00:00At the hearing held by Vice President Sara Duterte and the investigation of the statements of former President Rodrigo Duterte,

00:09we will discuss together with the Department of Justice Undersecretary Jesse Andres.

00:16Jusec Andres, good afternoon to you.

00:20Good afternoon, Nina and Weng, and good afternoon to all of our listeners.

00:28Vice President Sara Duterte said that she has already received the NBI subpoena,

00:34but that she will be rescheduled because she will attend the hearing at the House of Representatives.

00:42Has VP Sara already reached an agreement with the DOJ or the NBI regarding this, Jusec?

00:49That's right. We heard from her statement in the media that she will be heading to Congress for a hearing.

01:01That is also scheduled for Friday.

01:03And the NBI subpoena is also scheduled for the first investigation on Friday at the office of the NBI.

01:14If she will receive a request and she will say that because there is an early engagement and Congress invited her

01:27and she will attend the Congressional hearing, we will probably reschedule this.

01:36But also, possibly Monday or Tuesday next week, the investigation must be continued

01:44because the investigation we will do is very important and the situation is serious, the threat is serious.

01:53That's why we need to call the Vice President to give her statement and information

01:59on who she talked to to carry out the assassination of our President, First Lady, and Speaker Martin Romualdez.

02:10Jusec, VP Sara also said that she is using the anti-terrorism law against her to restrict her movement and freeze assets.

02:20What is the reaction of the DOJ?

02:23Well, because of her statement, she is not denying the video clip that the entire Philippines saw on social media

02:35where she gave bad words and she admitted to talking to a person to fulfill her request to seek revenge.

02:51Those are the three officials.

02:55It is a heavy evidence.

03:00That's why we decided to continue the investigation because the anti-terror law should be taken in the context of

03:12the previous statements of the Vice President together with the contemporaneous acts.

03:19Sometimes, as you know, former President Duterte also said that he is asking the military to use weapons

03:33to remedy his so-called fractured government or fractured governance.

03:40That's a very dangerous statement.

03:44Remember, if something happens to our President, the beneficiary of this will be the Vice President.

03:56That's why we are not taking that threat very lightly.

03:59The anti-terror law, which I may explain, is a very strong law.

04:06This is a law that was passed during the time of President Duterte.

04:13And with the provision of the anti-terror law, not only the acts of terrorism, not only the designation of terrorists,

04:24we are not doing that as a case against the Vice President.

04:29But the law of the anti-terror law is based on the proposal to commit terrorism,

04:39a conspiracy to commit terrorism.

04:43And the very proposal to commit terrorism is already a criminal act.

04:50I have heard a lot of people asking why the Vice President will become a terrorist.

04:55No. It's a different process, what we call designation as terrorist.

05:00It needs a different evidence.

05:03But you don't need to be designated as a terrorist before you possibly violate the provision of the anti-terror law.

05:13Because we will look at Section 4 of the anti-terror law.

05:18Anybody who engages or intends to cause death or serious bodily injury to any person

05:26in the context of causing destabilization or sowing fear,

05:32those are what we call acts of terrorism.

05:36And any attempt or proposal to commit these acts is already punishable.

05:42That's why we are not branding the Vice President as a terrorist.

05:49But he could possibly become liable under the anti-terror law simply by conspiring.

05:55Conspiracy consists of two people coming to an agreement to execute any of these acts,

06:01including causing death and bodily harm to another person, taken together with the Sedition Law.

06:08The Sedition Law, if there is an act of revenge or harm on a public official,

06:17that is also under the law.

06:21We are studying all of these.

06:23We need to protect our President and the law itself will protect the President.

06:29One of the responsibilities of the President is the responsibility of all Filipinos.

06:34That is how important the role of the Department of Justice is now.

06:39We are taking care of the safety of all people.

06:45This is a test case for us.

06:47We need to have accountability, not only for poor people.

06:52Sometimes, they say that there is no law that can be enforced if a person is influential and powerful.

07:01But now, this is a situation where we have to show that the rule of law applies to everyone

07:08and no one is above the law.

07:10Regarding the statement of former President Rodrigo Duterte,

07:16is this being investigated by the DOJ or the NBI?

07:20And what are the DOJ studies that suggest that the former President may have violated the law

07:27in his statements?

07:30That is correct.

07:32The Department of Justice, through the National Bureau of Investigation,

07:38and together with the Philippine National Police,

07:41we are all monitoring the utterances of the past President.

07:55And that is another dangerous action that is threatening, possibly, national security.

08:03I know that the Philippine National Police,

08:05the Armed Forces of the Philippines, is a professional organization.

08:10And they will never interfere into civil affairs and civil governance.

08:16But to provoke the military to be the remedy, quote-unquote, to a fractured governance,

08:25is something very uncalled for and out of order.

08:31That is why we are monitoring the events.

08:35There are also a few that we hear are rallying, but it seems that they are not anymore, they are leaving.

08:41And all of these things are being taken together.

08:45And if it is necessary for us to pursue the case, we will have to do it.

08:50That is the obligation of the Department of Justice,

08:53to investigate offenses, to enforce criminal laws,

08:58and possibly prosecute if the evidence warrants.

09:28A type of extrajudicial killing if it does not go through the judicial process.

09:34And the judicial process requires everyone the opportunity to be heard.

09:53Within the context of an investigation with due process,

09:57assisted by his counsel, so that it will be in conformity with the requirements of the rule of law.

10:04There is no other agenda but to enforce the law.

10:08But to enforce the law to the limit.

10:10So that we can show to the world, show to our citizens,

10:14that no one is above the law, whether you have power or influence,

10:17or you are an ordinary citizen, you have to face the law equally.

10:22And uniformly it will be applied.
