The ABC has obtained photographs of a fight between a WA Police Sergeant and a man, who alleges he was choked when a driving dispute escalated. He's been pushing for the officer to be charged since the incident in february last year, but police say there's insufficient evidence. The WA Parliamentary Inspector and the corruption and crime commission say police should have charged the sergeant with assault and let the courts decide if an offence occurred.

00:00It was supposed to be a normal afternoon school pick-up.
00:08Sean Beasley had his then 17-year-old daughter in the car
00:12when he alleges another driver cut him off in Perth's western suburbs.
00:16So I beeped the horn and then he immediately just shot his finger up.
00:20So I did the same thing.
00:21It was such an innocuous thing, you know, it really was.
00:24There was nothing to it.
00:25The situation escalated when the other driver got out of his vehicle
00:30and walked over to Mr Beasley's car and a fight ensued.
00:34The man, pictured, is Sergeant Glenn Morey, a serving police officer.
00:39Accounts of what occurred in the fight differ,
00:41but this is the moment Mr Beasley alleges he was choked.
00:45I was panicking, so I was like, OK, well, I need to get evidence.
00:49So I jumped out, I took a few photos and then I just chucked my phone to the ground
00:52and I jumped on his back.
00:55Mr Beasley says he managed to slip loose and hit the sergeant in the face.
01:00The father and daughter went straight to a police station to file a report.
01:04He had scratch marks on his neck and a torn shirt.
01:07Months later, he was advised by WA Police Internal Affairs
01:10there was insufficient evidence to lay charges against the sergeant.
01:15If it had have been me and there was photos of my hands around his neck,
01:20there's no way in hell they would have abandoned the pursuit.
01:24Mr Beasley took his complaint to the WA Corruption and Crime Commission
01:28and then the Parliamentary Inspector.
01:30They both agreed there was sufficient evidence to charge the sergeant
01:34with aggravated assault and suffocation and strangulation and let the courts decide.
01:40Jeremy King is a lawyer specialising in police misconduct allegations
01:44and he says it shouldn't be solely up to police to prosecute their own.
01:48In my experience, if you hand something back to police,
01:51they're either going to ignore it or they're going to do what they want to do anyway.
01:54You need an independent body that can review these charges
01:57and can also bring the charges themselves.
02:00The ABC has been unable to contact Sergeant Maury
02:03but understands he strenuously denies all the allegations.
02:07In a statement, WA Police said management investigated
02:10and took action against the officer
02:12but maintained there was insufficient evidence
02:15to prosecute any alleged criminal offences.
02:18It says it takes all allegations of police misconduct seriously.
