00:09JSJK, the Royal Malaysian Police, expressed its appreciation for the passing of the Law of Movement of the Penal Code 2024,
00:20which was passed for the first time in the People's Court on 9 July 2024.
00:27This movement is a positive step in the effort to intensify the investigation and enforcement of fraud cases,
00:36especially fraud in the Penal Code.
00:39Through this movement, individuals who are involved in fraud cases in the Penal Code,
00:45including account holders, will face heavier sentences through actions under new provisions.
00:55This development is highly appreciated by the PDRM,
00:59given that at present there is no specific provision to punish those involved in this fraud case.
01:06The PDRM is confident that this movement will provide a new landscape in the enforcement of commercial crime laws.
01:15The following are some new provisions that have been passed.
01:20First, Section 424A of the Penal Code.
01:24This is intended to impose a penalty for the possession or control of other people's payment instruments or other people's bank accounts.
01:38Section 424B of the Penal Code
01:42This is intended to impose a penalty for the possession or control of other people's payment instruments or other people's bank accounts.
01:55Section 424C of the Penal Code
02:00This is intended to impose a penalty for the possession or control of other people's payment instruments or other people's bank accounts.

03:17The Ministry of Commercial Crimes welcomes the recommendations of the Minister of Finance, Lim Hui Ying,
03:26that the institutions of banks need to carry out a detailed investigation on unauthorized bank transactions.
03:36Banks should not blame customers for the losses they suffer from bank fraud in exchange for
03:46a clear proof that the customer failed to protect their personal safety evidence.
03:54For example, in the newspaper The Star, dated 10 July 2024,

04:06there is an accusation by an account broker that he has been brought by a syndicate to several banks to open an account
04:15without much questioning by the bank employees on duty.
04:19In short, there are bank employees who work with the syndicate to facilitate the opening of an account
04:27by an individual who is supposedly the owner of the company to allow money to be transferred to the company's account.
04:37Under the new regulations that will be enforced,
04:40the JSJK will also investigate and sue the bank employees involved in the activities of the syndicate.
04:49As an additional step, the PDRM recommends that the banks clean up their system
04:55to ensure customer safety.
04:59We also acknowledge or say thank you in several cases
05:06where bank employees also obstructed the opening of this account.
05:12There are two cases that we know for sure,
05:15and there are also cases in Penang where bank employees have blocked
05:22from account holders to transfer money.
05:27These are the steps that need to be praised
05:31because it helps the police in arresting this crime.
05:36For information, on July 9, 2024, the PDRM received another police report
05:42related to the loss of money from a bank account involving a loss of more than Rp 2 million.
05:49Through a report made at Kuala Kangsa, Perak,
05:52a complainant who is an accomplice of a local bank
05:56informed them that they found an accomplice in the same bank
06:01who has committed embezzlement by transferring money from a permanent deposit account to a third-party account.
06:11This accomplice's activities were only revealed
06:14when on June 27, 2024,
06:17two permanent deposit account holders
06:20came to the bank to withdraw money from their permanent deposit account.
06:26After the embezzlement was made,
06:28it was found that some of their permanent deposit accounts had been sealed.
06:32These customers denied ever making a deposit or withdrawing money from their permanent deposit account
06:41Based on the investigation by the bank,
06:44it is suspected that an accomplice has made the embezzlement
06:48and deposited it to several different accounts.
06:53The accomplice and the main suspect in this case
06:56passed away on July 5, 2024.
07:00No matter what, the main suspect has passed away.
07:05We will continue the investigation under Section 408 of the Penal Code.
