Ndërsa pritej qe gjykata e apelit te shpallte këtë te hëne vendimin për 29 te pandehurit e akuzuar per shpërthimin e 15 marsit 2008 ne Gërdec, kjo gjë nuk ka ndodhur. Ne një seance qe zgjati vetëm 5 minuta trupi gjykues i kryesuar nga gjyqtari Alaudin Malaj, i cili është mjekoheshit edhe kryetari i kësaj Gjykate, deklaroi se për shkak te volumit te madh te dosjes, gjykata e ka patur te pamundur te përfundonte vendimmarrjen. Por vendimi gjykatës nuk ka qene i papritur për te pandehurit dhe avokatet e tyre, shumica e te cilëve nuk u paraqiten ne gjykate. Ndërkohe pas seancës familjaret e 26 viktimave, akuzuan gjykatën se po përsërit te njëjtën skeme si shkalla e pare e gjyqësorit. Seanca e radhës u la për ne 13 shkurt. Një vit me pare gjykata e shkalles se Tiranës shpalli vendimin për 29 te akuzuarit duke dhëne dënimin me te rende me 18 vite burg për dy te pandehurit Dritan Minxolli dhe Ylli Pinari dhe me dhjete vjet për dy te akuzuari e tjerë Mihal Delijorgji dhe Sokol Ngjci. Për te akuzuari e tjerë dënimet varionin nga 6 vjet deri ne gjobe.
