00:00There's no question about it, Sam went too far.
00:02She revealed too much about the defendant and she tainted the identification.
00:06Which means I'd have to disclose all this to the defense,
00:08which, of course, would probably cost us the case.
00:13You're right.
00:16On a theoretical level, anyway.
00:20Meaning what?
00:21Years ago, I was trying this monster from Queens.
00:32He'd raped and killed a seven-year-old girl, stabbed her to death.
00:37We knew he did it.
00:38The police found her blood on his shirt, on his pants.
00:41But the judge didn't allow it.
00:44Cops had entered his apartment without a search warrant.
00:46They claimed the manager had given him consent.
00:48Anyway, the blood evidence got tossed,
00:52so our case went from a slam dunk to a jump ball.
00:55And then, on the morning of my closing,
01:01I found this note on my desk.
01:04It said, I need you to know that I killed that little girl.
01:09It was me, not Jim Cooney.
01:13I had no idea how it got there.
01:15No idea who wrote it.
01:16It was just sitting there on my desk.
01:19Now, theoretically, that's exculpatory evidence.
01:23I have to turn it over to the defense.
01:24Theoretically, that is practically the definition of exculpatory evidence.
01:28Yeah.
01:30If I actually saw the note.
01:35Now, I knew with 100% certainty
01:40that the defendant killed that little girl.
01:43And the man who wrote that note, if he even existed,
01:48had absolutely nothing to do with the case.
01:52So I ignored it.
01:54I turned around.
01:57I went about my day like it had never happened.
02:04I thought the point of all this was to avoid those kind of human choices,
02:10to avoid playing God.
02:12It is.
02:14That is the goal, 100%.
02:16But there are certain times in life
02:21when it's impossible to do that.
02:26When the right thing to do
02:28is to actually look the other way.
