00:00Prosecuting a case of vigilante justice is very difficult.
00:03Prosecutors know that the chance of an acquittal is high.
00:07I personally think that the father should be charged, but he should get little to no time.
00:12You can't have members of society take the law into their own hands.
00:17That renders our criminal justice system futile.
00:22Chaos ensued at a Grove City, Ohio home in July
00:25after her father lured his daughter's alleged rapist to his home and shot him.
00:30According to Prosecutors, Diego Montoya Gonzalez was shot by Malik Chandler
00:35after the 11-year-old's mother discovered a video on their daughter's phone
00:39that showed Gonzalez sexually assaulting the girl.
00:42According to WNBS, the day after the discovery, Chandler pretended to be his daughter on TikTok
00:47to get Montoya Gonzalez back to their home where he shot him twice.
00:51Chandler told investigators he intended to just beat up Gonzalez,
00:55hold him there, and then call police.
00:57But he thought he saw the alleged sicko reach for a gun in his pocket,
01:01picked up his gun off the counter, and opened fire.
01:04Chandler was charged with felony assault, and his bond was set at $100,000.
01:09While Gonzalez was indicted by a grand jury on five counts of pandering sexually-oriented material,
01:15two counts of rape, and one count of obstruction of official business.
01:18His bond was set at $20,000 for cognizance and $50,000 cash.
01:23The Post spoke with former Los Angeles federal prosecutor Nima Rahmani about the case.
01:28My name is Nima Rahmani.
01:30I'm a former federal prosecutor and the president of West Coast Trial Lawyers.
01:33Prosecuting a case of vigilante justice is very difficult.
01:37Oftentimes, you'll deal with jury nullification or other issues
01:42where jurors just don't want to convict someone who is protecting someone else,
01:47especially if it's their child who's being sexually abused.
01:50Vigilante justice cases that go to trial are few and far between
01:54because prosecutors know that the chance of an acquittal is high.
01:58What they try to do is plea these cases out
02:01because oftentimes there's a moral justification for the use of force,
02:06even though there's not a legal one.
02:08We certainly can't have members of society taking the law into their own hands.
02:13Can't serve as a judge, jury, and executioner.
