00:00Police, the defendant kicked the officer in the face, the neck, and the chest while the officer was on active
00:08duty.
00:09That officer sustained swelling to the face, substantial pain to the arm.
00:14The defendant was subsequently then transferred to the hospital for treatment, where the defendant allegedly then kicked the nurse in
00:20the chest.
00:21The officer in this case was taken to a local area hospital for treatment to those injuries.
00:26For those reasons, Judge, we are asking for monetary bail in the amount of $20,000 cash, $60,000 partially
00:33secured bond at 10%.
00:35Should the defendant be convicted of the top count, she is facing two to seven years' determinant.
00:41We do believe that monetary bail is the kind and degree of control reasonably necessary to assure this defendant's return
00:47to court.
00:48Okay, thank you.
00:50Counselors, I will hear you. Are you serving for us by a jury notice?
00:55Your Honor, we would ask for an extension of that date, of the grand jury date.
01:00I understand it's an October 16th date?
01:03Counselor, I'm simply asking you if you're serving for us grand jury notice.
01:07No, no.
01:07And if you're not.
01:09We would ask for notification of the grand jury.
01:13You just got the notice.
01:15It's on 1016, counsel.
01:191016 in that the people will present this case before the grand jury.
01:24I'm simply asking if your client would like to reserve her right to testify before the grand jury.
01:30Yes, Your Honor.
01:31Absolutely.
01:31So you're serving for us grand jury notice.
01:33Yes, Your Honor.
01:35Okay, and as to the order of protection, counsel, we'll hear you.
01:40Your Honor, we don't believe that there is a need for an order of protection in this case.
01:45These are strangers.
01:47There's no indication that there will be any sort of that they'll cross paths ever again.
01:53Again, we're prepared to also argue about the circumstances that gave rise to the complaint in this case.
02:01But we do not believe, Your Honor, that this is an intentional assault.
02:08We do not believe that our client will.
02:12Your Honor, Ms. Blair is a 54-year-old single mother with significant health issues.
02:18The dog who is referenced in the complaint is a certified service animal.
02:24This is Ms. Blair's first brush with the criminal justice system.
02:29She's never been arrested.
02:30She's never been convicted of any crimes, felony war misdemeanor, and she has no, not so much as a parking
02:38ticket.
02:39Your Honor, the circumstances alleged in the complaint are the product of a medical emergency, not intentional criminal conduct.
02:45Again, Ms. Blair is 54 years old.
02:48She's been diagnosed with multiple sclerosis and Parkinson's-ism, conditions that greatly impact the neurological system.
02:57Prior to the flight and issue, Ms. Blair missed several doses of Nudaxa, a powerful medication that controls severe neurological
03:08symptoms.
03:08And Ms. Blair boarded this flight after being on set and working extensive hours and exhaustive hours in the days
03:21leading up to this flight.
03:23Additionally, Your Honor, at one point during the flight, there was an incident where Ms. Blair actually fell and hit
03:29her head.
03:30These factors, Your Honor, coupled with the altitude, resulted in a state of severe confusion and disorientation.
03:38And the medical causes of this are corroborated by the fact that law enforcement had to transport Ms. Blair to
03:45the hospital last night,
03:47where she was discharged after approximately seven or eight hours, and just hours later, she had to be transported back
03:55to the hospital for administration of additional medication.
04:00Ms. Blair did not get on that plane intending for any of this, Your Honor.
04:04Again, this was a medical emergency.
04:08She is now a flight risk.
04:09She has sole U.S. citizenship.
04:13Her family is all in the United States.
04:15She has a minor son, sisters, cousins, aunts, and uncles.
04:19They're all in the United States.
04:21Her career is here in the United States.
