00:00Apple sued for AI training misuse?
00:03Apple's shiny new Apple intelligence just got hit with a very un-Apple problem, a class-action lawsuit.
00:09Two neuroscience professors, Susana Martinez-Conday and Stephen Maknik from SUNY Health Sciences University,
00:16are suing Apple, claiming the company trained its AI on pirated copies of their books.
00:21The lawsuit, filed late Friday, accuses Apple of using their works Champions of Illusion and Sleights of Mind
00:27without permission to train its foundation models and OpenELM language models.
00:32According to the filing, those titles were part of Books 3, a shadow library that scraped roughly 186,000 books
00:39from a private BitTorrent tracker called Bibliotic.
00:42Books 3 was once bundled into a dataset called The Pile,
00:45which Apple itself acknowledged using in documentation for OpenELM back in April 2024.
00:52Apple's lawyers will probably point out that Books 3 was taken down in late 2023
00:56for copyright infringement, and that there's no clear proof Apple actually used those exact books.
01:02Still, the authors argue that if their titles were in the dataset,
01:06Apple copied them in their entirety without authorization,
01:09which could mean up to $150,000 per work in damages if the court finds willful infringement.
01:15This isn't the first time AI training data has landed a tech giant in court,
01:20with similar lawsuits against OpenAI, Meta, and Anthropic with mixed results.
01:25In one case, a judge even ruled that while training on copyrighted books might be fair use,
01:30storing those books afterward could violate copyright.
01:33There's also a subtle twist.
01:35Apple doesn't use its AI to summarize or republish content,
01:39so the case might hinge on whether mere training counts as copying.
01:42For now, Apple's keeping quiet,
01:45while the professors are asking for a jury trial,
01:47financial damages, and a ban on further use of their works.
