with his arms bleeding, established that he has been stabbed.
01:37They contacted the police and the ambulance and say that they've got this male here who has got stab wounds and they suggest that there's possibly someone else with injuries.
01:48The reality is there is a woman, Claire Parry, half hanging out of the driver's seat of a car and fighting for her life.
02:03Dorset police and paramedics arrive.
02:05Dorset police and paramedics arrive.
02:06Dorset police and paramedics arrive.
02:07To find the injured man is someone familiar.
02:10Timothy Bramer, a local police officer.
02:14The chances are they probably know Timothy Bramer.
02:25He's a fellow colleague.
02:27Dorset's not the biggest police force in the UK.
02:30So a lot of these people would know each other.
02:33Get him in there.
02:34Get him in there.
02:35We'll leave the question to you guys.
02:36We'll just medically look at it and go from that way, can't you?
02:39Right, Tim.
02:40Yeah, yeah, no problem.
02:43I'm going to, I'm going to check these.
02:45Can you stand up?
02:46Do you want some hands?
02:47Do you want hands?
02:48Ready?
02:49One, two, three, three.
02:50And so when you turn up and you see a fellow colleague in different circumstances other than work, so he's not wearing a top, he's not in uniform, he's clearly got an injury, he's very emotional.
03:02He can confuse you a little bit and you, you know, you're trying to get your senses as to what's going on here.
03:07But obviously, he's a colleague, they are going to be thinking that he's honest and he's telling the truth.
03:15The account that PC Timothy Bramer gives to paramedics is noted by the police officer.
03:21Inside the ambulance, it's double checked.
03:25I've just obviously, because I've been listening to what's been said, I've written down what you've said to me, what's been said, right?
03:30So when anyone makes comment to a police officer, ideally under caution, it's important to keep an accurate record of what that person says.
03:40And that's called a significant statement.
03:43When we first got here, when I first saw you outside, you were asked by the paramedics what was happening.
03:50And so it could become significant later on when you're having an interview with somebody, particularly if they change their account as to what they told officers at the scene.
03:58You said something to me, so I was having an affair with her. She got me to meet her here. She was going to tell my wife.
04:13Claire Parry suggested they meet at three o'clock that afternoon at the Horns Inn, which is a pub in a small village called West Parley, just outside of Bournemouth.
04:21Timothy Bramer arrived about half an hour early, actually, about 2.30 and pulled up in the car park, waiting for Claire to arrive.
04:33And 15 minutes later, about 2.45pm, Claire Parry arrived in her car, pulled up beside him, got out of her car and then got into the passenger seat of Bramer's vehicle.
04:44They'd been having an affair for 10 years while they were both married.
04:51And she said, I'm going to tell your wife, I'm going to disclose what's been going on between the two of us.
04:59He's obviously panicked by this, doesn't want that to happen and pleads with her to not tell his wife.
05:05And it appears that she grabbed his phone and texted Bramer's wife, saying, I am cheating on you.
05:13That's when a fight seems to have broken out and only one of them walked away from the car.
05:20As paramedics rush to help Claire Parry, inside the ambulance, a police officer checks the details given by Timothy Bramer.
05:41You said something to me, so I was having an affair with her, she got me to meet her here.
05:46She was going to tell my wife.
05:48And then just now, when you're given the paramedic a bit more of the details, the female arrived.
05:54You all right there? Sorry.
05:56Yeah.
05:57The female arrived after me and jumped in my car.
06:00She was so angry, she was going to tell my wife we were having an affair for years.
06:06She was going through my phone.
06:08I don't remember what happened.
06:10She was going through my phone.
06:12I think she told my wife I was going to drive off and kill myself.
06:16The wounds were caused by a pen and knife in my car.
06:19I've had it for years.
06:20Don't remember what happened.
06:22Just felt it go in, I think, three times.
06:28If you're happy, that's basically what you've said to the paramedic.
06:31Obviously not word for word.
06:32If I can get you to sign your life away for us there, please.
06:35It is good practice to get significant comments signed to show it's a true and accurate record of what's being said.
06:41Now, in this day and age, even better, we have body-worn videos.
06:44So that cannot be disputed.
06:46All right, Tim, this research is going to get arrested.
06:49At the moment, I'm arresting you on suspicion of attempted murder.
06:54That's quite interesting.
06:55He's sat there just signing the pocket notebook, blowing his nose,
07:00and then the officer tells him he's going to be arrested,
07:03and it's almost surprised that he's being arrested.
07:06At the moment, I'm arresting you on suspicion of attempted murder.
07:09Do you not have to say anything?
07:10It shows almost a level of arrogance to think that he was actually going to get away with this
07:14and they were just going to accept his account
07:16and let him go off to hospital without being arrested.
07:19Do you not have to say anything?
07:20Do you not have to say anything?
07:21Do you not mention my question?
07:22Somebody there at Lyman call.
07:23Anything you do say may be given evidence.
07:25OK?
07:26Obviously, we're going to let the paramedics take you down, sir, to hospital,
07:29get you all checked out first.
07:31Obviously, you know the process from there, all right?
07:33Yeah.
07:34Yeah.
07:35It's all right.
07:36I'm so sorry.
07:37That's all right.
07:38Oh!
07:39That's fine.
07:40We'll get you down to hospital so we can get you all checked out
07:42and then we can do it from there, all right?
07:44Yeah.
07:46So, initially, he was arrested on suspicion of attempted murder.
07:49Claire was still alive.
07:51She was unconscious and she really was fighting for her life in that car
07:54at the back of the car park.
07:59Detectives begin their investigation.
08:02The two patients are taken to separate hospitals.
08:06The life of Claire Parry, aged 41, is now in the hands of her medical colleagues.
08:12Claire Parry was a married mother of two.
08:16She worked as a nurse in Bournemouth for 20 years.
08:19She had massive internal bleeding.
08:22She had lots of bruising along her jawline, on her neck,
08:26and there were 31 separate sites on her upper body of blunt force trauma.
08:39Despite fighting hard and despite the medics doing all they could,
08:43she passed away the next day.
08:51Bremer was then re-arrested on suspicion of murder at Salisbury Hospital.
08:55And there's more body-worn camera footage of that arrest.
08:58And again, you see the hysterical Bremer that we saw in the footage from the day before.
09:02The footage, which wasn't released to the public, shows Timothy Bremer sobbing.
09:10He was very sorry, but he kept saying,
09:13I'm not a bad man, I'm not a bad person.
09:16I'm going to go to prison.
09:17I'm not going to see my son for a number of years.
09:20It's all about him.
09:21There's no real reference to Claire and what damage he's done to her,
09:25to her family, and also his wider family as well.
09:29It's all about him.
09:30He's very focused on the impact it's had on him.
09:35Self-pleading and self-serving.
09:38A policeman trying to deceive the police.
09:42It was clear to me that he was lying
09:44and he was lying all the way throughout that process.
09:46And this is what you find in murder investigations,
09:48is that you have to lift the lid and you start scratching around
09:51and all sorts of things come out of the woodwork.
09:59The nurse has died after being found unconscious with serious neck injuries.
10:15Claire Parry, aged 41, a mother of two, was rushed to Bournemouth Hospital
10:20as paramedics treated a man found nearby for knife wounds.
10:24The man who's recovering at Salisbury District Hospital
10:29has been named as Police Constable Timothy Bramer, also married.
10:34He's been arrested on suspicion of murder.
10:39How can they have an affair for ten years
10:41and how can it come to a stage where someone's lost their life?
10:44It was a big shockwave through the community.
10:47It was a really intense case.
10:57Timothy Bramer was a 41-year-old police officer
11:00stationed in Dorset on the south coast.
11:03He'd been at police officers for about 17 years.
11:06Most of his career was in the roads policing unit,
11:08so that's the traffic department that deal with speeding motorists
11:11and also attend road traffic accidents.
11:14Bramer was a popular police officer.
11:16He was good at his job, and on one occasion,
11:19him and a colleague were commended for their bravery
11:21where they came across a burning building,
11:23broke into that building and rescued a family.
11:26So he was quite well-known within Dorset police.
11:29Bramer was married, he had a child, and on the face of it,
11:33he was seen as this doting husband and doting father.
11:36But he had a secret life, a double life, as it were.
11:39Bramer and Clare met whilst Clare was working as a nurse
11:47at the Bournemouth Hospital.
11:49Bramer, being a roads policing officer,
11:52he would have had occasions to have gone into the hospital
11:55to either deal with accident victims or drink driver cases
11:59and that sort of stuff.
12:00So they struck up a friendship,
12:01which then turned into a relationship fairly quickly.
12:04But obviously, at that time, he was married
12:06and Clare knew nothing about this.
12:08Now, a year later, Clare married a police officer,
12:11also from Dorset, but the affair continued as far as we know.
12:14You said, so I was having an affair with her.
12:20She got me to meet her here.
12:22She was going to tell my wife.
12:25The investigation confirms that Clare Parry
12:27did want the meeting with Bramer,
12:30because she discovered more secrets about him.
12:35I think Clare was becoming wise to who Bramer really was.
12:39I think she was so infatuated by him throughout their affair
12:43that she didn't realise that he was a womaniser.
12:47Clare Parry started to become suspicious,
12:49so she did her own detective work
12:51and she actually found out that he was seeing
12:53another police officer in the same force.
12:56So this was a second affair that he was having.
12:59Both women got together, they started to confide in each other
13:02and they were suspicious that there might even be other women
13:05on the scene as well.
13:08That's when Clare Parry said that she was going to ruin Bramer.
13:11She described her feelings as hell hath no fury
13:15and said that she was going to bring down Manhall Bramer,
13:19as she called him.
13:21She realised who he was, wanted him to tell his wife
13:24and that was why they met up eventually at the Horns Inn in West Parley.
13:28The arresting officer reads to Bramer the details he gave to paramedics.
13:34The man arrived after me and jumped in my car.
13:38She was so angry.
13:40She was going to tell my wife we were having an affair for years.
13:43She was going through my phone.
13:45I don't remember what happened.
13:47She was going through my phone.
13:49I think she told my wife I was going to drive off and kill myself.
13:53In his account, Bramer tried to play down what had happened in the car.
13:57It's very much like he was trying to control the situation
14:02and minimise the severity of what we know really did take place.
14:06He claimed that Clare Parry had refused to get out of his car.
14:10And that's where a bit of a disagreement emerged in the car,
14:13what he later described as being a kerfuffle.
14:16He said that as he was trying to drag her from the car,
14:19he accidentally applied pressure to her neck.
14:24And then she just was struggling to breathe and he left her there.
14:27So as far as he was concerned, he hadn't killed her.
14:30She wasn't in any particular danger.
14:32She was just struggling to breathe.
14:34And he then walked off to get sympathy
14:37and to get the emergency services to him.
14:42But Clare Parry's autopsy revealed a different story.
14:49She died as a result of compression to her neck.
14:52She had fractures in her neck.
14:54She also had numerous blunt force injuries to her trunk area
14:59and to her arms.
15:01And this clearly shows that there was a strong physical fight
15:04going on in that vehicle.
15:06But ultimately, it was the compression to her neck
15:08which starved her brain of oxygen that killed her.
15:11The pathologist said that for those injuries to be sustained,
15:14it would have had to be done by more conventional strangulation.
15:17They threw out the idea that it was in the crook of the neck,
15:19which was Bremer's version of events,
15:20as he was trying to get Clare out of the car
15:22so he can go off and kill himself.
15:26I was going to drive off and kill myself.
15:30After the arrest, the investigation discovered
15:32the full extent of Timothy Bremer's deception.
15:35So that message is sent at 3.02 in the afternoon to Bremer's wife,
15:45and obviously she's shocked to receive that message.
15:48But what's more unnerving is three minutes later,
15:51Bremer, having had this argument with Clare,
15:54then takes this deliberate action to do a factory reset on his phone,
15:59which wipes all of the data from his phone,
16:01knowing that there's probably some incriminating evidence on there
16:04that he doesn't want anyone to see.
16:09Next, with bloodstains on his shorts and shirt,
16:12Bremer told the cyclists that he'd been the victim of an attack.
16:16He showed them his arm. He claimed he'd been stabbed.
16:21So one of the cyclists called 999.
16:25The terrible thing here is,
16:27because Bremer had accused Clare of attacking him,
16:31because he claimed he'd been stabbed,
16:33that meant the 999 operator said to the cyclist who made the call,
16:37don't go near the person in the car,
16:39thinking they could be dangerous.
16:41What did that mean for Clare?
16:42It means she never got the help she so desperately needed.
16:45Bremer is thinking,
16:49oh, my goodness, what have I done?
16:52What can I do to get out of this?
16:54So he's already thinking ahead as to, you know,
16:57what are the police going to ask me?
16:59What can I say?
17:00How am I going to make this look like either an accident
17:03or that I am defending myself?
17:05So his initial account is that I was stabbed by Clare
17:09and I was trying to get her out of the car.
17:11That's a classic self-defence defence.
17:14But his story changed as he was arrested.
17:18Knowing his statement would be used as evidence,
17:21Bremer, a policeman, didn't blame Clare directly.
17:25The wounds were caused by a pet knife in my car.
17:29I've had it for years.
17:31Don't remember what happened.
17:32Just felt it go in, I think, three times.
17:35Now, interestingly, what he's then done
17:37is he's then slightly changed his account,
17:39saying, I don't really know how those stab wounds appeared.
17:42His mind is whirring.
17:44He's trying to second-guess what's coming next.
17:46And he will know that when the police officers are saying to him,
17:49can you sign my pocket notebook as to what you've said.
17:52Can I get you to sign your life away for us there, please?
17:55He will be thinking, yeah, they've got me on what I've said already.
17:58They've, you know, I've committed to that.
18:00So I've got to stick with that story.
18:02And if I don't, it's going to look bad for me.
18:04All right, Tim, as you said, you're going to get arrested at the moment.
18:08I'm going to arrest you on suspicion of attempted murder.
18:10You don't have to say anything for me.
18:11I'm just going to make sure my question,
18:13somebody there at Lyman call.
18:14Anything you do so may be given evidence, OK?
18:16Obviously, we're going to let the paramedics take you down to the hospital,
18:19get you all checked out first.
18:21And, obviously, you know the process from there, all right?
18:24Yeah. Yeah.
18:25I'm so sorry.
18:27I'm so sorry.
18:28That's all right.
18:29Oh!
18:30He just gets very emotional.
18:32You know, he's sobbing uncontrollably.
18:35He's also probably trying to think about how do I play this out
18:38so that it looks like I am a bit of a victim in all of this.
18:50In custody, Bremer's story changed a third time.
18:54Now, he confessed he stabbed himself because he was suicidal
18:58and Claire didn't care.
19:02He confessed that actually the injuries that he had sustained to his arm
19:09were self-inflicted and they weren't caused by Claire.
19:13I think he's now starting to work out that actually he knows
19:16that the police could probably show that these wounds are self-inflicted,
19:20so that kicks out his argument of self-defence straight away.
19:24Timothy Bremer stood trial, charged with the murder of Claire Parry.
19:35But the trial judge ruled that Bremer qualified for a defence of loss of control,
19:41caused when Claire Parry texted his wife about their affair.
19:45Relatives of disgraced policeman Timothy Bremer hugged in court today as he was cleared of murder.
19:52Bremer, aged 41, killed Claire Parry after she sent a text to his wife revealing their affair.
19:59Bremer claimed he never intended to hurt Claire
20:02and the jury accepted his guilty plea to the lesser charge of manslaughter.
20:09Police and prosecutors decided to challenge the sentence of just ten and a half years.
20:15Mr Bremer was a serving Dorset police officer at the time he committed this offence.
20:22Officers swear an oath to protect the public, but he did the opposite.
20:28His criminal actions on that day were contrary to all policing values.
20:34The conviction of manslaughter and the sentencing of ten and a half years
20:42caused much upset and distress for Claire Parry's friends and family.
20:47They said it was far too lenient.
20:49So the Attorney General's office referred it to the Court of Appeal
20:53and they upped that sentence to thirteen and a half years in jail.
20:57I think what's important to remember is that there's more than one victim.
21:06Claire obviously is a victim, but so is her family.
21:10Her husband, who actually wanted to try again with their marriage.
21:14And also Bremer's wife is a victim.
21:16She had no idea who he was, effectively.
21:19He would have been a trained first aider.
21:22He would have gone to numerous road traffic accidents
21:25where people would have had serious life-threatening injuries
21:28and the first thing you do is one of the first things you do as a police officer
21:31is to save life and limb, you know, that's what you sign up for.
21:34And he hasn't done that, he's just walked away.
21:37He's thought about himself, thought about, I can't incriminate myself
21:40so I'm just going to delete my phone.
21:42And then he plays the victim to the members of the public that are walking past.
21:46Outrageous, really.
21:49In terms of summing up Timothy Bramer and his character,
21:53I think, well, he couldn't have put it better himself
21:56when in court he described himself as a devious bastard.
22:00He's driven himself to Costa Coffee.
22:05He's parked his vehicle.
22:10And he's walked in.
22:15What we see in this CCTV is a man sitting down and he's told staff that he's been attacked.
22:36And he appeared to be a man in great distress, crying, terrified that people were after him.
22:4836-year-old Luke Dan claims he was targeted while driving his car.
22:55Dan's story was that he was attacked by this individual,
23:00being in mind this individual was on foot.
23:02And Luke Dan was in a fairly sizeable vehicle at the time, his Range Rover.
23:08And he said he was attacked.
23:10And then he tried to get away from the attack.
23:12The Costa staff sat him down and calmed him down and said,
23:16we'll call the police, we'll help you out.
23:24Go ahead, caller, what's your emergency?
23:26Hiya, I work at Costa Coffee Marshmills.
23:28And we've just had a man come in.
23:30He's been attacked, he's saying.
23:31He's, like, quite shaken up.
23:32He's got, like, blood on him.
23:33We don't really know what to do with him.
23:35But he's, like, not letting anyone leave his side.
23:37Is he still with you now, yeah?
23:39Yeah.
23:40We've got him sat down, offered him a drink and that,
23:43but he doesn't, he's, like, quite shaken up.
23:45The staff are trying to show some sympathy to Luke Dan.
23:50It's clearly a very unusual thing that's just happened to them.
23:53They were just about to close.
23:55OK, does he need an ambulance?
24:00I don't think so, I'll ask him.
24:02No?
24:03Does he need an ambulance?
24:07I don't think he does.
24:08He seems to find he's just quite, like, upset.
24:11OK.
24:12Leading in the deer.
24:13OK.
24:14OK.
24:15What's his name?
24:17What's your name, sorry?
24:19Luke.
24:20Luke Dan.
24:21Luke Dan.
24:23Is that D-A-N?
24:26Is it D-A-N?
24:28Or double N?
24:29Double N.
24:30Double N.
24:31Double N on the N and N.
24:33He comes across as somebody who is fearful
24:36and has been shaken by the events.
24:40He's attracting quite a lot of sympathy.
24:43He's been attacked.
24:44He doesn't know whether it's male or female.
24:47Do you know anything about the person?
24:49Do you know the male or female?
24:50No, he's not responding, sorry.
24:51No.
24:52OK.
24:53And does it look like he's been attacked with a weapon?
24:55Yeah.
24:56Um, sorry.
24:57Does it look like he's been attacked with a weapon?
24:58Yeah.
24:59Um, sorry.
25:00Does it look like he's been attacked with a weapon?
25:01Were you attacked with a weapon?
25:02Do you know?
25:03No.
25:04No.
25:05No, he doesn't know.
25:06He's, like, crying.
25:07He just thinks he's in shock.
25:08The Costa staff reported what they saw,
25:09which was a man terrified, seemingly, for his life.
25:10You say he's got blood coming out of his ear?
25:11Yeah.
25:12Um, not literally coming out, but there is bleeding.
25:14Yeah.
25:15Has he got any other, like, facial injuries or anything?
25:16No, not that I can see.
25:17No worries.
25:18I will get that sent across.
25:19Um, so we'll get our next available officer out to you.
25:21Are you all right?
25:22Lovely.
25:23Thank you so much.
25:24You're welcome.
25:25Bye.
25:26Bye.
25:27Bye.
25:28Bye.
25:29Bye.
25:46While police deal with this call, there's also a report of a serious hit-and-run driving incident,
25:53just half a mile away.
25:55Eyewitnesses heard an argument between a driver and a pedestrian on a private residential road.
26:02Next, through the darkness, they saw the car run over the pedestrian.
26:07His name, David Kelly, aged 42.
26:13The witnesses were clear that, yes, Mr. Kelly had been aggressive, but that the other man
26:19then drove his vehicle at Mr. Kelly.
26:24Witnesses report that the car then ran over David Kelly a second time.
26:30This Range Rover vehicle drove over him, across his thigh, across his chest, which ruptured
26:35the aorta, and across his head, causing crushed injuries to the skull.
26:40And he drove off after that.
26:42And David Kelly died as a consequence of those multiple injuries shortly thereafter.
26:51Finally, witnesses said the large, dark car drove off into the night.
26:56Meanwhile, police also respond to the man in the coffee shop, who says he's been attacked.
27:03At the time, the police officers are deployed to Costa to try and make sense of it.
27:09The police have got a lot of information coming into them from the control room.
27:14So they're getting information coming in at the same time.
27:17They're asking Luke Dan for his account of his attack.
27:21And this is where the police investigation begins, where they will try to get to the bottom
27:28of what turned out to be a very elaborate lie.
27:31Yes, what's happened?
27:38You got attacked by who? You don't know who? How has it happened?
27:48The police officers probably received information that there's been a hit and run.
27:53He's probably got the description of that vehicle, a large black vehicle.
27:58You got attacked by who? You don't know who? How has it happened?
28:02And they're thinking that something's not quite right here.
28:07Here is a man who is saying he's the one who's at risk,
28:12when in fact they're getting reports that someone has been run over
28:17and sustained very serious injuries.
28:19Do you own a car, mate?
28:21What?
28:22Yeah.
28:23Yeah.
28:24What car do you own?
28:25I own a few different cars.
28:28OK, what are they?
28:29I own a few different cars.
28:31I own a Range Rover car.
28:32OK, what do you own?
28:33I own a Range Rover car.
28:38You own a Range Rover, do you?
28:39Yeah.
28:40What colour?
28:41Black.
28:42OK, is it that one up there, is it?
28:47OK.
28:48The police officer is trying to assess who owns that vehicle.
28:51Police officers are no doubt receiving information about the vehicle which is made of
28:56and the vehicle which is parked outside Costa answers that description.
29:01The police officer seeks confirmation that the Range Rover was used by the man being questioned.
29:10OK.
29:11Guys, have you seen anything at all?
29:13Uh, he literally, uh, out of the car decided to put it in the trash.
29:18That car came into his driveway.
29:21OK.
29:22And then he's here.
29:23And then he's come in here.
29:24Yeah, he's come in here.
29:25So, that would be extended.
29:27OK.
29:28All right.
29:29He's now establishing from an independent witness that that individual, Luke Dan, has come from that vehicle into the coffee shop, which has shown good presence of mind by an operational police officer who's getting a load of information at the moment.
29:43OK.
29:44509, I'm with the owner of a black Range Rover.
29:46We'll be going Code 9 shortly.
29:47OK, bud.
29:48At this moment in time, you're under arrest and suspicion of murder.
29:53At this point, the officer is really quick to make his decision.
29:57He's seen the vehicle outside, which he believes has been at the centre of this incident.
30:01He's seen that very evasive behaviour from Luke Dan.
30:05He doesn't believe him.
30:06And he decides to arrest.
30:08All right.
30:09So, he's made that decision.
30:10And he's now said he believes he's got enough suspicion to suspect that individual has committed an arrestable offence, on this occasion, murder.
30:19All right.
30:20Do you have to say anything at home in defence?
30:21If you do not mention a good question of something, should you let it rely on the court?
30:24Anything you do say may be given evidence.
30:25A decision that's taken him less than two minutes to make.
30:29Do you understand?
30:36He knows what he should do, and he's done it.
30:38And he's very clear to Luke Dan, at that time, exactly what is happening to him.
30:43He's being arrested on suspicion of murder, and he's cautioned.
30:55Police suspect the man in Costa Coffee is the driver in a hit-and-run case.
31:15The victim, David Kelly, is dead.
31:18Under arrest, the driver, Luke Dan, proclaims his innocence.
31:30Out of vision, the officer is handcuffing Luke Dan.
31:33What are you doing to me?
31:35What are you doing to me?
31:36Right, stand by.
31:40What are you doing to me?
31:43Are you a police officer?
31:44Yes, I am a police officer.
31:47Right, do you need to go first?
31:48He starts saying, are you a real policeman?
31:51And his voice has got this little boy sound to it.
31:58Right, stand out at the moment.
31:59This is all in suspicion.
32:00Are you a real police officer?
32:02Yes, I am a real police officer, OK?
32:03It's time to be in, all right?
32:04It's under suspicion, all right?
32:05What are you doing to me?
32:07Look, Dan, give it an impression that he's frightened, he's afraid.
32:12But actually, in my view, it's a sham.
32:16It's a complete act.
32:18Five-zero nights, I've been speaking to staff in Costa.
32:20The male's come in with a black Range Rover,
32:22driven into the retail park.
32:24He has blood to his ear, he's confused,
32:26not providing much circumstantial information as the halluses occurred
32:30and has then come into the store.
32:37Five-zero nights, we've got one in custody.
32:39I'm on the suspicion of...
32:40Murder.
32:41Murder.
32:42Of...
32:45What?
32:48What?
32:49What are you doing to me?
32:51What's your name, sir?
32:52What are you doing to me?
32:53What's your name?
32:54You've been arrested as well, I'm on suspicion.
32:56What?
32:57What's your name?
32:58My name's Luke.
32:59Your name's Luke, is it?
33:01What's your surname?
33:02Dan.
33:04What's your surname?
33:05Dan.
33:06OK.
33:07I remember thinking, this isn't Luke.
33:11This isn't the man I've sort of followed for the last ten years
33:14and reported on.
33:23For most of his 36 years, Luke Dan had been well known
33:27in the city of Plymouth.
33:28When he was younger, he was diagnosed with leukaemia, went to hospital, spent quite a lot
33:37of time in there, lost out on schooling. And when he recovered from that, he seemed to
33:43dedicate himself to raising money for other children who were suffering cancers.
33:49Luke Dan made a full recovery and turned his fundraising skills into making money for himself.
34:01From a young age, Luke had borrowed money from his dad, sold his first set of cars, kept reinvesting
34:06it, making more money, moved into selling high-end jewellery, invested in properties abroad, nightclubs,
34:14having shares in a taxi firm.
34:17He really enjoyed a really quite high profile within the community in Plymouth for exactly
34:22that.
34:23His entrepreneurship, his fundraising efforts, that's how he was well known across the city.
34:31His main business was second-hand cars. He was also known for sort of driving around
34:37in a flash white Lamborghini.
34:40There was a saying, if there's too much bling, ring it in. And Luke was enjoying a high profile
34:46there and some may have suggested that he was enjoying a profile that was beyond his means.
34:51Luke Dan's expensive lifestyle was being financed by more than second-hand cars.
35:06Luke Dan first came across my radar, whether it was intelligence and information received
35:12about potential misuse of drugs for dealing and possibly firearms offences.
35:16A raid was carried out at Dan's home, in one of the city's most expensive neighbourhoods.
35:25I commanded the operation. We knew the house was well protected with fences. There were a number
35:32of CCTV installations round about the house and floodlights as well. He was clearly security conscious.
35:39He had something else there to protect and he didn't want anybody coming anywhere near that.
35:44Drugs, a gun, and £40,000 in cash were seized. But the case was thrown out of court
35:55because of an error in the prosecution process. Luke Dan walked free.
36:00Not a lot seemed to stick to Luke. As with any criminal, if you evade the police and the court system,
36:13you can be emboldened. And I think there was that concern by the police that this may embolden him.
36:19So we'll have to keep our eye on him.
36:21I believe he started taking the view that he would always find a way of avoiding due process
36:28and avoid feeling the weight of law, which by now, in my view, he was clearly pushing.
36:34Luke had possibly overstepped the mark with a well-established gang within the city.
36:41Police are investigating five fire bomb attacks in a suspected turf war between rival drug gangs in Plymouth.
36:58I phoned up an inspector I knew and said, is it true that a motorbike gang in the city had gone to a war with Luke Dan?
37:06And he was like, oh, God, who told you?
37:09And I just went, well, you just have.
37:12A car showroom, vehicles, properties, a gym and a tattoo parlour were all set alight in what's believed to be a series of tit-for-tat attacks.
37:22Plymouth is not a high crime area. It's actually at a very low crime rate.
37:27So a firebombing of a house while somebody is in it is very, very rare.
37:33No injuries are reported. Police are appealing for calm.
37:37The police, they basically brought the hammer down and said to the people who were involved or whoever was orchestrating it, stop now or else.
37:51An uneasy truce was called between Luke Dan and the motorbike gang.
37:56But his life of crime continued to make headlines.
38:03He was jailed for 12 months for causing actual bodily harm.
38:10And shortly after release, jailed for another year for perverting the course of justice.
38:21I do remember encountering Luke's dad in court.
38:24He came up to me sort of nose to nose and it was like, why do you keep writing about my son?
38:29And I kind of just had to be honest and go, because he keeps getting arrested and charged.
38:34If somebody's going to commit a crime, they'll commit a crime and then I'll write about them.
38:38I just wasn't expecting it to be this crime.
38:41This crime would be the most serious of all and put Luke Dan behind bars for years.
38:58For the police, CCTV and eyewitness statements revealed what really happened.
39:04How two strangers clashed, one died, the other lied.
39:11This was a chance encounter.
39:13Luke Dan had been at a snooker club.
39:15He was driving back to his home.
39:17But by chance, he encountered David Kelly, who was clearly off his head on drugs and alcohol that night.
39:30Witnesses do report hearing a row, an argument between two people.
39:36They then hear an engine revving and a thud.
39:42He turned around, went back, drove his car back.
39:46And he slowly rolled over Kelly's body, starting with his legs, then his chest, and then his head.
39:52Drove a few yards, stopped, started making a phone call to the police.
39:59Someone just attacked me in my lane.
40:01In your lane?
40:03In my lane, I've tried to drive away from them and they just attacked me.
40:07Right, OK.
40:09They just attacked me in my car.
40:11OK, so you're in your car.
40:12Are you safe now if you manage to move away?
40:14No, no, they just attacked me and they just hit my car.
40:17They attacked my car.
40:18OK.
40:19They hit me and I pan around and they literally run.
40:23They just jammed around.
40:25Oh my God.
40:26Do you know who they are?
40:27No, I don't know.
40:29I don't know.
40:30I'm driving home up in the...
40:32Hello, do you know who they are?
40:34No, I don't know.
40:35I'm just, literally, I'm just panicking now.
40:37Call them.
40:38It was all about, I've been attacked.
40:42I'm being targeted.
40:44It's...
40:45It was all about him.
40:47And there was no way you couldn't have known that you'd rolled over Kelly.
40:53He knew he'd done wrong.
40:56And instead of calling 999 to ask for help for that man,
41:00he'd called 999 as part of his defence.
41:07After being arrested at Costa Coffee, Luke Dan's apparent confusion continued.
41:12Are you a real police officer?
41:16Yes, sir, I'm a real police officer, OK?
41:18It's time to be in, all right?
41:19It's under suspicion, all right?
41:20Give it to me!
41:21Luke is street smart.
41:26Very street smart.
41:27I was watching it thinking this doesn't seem like the guy who I've kept my eye on for the last decade.
41:34Why give it to me?
41:36It's almost as though the acting is preventing the real emotion.
41:42He's so determined to try to convince the officers that this is all just a big mistake.
41:48I think this video evidence, this body-worn video, turned out to be crucial in convincing the jury
41:55that Luke Dan was somebody capable of coming up with a lie and sticking to it.
42:01A 37-year-old man is tonight starting a 15-year prison sentence.
42:12Luke Dan was cleared of murder but found guilty of manslaughter for driving over and killing David Kelly.
42:22Friends and people who knew David Kelly really well were moved to tears as the verdict came in.
42:31They wanted to be there that day to see justice done for their friend.
42:38The judge called it a dark and foul night.
42:42Two strangers had clashed but only one was to blame.
42:48The judge said that he believed Luke Dan's ego had a really big part to play in what happened.
42:55He said Luke Dan wanted to show David Kelly he wasn't the kind of man who you should mess with.
43:04Luke's character was in effect his downfall.
43:09He could have just driven away.
43:10The circumstances of an arrest, any arrest, where you're going to deprive somebody of their liberty is always a big step for any police officer to take.
43:21We can say quite clearly this police officer has been diligent in his approach to it.
43:26He's taken the appropriate, proportionate steps for it.
43:29And I think that people should be satisfied that on this occasion they got it absolutely right.
43:34You're absolutely right.
44:04You're absolutely right.
44:05You're just right.
44:06You're right.
44:07You're right.
44:08You're right.
44:09We're right.
44:10You're right.
44:11And I know that you're right.
44:12You're right.
44:13You're right.
44:14And that's really good.
44:16You're right.
44:18But it's really good.
44:20That's great.
