01:36Today, we look deeper and think better about questions behind stories making the news.
01:42First, Article 1 of the impeachment trial.
01:45What does the evidence really show? And where is the line between questionable accounting and proven wrongdoing?
01:54Second, Sandro Marcos' revelation about the 2022 Marcos-Doterte alliance.
02:01Why are we hearing these details now? And what do they tell us about the political negotiations that shaped the
02:092022 election?
02:12And third, the flooding in Luzon.
02:15After billions have been allocated to flood control projects, why do communities remain so vulnerable?
02:22Let's begin with the impeachment trial. Specifically, Article 1.
02:29Do questionable documents or audit findings automatically prove that public funds were misused?
02:37Article 1 concerns P612.5 million in confidential funds, P500 million for the office of the vice president,
02:48and P112.5 million for the Department of Education.
02:55Two former land bank branch managers, Violeta Constantino, formerly the Shaw Boulevard branch manager,
03:03and Ninita Composano, formerly the DepEd branch manager, testified about unusually large cash withdrawals,
03:12including P125 million transactions.
03:16The four P125 million office of the vice president, cash withdrawals, total P500 million.
03:29Former land bank branch manager, Violeta Constantino, described the four transactions as unusual,
03:38while importantly saying they were not necessarily suspicious.
03:43The prosecution then subpoenaed COA personnel Roderick Wamil,
03:49a former COA state auditor assigned to the Intelligence and Confidential Funds Audit Office.
03:57The trial continued with questions about COA's auditing and confidential funds
04:02and the documentation submitted to support expenditures.
04:07The prosecution's theory is essentially that confidentiality does not mean exemption from accountability.
04:17Are the documents and liquidation records sufficient to establish that the funds were actually used for legitimate confidential operations?
04:27The defense's argument is that COA evidence is significant,
04:32but a COA finding is not automatically proof of an impeachable offense.
04:39The defense argued that COA identifying deficiencies, questionable documentation,
04:46or amounts requiring clarification does not by itself establish that the money was stolen,
04:54misappropriated, or personally benefited the vice president.
05:00So, we decided here in Beyond the Headlines to actually delay our commentary specific to Article 1.
05:09Among the four articles of impeachment, at least if we look at the schedule,
05:16Article 1 will have the longest exposure if we call it that way.
05:22And my commentary, again, I'll issue a disclaimer that I am not a lawyer.
05:31So, I represent everyday Cebuanos or everyday Filipinos following the impeachment trial.
05:38As we know by now, the impeachment is not only a legal proceeding or constitutional proceeding for that matter.
05:49It's also political.
05:51So, part of the reason why it's shown in public,
05:56it's because this also concerns public perception on how the trial is going,
06:02and eventually for the public to also come up with our own decision
06:09whether the vice president truly committed an impeachable offense.
06:15So, that said, let me begin the usual conversation that we had in the past
06:23by highlighting what I think were the prosecution's strongest points,
06:27and then I'll move towards the defense, what I think the defense's strongest points,
06:34and then we'll tie it or we'll tie the discussion from there.
06:38And just like in the past, if we also have lawyers reviewing,
06:43and if you have specific comments about the legal aspects of what I'm saying,
06:50feel free also to make your comments and to also ask questions for our viewers
06:54and engage in those conversations in the comment section.
06:58And we will do our best to go through each one of them just in case there will be,
07:02and then we'll also comment on these as necessary.
07:08So, let me start with what I think were the strongest points of the prosecution.
07:13So, I think the strongest point in my view is for the testimony concerning large cash withdrawals.
07:24If we're talking about 125 million peso withdrawal and then done four times,
07:33I will have to say, as a person watching the proceeding, it did bother me.

07:46I've not even seen one.
07:48So, for an everyday Filipinos, this is a large amount.
07:53And then, if done, at least from what we saw on the first few days of the impeachment trial,
08:01if done four times, it's really worth noting.
08:05So, I will have to say that the prosecution in that matter was able to raise the urgency for us
08:15to look more closely
08:16because 125 million peso withdrawal done in succession is unusual.
08:25If I have to say, Ibaro, the term of the land bank manager who described those transactions.
08:33The other thing also, which I find the strongest, is confidentiality does not also mean that these funds will have
08:44to go unaccounted.
08:47This is also one of the cleanest arguments in my view that the prosecution was able to surface.
08:56Because in the proceedings, it's already clear to me as an everyday Filipino that while the money was intended for
09:08confidential purposes,
09:11but at the end of the day, the money is still public money.
09:15So, that means whatever reporting, whatever auditing requirements will have to be satisfied.
09:26They may not exactly reveal the identity or the exact activity that these amounts were allocated
09:38because, again, these are confidential, but at least it should be established
09:44that proper accounting and auditing, proper accounting was made and auditing compliance were met.
09:54So, for me, that's a clean argument also that the prosecution was able to clearly establish.
10:02And then, let's go to the paper trail or the document trail because it looks like this is what the
10:11season two is about.
10:13It's following through the trail of documents such as receipts, dates, signature, supporting documents.
10:23And for me, at least in my opinion, there is a damaging impact the more they uncover withdrawals
10:35and the lack of clarity on whether the reporting requirements and the auditing requirements were actually met.
10:49And for me, the more the prosecution will uncover these documentation gaps,
10:58I also think that it's also creating doubt on the minds of the everyday Filipinos or viewers such as myself.
11:09And this one brings me also to the strength of the defense.
11:14Weird, no, after just telling you that this can be damaging, but I'm also now moving towards what I thought
11:22this is also the strength of what the defense is actually holding.
11:28Because if we are to look at the document trail, at least from what we are seeing until last week,
11:39because by the way, today there is no impeachment trial because of some weather conditions in the National Capital Region
11:48and Luzon.
11:49But at least from what we saw yesterday since the start of Article 1,
11:53while they were able to present the document trail,
11:59that they did not succeed, at least for now, that a wrongdoing, specifically a misappropriation was made,
12:14and then whether the money actually went to the pocket of the vice president.
12:19I'll create an analogy, no, just for, and I'm sorry if this is a lay analogy,
12:25but again, this is a representation of an everyday Filipino.
12:29It's also like,
12:30it's also like, it's a lot of expense reports that we also meet in our private corporate practice,
12:35because it's not like, it's a lot of expenses if they happen to be the money of the company.
12:41And there really are cases that the, if we just look at this objectively,
12:49there really are cases in which there are gaps in the expense report.
12:54So normally what happens in that process is we question those reports,
12:58or we also, and, or we withhold further requests for funding of that particular department.
13:08So we just stop short at questioning.
13:11But we don't immediately assume nga,

13:55So, a withdrawal in four successions of 125 million peso each really happened.
14:03But, as of this time,
14:06it's still unknown, no?
14:08Whether these 105 million are actually just gaps in reporting,
14:13or wala lang na klaro o expense or report ang expense,
14:21or are these really misappropriation?
