00:00Senator Bato will enjoy the protection of the law and the protection of the Senate
00:06in accordance with our rules and with Philippine laws.
00:09Mr. President, we have seen it all.
00:13I think this is the best evidence that can prove that the good senator,
00:20our colleague in this institution, is being chased by authorities.
00:24I'm not sure where they got the authority to chase him,
00:28and incidentally, I think he's about to be captured by them for purposes of serving him
00:35or rendering him or even surrendering him to the ICC.
00:41I'd like to ask, Mr. President, what is the authority of the National Bureau of Investigation
00:50in executing, for example, even if for the sake of an argument
00:54that the ICC issued a warrant of arrest against Senator Bato?
01:01As far as I know, Mr. President, the counterpart of the Interpol,
01:06which is the serving arm of the ICC in executing warrants,
01:12the Interpol's counterpart in this country is PCTC,
01:18which is the Philippine Center for Transnational Crimes.
01:24And I check that it is now under, it used to be under the office of the President
01:30and under the control of, control and supervision of the NAPOLCOM.
01:37But I think it's now under the control of the DILG.
01:40So, my question is, how come that the NBI is chasing Senator Bato
01:52for an apparent warrant of arrest which the former Senator Trillanes
01:58has been showing around that he got a warrant of arrest
02:04and he is personally serving it to the Senator?
02:07The first question is, is former Senator Trillanes now the sheriff of the ICC?
02:16And he has been working with the Interpol, Mr. President.
02:21This is all questionable.
02:25As I said earlier, Mr. President, this is not only an assault to our colleague,
02:32but principally, it is an assault, an insult to this institution.
02:40We can't do this, Mr. President.
02:47We need to protect the Senator.
02:50As I said earlier, and I manifested that Trillanes himself was a beneficiary of this institution's security.

03:08Ngayon, ironically, he's the one executing the very act which prevented him from being assaulted at the time.

03:35They did not only violate Article 145 of the Revised Penal Code as I earlier manifested.
03:46Former Senator Trillanes is even guilty of disurping authority, Mr. President.

03:56In the meantime, I'd like to move, Mr. President,
04:01that in the light of the recent adoption of the Senate, of Senate Resolution No. 44,
04:09I moved that Senator Bato be placed under the Senate Protective Custody, Mr. President,
04:16until he is able to get all and exhaust all legal remedies to protect himself.
04:30And until this institution is also able to do just the same.
04:36Mr. President,
04:42Article 59 of Rome's statute is very, very clear.
04:47It's very, very clear.
04:49Even for the sake of an argument that there is a valid warrant of rest against our colleague,
04:56Article 59 still states that the person to be arrested must be promptly delivered to a competent judicial authority
05:09in order to accomplish at least three things.
05:13Number one, to identify or to ascertain the identity of the person being arrested.
05:20Number two, whether the processes, the legal processes have been observed.
05:27And number three, whether or not his rights were protected.
05:31This is very, very important for purposes of protecting the due process and the rule of law,
05:39which our colleague can avail, Mr. President.
