In the wake of a car accident caused by massive flooding in Colorado last September, a man from Broomfield has indicated he plans to sue city authorities and the men who rescued him.

In the wake of a car accident caused by massive flooding in Colorado last September, a man from Broomfield has indicated he plans to sue city authorities and the men who rescued him.

Roy Ortiz said he was stuck in his overturned car for two hours as emergency crews failed to notice him.

The legal papers also state that the accident could have been prevented entirely had the road been closed or, at very least, marked.

Ortiz said he’s been reluctant to file the suit, but must in order to pay his hefty medical bills.

Among the injuries for which he was treated are hypothermia and tissue damage.

His brother, who arrived on the scene moments after the accident happened, said that despite his pleadings for a more thorough search, workers treated the incident as a recovery than a rescue.

It wasn’t until they started to tow the car out of the creek that they noticed Roy Ortiz was not only still in the vehicle, but alive.

The amount listed on the filing is a half a million dollars, but Ortiz’s lawyer said they don’t plan to go for the whole amount.
