37:17To charge his suspect with drink driving, Chris needs to test him on the evidential machine,
37:23while his alcohol levels are still high.

37:37The devices that we use at the roadside are a rough indicator of the amount of alcohol that's in your
37:41system and the machine now and in custody is a much more accurate and evidential machine.
37:46There's always that question of, are they going to be under when we get to the custody suite?
37:50Because every moment you're dropping that alcohol out of your system.
37:53I've witnessed driving on the road, he got a couple of lights out of the vehicle so I've stopped it.
37:57He's admitted to have been drinking four cans of Stella prior to driving and also that he'd
38:03swapped the vehicle from his cousin. So we've got to make those inquiries however at the moment
38:08he's been arrested.
38:09What we're going to do, we're going to do an evidential breath test then you're going to get
38:12better down a bit.

39:20Remaining professional, remaining calm and making sure that you deal with people in the right manner
39:25is absolutely imperative to make sure that we get everything right.

39:34When I tell you to do so, relax, take a deep breath, place the mouthpiece in your mouth
39:39and make a good seal around it with your lips, then blow steadily and evenly until I tell you to stop.
39:45Once this is done, it should take about five minutes, I'll get you dry clothes,
39:48we'll get you some snap, we'll get you a drink and then you can get your head down for a bit.
39:52Deep breath, and go.

40:06A good few hours with your head down, you'll be interviewed in the morning about the twat,
40:11and then you're going to be charged with the drink driving element.

40:17This chap's been very up and down, he's continued to be quite difficult in custody,
40:21but eventually he's been happy to provide two samples of breath in the evidential machine,
40:26and he's blown a lower evidential reading of 69, which is twice the legal limit,
40:31so he'll have to be interviewed in the morning about the twat element, if we can actually establish
40:35that's happened.
40:36I don't doubt that he's been living in that car for the last couple of days drinking,
40:40and I'm sure he's probably been driving around absolutely hammered as he was tonight.
40:44We'll see what we get in the morning, but realistically he's getting charged,
40:47he's going to get disqualified, so it's a good result.
41:02After four hours in a cell, Matt Cork's 18-year-old drink driver is sober enough to be charged.
41:08You don't have to say anything, but it may harm your defence if you don't have to mention now,
41:12something which you'll lead to a line in court. Anything you do say may be given in evidence, okay?
41:17So we're going to give you a bail, and you need to go to Chesterfield Magistrates Court

41:42Last year, Derbyshire police prosecuted more than 1,200 drink drivers
41:52and attended over 70 collisions where alcohol was involved.
41:57At no point has ever crossed my mind to think, having had a few pints,
42:01I'll, you know, forget the taxi, forget the five-minute walk, I'll just take my car, I'll risk it.
42:06The freedom that you get being able to drive, it's not a given right, it's a privilege at the end of the day.
42:11So why am I going to put my driving licence in jeopardy by taking that risk of getting behind
42:17the wheel after I've had a few drinks?
42:22I'm a driver on a road, my partner's a driver on a road, we drive around with our kids in the car,
42:27his friends in the car and it could be us that's been hit by a drink driver and it does scare the
42:32life out of me. Realistically, if you're going to have a drink, just don't drive and if you plan on
42:37driving, don't have a drink. A lot of fatalities and serious injuries do come from drink and drug
42:43drivers becoming more prevalent again. It's very frustrating for us because if you need a lift
42:48somewhere, you can either ring somebody to come and get you or you get a taxi or you can get a bus
42:52or you can walk. It just shows a blatant disregard for other people. If you're a drink driver,
42:57you've got to be lucky every time. We just need to be lucky once.
43:00In this episode, the suspected drink driver who left the scene of a collision with a motorbike,
43:12I take pictures as well. He's too much drinking.
43:15was convicted for failing to provide. No, we're not going to be helped. You never know.
43:22He was disqualified from driving for three years and given a six month community order
43:28to complete rehabilitation and alcohol treatment.

43:46Was sentenced to a 17 month disqualification, reduced by 17 weeks if she completes a drink driver
43:53safety course. Arrested on suspicion of driving whatsoever prescribed alcohol after being stopped
43:59driving a vehicle with no lights on. She's provided a sample of 77.
