00:49now we have a video of three different locations the whole shooting of the city

03:16skateboard and he was at mcdonald's on me and i'm over here and he's like laying there with bunch of
03:22blood and his eyes are open he's not breathing he's not breathing oh my god there's so much blood
03:37a 911 call came in indicating that a male had been injured that he's bleeding
03:46and until officers arrived on scene they discovered something much worse had happened
03:57they find him laying on the ground by the sidewalk in front of mcdonald's
04:02the 911 caller was with him they assessed his injuries they quickly realized that this was
04:11a major crime that had occurred the injured person is gabriel perez
04:20first responding officers began life-saving efforts
04:26but he was pronounced deceased at the scene
04:37by the time i arrived on scene officers had cordoned off the area
04:44we see he's got multiple apparent gunshot wounds
04:49mr perez was shot three times one of the bullets went through his heart
04:55and that's what killed him
05:00the first thing i wanted to do was speak with the 911 caller who was identified as marianne delgado
05:07detective hanson detective yonas fargo pd let's talk inside
05:11she was the only person on scene that knows the victim in this case
05:17where were you and gabe earlier this morning
05:19we were at a party
05:20she explained that the two had met up and went to a house party in south fargo
05:27was there any trouble at this party
05:29i don't think so i i left around one
05:32she went back to moorhead minnesota and left gabriel perez back at this house party
05:40perez starts sending her several messages
05:43and perez wants her to come back
05:46he wants a ride
05:47he said yo where are you at i said moorhead
05:51he said can you come pick me up
05:53what time was that at
05:554 24
05:57gabriel perez was sending in multiple texts
06:00increasing in urgency
06:03around 5 a.m gabriel perez sends her his last message
06:07please come and get me i fell so effing hard and i'm bleeding bad
06:11what time

06:15when she got there
06:17she found out what state he was in and called 9-1-1
06:27i started assessing the scene
06:30i did a walkthrough of it
06:31we see evidence of a shooting
06:36there's bullet impact marks in the sidewalk
06:38and in the concrete in the parking lot
06:41on the facade of mcdonald's
06:47one 45 caliber casing was found on scene
06:52so one of the questions is where are the other casings
06:55get forensics
06:56have them call in the area see if there's any more casings
06:58yep
07:00gabriel perez's cell phone was located near his body
07:05we wanted to see if that had any location information
07:09to show his whereabouts leading up to his death
07:13get a warrant for gabe's cell phone
07:15see who else he spoke to before you shot
07:24investigators give gabe's family the news
07:33i got a call from my mom
07:35hey mom
07:36and
07:37she was crying
07:40she ended up blurting out that
07:42gabriel's dead
07:46i remember just
07:48dropping on the floor
07:53i just couldn't process any of it
07:57i hear a loud banging on my door
07:59and my dad comes in and then he told me and i'm like
08:01hmm
08:02like
08:02are you joking with me
08:04because it just didn't seem real
08:09my phone starts ringing
08:12and that's my brother telling me hey
08:14they found gabriel dead at mcdonald's
08:18tears were running down my face
08:19and it feels like my rib exploded
08:23and i can't even breathe
08:27there are no witnesses to the crime
08:29so investigators pin their hopes on surveillance footage
08:35we quickly realized
08:38mcdonald's had multiple cameras
08:39okay this one right here
08:41this is going to give us some good footage
08:42we're going to have this area covered
08:45it was very fortunate
08:46in a sad way
08:48that this shooting happened outside of mcdonald's
08:50because there were several cameras
08:53pointed directly at the area of the shooting
08:55excuse me

08:57how many need to see your surveillance footage
09:03they have two cameras
09:05that covered the side of mcdonald's
09:08where gabriel pres was shot

09:14is pointing towards the south and the east
09:18and that covers part of main avenue
09:20going towards the east of mcdonald's
09:22spin it from 5 a.m
09:43we can see gabriel perez
09:50arrive at about 5 20 a.m
09:55zoom in from there
09:58it's at about 5 21 a.m
10:02he can see gabriel
10:04appears to be using a cell phone
10:07that's when he texts marianne delgado
10:10he was messaging miss delgado
10:12to tell her to come pick him up
10:15and had told her that
10:17he had slipped and fallen on his skateboard
10:20from what you could see in the security footage
10:22and she looked uninjured
10:24we don't know if he did fall off
10:26his skateboard
10:27or if he was just
10:29trying to get delgado
10:30to hurry up
10:31and get over to mcdonald's
10:35he then sits down on the curb
10:45the next thing we see is a black suv come flying into the parking lot
10:51the vehicle immediately approaches perez
10:56stops
10:58gabriel perez looks up to see who stopped abruptly right in front of him
11:06and immediately stands up and starts running to get away from this vehicle
11:11we don't know why
11:13that kid looks scared
11:16the vehicle speeds out of the parking lot
11:20and then drives eastbound on main avenue
11:24we need a better look at that vehicle
11:26you have a camera facing the other way
11:28can we see that one
11:31the mcdonald's restaurant had multiple cameras
11:34on this camera gabriel perez sits down
11:38just out of frame
11:45on the west facing camera we could see the vehicle enter the parking lot
11:57stop
11:58play that again
12:00at 5 23 a.m. we could see the vehicle stop right in front of gabriel perez
12:06zoom in
12:09the driver
12:11reaches across his body with his right hand
12:15you can see a pistol in his hand
12:19and he fires downward at gabriel perez
12:26you can see the recoil from the gun as multiple shots are fired
12:30he's point-blank shooting at the kid
12:34perez runs away
12:35as far as he can
12:38before he collapses to the ground
12:46the actions depicted in the mcdonald's footage
12:49very clearly identified that the person who pulled that trigger
12:53was acting with an intent to kill
12:57is that a white male
13:00maybe
13:00maybe black hair
13:02you could see that it was a man
13:05you couldn't make out his features exactly
13:08but you could tell that he was wearing some sort of gray shirt
13:13we really need to id this vehicle
13:16let's go back to the first thing
13:19stop
13:21play that one more time
13:24we slowed it down
13:25watch it several times trying to identify what make and model of that vehicle is
13:30that's a chevy
13:33it appears to be a black chevy trailblazer
13:37there was no license plate visible on the vehicle
13:40what's that on the rear windshield
13:42the video wasn't crystal clear
13:45but we could see the vehicle had unique stickers that we keyed in on
13:51there's one on the rear windshield
13:57there was also another sticker that stood out that was on the rear driver's side door
14:07so we put a bolo out for law enforcement within the whole metro area to be on the lookout for
14:14this vehicle
14:17next investigators retrace gabe's movements
14:20to find out what he was doing in the hours before his death
14:25delgado told us that she picks up gabriel perez
14:29and they go to this house party with people that delgado knew
14:34so the next question was
14:36did anything occur at this party that led to gabriel perez's death
14:42delgado said the people that were at the house party
14:44where a friend named devin and devin's boyfriend ryan
14:48we speak with them
14:50hey this is detective hanson from fargo pd
14:52what we learned from those interviews was that
14:56you actually suck at this game
14:58gabriel perez showed up
15:00he was hanging out with them
15:04and at one point in the night he receives some messages
15:10and it seemed like it was possibly something concerning to gabriel perez
15:16whatever conversation that he was having over his phone
15:20but they didn't know who he was communicating with
15:23devin went to bed and gabe and ryan were still up playing video games at the house
15:30eventually ryan went to bed while gabe was still there
15:34next day they wake up and gabriel was no longer there
15:38okay
15:39no one really knew where gabe was going when he left that night
15:44he just left
15:47we wanted to know who was gabriel talking to
15:51what would be concerning in his life
15:55why did gabriel go to mcdonald's at that time in the early morning hours
16:01we wanted to establish not only his timeline of when he left that house party
16:06but the specific route he took to get to mcdonald's
16:10we have a vehicle identified as a suspect vehicle
16:14is gabriel perez being followed by this vehicle along those routes
16:21so it was important for us to find any and all video of gabriel perez's route
16:29we looked at surveillance video from a traffic cam
16:33on 13th avenue and south university drive
16:37let's pull it from 4 a.m
16:40sometime after 4 a.m
16:42gabriel perez was sent in multiple texts telling delgado he needs a ride
16:47he arrived at mcdonald's at 5 20 a.m
16:51so that's the time frame we want to grab this video from
16:57look

17:06that's him
17:10the traffic cam at university and 13th avenue showed gabriel skateboarding at 5 0 9 a.m
17:18we could see in that video that gabe was traveling alone and he was traveling north
17:26it's pretty much just him on the street by himself
17:33watching this video of gabriel perez en route to mcdonald's nothing stood out as concerning
17:40so at that point
17:41so at that point the suspect vehicle was still at large and we had no identified person associated with the
17:47shooting
17:53across the state line in moorhead minnesota
17:57gabriel's family is in shock following his murder
18:03it's heart shattering you know like you don't know what to do in that situation what can you do
18:10police can only do so much but we wanted more to be done
18:15and we wanted to know who it was
18:21we wanted to know who it was
18:45and that's what i told my brothers probably nothing
18:47but he proceeded and called it anyway

18:51hello this is gabriel perez's uncle
18:56there's a frantic woman on the other side of the line
18:58and she's just starting to bawl and saying
19:01gabriel's it because of me
19:03it's my fault he's gone
19:05hold on hold on hold on
19:07it's okay stay on the line
19:09he's trying to calm her down try to get more information
19:11i want to help you
19:12then she hangs up
19:15at that point i'm shocked and i like i told them if it's a minnesota number
19:19morehead number she has to live close
19:24yeah
19:26approximately 6 40 pm
19:28we receive phone call from the uncles of gabriel perez
19:32and what did she say
19:34i spoke with a female
19:36this female implied that she had knowledge that gabriel perez was dead
19:41she was expressing guilt over his death
19:46she didn't identify herself at that point
19:48what was that number
19:50but we knew this number connects to somebody that's going to get us directly to the killer
19:57run this
19:59so we have that phone number ran through the fargo police records
20:02okay
20:04thank you
20:06any hits
20:06looks to be a vo number
20:08turns out that that phone number was actually a voice over ip number
20:13uh... ran by a company called text now
20:15i'm gonna call the da and we're gonna get a subpoena
20:19so i submitted an emergency disclosure to text now
20:22to identify who this woman is
20:25just twenty minutes later
20:28investigators receive news of another potential breakthrough in the case
20:33morehead police called us and said they located a black suv that appears to be a black chevy trailblazer
20:55there was a sticker on the back of the vehicle which had been partially
21:10partially peeled off
21:13that sticker
21:14that we could see on the surveillance video for mcdonald's
21:18had been removed
21:20however they did a poor job at removing it
21:23it was apparent it was the same vehicle
21:25what do we got here
21:29there's actually a fire cartridge casing
21:31on the outside of the front windshield
21:33right by the windshield wipers
21:36and it's a 45 caliber casing
21:39consistent with the one we found at the scene
21:42my thoughts are
21:44what are the odds
21:47we then obtained a search warrant
21:49and subsequently searched the vehicle
21:54one of the things that was found
21:57is a receipt
22:00and it's an ATM withdrawal receipt
22:03from Vision Bank in Fargo
22:07we could see that there was a time and a date stamp
22:11September 22nd at 9.04 p.m.
22:15the night that Gabe was killed
22:19so my next step is I went to Vision Bank
22:22and obtained a subpoena
22:23requesting that they provide me with any surveillance video the bank has
22:28to see who was withdrawing that money at that time
22:33while investigators wait for the ATM footage
22:37they receive a report on the number that was found in Gabe's bedroom
22:42hey
22:44I got a name to match that number
22:46shortly after midnight
22:48TexNow gets back to us
22:51I start looking through TexNow's data
22:54which identifies the subscriber
22:57as
22:58Izetta Cooley
23:01detectives run a background check on Izetta
23:04she's a 39 year old mother of seven
23:08Izetta Cooley and her husband
23:10have multiple children together
23:13they reside in Moorhead
23:17now we have a big decision on our hands
23:20how do we try to reach out to Izetta
23:23in a way that's not going to precipitate further violence
23:28what we decide is
23:30we can't risk reaching out
23:33until we knew more information
23:36why don't you pull up her social media
23:40initially
23:42we didn't see any direct link to Gabriel Perez
23:44he's like 20 years old at the time
23:48closer to the age of
23:49Izetta Cooley's oldest children
23:53investigators analyze Gabriel's Facebook records
23:56I saw on September 20th
23:59he friended
24:02Izetta Cooley
24:05and we can see some Facebook messages between Izetta and Gabriel Perez
24:11looking through those messages
24:13initially
24:13Izetta sent Gabriel messages
24:17saying she was looking for her daughter
24:20and quickly Gabriel Perez
24:24turns a message to Izetta
24:26saying how he thinks Izetta was attractive
24:31and that appeared to spark
24:34conversations back and forth
24:37that read pretty flirtatious between the two of them
24:42through the course of the next several days
24:44Izetta and Gabe keep talking
24:47on September 21st
24:50Gabriel seemed to initiate
24:52trying to coordinate a time to meet
24:54that the two were going to be romantic
24:57with each other
25:01and then a few hours before the murder
25:04the messages drastically change
25:09Izetta's messages about meeting up with Gabriel
25:12appeared to be increasing in urgency
25:17Izetta reached out to Gabe
25:19to set up a meetup at the McDonald's restaurant
25:22in that morning
25:23she's setting up the meet
25:27within minutes of him arriving
25:30Gabe reaches out to Izetta and tells her
25:33I'm here at the McDonald's
25:36two minutes after Gabriel sends the message
25:42the driver of the SUV
25:46shoots him dead
25:49the next step was figuring out
25:51who it was that was driving that trailblazer
25:54and who pulled the trigger
25:58investigators receive the surveillance footage
26:00from the ATM at Vision Bank
26:04the receipt showed the withdrawal of the ATM on September 22nd at 9.04
26:10so I wanted to see who was operating the vehicle at that time
26:16and I start looking at that video
26:33I see a black SUV appearing to be a black Chevy trailblazer
26:38it pulls right up to the ATM
26:42and that's where you get a good look of the driver
26:45with drawing cash
26:50stop
26:52you can see the stickers in the vehicle
26:56that matched the McDonald's video
26:59I'm gonna rewind this
27:02most notably
27:03you can see who's driving
27:06he's dressed
27:07in the same clothing
27:11that the shooter
27:12appeared to be wearing in the McDonald's video
27:15here's our shooter
27:18he's getting that receipt
27:21that was a pretty big moment in the investigation
27:24but now we needed to identify the driver
27:29when we found the vehicle
27:31there was no license plate
27:33but the vehicle has a vehicle identification number
27:36or VIN number
27:38we ran the VIN number of that vehicle
27:42and the VIN number
27:43came back to
27:46Izetta Cooley
27:49check for everyone who lives at that residence
27:52we start running backgrounds on them
27:55to figure out as much as we can
27:58Izetta Cooley was married to Miguel Cooley Sr.
28:04Investigators pull up Miguel's license
28:08the photo is a match for the driver in the ATM footage
28:13there's no doubt it was Miguel Cooley Sr. driving that vehicle
28:18we've now got a suspect identified
28:22so now we have to go apprehend him
28:29we obtain a search warrant for Miguel Cooley's residence
28:37Fargo PD, we have a warrant to search your property
28:40Izetta's home
28:42she was somewhat cooperative but you know kind of standoffish a little bit
28:49she says that Miguel Cooley is not at home
28:54if we don't find Miguel Cooley there himself
28:58the evidence we're looking for is any firearms
29:02particularly a pistol
29:05we found a lot of ammunition some of it 45 caliber consistent with what we found at the crime scene
29:15we also come across three sets of Chevy keys
29:20that's a significant piece of evidence
29:23those keys link that vehicle to that residence
29:28that solidified the connection between Miguel Cooley and this crime
29:34we request that Izetta turn over her cell phone
29:39investigators take Izetta to the police department for questioning
29:52she's interviewed by law enforcement
29:56I remember that being a very bizarre interview
29:58you can't do this
30:01I'm barely keeping it together
30:04it's like you can't even breathe
30:05I can't even breathe
30:08Izetta was not the most cooperative during the interview
30:12she was very vague on a lot of things
30:16I asked her if she was engaging
30:20with some sort of romantic relationship with Gabriel Perez
30:24it was not a relationship
30:26why didn't you want to meet with them?
30:28because all of us just read like you two are flirting
30:30I wasn't having a relationship
30:32so you were just toying around with them?
30:35or just flirting kind of for fun?
30:36well then what does it mean?
30:39Izetta Cooley also
30:40was maintaining her husband's innocence
30:43I don't know why we can incriminate him more than
30:49he's incriminating
30:51the whole shooting of our video
30:54oh gosh
30:55you guys need to end up not living on our team
30:58try me
30:59I'm done
31:02at the time we're interviewing Izetta
31:06we received a phone call
31:08authorities in Minnesota
31:11have tracked down Miguel Cooley
31:16Miguel Cooley
31:17Miguel Cooley
31:17is ultimately located
31:19in the Rochester, Minnesota area
31:21at his sister and brother-in-law's home
31:27the U.S. Marshals Fugitive Task Force
31:29were brought in
31:30to apprehend Miguel Cooley
31:35Miguel, give yourself up
31:39show your hands
31:41walk towards me with your hands up
31:44Miguel Cooley has changed his appearance
31:46he's shaved off his beard
31:48stop right there
31:49turn around
31:51place your hands behind your back
31:54the task force arrests Miguel Cooley
31:57for the murder of Gabriel Perez
32:02that was a really big relief for me and my family
32:08it's one step closer to getting Gabriel justice
32:13I was definitely glad that he got found
32:17but at the same time it's just like
32:20like I don't I didn't want it
32:23I don't want to accept the fact that Gabriel was gone
32:26so I you know what I mean I just felt so lost on it
32:32Miguel Cooley is transferred to the Mauer County Jail
32:37myself and three other detectives start conducting interviews
32:41we're trying to narrow down exactly why this occurred
32:46and I was curious as to whether or not Miguel Cooley
32:49would tell us anything about why he killed Gabriel Perez
32:53we're here to talk with you about what's been going on the last few days
32:56yeah other things like uh blur
33:00what pissed you off and got you to the point that Sunday morning happened
33:04what I don't know is the job
33:07we went to Austin
33:09Austin that's all
33:10yeah
33:11yeah I went there and wanted to get some tires
33:14but then having tires at the 1-1-3
33:18all he told us was everything was a blur
33:22he wanted to talk about having a flat tire
33:25so very nondescript
33:27nothing that would rule him out
33:35he requested his attorney
33:37so we never spoke
33:39any further than that
33:42it can be a little frustrating
33:44at times when people don't want to talk
33:46but I mean that's their right
33:51around this time we're able to get into the cell phone data from Izetta's phone
33:56we can access her texts
33:58we wanted to know if Izetta was complicit in any way
34:04I see that there's a text message
34:07a few hours after the murder
34:09Izetta sent a message to someone close to her
34:13she mentioned that prior to the murder
34:16Miguel ended up going to a restaurant called the frying pan
34:19to get food
34:24investigators head to the restaurant
34:25to analyze the surveillance footage for clues
34:28we don't know exactly when he was at the frying pan
34:31but we could start with working back from when he was at McDonald's
34:35can you show us 5 a.m. on September 23rd?
34:47sure enough
34:49Miguel Cooley entered the restaurant
34:51at about 5.09 a.m.
34:56the frying pan restaurant is within blocks of the McDonald's
35:00where Gabe Perez was shot and killed
35:03so the question was
35:05how did Miguel Cooley know that Gabe Perez would be in that McDonald's parking lot?
35:09just minutes later
35:19Cooley looks like he's ordered food or is waiting for an order
35:25in the video from the frying pan you can see Mr. Cooley's wearing the same shirt that he appears to
35:31be wearing on both the Vision Bank footage and the McDonald's footage
35:39Oh, he's really busy on his phone
35:43so he's within the area of the crime and communicating with someone in the moments before
35:51We know on the day of the murder
35:54Izetta and Gabriel are exchanging messages
35:58Izetta appears to be asking to meet with Gabriel Perez at McDonald's
36:03The frying pan video showed Miguel Cooley exiting the business at about 5.16 a.m.
36:10Gabriel Perez's last message to Izetta Cooley is at 5.21 a.m.
36:17and it just says that he's there at McDonald's
36:20and within minutes
36:22Miguel Cooley Sr. drives up
36:25and essentially executes him
36:31Detectives take a closer look at the Facebook messages between Izetta and Gabriel
36:36One of Izetta's messages, she describes what she's going to be wearing
36:40A white t-shirt and grey pants
36:43That message sounds a little suspicious
36:46Gabriel and Izetta know each other
36:48So if you're going to meet up, why do you need to know what they're wearing?
36:55But the messages arranging to meet at McDonald's
36:59may not have been submitted by Izetta
37:02That was possibly Miguel Cooley Sr. sending those messages from her account
37:10It's starting to make sense
37:13He's luring Gabriel Perez to McDonald's with the intent to kill him
37:19The person Gabe believed was Izetta Cooley told him to meet her at the McDonald's
37:26The person he met there was clearly not Izetta Cooley
37:31Miguel Cooley could have sent the messages which led Gabe to go to that location
37:40Miguel Cooley baited Gabe Perez to enter that parking lot
37:46Based upon all the evidence collected in this case
37:49We were able to charge Miguel with murder
37:53On August 22nd, 2019
37:57Miguel Cooley appears in court and pleads guilty to first-degree murder
38:04At Cooley's sentencing, prosecutors stepped through the events that led to Gabriel's death
38:12The evidence really showed that Gabriel Perez was engaging in flirtatious texts with Miguel Cooley's wife
38:21Gabe and Izetta were apparently communicating through Facebook Messenger
38:29Mr. Cooley was aware of these messages
38:34Mr. Cooley was aware of these messages
38:35And that's what fueled him in his rage
38:37You actually suck at this game
38:44Gabriel and Izetta arranged to meet at McDonald's
38:50Gabriel was directed to go there from Izetta's Facebook account
38:57But I believe Miguel Cooley probably took over her account
39:02Mr. Cooley knew Gabe Perez would be outside the McDonald's
39:10When Mr. Cooley entered that McDonald's parking lot, he moved with clear intent
39:15He drove directly towards Gabe Perez
39:20Stopped
39:23Shot him
39:24And left within seconds
39:28He had one reason for being there
39:30And that was to kill Gabe Perez
39:39On January 13th, 2020, Miguel Cooley is sentenced to 50 years in prison
39:46Izetta Cooley is charged with no crime in relation to Gabriel's murder
39:53There is no evidence that she had any involvement in what happened
39:58Law enforcement did an exceptional job investigating this case
40:03And part of that was recovering all of the security footage
40:10It was critical for us to prove our charge of murder
40:21I don't think we'll ever come to terms with losing Gabriel
40:24Losing somebody in general is painful
40:26But losing somebody in the way we lost Gabriel is worse
40:32Gabriel was one of the most caring people that I knew
40:36And that I've ever came across in my life
40:41Gabriel was close to turning 21 and we're only a year apart
40:45So we were just really close
40:49Not just my brother, but like my friend
40:54I could still like hear his voice
40:57Him asking how I am
40:59How loving he was
41:03That's what I miss most about him
