01:50an aspiring singer robin jenkins often had the right to sing the blues when it came to her
01:56relationship with david frostick the couple had been together for two up and down years when they
02:01moved from santa rosa california to las vegas in 2009 there the 45 year old robin hopes to make it
02:09as a
02:09singer still a fresh start doesn't mean old problems disappear in april of 2009 robin files a temporary
02:21protective order on frostick because of domestic abuse here she is in a las vegas courtroom based on
02:28your allegations here i know there has been an arrest for domestic battery yes i will go ahead and extend
02:33the order for one year ordering that he not have any contact with you or go to your residence without
02:40a police officer but less than one month later robin has the restraining order lifted ma'am you're
02:47wanting to go ahead today and actually dissolve the order yes and you're making that request voluntarily
02:53yes i am it would be a tragic mistake on may 10 2009 just six days after the order is
03:02lifted
03:03frostick allegedly stabs robin multiple times killing her for robin's close-knit family the news
03:11is devastating and devastation turns to frustration as frostick manages to delay his first degree murder
03:18trial for seven excruciating years now in september of 2016 with the case finally seeing the light of day
03:27robin's family has arrived in las vegas from california ready for their day in court as i recall it was
03:35mother's day and as you know robin's mother had died nine months before and she had gone against all of
03:43our wishes and having that restraining order lifted i get a call two in the morning they said robin's dead
03:56and dave's in custody
04:00and i heard you in the kitchen
04:04and the most amazing thing about that moment after crying and holding each other
04:13i remember you sat at the couch and you put your hands in your lap and you closed your eyes
04:19and you
04:20sat back and started reciting those affirmations that you taught us as children and it was just really
04:27clear that you weren't going to let go of the good but you knew that would prevail at some point
04:32and so
04:36that's really been a guiding light through seven years of pain to get to this place

04:48fighting on behalf of the jenkins family is seasoned chief deputy district attorney frank cuomo
04:53head of the department's homicide team he brings with him a unique perspective on his job i hate to
05:00say it from my perspective as a prosecutor i love stabbing cases because uh you really get to see
05:09the hatred the malice that your uh defendant had towards his victim to know that every time he plunged
05:18that knife into her body he could feel her body get weaker and weaker for somebody to know that he's
05:25playing god at that moment with robin jenkins's life and that's why i want to get him for first
05:31degree murder while robin's voice is now only a memory the voice of another victim in a different
05:38case the da's office is prosecuting rings out loud clear and powerfully my name is david quintana
05:45and on the night of august 9th 2014 i was brutally attacked outside my apartment
05:51usually i'm a type of person that has my guard up but the gentleman was asking for help regarding a
05:57pregnant woman i thought i was doing the right thing by letting him borrow my phone but that's when things
06:02started getting a little strange it was then when he said you know i'm gonna kill you and feeling the
06:09explosion of my teeth in my mouth and the blood running down my face where i knew that this wasn't
06:16something i was going to see the end of and david quintana isn't the only victim who found himself
06:21fighting for his life up against a brazen violent and manipulative couple in one of sin city's most
06:28perplexing cases it's a case that's likely to raise more questions than answers for prosecutors
06:34christopher hamner and thomas moskell as they go over the facts with district attorney steve wolfson
06:40just days before their trial we have two separate events both of them essentially are carjackings we
06:45have two defendants this is the first one this is nicholas crystal and his co-defendant is nina
06:51spiral what's weird about this case is we're not really sure if this is a bonnie and clyde thing we
06:56don't really know if basically he's kind of putting her up to doing stuff but what's very clear is
07:01the two of them are completely working together um the first case involves a victim where mr ayala
07:08is trying to get gas at a local gas station off of boulder highway and she comes up to him
07:13and she
07:14looks pregnant and she basically says i'm going through labor pains can you help me was she pregnant
07:18we don't really know okay and he agrees to take him to a hospital but then they change the game
07:23the
07:23minute they get in the car and so what ultimately happens is they rob him of his car because he
07:28stumbles
07:29to get out of the car and they take off and drive away leaving him bleeding bloody fractured skull
07:35um in the streets and that's what uh mr ayala ended up looking like after the event yeah five days
07:42later
07:43they come right back into town and now they're trying to find another ride david quintana is at
07:48his apartment complex crystal whips out a rock and just starts bashing david quintana in the face with it
07:54and just like with mr ayala crystal makes off with his truck that's what he looks like after mr
08:00crystal's done with them these were very very violent acts for little in return it wasn't necessary
08:06all you need to do to rob someone of their car is brandish a weapon but this guy yeah he
08:11i mean he
08:12wanted to kill these people what could his defense possibly be the defense is of course he didn't end up
08:17killing these people he stopped his attack short for different reasons but you know in front of a jury
08:22attempt for murder is one of the hardest things to prove sometimes yeah they've got to prove the
08:26element of a specific intent to kill and he could always say i never intended to kill the guy in
08:31fact
08:31i stopped hitting him right with nicholas crystal uh we have a super violent individual her on the
08:37other hand maybe she's the manipulator and he's the manipulated the thing is we don't think we really
08:41know because what you see on that video and that surveillance tape is without her an area
08:47i'll never get stooped he's part of the ruse she is the ruse
08:54knowing the video surveillance is key to their case prosecutors go to the gas station where this
09:00violent crime spree began we have one surveillance camera back there that's the one that's picking up
09:08everything that we have crystal and spyro they show up on foot i mean where they're coming from your
09:12guess is as good as mine they approach somebody over here they're talking to people and i think
09:17what they're looking for is one person to kind of one mark someone to kind of take the bait and
09:23start
09:24that conversation and ultimately when crystal and spyro can't find anybody they just decide to take it
09:28inside inside the convenience store an area all it comes in totally by himself he's not with anybody
09:33i mean he's a good mark the minute he walks out crystal is immediately getting spires attention
09:39telling her she's got to get up and that the two of them need to get out there and approach
09:45panera ayala before he leaves the premises completely she makes a beeline straight to his car
09:52and crystal he walks out of pictures so it's not to alarm ayala right that something's up yeah a
09:58pregnant woman like spyro is portraying herself to be um she seems helpless she was insisting that she
10:03needed to go to the hospital he seems pretty reluctant she starts crying and i think he's kind of on
10:08the
10:08fence and then that's when crystal walks over to kind of seal the deal right get him agree to do
10:15it
10:16he claims he's her brother instead of telling her to go in and call 911 he decided okay i'll give
10:21you
10:21a ride he did he did the nice thing he did the good thing
10:28as the trial begins the da's decide to separate the cases first trying nicholas crystal
10:35as the first victim aner ayala takes the stand he testifies about meeting the couple at the gas
10:41station and taking a ride from hell he'll never forget mr ayala i want to direct your attention to
10:47august 5th 2014 just after midnight that night seeing a pregnant woman for me it's a very touchy
10:55subject because i'm a father myself so when the defendant kept on uh asking me i finally agreed to give
11:03her
11:03a ride and i said i'll take you to the hospital but then on the way uh she possibly started
11:10feeling
11:10better and she changed that she wanted to go to a aunt's house i pulled over on to the side
11:16of the
11:17street he told her to get out and go knock on the door and then when she was getting out
11:24he told me go
11:25help her go help her i said you go help this is your sister not mine but she got out
11:32on her own he
11:33stayed in the car after after she came back he got up and went supposedly to knock on some door
11:41okay
11:41what happens then well it was probably like a few seconds i said like 30 seconds if we or less
11:49and then
11:50he came back and then i i felt the first blow to my head okay was there more than one
11:56blow oh yes
11:57there was multiple kept on hitting kept on hitting after my vision came back the only thing i heard
12:03was the the burning tires from my car uh i will pass the witness your honor all right any cross
12:09examination mr president thank you mr agar you need to greet me you come up to the apartment complex and
12:13the brother gets out of the vehicle he does and you testified then that the female stayed with you
12:20in the car yes now today you've made it a point that you and she were only there together for
12:2430 seconds
12:25correct maybe even less you were in fact in the car alone with her much longer than before you
12:31sir you engaged in intimate sexual contact with her sir the case against nicholas crystal and nina
12:48spiro begins with the couple's first victim immediately put on the defensive during tough
12:53cross-examination by crystal's attorney you engaged in intimate sexual contact with her sir
12:59jack john well that's absurd it goes straight to the and sure you pop yeah you pause that's how this
13:06whole fight broke out as you engaged in a sexual act with her he got back to the car and
13:10started
13:10punching you correct no you have no further questions thank you for your testimony you are excused
13:18well what do you think about the whole sex thing they were biting off on that a little bit well

13:21were and that's the beauty of being a defense attorney you're permitted to ask the question i mean let's face
13:26that most men aren't going to drive a woman across town at 12 20 in the morning unless sex is
13:30involved
13:31so they threw it out there and now the jury's speculating but the jury won't have to speculate
13:36when it comes to nina spiro she's taken a plea deal rather than face trial as a result she goes
13:43up in
13:44front of a different judge to enter her guilty plea miss spiro is present she's out in custody she's
13:49represented by mr buchanan the strategy or sensing is definitely going to be to argue for probation
13:56nina spiro was never the mastermind of this plan in any stretch of the imagination you're asking
14:02that in light of everything that she's done between these two cases we ask that the maximum six to 15
14:08year sentence be imposed on both counts and that they'd be run concurrent thank you all right thank you
14:14mr hammers because the fact of the matter is she pled guilty i mean she she accepted responsibility
14:19for this and i think an appropriate sentence would be a fixed five-year probation term let me ask you
14:24a question she's pregnant and due to have her baby in march of this year at the time that this
14:29event
14:29was going on was she pregnant or was that just she just making that up you weren't pregnant no okay

14:53i have some a lot of trauma because every time she goes to that station she's afraid
15:07i'm sorry i'm sorry if i could go back and not ask you i wouldn't ask you i would not

15:35the drift of my question and i asked mr ayala what would he do now he'd probably say no to
15:41that person
15:41and you know the state's saying they want to put you in jail because of what you did and that's
15:46a
15:46decision that i have to make my decision right did you take into account that the unborn child or
15:54yourself or many lives including your parents that are here now are being affected by the decision you
16:00made i'm adjudicating you guilty of second degree kidnapping i'm sentencing on 24 months minimum 84
16:10months maximum in the state's case against david frostick frostick has rejected various deals the
16:23da's office has offered now seven years after the crime attorneys from both sides get ready to deliver
16:30their important opening statements in this first degree murder trial trying the case for the state
16:35our chief deputy da's frank cuomo and susan benedict so on may 10th 2009 robin jenkins went to work
16:45at a local pf chanks restaurant came home started cooking dinner with the man that she shared the
16:52house with and that's defendant david she had been stabbed multiple times robin jenkins
17:09somebody grabbed her body ankles and dragged back into the house one of her arteries had been severed
17:17her blood in her body was pumped out by her heart within two minutes as she struggled to survive
17:26and as a result of what happened we will be asking you to find the defendant guilty of murder
17:32with use of a deadly weapon thank you defense opening thank you you will see inconsistencies in the
17:39testimonies in this case you will see inconsistencies between the testimony and the physical evidence
17:45in this case you will see that the physical evidence wasn't all collected it wasn't properly
17:50collected at the conclusion of this case you will have a substantial doubt as to whether or not the state
17:56has proven their case beyond a reasonable doubt that david frostick is guilty thank you
18:05now sir um on may 10th 2009 did you call your daughter yes when you got your daughter on on
18:14the
18:14line was there something that concerned you yes what was that it was a way in which she answered the
18:21phone she was tense and her response wasn't a normal response what was about the response that she
18:28said that caused you concern well things have been better that's what she said that's what she said what
18:34happened next that you heard i heard um sounds of um it sounded like scuffling in the background she said

18:46that and then there was a terrible scream can you describe that scream uh
18:58it was a scream that i'll never forget
19:06the shriek
19:08did it haunt you yes my oldest son and wife were in the next room he was yelling to me
19:16he was yelling jay jay something's happened to robin something's happened to robin
19:22and by that point we were face to face i've never seen my father in that condition
19:27ever he was frightened he was frantic and he was desperate because he couldn't do anything in that
19:33moment i picked up my cell phone and i called the police in las vegas two in the morning i
19:38got a
19:39call back from the police officer on the scene and what did he tell you he told me that robin
19:46was dead
19:47and that dave was in custody thank you okay so you can step down thank you for your testimony
19:56call your next witness please officer daniel point i want to direct your attention to may 10th of 2009
20:06made my way to the residence right away i noticed um blades in a body under the door and a
20:12large amount
20:13of blood in the doorway i saw somebody peeking out from the back room area um the male's head and
20:22then i
20:22started immediately um giving that person verbal commands uh metro please show me your hands he
20:28stepped forward and in the next room could you see if anything was in his hands yes as he was
20:33walking
20:33forward i noticed a knife drop out of his right hand what did you do next i kept on inching
20:39forward
20:40towards him closing the distance and eventually holding my weapon and going hands-on with the suspect
20:46then i took him outside uh to the front yard through the front door as uh we were going through
20:54the front door and on the front walkway we both uh fell out of the sidewalk uh we slipped in
21:02the blood
21:02okay thank you nothing further for us when you went hands-on with the individual is it possible that you
21:10had blood on yourself to transfer it onto that individual as you were taking him down yes okay
21:15because you actually had to touch him in order to take him down yes okay now do you recall that
21:21after all this happened you gave a statement to the police i mean they came and did an interview with
21:26you yes did you tell the officer that was interviewing you that when the subject came out of the kitchen

21:31did not appear that he had any blood on it yes i did nothing further your honor thank you
21:45as the murder trial against david frostick continues the state calls michael garland to the stand
21:51he had an interesting run-in with frostick the morning of the murder concerning frostick's behavior
21:56toward his wife so mr garland your wife indicated there was a dispute that she had uh with with this
22:03neighbor yes you saw this this individual that you took to be the one the male that lived in the
22:09home
22:09did you express uh your discontent with yeah i told him it was inappropriate for what he did and
22:14and that you know if if he continued to do it you know we could have a problem what was
22:19this state
22:20not affected any ordinary man would do if somebody touched their wife or something like that
22:23when you confronted him what was his reaction he kept backing up and and then he started
22:31screaming like like a little kid and took off running down the street did you chase him no i actually
22:38thought it was for a man to act that way when you're having a conversation i thought was comical all
22:42right

22:50as the trial nears its end the defense calls their only witness a blood expert mr harmer how are you
22:56currently employed i'm employed at the serological research institute as the chief forensics serologist
23:02and the executive director can you describe what testing you did i did a dna analysis of a set of
23:11fingernails from a victim and i found one nail had human blood under it i detected a type 21 and
23:20mr frostick's
23:22reference sample was a type 24 so that type is different from his dna types so i understand your
23:29testimony there was one found that did not belong to mr frostick that's correct okay and that would be
23:36dna from another male yes thank you very much sir we've passed away mr harmer you indicated to uh in
23:46your
23:47direct examination uh you don't know when that was placed there right that is correct the dna could
23:52have been placed under the uh females fingernails uh days before uh or at the time of the assault
24:00there's no way for me to tell what about an individual the victim who was uh working as a waitress
24:06yes they come in contact with a lot of cash credit cards hands so it'd be quite
24:13common for them to come in contact with different males pass witness anything further
24:26every single person had the same reaction when the defense rest yeah every single person went
24:33the jury too the jury did made the same face i made which was like um like looked around like
24:39are we being punks like this real like he brought in one witness that spoke for 12 minutes
24:47nothing of any substance the only explanation you can provide is for why he would take us through this
24:53seven-year period and his defense be so minimal is that he is delusional we've waited seven years for what
25:09in day two of the case against nicholas crystal prosecutors shift their focus to crystal's second
25:15victim david quintana he was allegedly attacked outside his las vegas apartment four days after the
25:22assault on the first victim an air ayala i want to turn your attention to august 9 2014. i was
25:31coming
25:31home as soon as i go in as the gate something got my attention there was uh somebody riding around
25:36on a
25:36bicycle i exit the vehicle he introduces himself tells me his name is nick um starts telling me a story
25:43about how he needs a ride to the hospital because according to him his girlfriend is pregnant and is
25:51about to uh give birth i uh told him that i couldn't give him a ride he then uh asked
25:58me if you could
25:59borrow my phone to make a phone call i hand him my phone okay so uh what happens next you
26:06know i i reach
26:07out for my phone back and i don't know we're surprised he uh he strikes me in the head with
26:12a rock
26:14and uh all of a sudden i i realize he continues to strike me strikes me a second time and
26:20the third
26:21time not only could i not see out of the right eye i was dripping blood all over and i
26:26can hear him
26:27saying uh you didn't think i was going to recognize you you didn't think i was going to recognize you

26:32remember what you did to my mom have you ever met this guy before never ever met his mom never
26:39um so what
26:40are you thinking now after what felt like minutes worth of the fighting i dropped 12
26:46fours i said to him i'm done take what you want i'm done what does he proceed to do he
26:54said i'm
26:54gonna kill you and i was in all fours he came up after saying that and struck me with the
27:01rock in
27:01the mouth and that's very powerful impact i could feel my teeth shattering as he was doing that i have
27:07no further questions at this time after breaking for the day the trial picks up with david quintana
27:14being cross-examined by crystal's attorney you were ultimately interviewed by a detective in this
27:19case correct yes detective youth and at that point in time
