A New York appeals court has refused President Donald Trump's bid to pause discovery in the defamation lawsuit brought by former 'Apprentice' contestant, Summer Zervos.

00:04the defamation lawsuit brought by former Apprentice contestant Summers Zervos.
00:09Zervos is suing the president over comments during the 2016 presidential election.
00:13After tape was published of Trump boasting to access Hollywood's Billy Bush about grabbing
00:17women's genitals, Trump denied ever assaulting women.
00:21As Trump came under fire for his comments, several women, including Zervos, came forward.
00:26Zervos accuses him of kissing her twice in 2007 and attacking her in a hotel room.
00:31Trump responded that he never met her at a hotel and attacked allegations from his accusers
00:35as 100% fabricated and made-up charges pushed strongly by the media in the Clinton campaign.
00:41In her lawsuit, Zervos claims she's been branded as a liar.
00:45Trump argued that the U.S. Constitution didn't allow this case to proceed right away thanks
00:49to the Supremacy Clause.
00:51Trump's attorney, Mark Kasowitz, posited that the clause means that state governments
00:56including their courts, refrained from interfering in the operations of the federal government.
01:01New York Supreme Court Judge Jennifer Schechter allowed a defamation lawsuit in March, writing,
01:06No one is above the law.
01:08The opinion stated,
01:09Nothing in the Supremacy Clause of the United States Constitution even suggests that the
01:13president cannot be called to account for wrongful conduct that bears no relationship
01:18to any federal executive responsibility.
01:21Looking to take advantage of this decision, Zervos' lawyers have set out subpoenas.
01:25Trump has been given until May 29th to respond to a demand that he be deposed.
01:30Trump hoped to delay everything by pushing New York's appeals court for a stay on the
01:34case, but that won't happen.
01:35The appellate decision could also be meaningful to third parties, in particular MGM, which is
01:40facing a demand for apprentice footage and documents showing any inappropriate comments
01:45from Trump towards women.
01:46It's possible that MGM may look to quash the subpoena or attempt to limit it in scope.
