04:29And of course, if this were your whole case, which apparently it is, you would have all of
04:34these medical records saying cancer, cancer, cancer, bad foot, bad skin, bad foot,
04:41antibiotics, chemo, whatever it is. But you don't have that here, do you?

04:49I had to pawn it to pay for chemo.

05:58When we get in the living room, I hear something from his bedroom.
06:01I go to open his bedroom door and he's pushing against it.
06:05We're yelling back and forth. He's telling me to leave.
06:08And so I turn around to leave and he grabs me and pushes me towards the door.

10:04that he had pawned the mower, which led to McNamara forcing her out of the residence.
10:08So I just want to be clear, you spoke to a police officer?

10:11And you spoke to the police officer about how she kicked the screen door so hard she
10:15broke it in the frame?

10:16And about how her husband pulled a gun on you?

10:19Okay. None of that was in the police report.
10:21You see, when you're talking about a complaint that someone threatened you with a gun,
10:26the police department typically put that in a police report.

10:32August 20th, 2024, were you with your wife at the house?

10:37Did you ever pull a gun on him during that incident?

10:46She's arguing with his girlfriend.

10:53He doesn't want to go to the pawn shop to let us pay for it to get the item back.

11:00This pawn shop, you knew that she and her husband still owed money on this lawnmower, correct?

11:16I get that you might be struggling, but at the same time, we're on the hook for the money.

11:23Matter of fact, we haven't gotten a payment in over a year.

11:52I tend to agree, and I tend to believe that you would have no reason
11:55to sell him without telling him that the money that you needed from him was going to be used

16:14And they were just arguing.

16:18And so she goes to the front door and kicks it open.
16:21And she's like, come find me then.
16:23So, whenever they started arguing outside in the front,
16:25it was just me and Cody out there.
16:26And I was just like, I just, I don't know.
16:28I was just standing there.
16:29And then he walked.
16:30So you say somebody's angrily banging at the door.
16:33I didn't hear it.
16:33And you're like, you know what?
16:35I'm going to go handle this.

16:39And so let's assume that happened.

17:24When you were outside, did you see him with a gun?

17:29So if he would have pointed a gun, the way you would have had the police show up,
17:33was, as Judge Levy was pointing out, that's not what you told them.
17:37Even by your own testimony in here, you requested a no trespass order.
17:41So that goes to your credibility as well with regard to the gun.
17:45So when you were in the house and you say that she kind of kicked or pushed the door,
17:50how did she do that?
17:51Can you explain?

17:56It's kind of the middle, because like where the little handle thing is,
17:58where you could press it like that.
17:59It was a little bit underneath it, because she just lifted up and just pushed like that,

18:04And that's what I wanted to know, because this door, this here is way up.

18:18And you have a $1,600 estimate for something that you've not fixed.

19:40And anything that he could have substantiated that would have lent him some credibility,
19:44he didn't bring with him.
19:45Also, with regard to the medication, if you go to one of these stores, you know, the big
19:50stores, they'll print up anything for you and bring it out.
19:53Because I get it that he said, listen, back when I took it, I didn't know I was going to
19:56need it.
19:56And that rang true, but the reality is all he had to do was go back and say, listen, can
20:00you show me my list of medications and so on?
20:03I just found her credible.
20:04I think she's entitled to the money, the balance that she sold him the lawnmower for.
20:09But I do want to say one thing.
20:10I did look up the value of the used lawnmowers.
20:12And even those that were from 2015, 2013 were well over $1,500.
20:19So I can't imagine that she would have given him such a great deal at less than $2,500.
20:25I think she's entitled to what she's asked for.
20:28And I believe that he gets nothing on his counterclaim.
20:32And one of the things, somebody would have told somebody about a gun.
20:34I mean, in an altercation like that, somebody would have said to the police,
20:38there was a gun involved, and nobody did.
20:40Right.
20:40None of that was in the police report.
20:42And the defendant was unable to explain why that was.
20:45I believe that the plaintiff has, in fact, met her burden with respect to the $2,500
20:50agreement that they had.
20:51And she acknowledged that he paid $140 towards the purchase price,
20:55leaving her with $2,360 that he owes her for that.
21:01Tanya, I thought that your examination of him with respect to
21:03him knowing that he did the wrong thing when he pawned the lawnmower that he did not yet own,
21:09because he had not finished paying it off, was right on the mark.
21:12If he didn't think it was wrong, he would have told her he was doing it.
21:16But he never did, because he knew that the leasing company was still taking payments on that.
21:21And for him to deny that was as silly as his girlfriend's statement was when she came in
21:27and say, oh yeah, I put that in my sworn statement that someone came and fixed it,
21:31but I don't know how it got there.
21:33They're just lying.
21:34Look, I think she's more than proven her case.
21:36I think if you look at all of the circumstances that gave rise to their showing up to the house
21:40in the first place, I think they were upset.
21:43Sure.
21:43And I think her brother did kind of want to get her out of there.

21:47He has no receipts for payments.
21:48He has no receipts for medication.
21:50He has no evidence that there was ever any medication.
21:53I just find him lacking across the board.
21:55I would give her everything she's asking for, including the cash out payment.

22:16Well, you know, much of what happens in a courtroom is determined by credibility.
22:20And credibility is assessed by all of us.
22:22Not by just what you say, but what you don't say.
22:25And not by the evidence that you produce,
22:28sometimes by the evidence that you don't produce.
22:30So when you say you don't have proof of a pharmacy bill, why not go back to the pharmacy
22:36and have them print out a receipt to show what you paid or what you didn't pay?
22:40When you say you called the police and you report a handgun being pointed,
22:44which is an armed felony offense, that brings out a different result.
22:48So I think you can tell by that that the credibility issue, the weight, the 51%,
22:53the preponderance of the evidence goes to you.
22:57So as to your main claim here, the request for $2,510, we believe you that you agreed to $2
23:04,500.
23:05We believe you that he borrowed $150.
23:08And we believe you when you say he repaid $140 of that debt that he owes you.
23:14So to that extent, you've prevailed.
23:16Sir, you on the other hand, we did not find what you said credible.
23:20And so as to the damages, the fact that it was not repaired, and we don't know if you will
23:25repair it,
23:26the bottom line here is we are going to dismiss your counter claim.
23:29We wish that you both go on your way and spend your money wisely.
