00:24simple. That's a civil issue. Well, it isn't until it turns into murder.

01:18In May of 2018, I was shot in the face. The bullet went in the right side. It went through
01:27my nose,
01:28and it came out in my ear. I'm really lucky to be here today.
01:40Me and my husband, Dave, moved to Mount Sterling in 2002. We lived in Ohio, and my parents retired
01:49and came to Mount Sterling because their family's down here. So we followed.
01:55Mount Sterling is a small community. It's about 36 miles from Lexington. Pretty much everybody knows
02:04everybody, and everybody's nice here. They're friendly. We're in our own little world here.
02:12Pretty much my mom's entire family is from Kentucky. My grandparents lived here,
02:17and my aunts and uncles. Shauna's like my daughter. Even though Shauna was an adult,
02:25I wanted to make sure Shauna was taken care of. Yes.
02:31Shauna's family is pretty good-sized. Everybody's close. You go up and count houses, and half the family is in
02:40every house up there.
02:42The kids run up to each family member's house from one to another, knocking on doors, going and getting candy.
02:49My parents lived right across the street from us. It was good.
02:54I mean, we was all close and spent time together, and, you know, I had a pool in my yard.
03:01So we had a lot of cookouts and dinners. Dave and I, we were always laughing and joking and smiling.
03:10He didn't really have a close-knit family like ours, so David did appreciate having a big family around.
03:18My mom and Dave got together when I was about two years old. I have always had two dads. I
03:24was very blessed in that aspect.
03:27Dave watched me grow up, and he was there every time I made a mistake or did something good, he
03:33was there.
03:34And I'm just so thankful for that.
03:46In 1995, I was living in Franklin, Ohio. I worked at Warren County Board of Developmental Disabilities.
03:55I was working as a bus driver, and I transferred clients to and from home each day so they could
04:04do work.
04:06David worked inside the group home. My first interaction with David was his very first day we got into an
04:15argument.
04:16We would argue and fuss, and he complained about me, but each day I had to transport a behavioral student,
04:25and he had to go with me. So then we started talking and was civil to each other.
04:32He warmed up to me, and it just went from there, and we just kind of clicked.
04:39We eventually started dating and living together in my house with my daughter, Haley.
04:46One of my first memories of my mom and Dave together was all of us going to Tennessee.
04:53We're on vacation in Gatlinburg. We woke up one morning, and he said,
04:58do you want to get married today? And I was like, yeah, right. Neither one of us had clothes to
05:05get
05:05married in. We both had shorts on, I had a beer t-shirt on, and Haley was probably the only
05:11one that even
05:12had a cute outfit on, because she was tiny and I dressed her cute.
05:16They just knew they wanted to be together, so they tied the knot.
05:23And then my mom found out she was pregnant with my sister.
05:27It was just a chance that I took on him, and it was a chance that Dave took on me.
05:40Everybody in our neighborhood, I mean, we all got along. We were close-knit. I'd lived there 14 years,
05:48and I did not have any problems with any neighbor. Up until Francis came, and then it all changed.
06:01Frances did have a long history with our family in Mount Sterling, but she was actually quite a bit
06:07older than me. I didn't know much about Frances other than her. My cousin was very good friends,
06:14and she had stayed with my grandma when she was younger because she was having family problems.
06:21Frances became part of our family when she was 15, 16 years old.
06:28Frances didn't really have a good home situation. She told us that her mom wasn't good to her, but
06:38I was never sure. She enjoyed being with my family. She was there so much. After a while,
06:48we just always introduced her as our niece. She became close to us. We all loved her. She was funny.
06:56She was fun to be with.
07:01I don't know what happened to her. I had not heard a word about Frances for years,
07:10until one day. She just showed up. She was getting divorced, and she was coming back home.
07:20Frances wanted to buy property and live by us because, really, she had been a part of our family.
07:27When she first came here, Frances had all kinds of money. She told us when she got a divorce from
07:35her
07:35husband, she got a big settlement.
07:41Frances had bought the property straight across the street from us,
07:45and she was going to put her a new double white in there. But there was an old house,
07:49and it had to be torn down, and the yard had to be straightened up.
07:52So she asked me if she could stay with me until she got her house done. I said,
07:57yes, that's fine. You can stay. I could get along with pretty much anybody, and I thought,
08:02I'm going to help her. My main goal was to just be there and treat her like family,
08:09and that's what I intended on doing.
08:14Frances moved in with us at the end of November. I was on disability, unable to work,
08:22and Dave worked at a factory out here in Mount Sterling that makes parts for cars.
08:28David also worked part-time at the Montgomery County Regional Jail as a deputy jailer,
08:34and he was such a hard worker. He worked all the time.
08:38Both of my daughters were out of the house, so, I mean, I thought it would be good company for
08:43me,
08:44for Frances to be there. Me and Frances would get out and go shopping. We'd go out to eat.
08:51We went to the movies. We had cookouts. We used to go to a club downtown and dance,
08:59and we just had fun.
09:03But then we started having problems.
09:06She'd get a little short with me or upset, but I just blew it off and didn't address him.
09:16Frances' personality became bossy. Everything had to be her way. Like, she wanted to take over.
09:31I was vacuuming my house one morning early, and she came out there and pulled the plug out of the
09:40outlet and said,
09:42it's too early to be vacuuming. And I was like, whoa, this is my house.
09:50I started seeing more signs that it wasn't a good idea for her to be with me.
09:58She had told me about a video that she was in, and we watched it on YouTube.
10:04Muslims, they follow the same satanic book that they all do. They all read the same pages.
10:10Here's the thing. I don't even see Islam as a religion. It's a death cult, a glorified death cult.

10:39I thought it was a little bit crazy,
10:43but she thought it was cool that she was in this video protesting. And then I started thinking,
10:51she may be a little racist. This is not going to work. David did not like her at all. He
11:02said,
11:02she's troubled from the beginning. She's loud mouthed and she is an attention seeker. He was a very good
11:10judge of people.
11:16In 2016, I was living in Ohio. I had met my husband. My son Owen was born in 2013,
11:26so I had already had a son when I met my husband. I visited my parents almost every other weekend.
11:34Dave and I was very close with Owen.
11:37And Owen was the highlight of his life because he had two girls. So he wanted a boy in the
11:44family so
11:44bad. The moment that Owen was born, Dave was there every single day, rocking him to sleep, holding him,
11:52watching NASCAR with him. You would think that they had been best friends their whole lives.
11:58He was our world. It's different when you have a grandkid.
12:05Haley brought Owen to visit one weekend. And when they come in, Haley's like, who is that?
12:12And I said, that's Francis. She's staying with me.
12:16When I learned about Francis moving in with my parents, it was a big surprise. I didn't know this
12:23lady. I didn't know anything about her. Meeting Francis for the first time, she was different.
12:31She was very awkward when we came into the house, kind of felt like we didn't belong. She made us
12:37very
12:37uncomfortable. Owen was three at the time that Francis moved in. So he was pretty rambunctious.
12:46He was hell on wheels. He didn't slow down for anything, maybe for a cup of chocolate milk.
12:54He was on the go all day long.
12:59Francis was just kind of a grumpy old lady when Owen was around. I don't think she really cared much
13:04for
13:05kids. And I think part of it took the spotlight off of her. I don't think she liked that.
13:12Francis had a wrestling bitch face. She always looked like she was about to ask for the manager.
13:19And that's just not my cup of tea.
13:28My arrangement with my oldest daughter was to get my grandson every other weekend,
13:32and he would stay with me all weekend. Francis was home resting in the bed,
13:39and Owen was riding his bike around the house. And he was making noise and hollering,
13:45hey, Mimi, watch me. And she came out of the bedroom and yelled at him and told him to get
13:53off
13:53that bike and be quiet. So she was trying to nap. It was a shock to me that she would
14:00have yelled at my
14:01grandson like that in my house. Her behavior towards my son was not acceptable in Dave's eyes. Nobody
14:10talked to his grandson like that. She couldn't come in and start trying to control the grandbabies now.
14:17That's just not going to happen. Those grandbabies are our prize and joy.
14:24I told her, you need to get your stuff together. And I'm going to take my grandson to eat. And
14:30when
14:30we get back, you better be out of my house. And we left. And when we came back, she was
14:35gone.
14:37When all the issues came with Francis, Dave wanted her to go. So he was happy when she left.
14:54I asked Francis to leave in January. And she moved into her new home across the street in March.
15:03When she moved in, I never dreamed we would have issues with her. I just assumed she'd stay over
15:11there and live her life. And we'd stay over here and live our life.
15:19But Francis decided she was going to try to cause problems. One of the first issues was the property
15:25line. Francis had moved in and she was kind of taking over a property that wasn't hers. It was
15:32actually my grandfather's. Francis wanted to build a driveway. But she wanted to take it over on my dad's
15:38property. And my dad would not let her. My grandfather was getting very irritated. And she
15:45was not backing down. They had it surveyed. And he was right. She was way over the property line.
15:52But that wasn't good enough. Francis went ahead and built the driveway. My dad was furious.
16:02My grandfather decided to mark it off very vividly for her. He put some vehicles there. Upside down.
16:15Yeah. He flipped cars over. Welcome to Kentucky.
16:22From that point on, it just went downhill real quick.
16:31My mom at the time wasn't working because of her health problems. She was staying at home a lot.
16:38And my sister was off to college. I was obviously grown and living in a completely different state.
16:45I know that she was getting kind of lonely. So she decided, you know, I think I'm going to
16:50try to get out of the house a little bit. My friends had a tanning salon. And one of my
16:58best
16:58friends worked for them. And I hung out there all the time. While mom was at the tanning salon and
17:06helping
17:06her friends, Francis came out to the salon and kind of was making a scene. And then my mom told
17:13her
17:13she had to leave. And then Francis made a post on Facebook to the business saying that she was
17:21going to report them for me working there. She was accusing me of working while I was on disability.
17:27And she was going to try to report me. But I was not working. I was just volunteering and hanging
17:34out.
17:35She was just trying to get the business owners in trouble.
17:40My mom is one to protect her tribe. So when Francis decided that she was going to take my mom
17:46down and
17:46the tanning salon down, my mom said that it wasn't going to happen. She's not the type that you can
17:51bully.
17:54I went out my front door and went over there.
17:59And I told her, you know, mind your own business. Nobody's bothering you. And we don't want to be
18:05bothered. I did ask her why she was doing it. And she just laughed. And she said, because I can.
18:13And then we got into a fight. It wasn't just pulling hair slapping. It was a fight.

18:23David come and broke it up and drug me off of her.
18:30Francis called 911. 911, where is your emergency?
18:34The neighbor come down here and started beating on my door with a stick and a hole and saying,
18:38I'm going to kill you, bitch. And when I opened the door, she started getting me with the fucking stick
18:43attention. And what's her name? Her name is Shauna Scott. David Scott's wife. David Scott come in my
18:51house and jerked me down and let her hit me in the face. I absolutely want to press charges.
18:58I worked for Montgomery County Sheriff's Department. I was a deputy sheriff there. We had to respond to
19:04Washington Street. There was an incident that the neighbors had a fight, a minor assault.
19:12Francis was telling me that she was struck with a stick.
19:17Francis told the police that I took a hole and that I hit her with it and that David beat
19:22her with
19:22it. And she demanded that I be arrested immediately. She didn't have any injuries on her that I was,
19:29that I seen to show that she was struck with the stick. I can't make an arrest on an assault
19:36unless
19:37there's very serious physical injuries that we can see. I mean, was we scuffed up from rolling on the
19:44ground? Absolutely. But no, she was, she was fine. Then all of a sudden the next day she had a
19:51neck
19:51brace on, an arm brace on. Francis did follow up with the steps to formally press charges against
20:01Shawna. She went to the county attorney and a warrant was issued for Shawna in that case.
20:10I was arrested two weeks after the fight. But I mean, I knew it was coming because she was not
20:16going
20:16to stop until they arrested me. And while we got to the jail, I called David and said,
20:23I'm at the jail, I'm being arrested. And so he said, I'll be right there.
20:33This is the first time I've ever been in trouble.
20:36I was embarrassed because Dave still worked at the jail part-time as a deputy jailer.
20:44Dave calls me, lets me know that my mom and Francis physically assaulted each other. And that Francis
20:52was pressing charges and wanted to see her in jail. I was kind of in shock. And I've never seen
21:00my mom
21:00act like that. Dave kept in contact with us after the altercation. He was definitely worried about it
21:08because he didn't want anything to go against his name or Shawna's. Dave said that he was going to
21:16get things settled and just try to let everybody cool off. Well, I don't think everybody cooled off.
21:25When I got home from being released from jail, Francis was out in her yard, video recording on her phone.
21:34She was mad. She called the jail. She called the sheriff's office,
21:37demanding that they put me in jail for 18 months for assaulting her.
21:48I'm being unfairly treated here in Montgomery County, and I don't deserve this.
21:53But these people come to my house and assaulted me, and they will not do anything to them.
22:00I told the sheriff that, too. He works at the jail, so they think they can do anything up here,
22:06and just because David has that conviction, they can get away with it.
22:10I have reached out to the state police. I have talked to the attorney general three different times.
22:16They advised me to report this to the FBI, and I did so. The FBI told me I needed to
22:22file a complaint
22:23within the DOJ, and I am in the process right now of writing a letter to President Trump.
22:30This is not going to be swept under the floor.
22:33Frances had this idea in her head that Dave working at the jail made it impossible for my mom
22:39to face charges, which is absolutely absurd. The good old boy system here protecting David Scott
22:44and his wife is going to end. It's going to end.
22:50Two weeks after I was released from jail, they served me with a paper to go to court.
23:02The case came to me in 2017, and I was appointed as prosecutor.
23:09Shawna Scott was being charged with assault in the fourth-degree minor injury. It's a Class A misdemeanor.
23:15I had learned from reviewing the report that it was a neighbor-on-neighbor case where Ms.
23:20Zoyer was the victim of an assault. My first impression was pretty clear-cut, and I'm like,
23:27okay, well, hopefully this is something that we can, you know, get resolved.
23:32After my first court appearance, I wasn't no danger to no one. I was just sitting home waiting for my
23:39trial.
23:41Shawna was under a no-contact order as part of her bond in the criminal case.
23:45She used to have no contact with the victim, and in this case, that was Frances Zoyer.
23:50If she did violate that no-contact order, she could potentially be taken back into custody.
23:58I was not allowed to mow my front yard. I was not allowed to go to my own mailbox,
24:03because it was 500 foot too hard. That's how close we lived.
24:09I think that Frances really started to try to bait my mom to cross that line so that she can
24:15make a
24:15phone call and have my mom thrown in jail, which is what she wanted all along.
24:20From that point on, she was nonstop calling the police.
24:26It doesn't matter what we did, she would call the cops on us.
24:54It's gone, and of course, my lovely neighbors are smiling, so it's like they don't.
25:00I am so sorry. It was rolled back into the backseat.
25:04Oh, you found it?

25:07Every time I walk out my damn yard, they're out here videotaping me like I'm some kind of
25:12movie star. These are not paparazzi. Don't I have the right to privacy here?
25:19I was called to Washington Avenue almost daily. I mean, it was over and over, just all the time.
25:27Mr. McCain, dispatch.
25:29My ghost neighbors around here sitting off fireworks,
25:32and the sparks are flying on top of my vehicle and my home.
25:36I'll get a deputy headed out that way, okay?
25:41We have to respond to every call, and that's hard in this small community because most of the time,
25:47we only had two deputies on duty at one time.
26:01Princess did anything she could to antagonize me.
26:05My youngest daughter is biracial. Frances called my daughter the n-word.
26:12But I wouldn't fall for it. I stayed away from her.
26:17And I think she was racist against Dave. I think she had it out for Dave from day one.
26:24I remember one weekend, David went out to start the car,
26:28and this car was across the street in my dad's property.
26:36David Scott came here this morning, and I called the sheriff again today, called the state police also.
26:42The man that they won't protect me from pulled into the driveway beside my driveway.
26:49Frances came up to his car. She went around the car windows, beating on the car windows, cussing and calling
26:58names.
26:59I went over and videotaped his car sitting there running with him in it.
27:05Howard put the blinders thing in front so you can't see in the car, and he'd sit there in the
27:09car,
27:10and he wouldn't roll down his window.
27:12He said, if you're a man, come out here and fight me. Just crazy.
27:19He just drove away.
27:25And I said, why wouldn't you call the law?
27:27And he said, what's the law going to do? They're not going to do anything.
27:33The sheriff keeps saying, if we don't see it, it never happens.
27:36I asked him today, I said, how about murder?
27:40If they come down here and murder me, you don't see it.
27:45So whatever happens, all right, I'm going to lose my life over this.
27:48That's not there. That's there.
27:50Can somebody in this county do something for me once?
27:56Dave stayed so calm through this.
27:59She tormented Dave.
28:01He never said anything.
28:04He was not confrontational.
28:06He would say, just let it be. It is what it is.
28:10Dave was a peacemaker.
28:11He was definitely the calm to my storm.
28:13He would always say, she's just a clown. Don't attend her circus.
28:22It kind of just spiraled from there.
28:25Every time my mom was outside, she was harassing her,
28:29yelling crazy things at her.
28:31Frances really started stalking my mom everywhere she went.
28:35She would follow me and Owen to the grocery store, block us in at Kroger's, where I couldn't get out.
28:44Anything she could think of to do to aggravate, she would do it.
28:49I would have Owen out in the yard. My nieces would be out in the pool.
28:55Frances would lay out in her yard topless.
28:59She'd be out there mowing her yard naked, showing her butt, mooning them, showing them her boobs.
29:27The cops informed us that that's not against the law, so there's nothing we could do about it.
29:33In the state of Kentucky, it's not a crime for a woman to be topless.
29:38But you can't show your genitalia, and that's for guys and girls.
29:44I mean, it's a crazy law, because there's children out and about, but we do have some odd laws here.
29:51Haley was very uncomfortable with Owen coming down because of what was going on.
29:56They didn't feel safe there with Frances, the way she was acting.
30:02I refused to let my son Owen come visit.
30:05At this point, I was pregnant with my second son.
30:08I have to think of my family first before I take them down there and put them around Frances
30:14in an unknown situation.
30:16And when I explained all these feelings to Dave, he saw where I was coming from,
30:20but everybody else around me thought that I was just being dramatic.
30:24It was awful.
30:25We was upset and, you know, hurt, because our lives revolved around that baby.
30:33And I didn't talk to her for a while, but Dave never stopped talking to her.
30:41As we're entering 2018, things were just awful.
30:46Dave and I felt like we was prisoners in our own home.
30:50There was just no peace there.
30:53And we was miserable for a year.
30:59Every time we turned around, there was cops knocking on our door.
31:04Dave went down and talked to them and was like, you know, we need help.
31:08We don't know where to go from here.
31:15I started working at the Montgomery County Regional Jail in 2016.
31:20And that's when I first got to know Dave.
31:25Corrections is the hardest job that I've had, but Dave made the job so much easier.
31:33When he walked in, even the inmates, like, they were like, you know, they'd be in the window like,
31:39what's up, Dave?
31:42Dave, he is like a, it is what it is type guy.
31:45Like, you know, he lets things go.
31:48But in spring of 2018, I knew Dave was going through some things at home.
31:55Like, I knew he wasn't okay.
31:57He would come in more, like, a little bit more irritable.
32:00He just kept saying, man, I have this neighbor that's, like, won't, won't leave us alone, you know?
32:08It's like, he, like, and that, like, Dave doesn't really cuss.
32:11So it's like, he just wanted the peace.
32:15If you don't have a stable home life and corrections, then it's really hard because you have all this
32:22chaos and the last thing you want to do is go home and, like, deal with more chaos.
32:29My mom and Dave started to really have some issues with each other because Francis was
32:36kind of driving a wedge into things.
32:43In March 2018, I was prosecuting Shauna's assault on Francis.
32:50And we set a trial date for May of 2018.
32:55The nature of the offense was that Shauna went over to Francis's house
33:00and then there was a physical altercation between the two that resulted in them going to the ground.
33:06Francis would call me almost daily to complain about
33:12Shauna or Shauna's family members
33:15or how the police are conspiring against her
33:19and the local judges were conspiring against her.
33:23When I would just try to explain to her, like, you know, look,
33:27I understand that you think that this should be a higher offense,
33:29but here's what the law is and this is what it is at this point.
33:32But she didn't really want to hear about any of that.
33:35It was, from her perspective, she was the only victim doing nothing wrong.
33:42She was totally infatuated.
33:45This was her entire life, was prosecuting this case and getting Shauna Scott in jail.
33:51I sent out the subpoenas for this May date,
33:54started talking to some potential witnesses, getting them prepped for trial.
33:59I contacted the neighbor who was on scene before Shauna's assault on Francis.
34:06She was a neutral witness. She wasn't a family member. She wasn't a friend of Francis's.
34:11Can you just briefly just, just tell me what you observed?
34:15It's been so long ago and stuff. I don't want involved with it no more.
34:19Has there been some sort of issue going on between you and Ms.
34:22Zoyer? Makes you want to just stay out of it?
34:24She's just harassing me, if you want me to be honest.
34:27She takes me every day, paragraph after paragraph after paragraph.
34:31Well, you need to call Andrew. You need to go to the police department. You need to do this.
34:34You need to go pick up your subpoena. This has been going for almost a year now.
34:38I have reason to believe that Amy is calling and making false reports because she wanted me to
34:46call you and report some stuff that Shauna was doing. I've asked her repeatedly to leave me alone.
34:51If I do have to go in front of the judge, I will tell him that she has done nothing
34:55but harass me
34:56and it's probably not going to look good on her behalf.
35:00I didn't want this case to necessarily be presented before a jury because
35:04Francis, I didn't believe, was going to come off as a very sympathetic victim.
35:09I'm not naive enough to believe that juries, when they go back there,
35:13are not going to consider other stuff as well.
35:16Taking that all into consideration, it's just one that you don't want to put before a jury.
35:28In May of 2018, my attorney called and said,
35:32Shauna, this is what we've been offered by the prosecution, a plea deal, which would be
35:38anger management classes and probation for one year. And he said, let's take it and put this behind us.
35:45And I said, I totally agree. We were scheduled to go to court on the Monday after Memorial Day weekend.
35:54I was looking forward to it being all behind me, but I knew it wasn't going to be over with
35:59her
36:00because she wanted me to go to jail for 18 months. She was really, really livid when she found out
36:07about
36:07the plea deal.
36:08This county will not protect me in any way. Once it gets in front of the judge,
36:13the judge's order is final. This whole situation is crazy.
36:19He could come right here at my door right now with a freaking gun and threat me and nobody would
36:24do a
36:24damn thing. Nobody. I have lived like a prisoner here in my own home, but nobody will do anything.
36:32That nobody will do anything to this family because David Scott is married to the slut.
36:43Dave was starting to also get the gut feeling that things were not going to settle down even after
36:47it was settled in court. So he decided to start putting cameras up around the house and the property.
36:55With the security cameras, I was hoping to show proof what she was doing and to keep my family safe.
37:07It was Memorial Day weekend and I was in the house cleaning and mopping.
37:13Dave was outside on the back porch installing the last of our cameras.

37:22My name is Francis Sawyer. I have emergency protective order against a neighbor.
37:29I can't get this court here to understand how dangerous this idiot is.
37:34Okay, ma'am. I'm familiar with the previous history.
37:41I can't take any more of this.
37:53I told Shawna right to her face. I said, I am not going to be fuck with anymore.
37:59I will not tolerate it anymore. Today is when it stops.
38:14I remember this awful bang.
38:25And I was down.

38:55And then I heard my sister screaming.
38:59And when I went out, I went to David.

39:50May 26th, I was actually off duty that night.
39:52My buddy called me, which was working.
39:55And he said that, uh, Francis was identified as a shooter.

40:09Listen to me, I'm here to help you, okay?
40:13Leave me alone.
40:14No, listen to me.

40:23They went over and had a standoff out in front of her house.
40:29And I have pleaded for help.
40:31For a year, I begged for help.
40:33And nobody will help me.

40:57May 26, 2018, my husband, myself, and our son Owen was home.
41:06My husband's phone rang.
41:11And he answered it.
41:14And he just kind of looked at me.
41:18All I heard him say was, we're on our way.
41:23Being almost 35 weeks pregnant, I really didn't want to leave the house.
41:28He looked at me and he just kind of calmly told me she finally snapped.
41:33And I said, what do you mean?
41:35I told Haley at that point in time, your mom and Dave got shot.
41:41And I said, Dave didn't make it.
41:53All I could say was, no, not my Dave, not my Dave.
41:59A lot of people underestimated our relationship because I was a stepdaughter.
42:04But he was my stepdad for 20 plus years.
42:09My next thought was, I'm not going to make it in time to see my mom before she dies.
42:15I was terrified that I wasn't going to get to say bye because at the time,
42:19her and I were not on the best terms because of this whole situation.
42:23And, you know, guilt starts eating you alive.
42:26And then, that's a long drive from Ohio. That's three hours.
42:34When we got to the hospital that night, we weren't able to see my mom.
42:37And they said they were putting her in the trauma center
42:40because she had been shot in the face.
42:43When I was told that she was shot in the face point blank,
42:47I was just racking my brain like, how is she still alive?
42:54I didn't know what was going to happen.
42:56We all slept in hospital chairs overnight and about 7.30 the next morning,
43:01they came out and told us that we'd be able to see her.
43:04She looked awful, almost unrecognizable.
43:08Her face was a bloody mess. Her hair was covered in blood still.
43:13But I was so glad that she was okay.
43:17Once they started pulling the tubes out, my mom woke up.
43:21They gave her a whiteboard and a marker.
43:24The first thing that she wrote was David.
43:28She didn't know that he didn't make it.
43:32My dad and my girls told me that he had passed away.
43:53I learned that Frances walked from her yard straight through my front yard,
43:59up my front porch, and inside my door shot me right in the face.
44:07I went down.
44:10She went out the back door and Dave was holding his hands up, saying, whoa, whoa, whoa.
44:18Well, then when he held his hands up, she shot through his ring finger
44:23and it went through and pierced his heart.
44:31I was just, I couldn't believe it.
44:34Our lives were to wear apart in that moment.
44:41They moved me into a trauma unit.
44:46I still had a hole in my face from the bullet.
44:49They said I was going to be there at least three weeks.
44:53And I said, no, I'm not.
44:56I'm leaving here because I'm going home to my husband's funeral.
45:05The next day, they did let me go down and spend some time with Dave at the funeral home.
45:11He wasn't dressed yet or anything.
45:15They wouldn't uncover him and let me see any wounds or anything.
45:19But I did get to sit with him for a while.
45:23When I was sitting there with him, I felt like I don't know where to go from here.
45:29I don't know what to do without him.
45:32I just didn't know what to go from there.
45:40I just told him that I loved him and I was so sorry that I can't believe this happened.
45:48I just told him that I was so sorry.
45:49An emotional farewell as the body of slain deputy jailer David Scott was loaded into a hearse Monday afternoon.
45:57While hundreds spent the day mourning inside the funeral home,
46:01dozens of jails across the state also paid their respects,
46:05sending deputies to work the Montgomery County Jail so all of Scott's co-workers could attend his service.
46:12His funeral was beautiful.
46:15Dave's loss not just affected our community.
46:19I mean, everyone around knew Dave.
46:23We lost the legend.
46:26Dave was remembered as an officer.
46:29We block all the intersections.
46:32We'll do all the ceremony there, the 21-gun salute.
46:39I would never think that it would have escalated the way it was.
46:42Because I did respond to her house many times.
46:45I looked at it as if I could do something else.
46:50And I still think about that.
46:52It's just one of the things that, you know, you just kind of beat yourself up.
47:05Over 850 people was there.
47:10Owen, he sat right with me the whole time.
47:14And he said that, uh, I'm going to be here for you, baby.
47:19I'm going to be here for you.
47:20And I knew he knew then that his papa was not coming back.
47:25Just Owen being there, I think, really helped my mom.
47:29You would catch him just patting her on the back or giving her random hugs.
47:34Just making sure that she was okay.
47:36At the funeral, she held on to me a little tighter.
47:41It's sad that it took something like that for my mom and I to get back on the same page.
47:48But we're family, and we got to stick together because we're all we have now.
47:55Haley was 30-something weeks pregnant when Dave passed away.
48:01So we buried him June 2nd, and our second grandson was born July 9th.
48:11Obviously, my mom was still in recovery when our son River was born.
48:15But from that moment on, I think that she saw River as, you know, a saving grace.
48:23Something to help keep, you know, her fighting.
48:26And she's always had a special relationship with River ever since.
48:32I just want to be here for my kids and my grandkids.
48:39Because they are the most important thing to me.
48:51Years later, they come to us and told us this is the plea deal that we're going to offer.
49:01Sorry, I'm still so angry about that.
49:06They told us if we go through a trial, it's going to be excruciating.
49:12I just didn't want to put my kids through no more than they had to go through.
49:16Showing all the photos of Dave's body, you know, everything.
49:23And we agreed for that plea deal.
49:26Was that what I wanted?
49:28Probably not.
49:31But was it best for us?
49:33Yes, I think so at the time.
49:44We're here for final sentencing at this time.

49:48I think Haley is first.
49:53You deserve so much more than the sentence you are receiving today.
49:57But it's at least a good start for taking the life of a proud father, grandfather, an adoring husband, and
50:04a pillar of this community.
50:05I know families of the victims typically in their statements with, I forgive you, or I need to forgive you
50:12to move on, but I want to make myself very clear.
50:16I do not forgive you.
50:18I don't want to forgive you, and I'm never going to forgive you.
50:29That's my biggest fear for Frances to be paroleed.
50:34My fear for my kids, my family.
50:37Honestly, I hope she never gets out.
50:40I mean, it's still a fear that's in the back of my head every day.
50:46Frances never gave an explanation for anything.
50:48She didn't believe she'd done anything wrong.
50:50There wasn't no self-defense.
50:52There wasn't, you know, there's nothing there.
50:55She took his life for no reason.
50:59I don't think that that woman deserves to ever be on the outside again, unless she's in a coffin.
51:14I knew that I had a long road ahead of me.
51:18That long road has included 16 facial surgeries because all the bones in my face were broken.
51:26The loss of my sight in my left eye, the loss of my hearing in my left ear, scars on
51:32my face.
51:33It's just a lot of surgeries and a lot of healing, trying to get better.
51:41Since David passed away, I take it one day at a time.
51:46Some days I have good days, some days I have bad days.
51:50Birthdays and holidays, very hard.
51:53And I don't know if it'll ever get easier, but I have to be strong for the kids.
51:57So that's what I do.
