00:19 of charges against Brij Bhushan.
00:21 The charge sheet was filed in the sexual harassment case filed by six women wrestlers.
00:26 Additional public prosecutor Atul Srivastav, representing Delhi police, told the court
00:31 that the WFI chief knew what he was doing.
00:34 He said that Brij Bhushan's intention was to outrage the modesty of the wrestlers.
00:38 Srivastav also pointed out that there are three types of evidence against Sharan Singh
00:42 which are enough to frame charges.
00:45 These include a written complaint and two recorded statements under sections 161 i.e.
00:50 examination of witnesses by the police and 164 i.e. statements recorded by a magistrate
00:56 under the Code of Criminal Procedure.
00:58 Srivastav said that the court is within the jurisdiction to frame charges against Brij
01:02 Bhushan Singh.
01:03 He also countered the argument made by the WFI chief's lawyer that sanction under section
01:08 188 of CRPC is required for cases that took place outside India.
01:12 Atul Srivastav referred to an earlier judgment and argued that sanction would be required
01:17 only if all the offences were committed outside India.
01:20 He said that the offences took place in Delhi as well as other places so sanction was not
01:25 required.
01:26 Brij Bhushan's lawyer, Advocate Rajiv Mohan, earlier submitted that the Delhi court does
01:30 not have jurisdiction to decide on offences which took place outside the country unless
01:35 that sanction is obtained.
01:36 Srivastav also told the court that all the witnesses in the case said that the co-accused
01:41 Vinod Kumar aided and facilitated Brij Bhushan's acts.
01:45 Before his suspension as the former Additional Secretary of WFI, Kumar worked closely with
01:50 Brij Bhushan Singh and looked after the day-to-day affairs of the wrestling body.
01:54 The Delhi police filed the charge sheet against the six-time MP on June 15 under sections
01:58 354, assault or criminal force to women with intent to outrage her modesty, 354A, sexual
02:05 harassment, 354D, stalking and 506, criminal intimidation of the Indian penal court.
