00:00Buongiorno, sir. Buongiorno, Hawaii.
00:02You're going all day? Yeah. Fine.
00:04When was the last time you had some of the drinks? Last night.
00:06I'm going to move it back and forth. I need you to follow it with your eyes.
00:09Your eyes are open. Do you understand that?
00:11Yeah.
00:12Two, three, four, five.
00:16How do I feel? I got everything.
00:19Oh, before you sit down.
00:21Just place your hands on your back for me. Palms up.
00:23Good morning, sir.
00:43Good morning, Hawaii.
00:45You doing okay? Yeah. Fine.
00:47When was the last time you had some of the drinks? Last night.
00:50How about how many hours ago?
00:52Like 10 hours ago.
00:53At least.
00:57How many drinks did you have?
00:59A few beers, sir.
01:01Define a few beers.
01:03A few beers.
01:05Define a few beers.
01:06Like three.
01:07Okay. Yeah.
01:08What did you drink?
01:09Light beer. Milk of light.
01:11Milk of light? Yeah.
01:12Anything else?
01:12Nope.
01:14Okay.
01:15Who were you with?
01:18My F.O.
01:19Okay.
01:19Yeah.
01:20Would you be willing to provide
01:21and feel sobriety with me right now?
01:24No.
01:24Why not?
01:25There's no need?
01:27Well, I can smell an odor
01:29consistent with an alcoholic beverage.
01:31Oh, sorry.
01:32Okay.
01:33Please.
01:35What is that?
01:36Rose.
01:38Do you have any fresh ones
01:39that haven't been in your mouth?
01:40Yeah.
01:41Right in my bag.
01:42Okay.
01:49Thank you.
01:50Thank you.
01:50Thank you.
01:51I can smell it.
01:56I can smell it.
01:56It smells mini.
02:24It smells mini.
02:24So my answer is,
02:39I don't have a PBT.
02:41Like, obviously,
02:42it's a fully booked flight.
02:43Yeah.
02:44Okay.
02:45Here's a few.
02:46We know,
02:46so one is that for eight hours,
02:48I suppose,
02:48from the last break.
02:50We have that.
02:50Yeah.
02:51We have that.
02:51so we've already had a report
02:55that said that it could possibly
02:56there might be some alleviation.
02:58Someone detected the smell of alcohol
03:00and then they reported the guys.
03:03I'm just telling you,
03:05we got the call.
03:07I understand.
03:08I can sense,
03:12or I can have a spell of an adult brother
03:16coming off of you.
03:17I don't know if it's coming out of your mouth
03:18or of your skin.
03:19If it's coming out of the cork,
03:21I get it.
03:23But,
03:24we got to do our thing,
03:26so,
03:27you know,
03:28we'll find out.
03:30Do I see him?
03:31Would you do field sobriety?
03:36Sure.
03:38Do you have a jacket or something?
03:40Because it's kind of cold inside.
03:51I'm not sure we can do it right here.
03:53Okay,
03:54you hear that?
03:59Yeah.
04:00I'm going to do the eyes first,
04:05just watch it.
04:06Because I'm saying,
04:07I know you're not certified,
04:08so,
04:08I have to do it,
04:09but just watch the clues and stuff.
04:12Because,
04:12this would be a brand new,
04:16uncharted territory.
04:18I've talked to the first officer also.
04:20Yeah.
04:21I'll be fine.
04:21You guys want to talk to the flammetants?
04:24They were there, too.
04:25Okay.
04:26We'll do that.
04:27We'll go ahead and do one second.
04:28Do you have any dick time?
04:30or push back?
04:31Yeah.
04:32We do.
04:33We do.
04:35I don't have my phone,
04:36but my watch is dead,
04:37but,
04:38uh,
04:40it's like a few minutes.
04:41I don't know.
04:42Well,
04:42this can go quickly,
04:44but just come over here.
04:45Okay.
04:45All right.
04:47Okay,
04:47so do you have any health issues?
04:49I'm sorry,
04:50you're a pilot suit.
04:51You can't have any crazy health issues
04:52or any problems or anything?
04:53I noticed you wear contact,
04:55or you got glasses.
04:55I do.
04:56Okay.
04:56so I'm just going to ask you to do it.
04:58You just go away from the passenger.
05:01Yeah.
05:01Yeah.
05:01Sure.
05:04Okay,
05:04so all I need you to do
05:05is the tip of my pen right here,
05:07this little white tip,
05:09I'm going to move it back and forth.
05:10Yeah.
05:10I need you to follow it
05:11with your eyes,
05:12and your eyes open.
05:13Mm-hmm.
05:13Do you understand that?
05:14Yeah.
05:14Do you want to add any issues
05:15to do that for me?
05:16Okay.
05:17So just pay attention
05:18with the tip of the spin.
05:19Okay.
05:19Okay.
05:44All right.
05:45For this next exercise,
05:47I know it's kind of difficult
05:50because I have an incline,
05:52but just on here
05:56on this more flat surface,
05:57I need you to take
05:58a series of heel-toe steps.
06:00I'm going to explain it to you.
06:01What you're going to do
06:02is you're going to put your left foot
06:03or your right foot,
06:04whichever is more comfortable.
06:05I'm left-handed,
06:06so I'm using my right foot first.
06:08You're going to go heel-toe,
06:09and if you just take a step
06:10to the side really quick,
06:11you're just going to take
06:12a series of heel-toe steps
06:13and count out loud.
06:15One, two, three, four, five.
06:20You're going to do that
06:20until you get to ten.
06:21Make sure you count out loud.
06:23Make sure you go heel-toe.
06:24Don't look down,
06:25but put your arms out for balance.
06:27No problem.
06:27Do you have any issues with that?
06:28No problem.
06:28No problem.
06:30I walk here.
06:31So it gets well.
06:32You can start right there.
06:35All right.
06:36You ready?
06:36Yeah.
06:37You may begin.
06:37One, two, three, four, five,
06:43six, seven, eight, nine.
06:47Do you turn around and go the other way?
06:51One, two, three, four, five,
06:56six, seven, eight, nine, ten.
07:02All right, if you step down
07:10on this little platform.
07:12All right, so this next test
07:14is called the one-legged stand.
07:16So what you're going to do
07:17is whichever foot you prefer,
07:20whichever one you feel like
07:20you have a stronger balance with,
07:22you're just going to,
07:22with your hands at your side,
07:24put your foot out in front of you
07:26like this,
07:26and you're going to hold it
07:27and just count out loud
07:28one-one-thousand,
07:29two-one-thousand,
07:30three-one-thousand,
07:31let's go ahead and tell you to start.
07:32Okay.
07:33We'll start until I tell you to begin.
07:34Do you understand the instructions?
07:35Sure.
07:351 1,000, 2 1,000, 3 1,000, 4 1,000, 5 1,000, 6 1,000, 7 1,000, 8 1,000, 9 1,000, 10 1,000, 11 1,000, 12 1,000, 14 1,000, 14 1,000, 15 1,000, 16 1,000.
07:57Ok, you can stop there.
07:58Um, just do me a favor and just hang out really quick.
08:03Here's a mince back.
08:04I just gotta go talk with them.
08:05Sure.
08:06Ok.
08:11Yeah.
08:12I saw it, yeah, the Night Stagnus.
08:15I didn't really see it in the walk-in time.
08:18Um, but I definitely saw the Night Stagnus.
08:21Yeah.
08:22So.
08:23Yeah.
08:24So.
08:25At this point, would it be, do we lie less safe?
08:30It doesn't ever yield a blood car, or?
08:33Yeah.
08:34There's the news there.
08:35I don't know.
08:36I'll give that.
08:37I'll give that.
08:38I'll give that.
08:39Whatever you saw as well.
08:43Yeah, on there.
08:45Hey, sir.
08:46What's up?
08:47So, my name's Corporal Vest.
08:48I'm the supervisor now at the Airport Police Department.
08:50Um, so did you guys know I had a few drinks last night?
08:53I met here.
08:54We had a drink, yeah.
08:56Ok.
08:57So, my problem is, is that right now, Sam talking to you, I don't smell anything coming off of
09:03you.
09:04I can smell a very strong odor alcohol beverage coming off of him.
09:08And that's a huge issue, regardless in general, whether we were standing on the side
09:12of the road, you know, if I go to Camry, he was right next to you.
09:15But it's a bigger issue, because there's, what, probably a hundred million.
09:20It doesn't matter if it's found a point, yeah.
09:22But, the issue is, I can detect it.
09:28And so, obviously, I don't know where you guys are based out of, where the hub is.
09:32But, with the FST that I just put him through, he did exhibit signs of impairment on top of
09:38the auto-officer as well.
09:40So, I'm going to make a phone call to my supervisor.
09:43But, there's a very strong possibility, a very strong probability, that he's going to be
09:49taking a shot at the retention center for the willful intent to operate an aircraft
09:55for intoxicated.
09:56So, if you need to start making some phone calls, I'm just going to start doing that.
09:59Okay.
10:00Alright, so, do you have any personal belongings on the plane?
10:04I do.
10:05What do you have on there?
10:06Just, like, a go bag and, like, a throw on everything?
10:07Yeah.
10:08Okay.
10:09Um, so, my issue is, is I'm trained in standardized field sobriety, and you've exhibited strong
10:19signs, and even after speaking with your first pilot, like, the issue is, would you agree
10:24to a blood draw to test your blood alcohol content?
10:27No.
10:28Okay.
10:29Well, the issue is, is when you agreed to the field sobriety, you exhibited the symptoms,
10:33and if you're refusing to a blood draw, that's DUI less safe for the willful intention to operate
10:38a commercial aircraft.
10:39Seriously?
10:40Yes, sir.
10:41How did I fail?
10:42I did everything.
10:43The signs that you exhibited during those three tests, I'm able to articulate based off
10:49of those, and the odor coming off of your person, it's very consistent with DUI.
10:58Okay.
10:59Well.
11:00Yeah.
11:01So, what do you want me to do?
11:05So, what's going to happen is, if you don't agree to a blood draw, it'll be DUI less safe.
11:10It'll be booked into the Chatham County Detention Center, and you can, we'll give you a phone call,
11:15you can, more than likely, because it's what, Tuesday?
11:19It's a weekday.
11:21But that's the route they're going to have to take, unfortunately, okay?
11:26Okay.
11:27And if I did agree to a blood draw, then what?
11:29I mean, that's just, it's a good part of the ongoing investigation, that it's like, you know,
11:33I did my part, but it's like, your blood is the, like, the non-negotiable.
11:38Like, that'll prove whether or not it is what it is.
11:42Mm-hmm.
11:43So.
11:44Okay.
11:45Yeah.
11:46Well.
11:47But obviously, I can't coax you in it.
11:51You have your right, you said no.
11:52Right.
11:53So based off that alone, and based off the fields of right that you...
11:55Even if I gave you blood, then nothing would change.
11:57Okay.
11:58Right?
11:59That, that is your willful choice that you were willing to make, but based off the calls
12:04that we received stating that people down in TSA could smell what smelled like alcohol
12:11coming off of your breath.
12:12And they're not trained.
12:13I am trained in odor hall, odor and alcohol.
12:16Okay.
12:17That's fine.
12:18I mean, nothing's going to change your mind.
12:21I didn't even talk to TSA today.
12:23I went to KCM.
12:25That's operated by TSA.
12:26Right.
12:27Right.
12:28Okay.
12:29So.
12:30Alright.
12:31I'll get my stuff, but whatever you gotta do.
12:34Okay.
12:35My officer is going to grab your stuff.
12:38If you don't mind, we're just going to head up to the patrol car so that way we don't
12:41have to do it all in front of the public eye.
12:42As long as you just be cool, I'll be cool.
12:44Oh, absolutely.
12:45So.
12:46But, yeah.
12:47I'd like to...
12:48I mean, I can't grab my stuff myself.
12:50If you would like to, we can do that.
12:52Yeah.
12:53Okay.
13:18Okay.
13:19I'm just going this way
13:23Now really quickly, like I said, I'm going to be cool with you
13:33I don't know if it's a shitty scenario
13:34Do you have like a driver's license with you?
13:36I do
13:36I have to get that just for documentational purposes
13:49I hate having two phones
13:54And then, can you mind just taking off the lanyard
14:09So I can take a picture of your Southwest credentials too
14:12Sure
14:13All right guys, I'll go to the next one
14:43Sì
15:13So, I don't believe that they're going to allow you to keep all this at the jail, so we're just going to log in to our evidence here, so that way once you get bailed out, you come back here, there'll be a property sheet and everything, so you'll have to come back out here, then our evidence custodian will sign your luggage back out to you, okay?
15:32I guess. How about my wallet?
15:34You can keep that. Do you have your phone as well?
15:37Yeah.
15:38They'll let you keep those, unfortunately, just because it's like big luggage and everything, they don't let people keep that anymore.
15:43So, unfortunately, this isn't an integrity part. I just have to read you the Applied Consent Law in Georgia, even though I know your license was out of a different state, and you're just currently in Georgia.
15:55So, the Applied Consent Law for people over the age of 21 states that in the state of Georgia has conditioned people with the privilege to drive upon highways in the state upon the submission to the state-administered chemical tests of your blood, breath, or urine, other bodily substances for the purpose of determining you are under the influence of alcohol or drugs.
16:16If you refuse this testing, your Georgia driver's license, or in this case your out-of-state license, will be suspended for the privilege of a minimum of one year.
16:26A refusal to submit blood testing may be offered into evidence against you at trial. If you submit to testing and the results indicate an alcohol concentration of 0.08 grams or more, your Georgia or out-of-state driver's license or privilege to drive on the highways of this state may be suspended for a minimum of one year.
16:47You are entitled to additional chemical tests of your blood or other bodily substances at your own expense and from qualified personnel of your own choosing.
16:58You've already agreed that you did not want to participate in the blood drug.
17:02So, because of that, I'm now going to detain you. Like I said, why don't you just continue to be cool with me?
17:07Of course.
17:08Okay?
17:08Yeah.
17:09So, you just step over here really quick.
17:13Step on.
17:14Last.
17:15Yeah, we can get this.
17:17Stand up.
17:21If you just want to put it up there with your ID and everything, it'll be all in with a little baggie for you.
17:31So, you're going to just stand fast away from me?
17:33Oh, hang on.
17:33Before you set up, just place your hand up in the barricade for me.
17:36Palms up.
17:40Let's go.
17:40Let's go.
17:40Let's go.
17:40Let's go.
17:41Let's go.
17:41Let's go.
17:41Let's go.
17:41Let's go.
17:41Let's go.
17:41Let's go.
17:42Let's go.
17:42Let's go.
17:43Let's go.
17:43Let's go.
17:44Let's go.
17:44Let's go.
17:45Let's go.
17:45Let's go.
17:46Let's go.
17:46Let's go.
