00:00Happy Sunday, and welcome back to Dentro la Storia, the channel for those who love contemporary
00:05history.
00:06It is 2025, and we are heading toward 2026, the year we will celebrate the 80th anniversary
00:14of the Italian Republic.
00:16And what better way to celebrate this anniversary than to re-read the articles of our Constitution?
00:22That is why Giovanni and I have decided to dedicate several Sundays from now until June
00:292026 specifically to reading and discussing some articles, a reading that will also include
00:36commentary to better understand the choices made by our founding fathers and the desire
00:41to create a different state.
00:43We talked about Article 1.
00:46We talked about Article 3.
00:48Today, it's the turn of Article 5, which I will now read.
00:52The Republic, original and indivisible, recognizes and promotes local autonomy, implements the
00:59widest administrative decentralization in services dependent on the state, adapts the principles
01:05and methods of its legislation to the needs of autonomy and decentralization.
01:09What did our founding fathers mean by these lines, by these words?
01:15The framers intended to guarantee the utmost freedom to local communities in managing
01:22local interests, recognizing their special autonomy, fully aware that the relationship between
01:30the state and local authorities would constantly characterize the public and political debate.
01:35This article, Article 5, elevates the principle of local autonomy to a fundamental principle, not
01:43leaving it as a mere organizational model.
01:46The reason?
01:47The reason is to be found later on.
01:50In the second part of the Constitution, the one concerning the structure of the state,
01:54within local authorities, the regions, the provinces, which no longer exist today, and the municipalities,
02:01the possibility of exclusive or concurrent legislation in certain matters.
02:06It is the recognition of certain peculiarities, of certain specific cases, that call for greater
02:13attention from local administrators to these issues, compared to a central administration.
02:19The framers learned from Italy's long experience with a centralized state, first monarchical and
02:25then dictatorial, and they realized that the top-down imposition of one-size-fits-all directives
02:33can be extremely destructive to the state that is to be born, that is to be formed.
02:39And so, they provide options, ways out in the face of possible points of friction, or simply
02:49opportunities to resolve them, matters that would sometimes require going to court.
02:54And sometimes it happens.
02:56Let's consider the administrative courts, that is, the TAR, the Regional Administrative Court,
03:00and the Court of Second Instance, which is the Council of State, precisely to settle these
03:05matters.
03:06But even more so, the constitutional framers foresee the possibility among local administrators
03:14in locally administered areas to take certain actions, and to have certain powers.
03:21All this is part of a complex system of checks and balances, which was conceived during the
03:2918 months of work to arrive at the definitive text of the Constitution, in which today is
03:37the fundamental, necessary foundation of our public life.
