Atty. Sheila Sison and Atty. Jay Tolosa clash over a video from a 2024 House hearing showing Atty. Michael Poa with Representative Jonathan Keith Flores.

Sison called for the video to be paused, arguing that the part being played was a “third-party declaration” and could not be used to confront Poa, citing the court’s earlier ruling on third-party statements.

Tolosa argued back, pointing out that Poa himself appeared in the video and was the one testifying. Adding that the video will only be used to give context.

00:00Tech Booth, please play video number one.
00:05This shows portions of the hearing conducted on October 17, 2024.
00:22For me, forgive me po.
00:24Ang labo kasi na you're saying na ito yung information that we gathered using this reward money, supposedly, and that
00:35in effect, the AFP...
00:39Kindly pause it, Tech.
00:42Yes, Attorney Sela.
00:44I think the court just ruled a moment ago, Your Honor.
00:48This cannot be replayed and used to confront the witness.
00:52Because as far as this witness is concerned, this remains to be a third-party declaration, Your Honor.
00:59Your Honor, third-party declaration, we can see Attorney Poa right there.
01:04That was him testifying.
01:06But, Your Honor, the playback right now is not of Attorney Poa, but of Representative Flores speaking, Your Honor.
01:12Again, Your Honor, it's context.
01:13Next, so we will understand the answer given by Attorney Poa.
01:18Are we saying we can't believe the answers given there by the witness that we're watching right now?
01:23Her co-defense counsel, Attorney Poa?
01:26Then, Your Honor, all the counsel has to do is to confront the witness with the answer he gave.
01:32And that's precisely what we're trying to do.
01:35But to give context, of course, we have to see the question first so that we will know the context
01:41of that answer.
01:42There was no ruling stated by the Honorable Court preventing us from showing this video, Your Honor.
01:49Counsels, please.
01:50We're nearly about to break for lunch.
01:52Lower it down a notch.
01:58Yes, Attorney J, you can just ask Attorney Poa, you remember being asked and answering in this manner?
02:07Again, because clearly, Attorney J, the Honorable Flores, whom I see there, if I'm not mistaken,
02:19is making or at that time was making some conclusions and clear accusations,
02:24which we will try to avoid in this court unless you want to present the Honorable Flores.
02:29So kindly phrase it or this chair can do it so that we can get to somewhere before we pause
02:34for lunch.
02:35Ask the question that Attorney J, that the Honorable Flores asked and let the witness answer
02:41without showing that video of the Honorable Flores Anymore Counsel.
