00:05questioning the return to the National Treasury
00:08of the government's unused subsidy to the Philippine Health Insurance Corporation of PhinHealth.
00:14In a comment made on September 4, in the so-called unconstitutional petition,
00:20Solicitor General Menardo Guevara denied
00:24that Section 1D of the 2024 General Appropriations Act
00:28does not violate the right to health guaranteed under the Constitution.
00:34He also insisted that PhinHealth's income is more than enough
00:38to pay for benefit claims and operating expenses
00:42and that the idle PhinHealth funds are too much
00:44for the necessary funds for its maintenance and operations,
00:48including the payment for any remaining claims for the fiscal year 2023.
00:54Aside from the net income of an average of Php 100 billion in the past three years,
01:00there is a reserve fund of more than Php 488 million in March 2024.
01:07Guevara also insisted that the petition should not violate the requirements
01:12for the implementation of the Judicial Review.
01:14Petitioners should not use legal remedies
01:18and violate the doctrines of the hierarchy of the courts.
01:22Therefore, the petition should be dismissed.
01:24It should also not be shown in the petition that it affects the access of people to health services.
