00:00Former President Rodrigo Duterte's common law partner, Hanilet Abancenia, did not make it to the detention facility of the International Criminal Court.
00:10Live from Deheg, we will have a first look at the story of Maris Umar.
00:13Maris.
00:18Igan, it's 11.14 p.m. here in the Netherlands.
00:22Former President Rodrigo Duterte's supporters are preparing for his 80th birthday this March 28.
00:33Former President Rodrigo Duterte's common law partner, Hanilet Abancenia, visited the Scriveningan Prison again
00:41hoping to visit her.
00:43But for the second time, she still did not make it to the ICC detention facility.
00:48She was still with the supporters when some of them gave birthday greeting cards to the former president.
00:55One of Duterte's lawyers asked her for a favor
00:59and promised to force her and Veronica's child to enter on the same day.
01:04She even wished for it to happen on Saturday.
01:06Before Hanilet, Vice President Sara Duterte also arrived at the detention facility,
01:11who also did not make it.
01:13She only took four suitcases and a return box that was supposed to be for the former president
01:18but she was not able to accommodate inside.
01:22I can't stay here for long.
01:25For you, for me, please don't video their...
01:29That's prohibited.
01:30For their product, they are videoing their building and the people who enter and exit there.
01:40Meanwhile, even though the deadline for the disclosure of evidence is still in April,
01:47the disclosure of evidence was submitted by the prosecution.
01:52The first part of their evidence was submitted to the International Criminal Court
01:56and the defense was copy-furnished here.
02:03The lead counsel of former President Rodrigo Duterte already received the first batch of documents
02:08from the Office of the Prosecutor of the International Criminal Court.
02:11According to Atty. Nicholas Kaufman, the documents are confidential
02:15and the prosecution is obligated to give it to the defense in accordance with the Rome Statute.
02:20According to Atty. Gilbert Andres, an ICC-accredited lawyer
02:24who helps victims of extrajudicial killings,
02:27This disclosure of evidence, we can say that these are the evidences
02:33that are also included in the application for an arrest warrant
02:37that was filed by the Office of the Prosecutor.
02:41That's where we will know if we will relate it to the application.
02:48But as to the specifics, we don't know that for now.
02:52Six months after his first appearance in the ICC for the murder as a crime against humanity
02:59due to the drug war of his administration,
03:01the confirmation of charges against former President Duterte was filed in September.
03:06According to the ICC spokesman, Dr. Fadya Labdala, who is my exclusive interviewee,
03:11there will be judged by the pre-trial chamber 1 if the case will be trashed or will be directed to litigation.
03:18The prosecution should choose the strongest evidence to defend the case against Duterte
03:24that he systematically attempted to attack his war on drugs that victims committed.
03:29The witnesses may face and cross-examine each other.
03:33That's why it's possible for Duterte to face the witnesses.
03:36Not all witnesses are victims.
03:38And not all the victims are witnesses.
03:41Actually, a very limited number of victims would be called to be a witness.
03:45And normally, most of the victims will be represented by a lawyer.
03:52In very few instances, the judges allowed one or two of the victims
03:57to come in person and tell their stories.
03:59But they are not there to accuse someone.
04:01They are there to present their point of view, their observation, and their stories to the judges.
04:06The accusation is done by the prosecutor.
04:09On September 23, the confirmation of charges hearing of former President Rodrigo Duterte was filed
04:14here in the ICC for the case of crimes against humanity.
04:18And it can last up to 3 days.
04:21But there is a 60-day waiting period before the court can decide
04:27if his case will continue in the trial stage or not.
04:30Under Duterte's arrest warrant,
04:3217 individuals were charged with murder by the Davao Death Squad
04:37and 24 others were charged by law enforcers.
04:40So if there is a plan that involves a widespread or systematic recurrent attack against civilian population,
04:48even one murder may be considered a crime against humanity.
04:52Before September 23, the pre-trial chamber can call for a hearing
04:57if there is a need to discuss procedural matters
05:00or if Duterte's request for an interim release will be discussed
05:04before filing his defense.
05:06According to Dr. L. Abdala,
05:08this kind of request for interim release will be given.
05:11But the country should follow his instructions in the conditions of the ICC.
05:15If the former president wants to return to the Philippines,
05:18the government should follow the conditions.
05:21But according to Malacanang,
05:46So it means that if we will not cooperate with the ICC,
05:51even that prayer or even that manifestation of the ICC,
05:55we will not take cognizance of that.
05:57Malacanang first insisted that Duterte's resignation
06:01is an obligation of the country as a member of the Interpol and not as a member of the ICC.
06:05According to Palacio, there should be consistency in the direct cooperation with the ICC.
06:11We will say that we will cooperate with the ICC when it comes to the interim release
06:15because all the issues there will be solved.
06:18It will also be solved if there will be a freeze order for his assets.
06:23Will the Duterte family want us to cooperate with the ICC
06:28so that all their assets, hidden or not hidden,
06:32we will cooperate with the ICC to seize all their assets?
06:37We are still trying to get a reaction from the Duterte family to what Palacio said.
06:41According to the former chief presidential legal counsel of Duterte,
06:45Atty. Salvador Panelo,
06:46Of course, we want him to be here.
06:50How can we apply treason?
06:53He knew he was going to be arrested, he went home.
06:56Streaming is only for the public.
07:00Yesterday, Hanilet and her daughter, Veronica, also visited the ICC detention facility.
07:10But they did not have a chance to go inside to see Kitty's father.
07:17But Kitty told us that her birthday wish for her father is good health.
07:24Meanwhile, tomorrow here in the Netherlands,
07:27the program will be held at 10 a.m.
07:30and there will be a picnic of supporters of former President Rodrigo Duterte
07:34to celebrate his birthday in front of the detention facility.
