00:18that the murder was committed in the commission of a kidnapping,
00:22which makes it potentially a special circumstance capital case.
00:26You will also see on the complaint that is the only charge.
00:30There is an allegation, sometimes it's confusing, about 1170H
00:35and whether Mr. Bwo had a prior conviction.
00:38There's no indication that he did.
00:39We filed that information as notice to the defense that this obviously would be a state prison case
00:44and not a county prison case.
00:46And there's also a firearm allegation as a result of the manner in which the victim, Mr. Shakur, was murdered.
