18:56were responsible
18:57for the road rage attack.
18:58They investigated the motorcycle.
19:03So when the bike was recovered,
19:05we did some checks on it
19:06because it didn't have
19:07any number plates.
19:08So what we do is
19:09we check the VIN number
19:10and any other numbers
19:11that are associated with it
19:12to find out the actual
19:13true identity of that motorbike.
19:18Once that was completed,
19:19that came back
19:20as a stolen motorbike
19:21from the Manchester area.
19:22and that was stolen
19:25some months earlier.
19:26So the likelihood is
19:28that motorbike
19:29could have passed hands
19:30a number of times
19:31through different criminals
19:32or it could have been used
19:33as what we call
19:34a pull vehicle.
19:35So different criminals
19:36will use it
19:37at different times
19:38so that they can change
19:39their vehicles
19:40on a regular basis.
19:41The discovery suggested
19:46a more organised nature
19:47to their offending.
19:54Detectives also recovered
19:55and examined doorbell footage
19:56of the road rage incident.
19:58So that was them
20:01that just went past.
20:04This car here now
20:05is the victim's car.
20:10So the passenger gets out
20:11and sort of challenges them
20:13for driving like maniacs
20:15through the street.
20:16And that was the bus
20:17trying to get past.
20:18And then they drive off.
20:25The doorbell footage
20:26captured the moment
20:27the motorist's window
20:28was smashed.

20:40what the suspects
20:41were wearing.

20:46caused the damage
20:47has got this distinctive
20:48light-coloured sort of
20:50patch across the top

20:54of his jacket as well.
20:57When you then compare that
20:58to the M-Pass footage.

21:04we know that Fagan
21:05was the rider,
21:06the driver of the bike.

21:10clothing.

21:12the patch is identical.
21:13We know from the fact that
21:17they've been on camera
21:18for over an hour
21:19that they haven't
21:20swapped clothes or anything.
21:22The person that's caused
21:23that damage there
21:24is Fagan.

21:27stood in the background.
21:30So Fagan had the implementer
21:31smashed the back window
21:32of the car as well.
21:33If they were both wearing black
21:34it would have been really
21:35difficult.
21:36But because he's got that
21:37distinctive jacket on
21:38that's really helped us.
21:39The evidence pointed to Fagan
21:40being responsible for the
21:41attack on the motorist.

27:01The caller not only claimed Fagan was responsible for the
27:30attack, but also other criminal activities.
27:35The victim had told us that Fagan was a drug dealer
27:38and that he had a drug debt to Fagan.
27:41However, just that information isn't enough for us
27:44to make a charge for a drug offence.
27:47So it's important for the police to make sure that we
27:49gather as much evidence as we can to show that Fagan
27:53is dealing drugs.
27:55When officers conducted door-to-door inquiries,
28:03they recovered doorbell footage.
28:06CCTV is pretty much as good as having an eyewitness.
28:11And sometimes it's even better because eyewitnesses,
28:13sometimes the events can be distorted and what they
28:16remember about the events.
28:17But if you've got it on CCTV, it's very much can't be disputed.
28:21Especially if it's as clear CCTV with distinctive clothing.
28:26It's really good evidence that we can use in court.
28:30The CCTV showed the victim speaking to his assailant
28:34moments before the attack.
28:36So that's just before the incident has happened,
28:54before the assault has happened, because the victim goes down
28:59the alleyway and then they meet him the other side.

29:03He says his name twice.
29:09So there he says, Fagan, the money will be there tomorrow,
29:11I swear down, all right?
29:13Fagan's on the motorbike, or on a motorbike,
29:16and he's wearing the same jacket again,
29:19the distinctive thing across the shoulders.
29:22Police also retrieved the bag discarded by Mitchell at the time
29:36of his arrest.
29:41That bag there on the screen is this bag here that we've seized.

29:48so that is where we've seized this bag from.

29:56And there was a knife used in the earlier incident

30:10There's another bag here which did have cannabis in it.
30:20And there was also Mitchell's bank cards in the bag as well.
30:25When you recover evidence, like we did out of the bag,
30:30which is the wraps of drugs, a knife,
30:33my first thought is that is a drug dealer.
30:37Sometimes they'll have weapons because it may be
30:39that other drug dealers might take umbrage
30:41to the fact that they're dealing on their patch.
30:43Or there may be other drug users who try and take those drugs from them,
30:47so they have weapons to protect themselves and to threaten other people.
30:50And then obviously the drugs themselves which they're using to sell
30:54and to make money.
31:00The development brought the police one step closer
31:03to being able to charge Fagan and Mitchell with drug offences.
31:07We were originally investigating an assault
31:10and a public order offence of criminal damage.
31:13Once they'd been detained and we were able to recover the extra evidence,
31:17we knew straight away that it would be important
31:20to try and get them charged with the possession
31:22with intense supply offence.
31:24In situations like this where they've been causing
31:28so much harm to members of the public,
31:30it's important to try and take them off the streets
31:32for as long as we can.
31:34Possession with intent to supply carries a maximum sentence
31:42of life imprisonment.
31:45We have to be able to prove to a jury
31:47that that person had those drugs not just for their own use
31:50but to sell on to other people.
31:55The contents of the bag were sent for analysis,
31:57along with two mobile phones seized from the suspects.
32:01Because it's really difficult sometimes to tie what's in that bag
32:05to the person that we've taken it from.
32:07We need to have forensic evidence,
32:09that could be fingerprints or DNA.
32:11Would the forensics prove their involvement,
32:15or were detectives forced to release them?
32:19Two suspects, Jake Fagan and Connor Mitchell,
32:37were arrested by Cheshire police on suspicion of multiple crimes.
32:41Fagan's taken a knife and used it as a threat,
32:47and then smashed the car window.
32:49We really wanted to remand them in custody.
32:51Detectives pursued charges for serious assault,
32:55driving offences, criminal damage and drug dealing.
32:59There's enough bags there to show that it was for supply.
33:04Onwards, it's not going to be for personal use.
33:06We knew straight away that it would be important
33:09to try and get them charged with the possession
33:11with intense supply offence
33:13and take them off the streets for as long as we can.
33:15With only hours to go before they were due to be released,
33:22the detectives finally had enough evidence
33:25to challenge them in interview.

33:36Jake Fagan was first asked about the road rage incident
33:40that led to the pursuit.
33:42So, what can you tell me about an incident that happened yesterday?
33:47Well, that was just before you were arrested.
33:49So there's been a bit of a road rage incident.
33:53What can you tell me about that?
33:55Were you involved in that incident?
34:04When he didn't respond,
34:06they moved on to the assault that happened a few days earlier.
34:10My colleague's going to show you have some ring doorbell from the edge.
34:19Are you one of the males on the motorbikes?
34:27Do you recognise the male just here?

34:30Are you responsible for assaulting this male?
34:46Next, they asked about the discarded bag.
34:48In that bag was a number of quite large wraps of white powder.
34:57What can you tell me about them?
35:04Testing and things like that, forensic testing,
35:06is ongoing as we speak.
35:07We've got our drugs experts having a look at that, OK?
35:10Do they belong to you?
35:17Fagan continued to remain silent.
35:19So that blade, that knife was inside the bag with the drugs and with the money.

35:44Over the course of the hour-long interview, Jake Fagan refused to answer the questions.
35:58But would Connor Mitchell offer any explanation?
36:01What can you tell me, then, about this incident that happened yesterday?
36:04I was just out chilling, minding me own business.
36:09Well, I met a couple of friends that mentioned names.
36:12A few of them, about five or ten.
36:15The helicopter started following us.
36:17Chased us around, that's it, really.
36:18Like, you know what I mean?
36:19Just, that's it.
36:21I don't know the person on the bike.
36:23I got thrown a bag off one of the kids.
36:26I put the bag round my neck, you know what I mean?
36:28So the helicopter's rocked up, you've jumped on the back of the bike,
36:32and someone's chucked a bag at you.
36:33Like, literally, the helicopter was coming.
36:36He threw me the bag.
36:37I said, Sam, I'm not mentioning my names.
36:40Honestly, all I remember me doing is pulling my bag part out of my pocket
36:43and my phone trying to stuff them in.
36:45And my phone wouldn't stuff in.
36:47So I left my phone and put my phone back in my pocket.
36:50Police following you and your mate on the bike.
36:53I don't know the bike.

39:39Following the interviews, detectives decided to approach the CPS for a charging decision.
39:44They agreed to charge Fagan with the earlier serious assault and dangerous driving.
39:53And both men, with possessing a bladed article, the road rage incident and possession with intent to supply.
40:00Sometimes they wait until you've got the forensic evidence, but on this occasion, based on the weight of the evidence that we had managed to capture,
40:09CPS were happy to authorise the possession with intent to supply a charge straight away.
40:14Fagan and Mitchell were remanded into custody, awaiting trial.
40:29Whilst they were on remand, detectives received the results of the forensic and digital analysis.
40:35To prove to a jury that that person had those drugs to sell on to other people.
40:41We look for DNA evidence where the wraps of drugs have been tied,
40:44and that proves that the person who's tied those bags is making those individual deals to sell on.
40:52And also, what's on their mobile phone, you'll have messages offering to sell it to other people
40:56and making arrangements for that sale to take place.
40:59So, the forensics from the wraps of white powder from the bag, the white powder was confirmed that it's cocaine.
41:09And testing from the swabs that were taken from the actual knot of the wrap,
41:17both Fagan's and Mitchell's DNA comes back as being present in the knots to say that they've actually tied them.
41:25The forensics contradicted the claims Mitchell made in interview.
41:32We can say that it was cocaine.
41:35We can say that they've both been involved in the preparation of that cocaine to sell on.
41:40Jake Fagan's DNA was on the handle of the knife, and also his blood is present on the handle of the knife as well.
41:49This is some messages from Fagan's phone.
41:54So, these are messages that he sent out, saying anyone for peddler work.
42:01If they drive, it's even better.
42:03This is into like a group chat.
42:05In this same group chat, he's sending them addresses.
42:09Fagan's messaging to say peddler work, so people on bikes to go distribute drugs for him.
42:14He was involved in the drug dealing, and he's fairly high up.
42:20So, this is a video from Fagan's phone, and it's just a video of loads of cash on the floor.
42:30There's a message on Mitchell's phone where he's messaged someone else to say,
42:36is this whoever, and then saying, it's F's runner.
42:41He's dealing for Fagan there.
42:44So, basically, Fagan's employing him as his runner.
42:50On Mitchell's phone, he's actually recorded himself with the helicopter in the background as they're making off on the police.
42:57He thought they weren't going to get caught, and then he'd send it to all his mates to show how he got away from the police on a motorbike.
43:09And it just shows how reckless they were.
43:10The forensic download of the phone, coupled with the forensic results from the drugs that were in the bag,
43:21they were both involved in preparing those bags for onward sale of the Class A drugs,
43:27so it's really, really strong evidence.

44:20To get Fagan and Mitchell off the streets and in prison,
44:22it's going to keep the residents of Cheshire a lot, lot safer
44:25lot safer because they're habitual weapons carriers and they won't think twice about
44:31using violence. They're not going to be able to go out the streets to deal drugs, to intimidate
44:36people, to offer violence. It was really good for us to be able to get the evidence to put
44:43them in prison for a long time.
