00:07Kaleigh Hanks and Ian Payton are irresistibly drawn to each other despite their obvious
00:12differences. There was many times we just said just don't go back don't you know but she loved
00:22him and there was nothing we could do. It was an off and on relationship
00:30seeing Kaleigh merely speaking to someone in the street was enough to make him think she had to
00:36die. Would anyone see the danger lurking beneath the surface of the turbulent relationship before
00:42it was too late?
00:59Bexhill on sea an ideal environment to raise a family something Kaleigh Hanks was told that she'd
01:05never have the chance to do.
01:07She thought every woman's prerogative was to have a baby and she found it kind of hard being around
01:14others that had babies. She generally did find it hard. It broke her.
01:24Family was everything to Kaleigh Hanks as DCI Andy Wilson home would one day discover.
01:31Everything that we learned from from friends from family was that she was absolutely committed to
01:38her family especially her relationship with her mum Sue and her sister Emma. Keen to replicate the
01:43family life that she'd enjoyed when growing up car home worker Kaleigh had married young
01:48but very soon the relationship was on shifting sands her first marriage it wasn't it wasn't a bad one
01:59very at first very loving then Kaleigh was told that she couldn't have children and so being a very
02:08very sort of optimistic and driven person she threw herself into life she wanted to make something of
02:14her career she wanted to make something of her life she wanted to travel. So they separated and they
02:22were in the middle of a divorce. So amicable was the split that the couple was still living happily
02:29together as housemates when in 2016 Kaleigh met sales rep Ian Payton. She was out with a friend one
02:37night in the local pub um then that closed and she met him in a strip club. Kaleigh and Ian
02:46both I think
02:46very sociable people they enjoyed spending time with other people and that's exactly what they were
02:51doing when they met um they were out socializing with friends. He gave the chase he booed and clued her.
03:00Ian won Kaleigh over but almost immediately her new lover started laying down the law.
03:06Pretty much say a month down the line it went sour.
03:13He didn't like the fact that she was still in her marital home with her husband didn't think it was
03:19right they were living together always had the thought of them sleeping with each other still
03:26like and it got very cold so he made her then move out
03:35he didn't want her having anything to do with her husband and made her move in with him.
03:42It was an early sign of how Ian Payton was going to be but he largely hid his behavior from
03:47Kaleigh's
03:48family the slightly older man charmed them whenever he could.
03:53He obviously was very good at this he was obviously very very good at this manipulation because Kaleigh's
03:58sister Emma was completely won over by him she thought he was fabulous.
04:03You know nice guy come across very nice you know very fun bubbly you know genuine
04:10from the first word my mum didn't like him my partner didn't like him my kids seem to have
04:18loved him but other people was a bit shady around him.
04:23Kaleigh moved into Ian's flat in St Leonard's a small town just along the coast from Bex Hill
04:29very quickly their relationship became volatile.
04:34I think people that we've spoken to about Kaleigh and Ian's relationship have described it as being
04:40a toxic relationship a really complex relationship one that started off really strong and and then
04:49deteriorated into into something that was absolutely untenable.
04:58The couple would have bitter arguments but Ian made sure his was the version of events that everybody
05:03heard about. He would always be the first one to mention an argument or an upset that they have and
05:11always tried to make it out that it was Kaleigh rather than both of them it felt a bit like
05:16tit for tat.
05:18Each suspected the other of infidelity and Ian was happy to play on Kaleigh's jealousy.
05:25He would hide text messages he would sit there on his phone and then Kaleigh would walk back
05:30into the room and he'd quickly put it away sleep with his phone underneath the pillow just generally
05:37like helped to make her feel a bit paranoid and it was happening all the time and then he would
05:43say
05:44like I'm not having an affair you're thinking you're thinking it I'm not doing it and trying to make
05:52her feel like she was going mad. Jill Bond, a former police inspector who specializes in domestic abuse
05:59recognizes this as part of a pattern of behavior a worrying one. That form of coercive control that
06:06form of head working as it's known gaslighting making the person believe that actually they are
06:12the ones at fault questioning themselves questioning their own sanity. He would kick her out and then so
06:20she'd have to sleep on the side of a road or someone's porch or like wherever she could find.
06:25She was sleeping rough on park benches if she ever had the temerity to disagree with this man. She
06:33was being treated less than a dog. And then he would ring her back up and say come back and
06:41everything's
06:42fine just a lot of mental games. At home she was never able to wear pajamas she always had to
06:51brush her
06:52hair and do her makeup wear nice clothes. Very much had to be doled up if they went out had
06:59to like buy
06:59things new. Always like if we went out like to the pub or something. It was always she had to
07:08present
07:08herself well she wasn't allowed to down dress or go out kind of relaxed she had to be always done
07:15up and
07:15smart and kind of present herself to everyone as his. She would have to make that effort and then be
07:22told off because everybody was looking at her and giving her attention which he didn't like. Social
07:30occasions were a frequent flashpoint for the couple when under the influence of drink or drugs
07:35Peyton could be especially cruel.
07:41Went out for a meal all together and went back to Ian's had a few more drinks.
07:48Kaylee and Emma went outside and maybe for a cigarette or whatever reason they went outside.
07:52When they tried to come back inside that they couldn't get in and they couldn't get in because
07:57Ian had locked the door. Like literally he locked us out it was raining.
08:04They had to beg him to allow them to come in and he told them they could not.
08:10Then he let us back in and Kaylee was like oh I'm sorry and he was like no you're not
08:15sorry
08:16and she was like I love you and he was like no you don't otherwise you wouldn't have gone out
08:21and
08:21she said I do and he was like prove it and she was like well how do you want me
08:24to prove it
08:25and he then said well get down on your hands and knees and tell me how much you love me.
08:31As far as alarm bells go must be just about the biggest alarm bell you could possibly hear.
08:37Horrified Emma Hanks watched as her sister submitted to Peyton's demand.
08:42And she got down on her hands and knees and then said I love you and he's like no it's
08:47not good
08:47enough and in the end she was like on her knees like in the pro position and it's like I
08:53love you I
08:54love you I love you please and then he was like oh get up like as in like stop being
09:00desperate and
09:01then started laughing at her. Neither Kaylee nor her family knew of something else about Peyton.
09:07If they had it would have worried them deeply. Detectives would learn of Peyton's violent ways.
09:14Ian I think showed a real propensity for grabbing people's throat and through police investigations
09:20we were able to identify that there were other instances where Ian had grabbed people by the
09:26throat in violent attacks in public and in private and it seemed to us to be his his go-to
09:32move.
09:33It's you know the sort of aggressive act that he went to first of all.
09:39The first occasion upon which he put hands on Kaylee's neck was not the first occasion upon which
09:44he'd done that to anybody. He had done it to a former girlfriend. He had done it to a male
09:50friend.
09:51How long could Kaylee ride the crest of Peyton's ever-changing moods and stay alive?
09:58He pointed his two fingers at her forehead and said no one would believe you anyway. You're crazy, you're mental.
10:23Periods of stability and calm were few and far between in the world of Ian Payton and Kaylee Hanks.
10:28Their phones gave the topsy-turvy game away.
10:31There were a large volume of messages from from both sets of phones that we recovered.
10:38DCI Andy Wilson home would soon be tasked with building a picture of the couple's life together.
10:44I think they really tell a story of a real mixed relationship one where there are
10:50periods that people are incredibly happy together and it's a really strong loving relationship and then
10:55these periods of real distrust and anger with each other and also some concern about the state of the
11:01relationship. And I think they show in everyday life the sort of roller coaster that Ian and
11:08Kaylee went on through their time together.
11:11On one occasion in 2017, Sister Emma thought the couple had split up for good.
11:16So they'd had an argument and asked and Kaylee had asked Ian to stay away from her and not contact
11:22either me or her or any of my family ever again. He moved her stuff out of his house and
11:31brought it
11:32back to Kaylee and Gavin's marital home. Then I went home thinking everything had settled and about half an
11:41hour Kaylee said she was coming over with Ian. Then they pulled up and Kaylee automatically just jumped
11:49out the car and said he's just grabbed me by the hair and slammed my head down on the dashboard.
11:59Thing to remember here, he is 19 stone. He is six foot tall and twice her size and he leans
12:06across and
12:06smashes this poor girl's face off of the dashboard of a car. And when they get to her sister's house,
12:12she tells her sister and he just flatly denies it, denies that it happened.
12:17And he was like, no, no, I didn't. No, I didn't. She hit me. She smacked me across the face.
12:23My partner then asked him just to get in the car and go. And then Kaylee kicked the door on
12:30his shin.
12:33Not very long after that, he dragged her out of the car by her hair. And again,
12:37she told her family and he just denied it happened.
12:41Though Kaylee's family knew some of what she suffered at her boyfriend's hands,
12:45much later on, more would come to light.
12:48Quite a lot of the things that she'd said, um, we didn't witness.
12:53Kaylee did keep diaries. She did keep notes. And I do think that she was concerned
12:58about her relationship with Ian. Her words would eventually be read out in court.
13:05Ian keeps telling me I'm no good. Ian would kick me out and I would leave and sleep on a
13:09bench.
13:10We had a night out at Yates's and Ian called me names.
13:14I would say without a shadow of a doubt, there was, um, there was certainly an impact on Kaylee's mental
13:19health.
13:20She'd become very depressed, anxious. She'd been diagnosed with OCD, like, delusional thoughts,
13:27where, medical-wise, she thought she was ill when she wasn't.
13:32Struggling with her mental health, Kaylee was even more susceptible to being controlled
13:37by her on-off lover. Kaylee's diary entries would expose how violent Ian would become.
13:44She wrote in one.
13:45Ian has strangled me and if I tell the police, they would not believe me.
13:49He would do these terrible things and he would just deny them. And if he was challenged upon
13:54by Kaylee or by anyone else, well, he would resort to casting aspersions on Kaylee's mental health.
14:00And that, I think, was the turning point for her as well, because she then went very within
14:07herself, but very withdrawn. When my sister said she was going to go to the police, go and ask for
14:12help,
14:12um, he pointed his two fingers at her forehead and said, no-one would believe you anyway,
14:19you're crazy, you're mental. There was many a times where she said, just don't go back, don't,
14:26you know, but she loved him and there was nothing we could do.
14:32And then something remarkable happened which gave Kaylee renewed hope for her future,
14:36what she thought was a miracle. After being told by the medical professionals it could never happen,
14:44she fell pregnant by Ian.
14:49Kaylee was absolutely over the moon that she was pregnant,
14:54um, that it was a FaceTime call on the toilet and it was, is this correct?
15:00And suddenly all the terrible things he'd done, they were in the past, they were a family,
15:05they were everything she'd ever wanted.
15:07I was very, very happy for her, but I was very, very worried.
15:12What was Ian Payton's reaction to Kaylee's news?
15:17Happy. Happy, but they were only together a couple of weeks.
15:21Because then Payton did something that despite everything, Kaylee never imagined he would do.
15:26He kicked her out of the flat one night and never to be seen again in nine months.
15:34Me and my sister made him aware of every appointment, every scan,
15:39messaged him so we had proof that it was happening.
15:44Kaylee didn't let her partner's absence take away the joy she was feeling.
15:48She just focused on the future. From that moment on, she stood up and she was going to be a
15:55mum.
15:57Emma's friend Adela would come to share in some of Kaylee's happiest moments.
16:01Everything was about the baby, everything. Every sentence she had with her, it was,
16:05I'm so excited, I can't wait, it's a couple more days. She was just ecstatic.
16:10During Kaylee's pregnancy, so she could save a bit of money, um, and just to take a lot of strain
16:18off of her,
16:19um, I asked her to move in with me and give up her property in another, obviously in another town,
16:25and make it easier for her to go to her appointments, and so I asked her to move in with
16:29me.
16:30But as Kaylee's due date approached, a decidedly mixed blessing, the re-emergence of Ian Payton.
16:40He only came back into her life when Emma contacted him two weeks before the baby was born,
16:46to say the baby is due in two weeks.
16:49Ian then chose to get back in contact and said thank you very much for letting him know,
16:55and would it be okay for him to attend, um, a hospital appointment?
17:00And suddenly, he made the decision, well, I'm back involved then, I'm now going to come and be a dad.
17:05And Kaylee accepted this with open arms. She was in such a position, she still wanted this so much,
17:12that she accepted this, this sort of terrible behaviour. She accepted it.
17:21And just like that, Payton had insinuated himself once again into every aspect of Kaylee's life.
17:27Would they finally be the happy family she was hoping for?
17:31Would they finally be the happy family she was hoping they could be?
17:35No.
17:37And when she went to see her sister, her sister noticed black marks, thick black marks around her neck.
17:59After Kaylee Hanks gave birth to her baby daughter, she moved out of her sister Emma's home, to a place
18:04of her own.
18:07When she had the baby, she wanted to make a go of things on her own, just be the mum
18:13that she always wanted to be.
18:15So she chose to move out and take that step forward.
18:19Local councillor Christine Bayless visited the flat that Kaylee now called home.
18:25It's right on the top floor of an old Victorian house.
18:30Very steep stairways. It was almost like it was up in the attic.
18:34And you found it hard to imagine how anybody would cope with a small baby in sort of that sort
18:41of situation.
18:43But Kaylee very quickly turned the cramped apartment in Bexhill Town Centre into the perfect nest for her little family.
18:49The first thing that struck me when I went into the home was how well appointed it was.
18:55She'd obviously taken great care in making her home something that was really warm and somewhere that it was great
19:01to spend time.
19:02Everything was really still very tidy. Everything was clearly well looked after.
19:07I had my little boy and she was so excited. And then, yeah, she had her little girl.
19:13They got on really well. My little boy would come over for playdates and they'd lay on the floor together
19:17and have tummy times.
19:18And just, it was lovely. Just kind of meet us three, like sitting there on the floor and it was
19:23really nice.
19:25Kaylee was amazing mum. She was loving, always had the baby in her thoughts. She lived for the baby.
19:33She was dedicated. She was a dedicated mum. You could tell that.
19:39You could tell by the way that she was with the child and the way she talked to the child.
19:45It was just, I was just left with a lasting impression that this was somebody that I really wanted to
19:51help.
19:53Kaylee was ready to raise her precious daughter as a single mother in their new London Road home.
19:57But he and Payton had other ideas.
20:00The day she moved in is the day that he stayed there permanently, even though he has his own flat.
20:07Ian never left Kaylee in the baby's side. And that's when me and my family thought,
20:12OK, this could be something of a new beginning.
20:16And for a while after the baby was born, he was allowed to play dad.
20:21And what's very interesting is for a very short time after the baby was born, the relationship became very good.
20:29Kaylee's loved ones were optimistic.
20:31They thought being a new father might change Ian and the way he treated the mother of his child.
20:37I wasn't surprised that Kaylee and Ian got back together.
20:41After having the baby, everything seemed perfect.
20:45And they were going to make a real go of things to be parents and to love one another.
20:53And be the best that they could.
20:56In a relationship that appeared for the first time calm and stable, Kaylee was able to focus on making the
21:01best life she could for her baby.
21:03It was now she met Christine Bayliss.
21:05Kaylee contacted me in July of 2019 and she had applied to go on the housing waiting list.
21:14She was single parent and she wrote to me saying that she hadn't heard anything from all the district council.
21:20She blew me away. I really loved her.
21:24She just wasn't what the stereotype you'd think of as a sort of single parent benefit scrounger.
21:31She was brilliant.
21:32She got a job.
21:33She was on maternity leave.
21:35She had real ambitions for her daughter.
21:38And I just left thinking if I can't help somebody like Kaylee, what's the point in being a counsellor?
21:46The counsellor's visit saw her see Payton as part of Kaylee's life.
21:51I went along to visit her.
21:53I met a guy there who she introduced me to as the father of her child.
21:59He was present all the time at that first initial meeting.
22:04After that meeting, she told me that they co-parented the daughter.
22:09He seemed fairly caring.
22:12And so he was for a month or two.
22:15While the baby was still tiny, her father's attitude changed.
22:19There was a hint of the return of the man who'd been so possessive and violent with Kaylee.
22:27And then it went downhill ever since then.
22:32Ian would come in from work, wouldn't pay any attention to the baby, just smoke, drink coffee,
22:39and just moan if he's tired or he's got a bad belly.
22:44And then he would suddenly pick the baby up and start the role.
22:51And then put her down like she was just a doll.
22:55And that's the way it was.
22:57He decided, I didn't want that, but now I do.
23:00I'm going to play daddy.
23:02And he played daddy for a while.
23:04But the monster came back.
23:09Ian was up to his old tricks again.
23:12Kaylee said she was feeling a bit suspicious of his actions.
23:17Again, the phone was being hidden.
23:20The phone was, like, used quite a lot of the time.
23:23So she just asked me, what should she do?
23:27And I said, confront him, but don't let him tell you otherwise.
23:31If he has nothing to worry about, then you'll know.
23:38The warning signs were there, but Kaylee thought she could overcome the couple's difficulties.
23:44Kaylee really was so focused on her daughter.
23:47She wanted things to be really straightforward.
23:48She wanted Ian to be really focused on her and their daughter.
23:54She wanted a knight in shining armour.
23:57And I think she was really determined to get that and to really, for her daughter,
24:02to put in such an effort to try and bring that about.
24:06In the last month, he was getting help.
24:09He was having counselling.
24:10We thought everything was slowly working itself out.
24:13He was dealing with his demons.
24:15Kaylee was dealing with hers.
24:17They just seemed to be like a family.
24:21But appearances were deceptive.
24:23As Bexhill's hot, dry summer weather brought tourists flocking to England's south coast,
24:28Ian was becoming, again, increasingly violent.
24:31At least once he hit her.
24:34Kaylee told no one.
24:36Kaylee never reported any domestic abuse to the police.
24:40Had she ever reported those two,
24:41naturally, she would have been listened to and taken seriously.
24:45There was a reason Kaylee did not report Ian's abuse.
24:49He would threaten her with social services.
24:53He would say, I'm going to call social services,
24:55I'm going to get them to take the baby away.
24:57And on top of the natural effects of the kind of physical and emotional abuse
25:03that he was inflicted on her, she's now living in fear that he'll call the police or he'll call
25:09social services and she'll lose her child.
25:11The one thing she's always wanted.
25:14We know it's not uncommon for there to be many instances of domestic abuse before
25:19people take the step of reporting it to the police.
25:24Kaylee Hanks was not yet ready to call the police,
25:27but she did begin to fear for her daughter's future.
25:30And on July 17, 29, she hinted at her fears.
25:35One of the most tragic things in this case is that Kaylee seems to have some inkling of what might
25:41be coming.
25:44Went over on the Wednesday to go and help Kaylee with the housework, help her out with the baby.
25:51From out of the blue, she asked me if anything ever happened to her,
25:56she would like me to have the baby.
25:58Making it clear, Emma, not Ian, is to have custody of her child.
26:03Me thinking, OK, because she's been poorly, she's getting a bit paranoid.
26:08So didn't think anything of it. Agreed.
26:11He strangled her. He has made her get on her hands and knees in their presence.
26:16He has beaten her. He has smashed her head off of a dashboard.
26:20He has done so, so much to prove that he is this evil monster.
26:25The following Saturday, a family gathering at Emma's house started on a sour note.
26:32She arrived with Ian. Ian came in through the gate first with the baby,
26:39dumped the baby in front of me, and I asked him where Kaylee was, how is, like, everybody.
26:47And he turned around and said, look, she's down there.
26:51Kaylee had spotted an old friend on the street. She had gone up and said hello, and they had a
26:56chat.
26:57Nothing more than that.
27:01Ian did not like the fact, um, that she was talking to another male. He was very annoyed.
27:08I could see by his facial expression when he came in through the gate,
27:13dropped the baby down in front of me, and then had about three roll-ups.
27:18And then afterwards, Ian had said nothing.
27:21And then Kaylee came bouncing through the gate, happy, went over to Ian, sat on his lap,
27:30give him a kiss, and everything seemed to be OK. Like, they were quite loving with one another.
27:38But Ian was biding his time until he and Kaylee were alone.
27:44At around 6.30pm, Kaylee and Ian left Emma's house.
27:49So I gave her a kiss, a cuddle. We said we loved each other.
27:54She walked out of the gate, um, and that was the last time we heard or see her.
28:07The last person to hear from Kaylee was a man called Ashley Boxall,
28:10the old friend she'd bumped into outside her sister's home.
28:15We know an argument started because that same man from the street was sent a text message by Kaylee.
28:22Ian accuses Kaylee of having an affair, and Kaylee makes some effort to contact the individual
28:29and get some confirmation for Ian.
28:31And the text message said, please tell Ian that we never had an affair, that we're just friends.
28:36And then she tried to call him. So the text message wasn't enough. She tried to call him.
28:41He didn't answer the phone, but he did send a text message back confirming,
28:44no, there's no affair. We're just friends.
28:50Ashley could see that Kaylee had read his response. Then she went offline.
28:55It would be hours before anyone found out what happened next.
29:00Kaylee was found in her bedroom. She was on the floor, right by the door,
29:05and really close to the crib where, um, where her daughter would have slept.
29:18In the early hours of Sunday, July 21st, 2019, Emma Hanks awoke to a night burn.
29:26In the morning, uh, it was half past four, I get a knock at the door, um, and I was
29:32a bit uneasy.
29:35Went down, obviously opened the door, um, to find two police officers stood there,
29:41um, and he asked my name and I said, yes, that's correct. And he said, is it okay if we
29:47come in?
29:50And I said, of course. Um, they followed me in and said, I'm sorry to have to tell you this,
29:58but we were called to a disturbance this morning, and your sister's dead.
30:05The major crime team at Sarian Sussex Police had begun to build a picture of Kaylee's final moments.
30:14Kaylee died in the very early hours of Sunday morning.
30:19But how? She had been strangled. Ian Payton offered police his version of events.
30:27On the night of Kaylee's death, Ian is the one who called the police. He called the police to tell
30:33them that Kaylee had died.
30:36And he told them that Kaylee had died in the course of an attack by Kaylee upon him.
30:46Ian's claimed that it was self-defence because Kaylee had charged at him with a knife.
30:54Um, so he acted in self-defence and held her by the throat.
31:00But from the very moment that Ian had made that 999 call, police began to note troubling anomalies.
31:07Initially, the call, um, after, um, Kaylee had, had been killed, it came to the police rather than the ambulance
31:15as a cry for help.
31:16Um, small details like that that made me think, well, that's quite an unusual thing if, if there's a tragic
31:21accident,
31:22something you didn't intend, you, you know, immediately try and get into the ambulance and try and get some help
31:27for Kaylee
31:27and try and get the situation back.
31:30There was shock in the local community as news spread of a violent incident in a town centre flat.
31:35The full facts were yet to be released.
31:38I heard about Kaylee's death actually from my son who sent me a text saying that there'd been a murder
31:44in,
31:44in, uh, London Road. I was sort of fairly shocked. And I just dropped Kaylee a, a text message to
31:52say,
31:52hope everything's all right. She didn't respond to me. I phoned a few more times and
31:57I walked up there. And of course, when I got to her flat, there was a policeman outside.
32:02He wouldn't tell me anything, uh, but he did take my telephone number and I, I did say to him,
32:08please tell me that the, the little baby is fine. Um, he said, I couldn't tell you that the baby
32:15is
32:15unharmed, but I can't tell you anything else. And I said, thank you. And on the way back, a police
32:21sergeant phoned me, um, from Lewis, from the, um, incident room, um, and just asked me what I knew
32:28and confirmed to me that she had been murdered.
32:33By this time, mid-morning on the Sunday, DCI Andy Wilson home and his team were following every
32:38possible line of inquiry. The detective story in the tragedy of Kaylee Hanks was underway.
32:44We always look at, um, things like phones. Um, we look at computers where we have them. But in
32:50Kaylee's case, we were looking at a really short period of time, um, for the investigation. And
32:56what we really needed to know was about her relationship with Ian and, um, Kaylee's family,
33:02friends, um, were all able to tell us what sort of relationship that was. Um, and we were quickly able
33:07to, to understand perhaps some of the difficulties that they'd been facing over the, um, the period
33:12preceding her murder. Friends and family painted a picture of a volatile, sometimes violent relationship.
33:22In custody at the local police station, Ian Payton described the events of the previous evening
33:27after the couple with their baby left Emma Hanks' home. Going on to Kaylee's flat and ordering some
33:34food together, um, and sharing that in the evening, um, Ian popped out to the shop. Um, and then when
33:39he
33:40came back, he, he describes the atmosphere changing, there being some arguments between him and Kaylee.
33:46They were clearly arguing because he thought she was having an affair. We know that from the text
33:49messages. But in fact, he said, no, no, it was about my ex-girlfriends and her jealousy.
33:54There was more argument and Ian described, um, Kaylee saying that their relationship had finished and
33:59that he was to, um, sleep on the sofa. Um, and Ian said that absolutely that's, that, you know,
34:04that suited him. He says that he went into her bedroom to get a pillow because he was going to
34:09sleep on the sofa. And, um, um, when he was doing that, Kaylee attacked him with a knife.
34:15Kaylee had come at him with a carving knife. Kaylee was trying to kill him, says Ian. And he said,
34:20I had to restrain her. But in Ian's words on the call that he made to emergency services that night,
34:26I think I restrained her too hard. Something else that jarred with investigating officers.
34:35Restraining someone by strangling them, it's, it's an incredibly brutal way of restraining someone.
34:40Um, and the force that's required to physically restrain someone to the point that, that they pass
34:46out and ultimately die, there's an awful lot of force. Um, and it, it, it seems absolutely incredible
34:53that, um, someone could consider that level of force as being appropriate against anyone,
34:59um, particularly their partner. There was certainly, um, disparity in size and height and weight between
35:07Kaylee and Ian. And so I would suggest that it would be relatively easy for Ian to restrain Kaylee in,
35:14you know, uh, all manner of different methods. Another factor in the case building against Payton
35:21was the time which elapsed between the incident and Ian calling emergency services. It appeared to be
35:26around 15 minutes. Kaylee was found in her bedroom. She was on the floor, um, right by the door,
35:33um, and really close to the crib where her daughter would have slept. So she was right beside her mum
35:41when
35:41she passed. Ian's reason for, for not calling, um, for an ambulance sooner was that he really needed to
35:48settle his daughter. He, he could hear that she was unsettled. Um, and he said that he was happy to
35:54leave Kaylee because he thought she was safe on the floor. When Ian returned to the bedroom,
35:5910 to 15 minutes later, he realized that she had still not moved, that she was in fact dead. When
36:06he
36:06finally made the 999 call, there was little anybody could do. The police, um, and the ambulance crews
36:12arrived really quickly at Kaylee's, uh, flat, um, and they really did work hard to try and save her life.
36:20Um, and they spent quite some time doing that, both the paramedics and police officers giving
36:24CPR there at the scene and trying everything absolutely possible. The problems with Ian's version
36:29of events were many. For one thing, if someone's coming at you with a carving knife, placing your hands
36:34around their neck is not going to protect you from the carving knife. Ian claimed that they had barreled
36:39around the room and that they had smashed into a dressing table. The dressing table, it seemed,
36:45on examination, was untouched. The scene in, in Kaylee's room was much like the rest of her flat.
36:52It was really well looked after. Everything was tidy. Everything was in his place. And there wasn't
36:56really, um, much to evidence, uh, that there was a struggle that had gone on in that room.
37:04Detectives found Ian Payton's account of how Kaylee had died difficult to believe,
37:08especially once the autopsy had been carried out.
37:12The forensic, um, pathologist was able to, to tell us that Kaylee had died from neck compression.
37:19Um, he discovered that there was bruising on both sides of Kaylee's neck and, um, and was able to say
37:25that he believed that that was as a result of, of neck compression. Um, it was quite separate to the
37:30medical intervention to try and save Kaylee's life. Also, we found that there were, um, hemorrhages
37:37in the eyes, particular hemorrhages, and they are found quite frequently in cases where somebody
37:43dies by strangulation. We carried out a micro CT scan of, um, of Kaylee's neck. And one of the bones
37:53in
37:53her neck, the hyoid bone, was found to be fractured. And again, that's found, um, to be fractured in a
37:58number of cases where, um, strangulation is the cause. She had the post-mortem on the Monday and on
38:05the Tuesday. We, we knew then when they charged him with murder, that's when they had to come and
38:15tell us. Um, and then it just went on from there. Six months later, 36-year-old Ian Payton stood
38:23in
38:23the dock at Hope Crown Court and denied murdering Kaylee Hanks.
38:28Throughout the course of the trial, Ian, um, was, he seemed very relaxed and unconcerned, um, about
38:36what was happening. He seemed, um, almost quite jocular that he wasn't, that he wasn't concerned
38:41about what was happening and how serious the events in the case were. I think perhaps his,
38:49his confidence is part of that persona, um, part of that control that he tried to exert over Kaylee.
38:56And I think by showing himself as, as being confident and even to a point disinterested in
39:02the trial, he sort of took back some of that control for himself and, um, was able to, um, cause,
39:09I think distressed the family. Payton continued to deny the charge against him. He insisted that
39:15Kaylee had come at him with a knife and that when he had tried to protect himself, he'd accidentally
39:20strangled her. His story simply did not stack up. Ian describes being attacked by Kaylee and
39:27sustaining injuries. And through our investigations and discussion with the pathologist, we were able to,
39:34to suggest that those injuries appeared to be self-inflicted by Ian. So it is, it was our case that
39:40Ian, um, was responsible for injuring himself with that knife.
39:47He's caused his own wounds and placed the knife beside her to make it look like they'd had,
39:54it made it look like that Kaylee had had the knife. Prosecutors told the jury that Ian Payton had
40:00strangled Kaylee to death, maintaining his hold on her throat for at least 15 seconds.
40:06It's an incredibly aggressive thing to do anyway, grabbing someone by the throat and the neck and,
40:12um, and squeezing so that they can't breathe. Um, but of course, when you do that, generally,
40:17when you release your hand, the person starts breathing again. And so in order to kill someone,
40:22um, by strangulation, you generally have to hold on for a long period after they've stopped breathing.
40:29And that was the prosecution's case that, um, that actually, in order to cause Kaylee's death,
40:35Ian had to hold on to her neck far longer than she'd stopped breathing.
40:42The autopsy found an injury to Kaylee's lip, as well as blood on the top that she'd been wearing
40:48earlier that day. There was bruising on her legs, cheek and the back of her head. Some of it new,
40:53some of it days old. These were signs that there'd been another choking incident a week or so earlier.
41:00Prior to her death, he's, he's, he's strangled her. We haven't, we don't know what it was over. We don't
41:07know
41:08what happened. I think that goes a long way to, to showing that that is, that is really something
41:14that he feels comfortable with and is, um, is something that he feels gives him a good degree
41:20of control and power over someone else. Despite Peyton's bravado in the dock,
41:27the jury was unconvinced by his version of events. On February 7th, 2020, they returned their verdict.
41:35Ian was found guilty of Kaylee's murder. He, uh, received a mandatory life sentence and he has
41:41to serve a minimum of 17 years. The verdict and the sentence are of little comfort to Kaylee's grieving
41:57family. You know, no matter how long he's got, he's still, we're still living without Kaylee.
42:12He's still living. He's still breathing. You know, he's still got food. He's, he's living a life
42:18in prison. He's got a second chance coming out. My sister's never going to have that chance.
42:27Where the family does find comfort is in raising the daughter that Kaylee left behind
42:31and in reading the diaries that she secretly kept. Real time, real love, real me, real us.
42:40Kaylee kept diaries for the baby for when she was older, just to give her the insight of what
42:47her dad was like and what Kaylee was like, what Kaylee had done previously, i.e. holidays,
42:56and just to give a real insight of the beginning and how she felt when she was pregnant. Me and
43:03Kaylee
43:03skinny dipping. Kaylee had just given words of wisdom from her mum, um, letting her know that
43:14her dad's was about and her dad wasn't all bad in their relationship. You know, there was happy
43:22times, but also Kaylee wrote down the things that he used to do to her, say to her. So just
43:30in case,
43:32like, everything about Kaylee's life was in a book. At a bowling night with your father was okay,
43:39not great due to your dad strangling my friend after. So the baby could read and understand
43:46what Kaylee was about. In the meantime, Emma Hanks wants to use Kaylee's story to stop another innocent
43:52person losing their life at the hands of their lover. I just urge anyone that's going through it,
43:58or they think they're going through it, just to go and get some help. Go and talk to someone. It
44:14just go and seek some advice.
