00:05A federal immigration agent allegedly aimed a gun
00:07at a U.S. citizen during a Chicago protest,
00:10shouting, you're dead liberal.
00:12According to a court filing,
00:14the threat marks a violation of a temporary restraining order
00:17against the Department of Homeland Security.
00:20Representing the Chicago Headline Club and other plaintiffs,
00:23the court document claims that DHS agents
00:25disregarded a temporary restraining order on force at protests.
00:29The plaintiffs allege that a federal officer
00:31pointed a pepper ball gun and then a real gun
00:34at a man who was lawfully standing on the side of the road
00:37voicing his opposition
00:38as agents were driving by in their vehicles.
00:42The incident, which involved a man who was reportedly unarmed,
00:45occurred during Little Village protests
00:47following federal operations earlier in the week.
00:50According to the filing,
00:51agents deployed tear gas and pepper munitions
00:54in violation of the restraining order
00:56that Judge Sarah L. Ellis issued against DHS,
01:00which allows such crowd control measures
01:02only when there is an immediate and serious threat of physical harm.
01:06On X, DHS defended the agents,
01:09stating they were reacting to rioters,
01:11who shot at agents with commercial artillery shell fireworks.
01:15They claimed the mob of rioters
01:17grew more hostile and violent,
01:19advancing toward agents
01:20and began throwing rocks and other objects at agents,
01:23including one that struck Chief Greg Bovino in the head.
01:27DHS continued,
01:28riot control measures were deployed,
01:30including by Chief Bovino,
01:31and arrests were made.
01:33Agents properly used their training.
01:35The use of chemical munitions
01:36was conducted in full accordance with CBP policy
01:39and was necessary to ensure the safety
01:41of both law enforcement and the public.
01:44The plaintiffs argue that the demonstrators were peaceful
01:46and that authorities failed to issue warnings
01:49before tear gas was used.
01:51They added that there is
01:52no evidence that commercial fireworks
01:54were fired by anyone at the scene.
01:57Aaron Reichlin Melnick,
01:59senior fellow at the American Immigration Council,
02:01weighed in on the incident,
02:03stating,
02:04DHS has to understand that it's playing with fire
02:07by refusing accountability
02:08for officer misconduct like this.
02:10People are being completely radicalized
02:12by interactions like this.
