00:00 Is defense ready to call its first witness?

00:02 I am, your honor.

00:04 I'm calling my witness. Does prosecution have a problem with that?

00:08 This is outrageous, your honor. They can't switch attorneys in the middle of a trial.

00:11 And that would be true except for the fact that I've been co-counsel on this case from day one.

00:19 I have the employee directory right here. My name is in it.

00:22 It's been there since the beginning of this trial, and if you wanted to object to me,

00:25 you would have had to have done it at the beginning of this trial.

00:28 Then I want them waiving all rights to a mistrial, and I want it in the record.

00:31 Your honor, I'm not going to be punished just because she didn't understand that I've been representing myself this whole time.

00:35 He's got a point, Ms. Gibbs.

00:40 My pleasure, your honor. I don't expect we'll be needing a mistrial at all.

00:45 Defense would like to call Gloria Danner to the stand.

00:48 Please state your name for the jury.

00:50 Gloria Danner.

00:52 Mrs. Danner, a number of years ago, your son Clifford was convicted of murder and sentenced to prison. Is that right?

00:59 Yes, for a crime he didn't commit.

01:02 How do you know he didn't commit it if he was convicted of it?

01:05 Because you proved he didn't.

01:07 Mrs. Danner, can you tell the jury why it is that you're here today testifying and not your son Clifford?

01:12 He was working late at that diner. It was the only place he could get a job when he got out.

01:17 Two men came in to rob the place and when Clifford tried to stop him, he was shot and killed.

01:25 I'm so sorry.

01:30 I worked my whole life to put him through school and he ends up dying at the back of that shit restaurant in that shit part of town.

01:45 Can you tell the jury why you agreed to come and share your story for me today?

01:49 Prison ruined Clifford's life.

01:55 And if you had been our lawyer from day one, he never would have been convicted in the first place.

02:05 Thank you, Gloria.

02:10 No more questions, Your Honor.

02:17 Mrs. Danner, I happen to be familiar with your son's case.

02:25 And I understand that in order to reopen it, Mr. Ross risked increasing his sentence to life.

02:32 That's correct.

02:34 Well, I'd like to know how you'd have felt if he lost that gamble.

02:37 I'd have been devastated.

02:39 And if that happened, how would you have felt if you then found out that Mr. Ross wasn't even a lawyer after all?

02:45 Objection, Your Honor. How many hypotheticals can she ask?

02:47 That's okay. I think everybody in this courtroom knows how they would feel.

02:53 No more questions, Your Honor.

02:57 I wouldn't have cared what a piece of paper had to say.

03:01 Because Mr. Ross is the only lawyer I ever ran into that ever gave a damn about my son.

03:09 [Gentle music]

03:11 Mr. Ross, would you care to call your next witness?

03:15 I can't imagine anyone being more eloquent than that, Your Honor.
