00:06We have a warrant to search the premises.
00:08The warrant includes your offices and the storage facility as well.
00:11Do we have something to hide?
00:12Bird wouldn't go to all this trouble for nothing.
00:14Wait until I get you in front of a jury.
00:17I understand that people have obtained a superseding indictment.
00:20First degree murder with special circumstance of murder for financial gain.
00:25I surrender myself to the court and I will be ready to defend myself on the charges of schedule.
00:32You think Ghazarian had Sam killed because he found out Sam was informing on him to the FBI?
00:36If he leaves the state, we can't subpoena him.
00:39I don't know if I'll stay on them. My entire case is riding on the subpoena.
00:43Cisco, where are you?
00:44Palm Springs.
00:45Ghazarian and Janine took off. I tracked them to a resort out here.
00:49I have a preliminary hearing coming up.
00:51They say I killed my business partner so I can get the whole business.
00:54Carter, it looks bad. They have an eyewitness.
00:56I didn't do this.
01:00Where are you taking me?
01:01Hey!
01:02Hey!
01:03Hey!
01:58How much younger are you going to keep me here?
01:59Hey! You know I didn't start on fire!
02:12No, they wouldn't let anybody in. The jail was on lockdown all weekend.
02:15Some kind of riot.
02:16I think he didn't call either. You don't think he got hurt, do you?
02:19If it was serious, we would have heard something.
02:21More likely he's in the shoe. They don't let you make calls from there.
02:24Why would they put him in solitary?
02:26I don't know, but we should find out.
02:28I'll be there in ten minutes.
02:30Yes, I'll let you know. Thank you.
02:32Okay, good. I filed an emergency motion to get in front of Judge Stone.
02:35Yeah, that's been moved up.
02:36What do you mean, Izzy?
02:37That was the judge's clerk. You guys were on for nine,
02:40but they just said they need you in there ASAP.
02:43Ms. Berg, Ms. Crane, Ms. McPherson,
02:46this is Assistant Sheriff Adams in charge of custody operations
02:49for the Sheriff's Department,
02:50and we have counsel for the Sheriff's Department present as well.
02:54We're already running late, so, Sheriff Adams,
02:57if you could please explain why you're here.
02:59Thank you, Judge.
03:00Um...
03:02I'm afraid we have a developing situation involving Mr. Haller.
03:06Since Friday evening, he's been held in the jail's secure housing unit.
03:10Can I ask why?
03:11He was at the center of a riot to put the entire facility
03:14on lockdown this weekend.
03:15Is he okay? Is he safe?
03:17Mr. Haller is fine, but his safety is what I am here to discuss.
03:22It is our department's belief that Mr. Haller's continued presence at the jail
03:25creates an ongoing danger to himself and to other inmates.
03:29Meaning what, exactly?
03:31Simply put, we no longer feel confident that we can...
03:35guarantee a safety at the county jail.
03:37Whoa, whoa, whoa. Hold on. What are you talking about?
03:40What he is talking about is exactly why we filed an emergency motion.
03:43We need to get Mr. Haller out.
03:45Over my dead body.
03:46Not Miss Burke.
03:47Your Honor, it is a statutory requirement that the defendant remain in custody.
03:51Now the jail is saying that they can't handle him?
03:55Move him to another wing or to one of the other eight jails
03:58that the sheriff's department oversees.
03:59Moving him won't solve anything.
04:01Will it, Sheriff?
04:02Because the problem isn't the jail, it's the people guarding it.
04:05Mr. Haller busted the deputies for eavesdropping,
04:09and now they want revenge.
04:11Is this true, Sheriff?
04:12There are issues with custodial security, yes.
04:16Now I recently brought in some new deputies who report directly to me.
04:20You mean you brought in spies to point out the troublemakers?
04:22I mean we're in the process of correcting the issues.
04:24Great. In the meantime, if the defendant is safe in the shoe,
04:28then why can't he stay there for the duration of the trial?
04:31Because he hasn't done anything to warrant solitary confinement,
04:34which infringes on his constitutional rights.
04:36And who knows how safe he'll be in the shoe?
04:39The deputies control that as much as they control the rest of the jail.
04:42Well, be that as it may, this was already ruled on, Judge.
04:46If the accused wanted to keep his speedy trial, he needed to forego bail.
04:51We have kept up our end of the bargain,
04:53and now the defense is looking to take advantage of...
04:56The defense would beg to disagree.
04:58We lost an entire weekend of prep while my client sat in solitary.
05:02If anyone gained an advantage, it's the people.
05:05Let me guess, it was one of your new deputies who put him in the shoe for his safety,
05:09which left you a whole bag of wrenches to clean up.
05:11I'm not trying to make excuses here.
05:13No, your department is trying to avoid a lawsuit,
05:15which you know is exactly what you're gonna get if anything happens to him inside.
05:19Your Honor, the defense respectfully but strongly requests the court release Mr. Haller from incarceration
05:25for his own safety and that of other inmates.
05:27And the people vehemently oppose this outrageous request
05:32and insist that the letter of the law be followed.
05:44Well, this is a cluster of...
05:51Let's go.
05:57Let's go, let's go, let's go visit.
06:02Let's go, let's go.
06:11We need a few.
06:18Let's go.
06:19For the militaryczy view of what we got there.
06:21Do we have no reason?
06:22Come to go, let's go there.
06:24Let's go, let's go.
06:25Just follow her behind the질,
06:26Let's go.
06:26Let's go.
06:28You okay?
06:32What the hell is going on, Meg?
06:33The judge agreed to let you out.
06:35Berg insisted he put you on house arrest.
06:40That's Deputy Bennett.
06:41He's gonna escort you between home and the courthouse every day.
06:45You're not allowed to go anywhere else.
06:49Get in the car.
06:57I'll see you at home, Mick.
07:44Lorna.
07:46You gotta see this.
07:50What is it?
07:51A security video from Carter's Liquor Store?
07:53Watch.
07:55This came first thing this morning.
07:57I was hoping you could poke holes in the story Rashad told us, but...
08:02Here's Rashad.
08:13Goes back to the storeroom, just like he said.
08:20And a few seconds later...
08:28That's all there is.
08:30The shooter knew exactly where the camera was and took it out.
08:33Carter owns the store.
08:35If anyone knows where the camera is, it would be him.
08:38His prelim is in a couple hours.
08:40I think I have a way to knock down Rashad's testimony,
08:43but this makes it look so much worse.
08:45Look, don't freak out yet.
08:47We still have time to find something.
08:49And I'm gonna come by court today for some real support.
08:52Aw.
08:52Thank you, Izzy.
08:54You hear from Cisco?
08:57Nope.
08:58Just call him.
08:59Will ya?
09:00Or text him.
09:02Something.
09:06Fine.
09:13Babe?
09:14Hey.
09:15I love you too.
09:16I've just been so worried.
09:19You big idiot.
09:20I know, and I am really sorry.
09:22I wasn't trying to lie about following Gazarian out here.
09:26I know.
09:27You were just doing your job.
09:30Have you seen those two goons that beat you up?
09:32No.
09:33No, which is kind of weird.
09:36Well, I am not complaining.
09:38Babe, I promise you it's safe.
09:40It's not dangerous at all.
09:41If anything, it's kind of...
09:45boring.
09:46Stuck in the room all day,
09:47watching Gazarian and Janine get in and out of the pool.
09:51Well, come home soon.
09:53Winston and I miss you.
09:54Yeah.
09:55How much do you miss me?
09:58I miss you so much.
10:00But not as much as I miss my Mini.
10:03Cisco, I hate driving your truck.
10:05I need a booster seat to see over the steering wheel.
10:08Babe, listen.
10:09I need the Mini to remain inconspicuous.
10:12Okay?
10:12That's what you said about your truck.
10:14You'll have the car and me
10:16back better than ever very soon.
10:18I promise.
10:19Good.
10:21Oh, I have a prelim.
10:23I have to get ready for it in two hours, so I gotta go.
10:25Knock them dead, huh?
10:27I know you will.
10:28I love you.
10:29Love you too, babe.
10:30Bye.
10:51So what do you think?
10:53I think Drucker.
10:54Guaranteed.
10:55She laid the foundation with Collins.
10:57Drucker brings it home.
10:58That's what I do.
10:59Yeah.
11:01All rise.
11:09You seated?
11:11All the goodness is, we've got plenty to work with.
11:14If Drucker decides to...
11:15Ms. Berg.
11:17Are the people ready?
11:18We are, Your Honor.
11:19The people call Paul Russo to the stand.
11:26The ballistics expert.
11:28Why would you start with him?
11:30And did the slug that you recovered from the defendant's garage match the slugs you recovered
11:36from the victim?
11:37Yes.
11:37The rounds were identical and fired from the same handgun.
11:40A Mossberg MC-2SC.
11:43And is that a common handgun?
11:45Very common, yes.
11:47Now, Mr. Russo, one issue that's been raised is the noise that a handgun makes.
11:51None of the defendant's neighbors reported hearing any gunshots that night.
11:56Can you explain how that might be?
11:58Well, in my opinion, the most likely explanation would be that the gun had a suppressor attached.
12:04A silencer?
12:05Yes, but contrary to popular belief, it doesn't completely silence the shot.
12:10It reduces the noise level to 100, 110 decibels.
12:14For the jury's sake, can you give a comparison in terms of noise level?
12:18Roughly the same as the sound of a kitchen blender on high or the sound of a car motor starting,
12:24but only for a fraction of a second.
12:27So in your opinion, would it be possible that the defendant's neighbors might not have noticed such a noise?
12:32I'd say likely, especially if they were asleep or watching TV.
12:36I mean, that is the purpose of a suppressor after all.
12:40Of course.
12:41Nothing further.
12:45Good afternoon, Mr. Russo.
12:48I won't keep you long.
12:49Just a couple questions.
12:51You testified that a suppressed round would have a noise level of about 100 to 110 decibels, correct?
12:58That's right.
12:58And that, especially just for a second, it's likely the neighbors would not have noticed this noise?
13:03In my opinion, yes.
13:14Defense Exhibit B, Your Honor.
13:21Mr. Russo, this is a diagram of Mr. Haller's home.
13:25As you can see, his garage is right here, and his bedroom is all the way back here.
13:33It's a diagonal distance of approximately 78 feet.
13:36Now, you testified that the neighbors at a similar distance would not have noticed this noise.
13:42If Mr. Haller were asleep in this bedroom here, then I assume he also would not have heard the noise?
13:49Correct?
13:50Uh, well, I suppose it's plausible that he may not have heard the noise.
13:54No, but you said likely, not plausible.
13:58I mean, it's the purpose of a suppressor, right?
14:02It's not an exact science.
14:04We'll just answer the question, Mr. Russo.
14:06If someone was in Mr. Haller's garage and killed the victim using a suppressor, then according to you, Mr. Haller
14:13could have slept through the entire thing, correct?
14:19He could have, yes.
14:23Nothing further.
14:26Mr. Johnson, can you please tell the court what you do for a living?
14:30Private security.
14:31I currently patrol the businesses on West Adams Boulevard from Vermont to Western.
14:35Have you always worked in security?
14:37Sort of.
14:39I'm a retired New York City police officer.
14:41My wife and I, we moved to L.A.
14:43We have family here.
14:44Plus, the weather.
14:46I see.
14:47Now, let's go back to December 20th of last year.
14:51Can you tell us what alerted you to a crime in progress?
14:55Sure.
14:56I was in my patrol car.
14:57I heard what I believed to be two gunshots, one right after another.
15:00So what did you do?
15:01I got out of my vehicle.
15:02I was on Kenwood, south of Adams.
15:04I heard a third pop.
15:06I ran to the corner, didn't know where the shots were coming from.
15:09But I saw the door to the liquor store ajar.
15:13So I went in, and there was Gary laying on the floor.
15:17That's Gary Karpright, the victim.
15:18Yes.
15:20And what was Mr. Karpright's condition?
15:23Not good.
15:26He was, uh...
15:29He was, uh...
15:32Excuse me.
15:33I'm sorry.
15:36He was shot through the abdomen.
15:39There was blood everywhere.
15:41I tried to stop the bleeding.
15:44It was bad.
15:46The stock board was shot and said that 9-1-1 was on his way.
15:50So I tried my best to administer CPR, but...
15:53Was Mr. Karpright still conscious?
15:55Barely.
15:56I just kept telling him to keep holding on.
15:58You know, that the paramedics would be there soon.
15:59Was he able to say anything to you?
16:05Mr. Johnson.
16:08It's like I said, he was in shock.
16:10I don't know if he knew what was going on.
16:12I'll ask you again, Mr. Johnson.
16:14What did Mr. Karpright say?
16:18He said...
16:23Carter.
16:24At least, that's what it sounded like to me.
16:26Objection.
16:27Hearsay.
16:27It's a dying declaration.
16:29Except, according to the medical report, he wasn't declared dead until almost 40 minutes later.
16:33Then it's an excited utterance, which is also a hearsay exception.
16:37I think getting shot meets the bar for a startling event.
16:40Then it's irrelevant and more prejudicial than probative.
16:43Your Honor, it is not in dispute that my client had an argument with the victim shortly before the shooting.
16:47But the mere fact that he uttered my client's name should have no bearing.
16:51You gave it a good shot, Ms. Crane.
16:53But the testimony comes in.
17:03It just keeps getting worse.
17:05I got duped, Izzy.
17:07I felt sorry for Carter, but now I'm starting to think he didn't.
17:10Well, you still have to represent him, right?
17:14If we want to get paid, I do.
17:19Hey, Elle, this is something for Mickey's case I need to follow up on.
17:24But keep your chin up, okay?
17:38It's a little bit.
17:41It's a little bit.
17:43I don't see any other things.
17:45But here we go.
17:47I don't know.
17:47Jagger's here.
17:49He'll be next.
17:54Is the witness ready?
17:56Yep, good to go.
18:00Ahem.
18:00Ahem.
18:03As Burr.
18:04Yes, I'm good.
18:06Yes, Your Honor, the people call Jessica Westfeld to the stand.
18:12Remind me who Jessica Westfeld is.
18:13She was one of our interns.
18:15We were only for a few months. Lorna hired her.
18:17Anything to worry about?
18:20I don't think I ever talked to her.
18:26Miss Westfeld, can you please explain to the jury your relationship to the defendant?
18:30I was an intern at Mr. Holler's law firm for about three months.
18:34During your time there, did Mr. Holler's firm represent the victim in this case, Mr. Scales?
18:39Uh, yes. On a fraud case.
18:43Objection. May we approach?
18:50Judge, this line of questioning violates attorney Klein privilege.
18:53Mr. Scales may be deceased, but the details of his representation are still privileged and confidential.
18:58Privilege doesn't apply here, Your Honor.
19:00Ms. Westfeld will not be revealing any confidential details of Mr. Scales' representation.
19:06Her testimony concerns a statement against interest by the defendant.
19:10I'll allow it, but I will cut you off immediately if you stray into anything privileged, Ms. Burke.
19:27Thank you so much for meeting with me, Dr. Schultz.
19:30Not at all.
19:31I was intrigued when Keith reached out from the LA Times about your master's thesis.
19:35How many people care about biofuel?
19:38Wind and solar are the media stars of renewable energy.
19:43Biofuel is the weird cousin that doesn't smell so good.
19:50I once drove behind a converted biodiesel fuel car.
19:53It smelled like egg rolls.
19:54I wasn't so bad.
19:55And you're one of the lucky ones.
19:58So what can I do for you?
19:59I'm happy to help advance the cause of science or, you know, sane public policy.
20:05Dr. Schultz, I have to come clean.
20:09I'm not actually a grad student.
20:12I don't even go to UCLA.
20:14What?
20:14I lied to that reporter trying to get some information.
20:18I actually work for a lawyer.
20:21Lawyer?
20:21Look, I wouldn't blame you if you don't want to talk to me at all, but I really need your
20:29help.
20:31How did you come to be at the courthouse that day?
20:34Lorna called and asked me to come.
20:36One of her heels snapped off, and it turns out she kept an extra pair of shoes at the office.
20:41When I arrived, she was with Mr. Holler and Mr. Scales.
20:44Why was Mr. Scales there?
20:46He had just come out of a hearing.
20:47That was the fraud case that I mentioned earlier.
20:50He had been accused of embezzling money from a charity.
20:53Do you remember the outcome of that case?
20:58Well, the judge agreed to supervise probation, and all he has to do is pay all the money back.
21:02Which is not happening anytime soon.
21:04What are you talking about?
21:05Look, I have to pay way more to my last investor.
21:08If I don't pay them, I'm dead.
21:09No, no, no, Sam.
21:10If you don't pay us, you're dead.
21:13He threatened Sam Scales?
21:17Yes.
21:17And those were his exact words.
21:20If you don't pay us, you're dead?
21:22Yes.
21:23I remember because Mr. Holler was very angry, and it scared me.
21:28So you took his threat seriously?
21:30Yes.
21:31In fact, I stopped working there not long after that.
21:34I'm sure you did.
21:36Thank you, Ms. Westphal.
21:37No more questions, Your Honor.
21:40I'll take this.
21:41And don't look so mad.
21:43It's not playing.
21:55Good afternoon, Ms. Westphal.
21:58If you don't mind, I would like to ask you about what you heard.
22:02That phrase, you're dead.
22:04Have you ever heard that used as a figure of speech before?
22:08Like, maybe a big sister says it to her little sister when she's wearing her clothes, touch
22:12my stuff again, you're dead.
22:13I mean, sure, I've heard it before, but this just felt more, I don't know, real, I guess.
22:22Right, because you said Mr. Holler was, um, how'd you put it, angry?
22:27Yes.
22:27At least that's how he seemed to me anyway.
22:30And how would you describe your time working at Mr. Holler's firm?
22:34It was fine.
22:36Just fine?
22:38Were you treated well?
22:39I got along well with Lorna and the rest of the staff.
22:43But not Mr. Holler?
22:46I can't say I knew him very well.
22:48Did he ever take an interest in you?
22:50Try to mentor you?
22:51No.
22:52Uh, he was always very busy.
22:54Sometimes he even forgot my name.
22:56Actually, most of the time.
22:58Oh, well, that must have upset you, right?
23:03I mean, you intern at a law firm to learn from a great lawyer not to be ignored.
23:08Objection.
23:09Relevance?
23:10Overruled, but get to the point, Miss McPherson.
23:12Almost there, Your Honor.
23:13Tell me, Miss Westfeld, what is your current job status?
23:16I, uh, recently passed the bar, and I'm considering my options.
23:20So you're unemployed.
23:22Has your internship with Mr. Holler helped in any way with the job search?
23:25Uh, no.
23:27He's on trial for murder, so not the greatest reference.
23:30You mentioned that you left Mr. Holler's firm not long ago.
23:33You implied that you chose to leave.
23:36But tell us, Miss Westfeld, was your departure voluntary?
23:41Well, they were, they were having financial difficulties, so...
23:45In other words, you were fired.
23:46Isn't that right?
23:51Yes.
23:52So, given that he terminated your employment and hasn't helped with your future job prospects,
23:56isn't it true that you hold a grudge against Mr. Holler?
23:59I mean, no, it's not like that.
24:01You even misconstrued a common figure of speech, because it's you who was mad at him.
24:05Absolutely not.
24:06No, I would never...
24:08Are you testifying today in retaliation?
24:10Objection.
24:15I'll withdraw the question.
24:18Good luck with the job hunt, Miss Westfeld.
24:21Nothing further.
24:42I hope I did enough today.
24:44Are you kidding?
24:45So you don't want to be a defense lawyer?
24:47Huh.
24:49I still can't believe Burke didn't put Drucker on first.
24:52I think starting late really threw her off.
24:55There's no way Dana made a mistake on that.
24:57That had to be calculated.
24:59You think she saved Drucker for a reason?
25:02What, you worry she's got an October surprise?
25:04It's the only thing that makes sense.
25:06Well, if it's about the financial gain motive, we can destroy that on cross.
25:11It's, it's weak.
25:12And Dana knows it.
25:13That's why I'm worried.
25:15Any more skeletons in your closet I should know about?
25:19Disgruntled former employees?
25:22Clients you've threatened?
25:23Max, I had a bad day in court and I took it out on Sam.
25:26I don't go around threatening my clients.
25:28Well, you have to admit, you fly off the handle sometimes.
25:31No, that's not my best quality, but it doesn't make me a murderer.
25:35We just have to get the jury to see that, that's all.
25:40If only people would judge you for your taste in food.
25:43Where do you find these places?
25:45Well, when you work out of your car, you eat all over the city.
25:49This jerk chicken is unbelievable.
25:51Yeah.
25:52Can I have a bite before you eat it all?
25:53Hmm.
25:57You can have one and that's it.
26:00Just this tiny little piece.
26:02I'll meet you.
26:05That's it.
26:09I've never been a foodie like you and Hayley, but I really do miss those places we used to go
26:13to.
26:15You miss the food or my charming company?
26:24I assume Hayley's been sending you food pics from Mexico.
26:27Oh, my mother is spoiling her.
26:28She might not want to come back.
26:30She does.
26:32She wants to see you get through this nightmare.
26:38I don't know how I could do this without you, Maggie.
26:43Running out of ways to say thank you.
27:01You should, uh, probably take that.
27:05Yeah.
27:11Hey, even if Dana has a trick up her sleeve, I still think she's going to rest her case tomorrow.
27:16It's time to serve Alex Kazarian.
27:17Yeah, I'll take this discount.
28:13Room service.
28:14Room service.
28:19I think they're gone, sir.
28:27I think they're gone, sir.
29:00Okay, it's safe.
29:34And how long have you been in robbery homicide detective 14 years 14 years it's a long time
29:44and how many murders have you investigated in that time too many close to a hundred and in your
29:51extensive experience have you had a case where a murderer tried to use their vehicle to dispose of
29:56the body objection relevance it goes to support the police focus on the defendant your honor
30:04overruled detective yes I have several times it's not uncommon especially when the murder is
30:11premeditated why would that matter well in a crime of passion the killer hasn't thought it through but
30:17if somebody plans to kill someone like for money say well they usually try to figure out a way to
30:23cover their tracks huh let's talk about that then you mentioned money as a motive did there come a
30:30time when you began to suspect that money might have been the motive behind this murder yes that
30:35was one theory that we explored we had witness statements to the effect that there was tension
30:39with a defendant over unpaid bills and did you investigate this yes to begin with we conducted
30:46searches at mr holler's home and office and then also of his remote storage facility where he keeps old
30:53files and what did you find there as we expected we found bills indicating two hundred thousand dollars
30:59and overdue legal fees from the victim along with copies of bounced checks indicating that the victim
31:06had attempted to avoid payment we also found a letter threatening action if those bills were not paid
31:11promptly people's five your honor detective can you read the highlighted portion there sure from my prior
31:22representation of you i know that you keep a legal fund to pay your attorney's fees and i expect to
31:28be
31:28paid out of that fund immediately otherwise i will have no choice but to take serious further action
31:34using any means at my disposal this is your final warning there's no signature but the defendant's name
31:42is at the bottom and what did you take from this well that mr holler believed that mr scales
31:49has a stash of money set aside and he wanted it we also searched the court records and found that
31:55mr holler
31:56had filed for both civil judgments and an attorney's lien against mr scales so he also tried to file
32:03a judgment forcing mr scales to pay more than that the lien applied as well to mr scales estate his
32:11estate
32:11yes meaning that if mr scales were to die then whatever money that he wouldn't pay before
32:20the defendant could collect once he was dead
32:43that's the best time babe please tell me you served his area i kind of hit a little snag
32:48but uh nothing i can't fix cisco the whole point of you being there is to keep tabs on them
32:53well
32:53they must have caught my scent because they ditched the mercedes and took off in a rental to go where
33:00uh i think they're trying to go to mexico what cisco he cannot cross the border it's not gonna happen
33:06i
33:07promise i'll run them off the road before they do okay i have to go to my hearing but iceberg
33:12is making
33:12this financial game look better and better we need this guy cisco okay i gotta go baby
33:21thank you detective nothing further your honor
33:24watch examination no no i can nail him in the search of my files i was there i might stick
33:30to
33:30the facts i'll let him drag you into anything thank you your honor detective this letter from my office
33:37to mr scales demanding payment you said i never signed him correct that's right apparently it was
33:43drawn up by your office manager and that she also draw up the court filings you refer to for judgments
33:48and liens i'm not really sure but you have no evidence that i knew any of this do you other
33:53than
33:53the fact that we found the letter in your files no and you have no evidence that the letter was
33:57ever
33:57sent to mr scales isn't that correct yes that is correct it was just a standard letter asking for
34:03payment right objection beyond the scope of the witness's knowledge the letter speaks for itself
34:08mr holler sustained okay let's uh let's talk about how you found this letter how did you access my
34:14storage facility as i said we had a search warrant yes but how did you physically get there
34:21sir i don't understand isn't it true that i led you there i volunteered to escort you even though
34:26i had no obligation to help you isn't that right we followed you there yes oh it was more than
34:32that detective don't you remember i even pulled over in my car and waited for you when you got
34:37stuck at a light so you wouldn't get lost you accompanied us on the search of your storage
34:42facility yes and how did you access my facility because it was locked right your associate met us
34:48there with the keys and unlocked it and then she led you to the file cabinet and unlocked those as
34:53well didn't she yes sounds like my staff and i were pretty cooperative with your search wouldn't
34:59you agree you didn't obstruct us because we had nothing to hide objection counsel is testifying my
35:06apologies your honor first time being forced to represent myself withdrawn this statement now tell
35:12me something detective in your extensive experience is it unusual for an attorney to file a judgment or
35:19obtain a lien to collect unpaid legal fees i wouldn't know no just like any other business owner might do
35:25like a mechanics lien you didn't research that i did not would you think it was unusual objection calls
35:33for speculation sorry again your honor i'm just trying to understand this supposed motive now when
35:39you were searching my files detected did you even bother to look for my tax returns so you could see
35:43whether or not i wrote off the unpaid bills as a loss no i didn't take any tax returns you
35:48didn't
35:49so you mean to tell us you spent hours searching my home my office my facilities you went through court
35:56records and anything else you can think of and in the end all you found was a letter i didn't
36:01even sign
36:01and a judgment and any business owner would get no
36:08that's not all we found actually
36:13you know well that's all you presented detective nothing further your honor but we reserve the
36:18right to recall this witness at a later time redirect your honor
36:26so detective you just mentioned that you found something more in your search can you talk about
36:33that yes we didn't confine our search just to paper files on the defendant's email server we found an
36:40email from a fraudulent charity set up by mr scales an email yes it seems that mr scales set up
36:48a
36:48phony fundraising drive to help migrants from latin america it was the kind of scan that was right
36:55in his wheelhouse objection your honor we have received no copy of any such email that's because
37:00the analysis of the defendant's computer was just completed that's why we didn't present the evidence
37:06in our direct examination but the defendant's question clearly opened the door and i have a copy of
37:13the email here for defense counsel i'll allow it but i'm going to construe this narrowly miss berg
37:22understood your honor i've never seen this before in my life so detective this email you found
37:30why did it seem important well the email was sent to a mailing list of a legitimate charity called
37:37fuertes unidos they helped provide legal aid for migrant workers in fact mr holler had donated his
37:43time to the organization in the past and mr scales was using the name of this organization to try and
37:50scam
37:50people into sending him money even worse he was using the defendant's name and likeness as well
37:57you mean he made it seem like mr holler was endorsing this phony fundraising appeal that's right
38:05obviously this could cause harm to the defendant's reputation or even potential liability it seemed
38:11clear to me that if the defendant were aware of this he would be furious about it and then objection
38:16speculation sustained the witness will only testify to facts and evidence is that understood yes your
38:24honor allow me to rephrase detective did you find any evidence that the defendant was aware of this
38:32email well as i said we found the email itself on the defendant's server he was a part of the
38:38mailing list
38:39it was in his junk folder but we had no way to know if it was sent there directly or
38:45if he had read it
38:46and then moved it there himself now detective you testified as to a possible financial motive for
38:52this murder does this email support that motive it's impossible to say but in my experience
39:01murders can have multiple motives imagine a man hates his wife and he stands to collect life insurance if
39:09she dies people often kill for more than one reason
39:12murders can have multiple motives due to have more of a
39:27murder caniar jargon die فقط
39:39she's here
39:47you saw the shooter yes just for a second before i ran back to the stock room what happened that
39:53i heard a gunshot i think he was taking out the security camera then i heard him yell give me
39:57all
39:58the fucking money and then i think gary shot back and then it sounded like a gun jammed
40:03and there was one more shot that was it did the shooter flee after that yeah i ran out i
40:09saw gary
40:10lying there it was so much blood i called 9-1-1 right away just to be clear mr harrison
40:17you were
40:18sure that the man with the gun that day was carter gates it was him yes
40:29thank you no further questions miss crane thank you your honor
40:39okay let me just make sure i have this straight mr harrison carter and gary had a huge fight
40:45correct yes and then carter took off and a few minutes later he came back into his own store
40:52with a mask on and a gun and demanded his own money doesn't that seem a little weird i guess
41:01he wanted it to look like a robbery you know that's why he shot off the security camera and
41:04you are sure that it was carter i mean yeah i'm pretty sure pretty sure i'm sure i know what
41:12i saw
41:12even though he had a black stocking over his head and you admitted that you only saw him for a
41:17second
41:17i know what i heard too it was his voice mr harrison do you know what confirmation bias is
41:27uh no it means that sometimes what you expected to happen affects your impression of what actually
41:34happened in this case maybe what you think you heard is really just what you expected to hear
41:40objection beyond the scope i'm just asking the witness for his own impressions your honor
41:46overruled the witness may answer tread carefully miss crane
41:53i i don't follow you gary and carter had a huge fight you were worried it might get violent so
41:58when someone came back in with a gun you just assumed it was carter no no that's not what i
42:03saw
42:04no you never saw the gunman's face do you even know if he was wearing the same clothes as carter
42:08well i don't know what carter was wearing but i exactly because you were in the stock room when
42:13they were fighting but it was his voice were you aware that carter had a criminal record
42:18i mean he mentioned it once it wasn't like he was trying to hide it did that scare you i
42:23don't know
42:23i just figured he came from a rough background i guess the kind where maybe you thought he was
42:29capable of violence i mean you knew he had a record you knew he was really mad and you were
42:35afraid of
42:36violence isn't it possible that you put all that together in your head and your brain just told you
42:40oh my god it's carter with a gun i don't know you don't know i don't i don't know i
42:45mean yeah sure sure
42:46i mean anything's possible right right thank you mr harrison
42:56so
43:03so
43:07Let's go.
43:36Let's go.
44:31Let's go.
44:35Let's go.
44:36Let's go.
44:36Let's go.
44:37Let's go.
44:43Let's go.
44:51Alex.
44:52No need to get violent.
44:59You scared the shit out of me.
45:02Oh.
45:04Who the hell...
45:06Wait, I know you.
45:07We have men, yes.
45:10This is for you.
45:11You've been served.
45:15Couldn't run from me forever.
45:18You think I care about a fucking subpoena?
45:25Give me a heart.
45:26It worked.
45:52Thanks again.
45:55Hey.
45:56I was just about to call you.
45:57I think we may have caught a break.
45:58What kind of break?
45:59In Mickey's case.
46:00Remember that scientist I was trying to track down?
46:02The EPA specialist from the LA Times article?
46:05Mm-hmm.
46:05I talked to him yesterday.
46:07He just called back and said he'd be willing to testify about the Biocrine scam.
46:11That is good news.
46:13What's wrong?
46:15Were you able to knock out the Rashad testimony?
46:17I think so.
46:18But it's not gonna be enough.
46:20You saw what happened.
46:21The security guard said the victim named my client right before he died.
46:25Sorry, Elle.
46:28I mean, Carter's pretty unlucky.
46:30The dead guy lives just long enough to ID him.
46:33What are the chances?
46:42Uh...
46:45What are the chances?
46:48Uh...
46:49I think we may have just caught a break.
46:52Uh-huh.
46:53That's what I said.
46:56Hey.
46:58It's Lorna.
46:59Yes, it's so good to hear your voice, too.
47:02Listen, I was wondering if you could just look through something for me.
47:06I promise it'll be quick.
47:15Well, at least we know what the October surprise was.
47:17What a load of bullshit, and the jury bought it, too.
47:20Isn't it your fault?
47:21No, it is my fault, Maggie.
47:23She laid a trap, and I stepped right into it.
47:26Exactly what you told me not to do.
47:28Well, there's nothing we can do about it now.
47:30You did a great job knocking down the financial gain motive.
47:34I never even knew you could deduct unpaid legal fees on your taxes.
47:37Well, it's because you can't.
47:39What?
47:40Well, you work for the government, so you wouldn't know.
47:43But if a client doesn't pay you, you just have to eat the loss.
47:47I never said you could.
47:48I just asked if you checked my returns.
47:51You bluffed.
47:53Right.
47:53Welcome to defense work.
47:56Mm-hmm.
48:00Some good news, at least.
48:05Okay.
48:31Okay.
48:32Great.
48:33So just let me know what you find.
48:35Bye.
48:35Bye.
48:39You think it'll work?
48:40It's worth a shot, right?
48:43Yep.
48:46Hey, hon, you get it done?
48:48Yeah, but I don't know.
48:50What?
48:52Something doesn't add up.
48:54I've been chasing this guy everywhere.
48:56When I finally serve him, he barely raises an eyebrow.
49:00So?
49:01Maybe he's just mellowed out since the last time you served him.
49:03No.
49:04He's not worried about us.
49:06Feels like there's something else.
49:08How'd you get past the two bodyguards?
49:10That's the thing.
49:11I haven't seen those two goons this whole time.
49:14Until just now, they can't.
49:18Holy shit.
49:19He wasn't worried about us.
49:21He was worried about them.
49:36Sister, what happened?
49:39We got a problem.
50:14Of course.
50:36He'd probably not.
