00:00Bobby Brown is suing Showtime Network's BBC and the producers of a Whitney Houston
00:04documentary entitled Can I Be Me? In a complaint filed on Wednesday in New York
00:08federal court, the Brown family, including the estate of the late Bobby Christina
00:12Brown, is seeking $2 million for their inclusion in the film. According to the
00:16complaint, the film contains footage that Brown and BKB has never consented to have
00:20released. Brown and BKB appear in the film for a substantial period of time in excess
00:25of 30 minutes. The footage was actually recorded prior to the divorce in 2007 between
00:30Brown and Houston. Brown never signed or executed a release for the airing of the
00:34material that appears in the film. The footage of Brown is approximately 15 years old.
00:38Brown claims that the film amounts to a misappropriation of publicity rights as well
00:42as a violation of the Lanham Act, also known as the Trademark Act. The complaint also
00:47alleges that the filmmakers unsuccessfully attempted to secure an interview with
00:50Brown and that the use of his name, persona and likeness were utilized by producers in
00:55marketing and promotion of the film without his consent. The complaint seeks a permanent
00:59injunction on top of monetary damages. Additionally, Brown is pursuing a separate
01:03breach of contract claim against B2 Entertainment, a dissolved company that had a deal
01:08with Brown's company for the Bravo reality series Being Bobby Brown. According to the
01:12complaint, B2 agreed not to use any materials associated with Brown's family, friends
01:17or employers without his consent in TV or film projects. However, the producers of
01:21Can I Be Me are said to have procured Being Bobby Brown footage for their own use in their documentary.
01:26Houston died of a drug overdose in 2012 and her daughter with Brown, Bobby Christina, passed away
01:31three years later at the age of 22. They are survived by R&B singer Brown, who now seeks to control
01:36exploitation of his name. Showtime did not immediately respond to a request for comment.
