A family lawyer has shared what Molly-Mae and Tommy's split might mean for them legally - including who gets the £1m engagement ring.  Tracey Moloney, 54, says it's unlikely Molly-Mae would be expected to return the sparkler Tommy proposed with.  Family solicitor Tracey claims under typical circumstances when a proposal is accepted, the ring is seen as a 'gift' - not just given on the condition they marry.  Tracey insists this means the £1m ring would be Molly's to do with it what she chooses unless Tommy could prove he was only giving it to her on those conditions.  She also explained possible scenarios for how they might handle their daughter Bambi's care - if they aren't able to decide amicably.  Tracey suggested Bambi's current daily routine and parent's schedules - including Tommy being out of the country for boxing - would be taken into account.  Therefore she reckons if it comes down to the courts, Molly-Mae would be more likely to get custody of the tot.

00:00So following the news that Tommy and Molly May have decided to bring their relationship to an

00:04end, I have been sent a whole heap of questions around how this is going to play out from a legal

00:08perspective. One of the most common questions I'm being asked at the moment is, does Molly get to

00:14keep the engagement ring? For those of you that are fans of the couple you'll know that when Tommy

00:18proposed he gave her a beautiful five carat pear-shaped engagement ring. So the rule around

00:24engagement rings is that if you accept them then they are a gift. So on the proposal if you say

00:30yes the engagement ring is seen as a gift. If Tommy had wanted the engagement ring returned to him

00:37then he would have to prove that the ring was given to her on the condition that she would

00:42marry him and if the marriage never went ahead then he wanted the ring back. Obviously we don't

00:48know if anything like that was entered into at the time of the proposal but let's say that it

00:54wasn't. In that case the ring belongs to Molly and it's up to her if she keeps it or if she gives

01:00it back. So what's the likely outcome in respect of Bambi now that Molly May and Tommy have decided

01:05to end their relationship? You would hope that Tommy and Molly could sit down and work that out

01:11between themselves amicably as in what's in Bambi's best interests but in the event that they're not

01:16able to do that and the matter proceeds to solicitors or even court then the legal solution

01:22will start by looking at what has been Bambi's routine up until this point. So what has been the

01:27status quo for her? You could argue that Tommy is out of the country frequently with his boxing career

01:35and that Bambi is used to being with Molly May and if that were the case then the court's more

01:40likely to make an order that Bambi remain with Molly May as her main carer and then have contact

01:47with Tommy but if Tommy wasn't in agreement with that then he could argue that it would be in

01:52Bambi's best interest for her to live with both Molly and himself. Typically given Bambi's age

01:59and she is so young it's more likely that the court's going to award Molly a live with order

02:06in respect of Bambi just because Molly has been that regular presence in Bambi's life while Tommy

02:14has been in and out of the UK following his career.
