00:01:38as if your friend or best friend was telling you about this case that they just heard about
00:01:42and that they can't stop researching or thinking about or talking about.

00:02:06Now, today, we are doing one of the infamous deep dives.
00:02:10And you may have heard about this case if you listen to true crime or follow true crime.
00:02:14You may have also seen clips of the trial or footage from the case in your TikTok feed
00:02:20or your Instagram Reels feed, because it's the case of Mackenzie Schirrilla,
00:02:25a name that a lot of people do know, but many don't.
00:02:29You also might be familiar with the name because Netflix just released a documentary about this case
00:02:35called The Crash.
00:02:37And what's really interesting is there's a lot of division with this case.
00:02:42Many people believe that what happened was intentional,
00:02:46that this is, you know, the product and result of a spoiled young girl who had everything in her life.
00:02:53And then the moment something went wrong, she decided to take it out on everybody else.
00:02:58While some say, no, this was absolutely accidental.
00:03:01She was too young to know how severe this was going to be and what her actions would truly cause.
00:03:07And there's a little bit of conflicting opinion out there.
00:03:12Now, I will say this personally.
00:03:14I first covered Mackenzie's case years ago.
00:03:17And with that, I have done extensive research.
00:03:21I've interviewed a lot of people close to the case.
00:03:23I participated in a documentary back then where I was shown a lot of privileged information before it even went
00:03:29to trial.
00:03:29Different things like that to where my belief is that this was absolutely intentional.
00:03:35But again, not everybody agrees with that.
00:03:38And that's certainly okay.
00:03:39Which, that's my point and why I'm coming on here today.
00:03:42I want to present the case to you with a set of fresh eyes, new perspectives, everything we've learned,
00:03:49things that have come out post-trial, so that then you can really decide for yourselves,
00:03:53what do you believe?
00:03:55Do you believe that this is all just a horrific, tragic accident?
00:03:59Or do you believe that this was calculated and intentional?
00:04:03So, let's start here.
00:04:05I want you for just a moment to imagine being a teenager again.
00:04:08And I say again because I feel like a lot of you aren't teens.
00:04:11I feel like we skew a little older over here.
00:04:13But if you are a teen, you're involved too.
00:04:15But I want you to imagine being a teenager and you're just graduating high school.
00:04:20It's that super exciting time in your life where you're young, you're full of life,
00:04:24you have dreams, ambitions, there's parties, there's excitement,
00:04:28and like you just can't wait for what's to come.
00:04:31But then you get word that three other teenagers who live in your area,
00:04:36potentially even are classmates of yours, were in a deadly car crash.
00:04:40And even more than that, one of the worst car crashes that first responders had ever seen in the Ohio
00:04:46area.
00:04:47It rattled the entire community.
00:04:49There was shock, grief, confusion.
00:04:52But above all else, there were a lot of rumors.
00:04:56Rumors that took what seemed to be a very simple yet tragic car accident
00:05:02into something potentially far worse.
00:05:05So, let's jump right in.
00:05:08In the early morning of July 31st, 2022,
00:05:12the peaceful suburb of Strongsville, Ohio, nestled just outside of Cleveland,
00:05:17became the scene of a heart-wrenching tragedy that rocked its tight-knit community forever.
00:05:23Initial reports began to surface about a devastating car accident involving three people,
00:05:2919-year-old Davion Flanagan, 20-year-old Dominic Russo, and 17-year-old Mackenzie Shrilla.
00:05:36Both Davion and Mackenzie had just graduated from Strongsville High School just a few months earlier.
00:05:43Early on in the investigation, law enforcement believed that Mackenzie Shrilla somehow lost control
00:05:49of the Toyota Camry that she was driving,
00:05:52and then crashed into a brick building on Alameda Drive at 534.
00:05:57It wasn't until approximately 45 minutes later at 6.15 a.m. that a passer-byer,
00:06:02a runner who was out for their morning jog, came upon the wreckage and immediately dialed 911.
00:06:08When law enforcement arrived, they found all three passengers unconscious,
00:06:13unresponsive, and trapped within what was now just a brutally mangled car frame.
00:06:19The first responders from Strongsville Fire Department worked quickly
00:06:22to help get Dominic, Davion, and Mackenzie out of the car.
00:06:27Unfortunately, though, both Dominic and Davion were declared dead at the scene.
00:06:32Mackenzie, who was driving the car, was critically injured and flown to MetroHealth Medical Center.
00:06:38Investigators waited for the results of her blood testing,
00:06:40which would show if drugs or alcohol played a role in this crash.
00:06:44The victim's families and the community were completely grief-stricken and, frankly, just sick about this.
00:06:51Dominic and Davion now had their potential dreams and futures abruptly cut short.
00:06:58Dominic had started a successful business and always talked about all of his big plans for the future.
00:07:04And Davion was a fantastic football player, well-known in the community,
00:07:08and had plans to open up his own barbershop after high school.
00:07:11But now, all of that was gone in an instant.
00:07:15The community's sadness and loss eventually led to many questions.
00:07:19Why was this a one-car accident?
00:07:22If Mackenzie lost control of the car, how did that happen?
00:07:25What was going on inside the car leading up to this?
00:07:28Was Mackenzie intoxicated or under the influence of some type of drug?
00:07:32Why were all three of them even over on Alamena Street in that part of town in the early morning
00:07:38hours to begin with?
00:07:39It's not near where Mackenzie, Dominic, or Davion lived,
00:07:42So where were they going?
00:07:44And how could this possibly happen?
00:07:47Mackenzie underwent extensive medical treatment for her injuries and somehow survived miraculously.
00:07:53However, she said that she couldn't remember what happened leading up to the crash.
00:07:58She said that she had blacked out.
00:08:00Now, just for a moment, I am going to draw on my personal experience for a second.
00:08:05A lot of you know who have been with me for a while on here, that you know that I
00:08:09was in a horrific car accident when I was 16 years old.
00:08:13I wasn't wearing my seatbelt.
00:08:15I flew, hit the windshield, knocked out some teeth, ended up having brain surgery from how awful this car accident
00:08:21was.
00:08:21And I can say, even now, I still do not remember anything from that accident.
00:08:27And I wasn't the one driving, but I was in the accident, and I'm still blacked out.
00:08:31I remember leaving the house that morning.
00:08:33I don't remember the accident.
00:08:34I don't remember the moments coming out of the accident.
00:08:39The first memory I have is when first responders were already there on scene,
00:08:44and they were cutting me out of my clothing and getting me out of the car.
00:08:47But I don't remember anything else.
00:08:49So there has been a lot of speculation if Mackenzie was, in fact, blacked out during the accident or not,
00:08:55or even has a recollection of the memories leading up to the accident itself.
00:09:00And if that's true or not, and I, well, I don't know in her situation if she's lying or if
00:09:06it were true.
00:09:06And we'll talk more about that as we go on.
00:09:08But I do want to mention that it is entirely possible to black out even the events leading up to
00:09:13the collision itself.
00:09:15Because for me, that is what exactly what happened.
00:09:18So while law enforcement began going further into their investigation,
00:09:22many people in the community began to talk.
00:09:24And the community had strong yet mixed feelings about what they thought happened here.
00:09:29Some people thought that this was just a tragic accident.
00:09:33But others who knew Mackenzie and Dominic and knew them more closely
00:09:36began to believe that this wasn't an accident at all.
00:09:40And instead, it was something far more sinister.
00:09:43Mackenzie and Dominic began dating in 2021.
00:09:46And they had an overall tumultuous relationship.
00:09:50They would break up, get back together, and then they would do it all over again.
00:09:54The pattern just was on repeat.
00:09:56And I know that that can be sort of a vague statement,
00:09:58saying that a relationship, you know, is tumultuous.
00:10:01But we're going to get into their relationship more in just a little bit here.
00:10:06So stick with me.
00:10:07Because a lot of information has come out since I first covered this case.
00:10:12Davion was one of Dominic's close friends.
00:10:14According to news reports, Davion, Dominic, and Mackenzie were hanging out at a party
00:10:19and smoking a little bit of weed the night leading up to the crash.
00:10:23And Mackenzie and Dominic offered to give Davion a ride home.
00:10:27Mackenzie was described by people who knew her in high school as selfish and entitled.
00:10:32And she never had to really take any accountability for her actions.
00:10:36She always just kind of got away with everything.
00:10:38After Mackenzie began to recover from the accident,
00:10:41many of the posts on her Instagram and TikTok really upset people as well.
00:10:46And we will get into specifically what she posted here shortly.
00:10:49Don't worry.
00:10:50Most of her social media has now been deleted.
00:10:53So I couldn't find much except for a few screenshots here and there.
00:10:57However, people in the community who knew her from school
00:11:00commented on social media about Mackenzie's behavior.
00:11:03And all of those comments are still public.
00:11:06Some of the posts said that her parents knew about her drug use
00:11:09and that her mom would like some of the pictures that she posted when she was smoking weed.
00:11:14And some pictures sparked outrage because people thought that she just was moving on with her life
00:11:19as if nothing ever happened with no remorse at all.
00:11:22There were also some pictures Mackenzie posted with her and her friend dressed as a weed for Halloween,
00:11:27which also caused a huge stir online.
00:11:30Several classmates weren't surprised that this horrific tragedy resulted from Mackenzie's actions,
00:11:36even going as far as to say that she probably would have killed someone one day anyway,
00:11:41and that she only cared about herself and herself only.
00:11:44Other people felt like Mackenzie had definitely done drugs and that that is what caused the crash.
00:11:50And the police seemed like they weren't doing anything about it.
00:11:53And now this was another situation where Mackenzie would just get away with her selfish and dangerous behavior once again.
00:11:59Well, all of that online speculation and discussion over what happened that tragic night
00:12:04wouldn't matter for much longer because a few days after Halloween, everything changed.
00:12:09It turned out that the police were not letting Mackenzie get away with anything,
00:12:13and they had been conducting a thorough investigation this entire time.
00:12:17On November 4, 2022, Mackenzie was arrested.
00:12:21According to court documents, Mackenzie faced a total of 18 charges.
00:12:26Counts 1 and 2, aggravated murder.
00:12:29Counts 3, 4, 5, and 6, murder.
00:12:32Counts 7, 8, 9, and 10, felonious assault.
00:12:36Counts 11 and 12, aggravated vehicular homicide.
00:12:39And all of these charges were related to that crash on July 31, 2022.
00:12:45Count 13, trafficking.
00:12:47Count 14, drug possession.
00:12:49And both of these charges were for the magic mushrooms that were found inside the car.
00:12:54Count 15, possessing criminal tools.
00:12:57And this was for a digital scale that was found in the car.
00:13:01So there were 15 charges in total related to the car crash and to the deaths of Dominic and Davion.
00:13:08The other three charges were for allegedly breaking into the Columbia Church of God in Columbia Station
00:13:13on July 19, 2022.
00:13:16Those charges were count 16, breaking and entering.
00:13:20Count 17, vandalism.
00:13:22Count 18, desecration.
00:13:25Mackenzie's blood test from the hospital revealed that she had THC in her system
00:13:29and that she was likely high at the time of the accident after their investigation and talking to witnesses who
00:13:35saw her that night.
00:13:36Even though mushrooms were found in her car, this was apparently not in her test result.
00:13:42Mackenzie's bail was set at $500,000.
00:13:44But she didn't get bailed out of jail and remained in juvenile custody until it was time for trial.
00:13:49The body cam footage of Mackenzie's arrest was finally released in 2025.
00:13:53And I have to be real with you, it's an absolute doozy.
00:13:58And I don't use that word lightly.
00:14:00I personally hate that word.
00:14:01And I don't want to give too much away before I show you guys some of the clips,
00:14:05which for those of you who are listening to the audio version of this,
00:14:08you'll be able to hear what's happening.
00:14:10But I do encourage you, pop over to YouTube, watch the visual as well,
00:14:14because I think that will provide more context.
00:14:17But what I have to say is that Mackenzie shows absolutely zero remorse.
00:14:23Zero remorse for any of the crimes that she was being charged with.
00:14:29Hi, Mackenzie.

00:14:52come off, okay?
00:14:54I can't wear any of it.
00:14:55No, I need you to take it off while you're in jail right now.
00:15:05I can't wear these?
00:15:07No.
00:15:08Unfortunately, everything's going to have to come off right now once we know when the detective comes back
00:15:13and we know for sure what's going on.
00:15:15Everything's going to be bagged up here.
00:15:17It's not going anywhere.
00:15:23Sorry, this is just, like, one of those, which is really hard to get off.
00:15:25That's fine.
00:15:26Take your time.
00:15:26Her first response to being told that she was being charged with murder was to take care of a bracelet.
00:15:33Take care of a bracelet so that it didn't break.
00:15:36And then, after being told that she could not wear any jewelry in jail, which obviously should be common sense,
00:15:42right?
00:15:42But I guess it's not all that common.
00:15:44Who knows?
00:15:44She started to break down.
00:15:47That's what rattled her.
00:15:48That's what made her upset because she couldn't wear jewelry into the jailhouse.
00:15:52I mean, again, it just kind of goes back, for me at least, into this spoiled, entitled, young girl thinking
00:15:58that the world revolves around her.
00:16:01But anyway, back to her arrest.

00:19:14Since she was a minor at the time of the crash and charged as such, there weren't many public details
00:19:20about this case that were released.
00:19:22However, all that changed in March of 2023 when prosecutors and the judge agreed to try her as an adult.
00:19:29When the crash occurred on July 31st, 2022, Mackenzie was 17.
00:19:34Her birthday is on August 2nd.
00:19:36So she turned 18 just two days after everything happened.
00:19:40She had a hearing in April of 2023 via Zoom, where Mackenzie pleaded not guilty as the judge continued her
00:19:47bond at $500,000.
00:19:49But again, Mackenzie remained in custody.
00:19:51During the hearing, the prosecution told the court the evidence in this case overwhelmingly indicates that these were intentional and
00:20:00purposeful deaths.
00:20:01On July 19th, 2023, almost a year after the horrific crash, Mackenzie had her first pretrial hearing.
00:20:09During the hearing, Mackenzie did not accept a plea deal that the prosecution was offering, and her lawyer indicated that
00:20:16they were prepared for trial.
00:20:17In the U.S., you have a right to a trial by jury or a bench trial.
00:20:22If defendants want to waive their right to a trial by jury for whatever reason, they can.
00:20:27And this can be a defense strategy if, for some reason, they are worried about what a jury verdict would
00:20:33be.
00:20:33Some defendants may feel like they would have more of a fair shot if the judge were to decide their
00:20:38verdict based on the law,
00:20:40fearing that potential jurors would make their decision based on emotion and not the law necessarily.
00:20:45However, that isn't the only reason that people waive trial by jury.
00:20:49There are a number of reasons why people choose that route.
00:20:53Additionally, defendants do not have to provide a reason to the court for their decision to waive a jury trial.
00:20:59So with that, that's what Mackenzie chose, and her bench trial was set for August 7th.
00:21:05The first day of trial began on August 7th, just five days after Mackenzie's 19th birthday.
00:21:11During opening statements, the prosecution detailed all of the moments leading up to the devastating crash.
00:21:186.15 in the morning, Strongsville Police and Emergency Personnel received the 911 call.
00:21:24They revealed the black box inside Mackenzie's vehicle had been clocked at 100 miles per hour.
00:21:30Black boxes aren't the official term.
00:21:33It's an EDR or event data recorder, but these devices record driving and vehicle data from immediately before, during, and
00:21:41after an automobile crash.
00:21:43And that wasn't all.
00:21:45They also had cold, hard evidence to prove this.
00:21:49Because when the accident occurred, a nearby building security camera caught the entire thing on video.
00:21:55In the video, you can see Mackenzie's car going extremely fast before disappearing off the screen and ultimately crashing.
00:22:03The prosecution also said that this didn't just happen based on reckless driving either,
00:22:09and they would present a witness who overheard Mackenzie's threats.
00:22:13That he observed at that time the defendant striking Dominic Russo with both hands,
00:22:19and that he overheard her make a statement, an admissible statement, and she said,
00:22:24Dominic, I'm going to crash this car.
00:22:27We find that it is especially important to her state of mind just two weeks later when she used the
00:22:33car to kill Dominic Russo.
00:22:35Despite this, Mackenzie's lawyer, Mr. McDonald, of course, had a much different perspective.
00:22:40He argued against the insinuation of intent.
00:22:43Instead, he said that this was a tragic accident rather than a premeditated act.
00:22:50How can you come to any conclusion other than, if anything, she's reckless?
00:22:56Is it just kids being kids?
00:22:58Is it Dominic grabbing the steering wheel?
00:23:00Is it Mackenzie maybe speeding and saying,
00:23:02Oh my God, park out, it's light, I'm coming up to this, I better do something.
00:23:06And she goes like that to avoid an accident, not acting purposely, but in fact trying to avoid it.
00:23:12Is it sudden acceleration panic?
00:23:18Those are all possibilities.
00:23:20Mr. McDonald also said that the side airbags going off in the final seconds before the crash
00:23:26could have contributed to the severity of the event.
00:23:29He said, and I quote,
00:23:31It occurred in about four and a half to five seconds before.
00:23:35It's a significant force that makes a huge sound.
00:23:38There's talcum powder or some type of powder that is let go.
00:23:42So if they only have five seconds of recordings,
00:23:45and those five seconds are all what happens after the airbag is deployed,
00:23:50how can you come to any conclusion other than, if anything, she's reckless?
00:23:55During the course of the four-day trial,
00:23:57many first responders and other witnesses were called to the stand.
00:24:01It turns out that there was more to the crash than just that video of Mackenzie flying by
00:24:06at 100 miles per hour.
00:24:08There was another building that captured footage of Mackenzie turning on the street
00:24:12before pressing on the gas.
00:24:15In this video, you can see Mackenzie driving at a completely normal speed,
00:24:19braking as she prepared to turn as well.
00:24:22Her blinker was on and was signaled to the correct direction that she was going.
00:24:27This video was key to the prosecution's argument,
00:24:30that this was intentional and wasn't some wild situation
00:24:33where she was driving completely out of control the entire time.
00:24:37Even worse, experts spoke about the EDR box in Mackenzie's car
00:24:42and said that through their investigation,
00:24:45they were able to determine that Mackenzie had the gas pedal pushed all the way down
00:24:49and made no attempt to ever even use the brakes.
00:24:54The crash team analyst also said about one second before the crash,
00:24:59the steering wheel made a hard right turn of 142.5 degrees.
00:25:04It also showed the impact from a sign in the grass outside of the building,
00:25:09which may have triggered the airbags before slamming into the brick wall.
00:25:14Mackenzie's attorney questioned the analyst about the wheel moving
00:25:17in an attempt to insinuate that it's possible that one of the victims moved the wheel
00:25:21by saying that it's basically impossible to know who pulled that wheel and caused the crash.
00:25:26He also suggested that because it was dark, maybe it was hard for Mackenzie to see.
00:25:31But even in his defense, he conceded that Mackenzie's handling of the car was in fact reckless.
00:25:38When the prosecution reviewed the crash scene photos
00:25:41and the photos of the victims during their autopsies,
00:25:44everyone in the courtroom was extremely emotional, including Mackenzie.
00:25:48Dominic's mother, Christine Russo, testified,
00:25:51The courtroom vibe changed instantly when she began her testimony.
00:25:56Everyone could tell that she had once cared deeply for Mackenzie.
00:26:00After all, Mackenzie had even lived with them for a while.
00:26:03But the love story that she painted between Mackenzie and her son, Dominic,
00:26:07was far from rosy.
00:26:09It seemed like they were always at odds with threats and arguments overshadowing the good times.
00:26:15She also brought up a text message that Mackenzie sent her after the crash
00:26:19where Mackenzie said,
00:26:21I remember turning onto the street and then my vision fades to black.
00:26:25It really kills me not being able to remember anything.
00:26:29I promise you I would tell you.
00:26:31I've been asking my therapist why I don't remember and she said it's because of trauma,
00:26:35but I'm going to try to get hypnotized and make myself remember.
00:26:40Then, Dominic's older brother, Angelo Russo, took his turn.
00:26:44The raw emotion in his voice said it all.
00:26:47He talked about how Mackenzie and his brother were constantly on and off again,
00:26:51saying,
00:26:52I witnessed a lot of negative behavior from her to my brother,
00:26:55and that just kind of pushed me away as a big brother figure because she just wasn't fair to him.
00:27:00One of Dominic's friends, Christopher Hench Martin, was also called to the stand to testify.
00:27:06This was to testify about an incident between Mackenzie and Dominic in a heated fight where she threatened him.
00:27:13According to court documents, on July 17, 2022, approximately two weeks before the deadly crash,
00:27:20Mackenzie was driving her vehicle on Interstate 71 with victim Dominic Russo as the passenger
00:27:26when she threatened to immediately crash the vehicle.
00:27:30Mackenzie was upset over a disagreement between the two of them,
00:27:33which resulted in Dominic seeking the help of his mother, Christine Russo,
00:27:37through a phone call asking her to come and pick him up.
00:27:40Dominic's friend, Christopher Hench Martin, went to pick up Dominic
00:27:43and remained on the phone with Dominic during the incident.
00:27:46While on the phone, he heard Mackenzie state,
00:27:49I will crash this car right now.
00:27:53Mackenzie exited the highway onto Route 82 between Pearl Road and Bagley Road.
00:27:58As the friend pulled up to get Dominic and Mackenzie's car pulled over to the side of the road,
00:28:03the passenger door opened and the friend observed Mackenzie striking Dominic with both of her hands.
00:28:09Dominic then exited the vehicle and left with his friend.
00:28:13The prosecution also brought up another incident in July of 2022 between Mackenzie and Dominic.
00:28:18According to court documents, in July of 2022, within the same month as the deadly crash,
00:28:24Mackenzie again made multiple threats toward Dominic.
00:28:28Videos recovered from Dominic's cell phone revealed the altercation involving Mackenzie,
00:28:33where she can be heard repeatedly degrading Dominic, threatening him and damaging his property.
00:28:39It is understood from the videos that Dominic was not comfortable letting Mackenzie inside of his home
00:28:44at the time, and he made multiple attempts to reason with Mackenzie,
00:28:48to calm the defendant down and communicate with the defendant in a better manner.
00:28:53Mackenzie refused these attempts and can be heard banging on Dominic's house door,
00:28:58demanding to be let inside.
00:29:00Mackenzie called Dominic a multitude of degrading and highly inappropriate names.
00:29:05Despite Dominic's efforts trying to reason with Mackenzie,
00:29:09she refused to listen and continued her erratic behavior.
00:29:13Exceedingly important are the threats made by Mackenzie to Dominic throughout the incident.
00:29:18She threatened to key Dominic's car if he would not let her in,
00:29:22and she verbally counted down multiple times in an attempt to force Dominic to let her in.
00:29:27She repeatedly told Dominic that this was his last chance to let her in,
00:29:31and she stated, and I quote,
00:29:33You're going to come open this door right now,
00:29:36or there's going to be a serious f***ing problem.
00:29:39She threatened to break the handle off the door,
00:29:42and can be heard hitting and damaging the door as well.
00:29:45Mackenzie stated, and I quote,
00:29:52Dominic then had to call his mom for help and stopped recording.
00:29:55Now that phone call that I just described has actually been made public.
00:30:00The original call was about nine minutes long,
00:30:03but honestly, it doesn't really take the full nine minutes to see that Mackenzie was threatening him.
00:30:09She was antagonizing him.
00:30:11But I forgot.
00:30:12Mackenzie, you broke up with me earlier.
00:30:14Because you are a little f***ing weak bitch.

00:33:03it's because the prosecution filed motions to allow it in,
00:33:07saying that it went to Mackenzie's motive.
00:33:09According to court documents,
00:33:11the prosecution believed Mackenzie's past threats
00:33:14and aggression toward Dominic
00:33:15provided an important perspective
00:33:18of how Mackenzie responds in situations
00:33:21where she is displeased
00:33:23or in disagreement with others.
00:33:25Further, the evidence shows
00:33:27that she was aware of her ability
00:33:29to cause harm to the victims,
00:33:31especially by means of her own vehicle,
00:33:33and how she could use the power of threats
00:33:36and control to ultimately reach the outcome
00:33:39that she desired.
00:33:40The other acts evidence confirms
00:33:42that there was no mistake or accident
00:33:44in deliberately crashing her car
00:33:46and ending the lives of the victims.
00:33:48Dr. Esther Steng,
00:33:49a Metro Health System trauma surgeon
00:33:51who worked on Mackenzie's medical report,
00:33:54was also a witness in the trial.
00:33:56She told the court that Mackenzie told their team
00:33:59at the hospital
00:33:59that she did not remember what led to the crash.
00:34:02The prosecution also asked the surgeon
00:34:04to read part of the medical report.
00:34:07She said, and I quote,
00:34:08patient then became tearful,
00:34:11processing heavy loss and a depression
00:34:13since her accident.
00:34:14Patient shared feelings of grief, guilt, and shame.
00:34:18Patient stated she wanted to die
00:34:20and that it was her fault for killing her boyfriend.
00:34:23One of the prosecution's theories
00:34:25was that Mackenzie was afraid
00:34:27that Dominic might break up with her
00:34:29or really leave her.
00:34:30So instead, she decided to kill him with her car
00:34:33like she had threatened to do in the past.
00:34:36And poor Davion,
00:34:37who was just innocently trying to get a ride home,
00:34:40was collateral damage.
00:34:42And Mackenzie didn't even care if he died too.
00:34:45However, some people who were at the same party
00:34:48before the crash didn't recall anything crazy going on
00:34:51between Dominic or Mackenzie that night.
00:34:54So either something must have happened in the car
00:34:56or she planned on going through with it that night anyway.
00:35:00But the prosecution had even more damning evidence
00:35:03to prove this was in fact a premeditated planned murder.
00:35:07Because there was evidence that Mackenzie
00:35:09had been to that area of the crash
00:35:11just three days beforehand.
00:35:12And they showed the courtroom data
00:35:14of her cell phone being in that vicinity.
00:35:17They suggested this as proof
00:35:19that she was familiar with the scene
00:35:21before the day of the crash
00:35:22and believe that this was her attempt
00:35:24to scope out the area and come up with a plan.
00:35:27It was also brought up
00:35:28that maybe Mackenzie was trying to kill herself
00:35:31along with Dominic and Davion in the car,
00:35:33but just happened to survive.

00:38:51that she was not suicidal in any way.
00:38:54McKenzie's mother took the stand near the end of the trial.
00:38:57She had a very different angle
00:38:59on what might have caused that tragic crash.
00:39:01She said that McKenzie has a condition called POTS,
00:39:05pastoral orthostatic tachycardia syndrome,
00:39:08a condition which causes dizziness.
00:39:11When the connection between the crash
00:39:13and McKenzie's condition was brought up,
00:39:15her mom said that it could be.
00:39:17McKenzie's aunt also testified
00:39:19with a much different story
00:39:20of what McKenzie and Dominic's relationship was like.
00:39:23She believed that the two were honestly
00:39:25head over heels for each other,
00:39:27despite all of the rumors
00:39:28and talk about them having a rocky relationship.
00:39:31Many people felt that McKenzie's mother's testimony
00:39:34was another example of her mom
00:39:36trying to excuse her daughter's bad behavior.
00:39:39Sharila is also facing charges of felonious assault
00:39:42and aggravated vehicular homicide.
00:39:45The judge says she'll deliver a verdict
00:39:47on Monday at 1 p.m.
00:39:48And then the verdict was in.
00:39:50There is nothing that I can do or say today
00:39:54that will return these two young men to their families.
00:39:57There is nothing I can say or do
00:40:00to restore McKenzie Sharila to the life she had
00:40:04before July 31st, 2022.

00:57:34Shortly after being released from the hospital, the police were provided additional videos
00:57:40of the defendant from her wheelchair as she attended a concert down in the flats.
00:57:46And again, your honor, I'm introducing these to the court to show the shocking lack of remorse.
00:57:52This was something that was being exhibited while the investigation was still going on before she was charged and arrested
00:58:01in November of last year.
00:58:02And these were the sort of things that were coming to the police and the shocking lack of remorse,
00:58:07coupled with the fact that the defendant was reported driving an automobile shortly after this event,
00:58:16that she was seen in Strongsville, again, driving a car in spite of the fact that as her mother testified,
00:58:22she got dizzy sometimes from a condition that she had to take salt pills for.
00:58:28In spite of the fact that it was, in fact, her mother who provided her with the car that she
00:58:33used to take Dominic and Davion's life.
00:58:36And I'm just going to say it.
00:58:38I literally cannot with any of this bullshit with her.

01:00:25So I called down, like over and over again, praying that he was going to answer the phone, and he
01:00:30didn't answer the phone.
01:00:31So then I tried to call his mom, and she didn't answer the phone either.
01:00:35And I still didn't know who was in the car.
01:00:36I didn't even know if she was alive, and I didn't know what was happening.
01:00:40So then we were in the waiting room.
01:00:43And then his mom ended up thinking she did call me, so he answered the phone, and I was like,

01:03:44Mackenzie and Dom and Abby all decided to go to this concert together while they were in the hospital.

01:03:50Everything she did after the accident was either an honor of him, to be able to say to him, or
01:03:56just be by him any way that she can.
01:03:59And she's, like, devastated and intrigued.
01:04:02It was the air that she breathes.
01:04:05And they went with his cousin.
01:04:07We spent all kinds of time with him after the accident.
01:04:11What was the other thing?
01:04:14I'm hearing an awful lot about your daughter.

01:04:18They all love each other.
01:04:20They all spend every day together.

01:05:27First of all, that was the most insincere apology made to the victim's families that
01:05:31she could have possibly come up with.
01:05:34Second, why the hell was she referring to Davion as a new friend?
01:05:38I'm glad the judge called her out on this and said, well, does that make his death less
01:05:43bad?
01:05:43Instead of a statement on behalf of Mackenzie, I believe she made these things 100 times
01:05:49more worse for her.
01:05:51Her entire little speech was trying to argue what the prosecution just said about her.
01:05:55Instead of, I don't know, saying just about anything else, it is truly unbelievable.
01:06:00Mackenzie spoke and begged the judge for mercy.
01:06:07Oh, God, and Davion, I'm so deeply sorry.
01:06:11I hope one day you can see how I never let this happen or joy on purpose.
01:06:16I wish I could remember what happened.

01:08:23When it came time for sentencing, the judge did not mince words and the judge absolutely
01:08:29slammed McKenzie.
01:08:32Today is the sentencing of the defendant for the purposeful and intentional murders of
01:08:36Davion Flanagan and Dominic Rousseau.
01:08:38And in a way, it's the second time their families are gathered again to grieve.
01:08:44It's also a day when McKenzie's family will grieve for the future of their daughter.
01:08:49All three of these families and the friends of these families are suffering and all of
01:08:55their lives have been irrevocably changed because of the actions of the defendant.
01:09:00The unintended and collateral consequences of a selfish, intentional, and cruel decision
01:09:08by McKenzie will ripple forever in time.
01:09:10It's literally changed history because it's ended two lives.
01:09:17Two young men are dead.
01:09:20Their deaths were horrible, terrifying, and tragic.
01:09:24I will say again, if any reasonable person reviews Exhibit 802, there can be no doubt in your mind
01:09:34what happened this night.
01:09:36There can be no doubt of the absolute terror of the two people in that car.
01:09:45The defendant controlled all the events.
01:09:48She chose the day.
01:09:50Specifically, she chose the day just before her 18th birthday.
01:09:54She chose to drive the car, the time to drive the car.
01:09:58She chose an obscure, previously scouted route through an industrial parkway.
01:10:02She chose the target to hit and the victims.
01:10:06She chose the means and the method to follow through.
01:10:09She planned and purposely executed the events of July 31st, 2022.
01:10:15The review of the evidence supports the factual findings, the forensic testimony, the testimony
01:10:21of the first responders, the testimony of the emergency room doctors who treated the defendant,
01:10:27the testimony of the coroner's medical examiner, the testimony of those who knew the victims
01:10:32and the defendant, and the testimony of the BMV official who provided evidence that not only
01:10:38did the defendant deny any medical condition when applying for her license, which her mother
01:10:42co-signed and attested to, but also that just after the accident, McKenzie renewed her
01:10:47driver's license and again denied any medical condition.
01:10:54In fact, the defendant was so concerned about driving that, as the state mentioned during the
01:10:59investigation, she asked if they could just suspend her license for 10 years.
01:11:03It is hard to fathom how a person could be concerned about their driving privileges, having
01:11:11just been responsible for the deaths of two people.
01:11:14There was no medical condition that caused this as an accident.
01:11:18There was no mechanical failure of the car.
01:11:21The record is clear on the facts and the evidence.
01:11:24Her mother's uncorroborated statements without any medical testimony or records is not persuasive.
01:11:30It is also important to remember that even if McKenzie intended to also die in this crash,
01:11:36that is irrelevant.
01:11:38A failed suicide attempt is not a defense to murder.
01:11:42And even in a murder suicide attempt, when a perpetrator executing the plan survives,
01:11:48the other death or deaths are still murder.
01:11:51There's only one person who's responsible for the pain of everyone in this room, and that
01:11:55person is you, McKenzie.
01:11:57Nobody else is responsible.
01:12:00This isn't the fault of Dominic's family or Davion's family or your family.
01:12:06And I know that each of you have asked your questions to yourselves, what if?
01:12:10What if I had done this or that?
01:12:12The truth of it is, none of us can control the intentions of another.
01:12:17And when there is a purposeful intent to harm or kill someone, it is the perpetrator alone
01:12:22who bears the responsibility for the choice and the consequences and the harm that follows.
01:12:30The difficulty for sentencing today, honestly, is whether or not I believe you should get
01:12:37consecutive sentences.
01:12:40I'm troubled that should I give you a concurrent sentence that people will believe that somehow
01:12:47I'm being disrespectful to one of the victims.
01:12:51And on the other hand, I have to weigh the punishment.
01:12:57There's a very good likelihood, McKenzie, that you will spend the rest of your life in prison.
01:13:08McKenzie was sentenced 15 years to life, meaning she will be at least 34 years old during the
01:13:14first time that she is eligible for parole.
01:13:16And unless McKenzie shows true change, takes accountability for her actions, or does some
01:13:22serious self-reflection to realize the devastation that she caused to her victims' families, she
01:13:28will be lucky if she gets out the first time she's up for parole.
01:13:32So that now leads us into some major updates in this case.
01:13:35After her trial, McKenzie got a new legal team, and they were doing everything in their power
01:13:41to prove that McKenzie was innocent.
01:13:43They claimed that she had a medical episode that occurred at or around the time of the
01:13:49car accident, what they're calling, quote, the incident.
01:13:52And they're saying that that medical episode caused her to ultimately lose consciousness,
01:13:57which then resulted in the crash.
01:13:59They also claimed that key evidence in the case had been missed during her trial, evidence
01:14:05that they say proved that Dominic was actually the one threatening McKenzie and not the other
01:14:11way around.
01:14:11Now, this proof that they had, it was text messages from McKenzie's phone.
01:14:16And one of the text messages is from July 17, 2022.
01:14:21It was sent at 12.45 p.m., so just afternoon.
01:14:25And it said, quote,
01:14:27Can you come get Dom?
01:14:28He just grabbed my steering wheel on the highway trying to spin out my car and hurt me.
01:14:34End quote.
01:14:34Then, that same day, just a few hours later, at 4.27 p.m., Dom texted McKenzie saying, quote,
01:14:42I'm sorry.
01:14:43To which she responded, that is not enough to fix it this time.
01:14:47So with these messages, her new legal team is saying, no, no, no, look.
01:14:51He is the one who put her life at risk in the past.
01:14:54He is the one who would antagonize her.
01:14:56We have a history here.
01:14:57We have a pattern.
01:14:58Which, to be honest, I think there was probably toxicity in both directions in this relationship.
01:15:03In October of 2024, McKenzie's defense team then filed its post-conviction relief petition,
01:15:09otherwise known as a PCR.
01:15:11And in this, they requested a new trial.
01:15:14But get this.
01:15:15You can't just file those things whenever you and your defense team are, you know, feeling up to it.
01:15:20It's something that has to be done in a timely manner.
01:15:23And McKenzie's defense team?
01:15:24Well, they were one day past the deadline that is mandated by Ohio law.
01:15:30So, Judge Nancy Margaret Russo, the same judge who found her guilty during her trial, denied this petition.
01:15:36Which, look, I can understand the frustration with that.
01:15:39Technically, yes, you gotta follow the rules.
01:15:41If it's mandated by state law, there's a deadline.
01:15:44I also can see the argument where people will say,
01:15:46it was only one day late, like, you know, don't be so rigid, let it go in, all of these
01:15:51things.
01:15:51But then, I think when you do that, you have to make allowances for two days late.
01:15:55Or three days late.
01:15:56I don't know.
01:15:57So, I understand the frustration here.
01:15:59But I also understand why the decision was made.
01:16:02So then, McKenzie's parents broke their silence.
01:16:05Now, up until this point, they were not doing interviews or any public appearances whatsoever.
01:16:10Now, why they finally decided to, who really knows?
01:16:13Maybe it was a Hail Mary.
01:16:14Maybe it was trying to humanize the situation.
01:16:16It's really unclear.
01:16:17And I want to play some of it for you.
01:16:19Because, if nothing else, I feel like it's fair to say, this family sure has the audacity.
01:16:25Okay?
01:16:26Now, again, if you are listening to the audio version of this, it will be clear.
01:16:29But there will be captions and video on the YouTube version.
01:16:33I struggle with this because how can I feel bad that these two boys died?
01:16:38And feel grief with these families?
01:16:40And then be absolutely overjoyed that my kid is alive.
01:16:45Show me one piece of evidence, one, that says she did this on purpose.
01:16:51Show it to me.
01:16:52Here it is.
01:16:53That's it.
01:16:53Then she's right where she belongs.
01:16:54And she's guilty of it.
01:16:56But there isn't any.
01:16:56There's no evidence what was going on in that car other than the information they gleamed from
01:17:02the black box information.
01:17:04And these poor families think she did it intentionally, and she didn't.
01:17:07And there's like, and they don't know.
01:17:10There's information they didn't see.
01:17:11There's information they didn't have.
01:17:12There's information we didn't see or have.
01:17:14Should she be in prison for murder?
01:17:17No.
01:17:17Absolutely not.
01:17:18Should she be in prison for aggravated vehicular homicide?
01:17:21I don't even know about that aggravated part.
01:17:24Because I don't think you can still say why I was going on in the car.
01:17:27Should she have been charged with reckless vehicular homicide, two counts?
01:17:30I don't even know.
01:17:31Absolutely.
01:17:32Absolutely.
01:17:32If it was medical.
01:17:33What kind of hopes, what kind of expectations do you have for Mackenzie's future?
01:17:39That the truth will set her free.
01:17:41That's what I need to have happen.
01:17:43The truth, that there was no intent.
01:17:44That part, the truth will set her free.
01:17:46So when I first saw this interview, my jaw was on the floor.
01:17:51Honestly, I don't even really know why.
01:17:53I mean, Mackenzie's mom had proved to us before that she just rambles and makes excuses for her daughter.
01:17:58So I don't know why I expected her to change or for there to be a different tone to this
01:18:03conversation or what.
01:18:04But it did somehow still surprise me.
01:18:07And I think if I were Mackenzie, I'm just, you know, putting myself in her shoes for a moment.
01:18:12I'd be telling my mom, you know, zip it.
01:18:14Stop talking.
01:18:15Go into hiding.
01:18:15I don't need you speaking on my behalf anymore.
01:18:18Because at this point, if she keeps it up, she may ruin any chance of Mackenzie ever getting out on
01:18:24parole.
01:18:24And while we're on the topic of the whole Sharilla family, we also have to go over another thing.
01:18:29I never had too much hope that Mackenzie would show actual remorse.
01:18:33I think she's entitled.
01:18:34I think she thinks that the rules don't apply to her.
01:18:37And I just never expected to see genuine remorse from her.
01:18:41Because to me, Mackenzie has already proved that she has always seen herself as the victim and that she probably
01:18:47always will think that way.
01:18:49And in the summer of 2025, there were some jail calls between Mackenzie and her mother that were released.
01:18:55One of the calls was from August of 2023.
01:18:58And it was about a court hearing that Mackenzie had been through.
01:19:01And instead of just describing this call to you, I'm going to play you some clips again.
01:19:05Because I feel like it is much better hearing things through their mouths and how they deliver the statements.
01:19:12So take a listen.

01:20:10Can you just pay my bond and get me out of here, please?
01:20:14Like go to a bailed bondsman and see if they can do the 10%?

01:21:06Mackenzie also brought up her medical condition, claiming that it had now gotten worse ever since being in jail and
01:21:12that now she was having even worse episodes than she ever had before.
01:21:17First of all, when I got diagnosed, nobody ever told me that could, like, anything about driving.
01:21:22Put that on the license.
01:21:23Exactly.
01:21:24That was never said.
01:21:25Uh-uh.
01:21:26Nope.
01:21:27And if we do have to, then we will.
01:21:30I wasn't afraid of hiding.
01:21:31Yes, like, I don't care.
01:21:31Like, why would we lie and just not do that?
01:21:34If I knew that could affect my driving, I probably would never drive.
01:21:37Like, what the fuck?
01:21:39Well, no, no.
01:21:40People are allowed to drive with that, so don't say that.
01:21:43And ever since I've gotten here, it's been bad again.
01:21:47Like, I don't know what it is.
01:21:48Like, I blacked out the other day, and, like, it was so weird.
01:21:53It was, like, not normal.
01:21:54Like, it wasn't, like, bad how it usually is, but it was also, like, not, like, good.

01:21:58It was, like, the first time I ever had a blackout like that.

01:22:02Well, just make sure you're eating, okay?
01:22:05When you get your comments, if you can do your commissary, make sure you get some chips.
01:22:07Now, like I said, those calls were back in 2023, so who really knows whether she was exaggerating those blackouts,
01:22:15exaggerating the symptoms, just trying to look better for her trial.
01:22:19Who knows?
01:22:20But it does seem to me, at least, like she still is standing by the idea that she had some
01:22:25sort of medical condition.
01:22:26And I'm really curious to know what you think about that, though, because when this case first exploded, it felt
01:22:32like, honestly, the overwhelming majority of people believed that Mackenzie was guilty.
01:22:38That this was intentional, entitlement, audacity, all those words, right?
01:22:43No question.
01:22:44But now, with some of these text messages coming out, and Mackenzie and her medical condition claims, do you feel
01:22:51the same?
01:22:52Do you feel like there's room for, you know, questioning that, and that maybe it's not as black and white
01:22:57as people thought?
01:22:58Do you think that those text messages are enough to potentially change the outcome of this case?
01:23:03And do you believe that there's a world in which some other scenario occurred, and that's what caused the crash?
01:23:09That it wasn't Mackenzie's doing.
01:23:11Whether it was one of the passengers grabbing the wheel, or some sort of genuine medical episode that triggered it.
01:23:19I don't know.

01:23:21Like I said at the beginning of this episode, I still firmly believe what I believe about this case.
01:23:26Yes, I don't think that those text messages are great, but again, I think it just shows toxicity from both
01:23:31sides.
01:23:31I still think that, even if it was a medical episode, I would imagine that there would be a level
01:23:37of remorse.
01:23:38Even if, when I've gotten into a car crash in the past, and if, like, I had someone in the
01:23:42car and I just rear-end somebody, you're remorseful.
01:23:45Even if it's an accident, you know?
01:23:46And so, even if it was this thing that she had no control over, where's the remorse?
01:23:51And the accountability with that to say, like, I'm devastated.
01:23:55I can't believe this happened.
01:23:56Like, my illness.
01:23:57I need help.
01:23:58I don't know.
01:23:59It's just not quite landing for me.
01:24:01But maybe I'm rigid in my views.
01:24:04Who the hell knows?
01:24:04So, curious to know what you guys think about this case.
