Stay of execution: 'Cloudy' lethal injection drug gets Georgia death row woman a reprieve

The State of Georgia was supposed to put Kelly Gissendaner to death on March 2nd but due to the death drug's condition, she has been given an indefinite stay.

In 1997, the then 29 year old Gissendaner conspired with her lover Gregory Owen to kill her husband Doug. He would later testify against Kelly in court, confessing to the murder.

While Owen got a life sentence with the possibility of parole, Gissendaner got the death penalty; unusual for someone who didn't directly commit the crime.

The Georgia Department of Corrections may be seeking to avoid a grisly scene like the one that occurred in Oklahoma last year when Clayton Lockett took 43 minutes to die after the state changed the drug cocktail due to short supply.

Though it isn't a commutation of sentence, with other death drugs being out of stock this could be the beginning of a new round of thinking about Capital Punishment in general.

The Georgia Supreme Court previously denied her motion for a stay, and rejected the claim that the punishment was disproportionate because she wasn't even present for the murder and yet got a tougher sentence.
