01:21you paid the plaintiff your portion of the music festival in cash.
01:26You wrote a check to the festival promoters, and it was a disaster,
01:30because the night before, the festival was canceled.
01:34So that is the mess that the two of you found yourselves in.

01:38But the hotel offered discounted rooms,
01:42since it seems like you all really got short shrift by this original promoter.
01:47So you decide you are going to take the trip.

01:50Because that trip, too, was a disaster,
01:52and that's why the two of you are in court today.

01:55Ms. Johnson, you are suing the defendant for $1,035.
01:59You say that she didn't pay for her half of the hotel,

02:04you loaned her some money because she didn't have spending money on the trip,
02:07and then you further allege that she actually stole money from you.

02:12Ms. Baldwin, you say that you had no obligation to repay some of these funds
02:17because the core part of your defense is that you'd already paid her for the festival.

02:29And then you would pay her for trip number two, the makeup trip,

02:35Let's talk about what happens after you decide to take the trip.

02:41Well, I called her once because I got the emails on the canceled trip,
02:46and I called her and said they've canceled the trip on us at the last minute,
02:50and we've already paid for our airline tickets and everything,
02:54but they weren't giving us any reasons or talking about giving us our money back.
02:59So I called down to the Hard Rock, and they offered us to come down at a lower rate
03:04because they said it was a lot of people in the same, and they had booked out the whole...
03:08And they were trying to accommodate these festival doors.
03:09Yeah, and they were really nice about it.
03:11And so I called Debbie, and I said,
03:13Look, they're offering us to come down, and it's like a little over $700 or so apiece
03:18by the time all the fees are added in.
03:20And she said she still wanted to go.
03:22I said, Well, what I'll do is I'll go ahead and I'll prepay,
03:27but you have to pay me back just like you paid on the other trip like you did.
03:31You can pay me in increments.
03:34So I said, Okay.
03:35Ms. Baldwin, I would like you to tell the court what was your understanding
03:40of how you were going to fulfill your payment obligation.
03:42First off, I thought she put the first trip on her credit card.
03:46That's what she was telling me because we're supposed to pay insurance on the credit card.
03:50So I'm thinking we'll get something back off our first trip that we paid for.
03:54And I'm thinking that will cover my...
03:57So you're thinking that she's going to get some money back by disputing that horrible experience
04:04that you were going to get your portion back, and then you would apply that toward the second part of
04:09the trip.

05:14Because I think the most serious allegation is that you claim she stole from you.
05:19Now, why would she steal from you?
05:21Because she kept trying to borrow money, and I refused to give her any money because she
05:25kept going.
05:26She went to the casino with the first money I gave her, and I told her not to do that
05:30because stuff had to be paid for.
05:31And if you're on a trip with no money, why would you go to the casino and spend the money
05:36that somebody gave you?

05:41I'm also going to tell you, candidly, Ms. Johnson, your evidence of the theft is that
05:45she said she had no money, and then she had some money.
05:48That's not the strongest case of theft.
05:50And now what really seems to be animating your lawsuit and your anger is something you said
05:55in your complaint, that you were diagnosed with kidney cancer, and you said what hurt me
06:01was that Debbie never, all in caps, never came to check on me while I was in the hospital.

06:08This was my friend of 30 years.
06:10I would have been there for her.
06:12When my health recovered, our friendship just wasn't the same.

10:48And you went there to file a small claims action, correct?
10:51And you did that against your friend of 30-plus years, right?
10:56You put in that form the truth that she stole from you.

15:43I'm the president and CEO of the Better Business Bureau of Los Angeles with about 24 million consumers in our
15:50area, about 470,000 businesses.
15:54Our BBB gets 1,100 consumer complaints per day, every day.
15:59Are you familiar with the music festival put on by Music Getaways?
16:02Oh, yeah.
16:04We have hundreds of phone calls came pouring in after the cancellation, and a lot of people lost thousands of
16:11dollars needlessly.
16:12Are you aware of any of those complaints being resolved?
16:16Did anybody get redress?
16:18We don't have any evidence at all of anybody getting any refunds, a transfer of that credit over to a
16:26new venue for a subsequent event.
16:29And incidentally, we don't also see anybody getting back to us that got refunds from their credit cards.
16:37So just because you pay on a credit card, which is advised, by the way, that's not necessarily a guarantee
16:43that you're going to get a refund.
16:44But it sure increases your chances, especially for domestic purchases.

17:20And you, ma'am, Ms. Johnson, you just told me, I want to make sure this is clear before I
17:24go back and deliberate with my colleagues, that you intended at first to pay the fee to the Music Fest
17:31people with your credit card, but only then, afterwards, sent a check because they gave you a discount.

17:55I have a sense that Adam is suspicious about some of the plaintiff's evidence, but I'll let you speak to
18:01that.
18:01I don't think that there is any evidence that the defendant stole money from her purse.
18:06I think it was a great point you made that if she was really concerned about a theft, that would
18:10have been in the complaint.
18:12But even if she had put it in that initial complaint, I just don't think that because somebody shows up
18:17with some balled-up money that that is at all, to me, dispositive of theft.
18:22With respect to the tips, one of you, I think it was you, Patricia, you said you didn't find the
18:27defendant credible because, remember, during her testimony, she said—
18:30Oh, I gave tips, too.
18:31In her answer, she said there was no obligation for me to pay back the tip.
18:35Now, I don't think she was credible, but I'm just not sure that there was an expectation of repayment for
18:40that amount.
18:41Where I am, I think, with you, Adam, I think there's some confusion about the numbers.
18:45I don't know about all of these international fees that were paid back and forth.
18:49I'm willing to reimburse her half of the hotel bill.
18:51Okay, so I'm with you on the tips and those extras.
18:53There was no evidence in there that when she gave this money over, especially knowing that she allegedly came on
18:59the trip with no money, that she was expecting repayment.
19:02So as to that, I'm not going to give her anything.
19:04I do think she was confused.
19:06The two sums of money, she lent her $75,000, and then she asked her for another $75,000, and
19:12she didn't want to give her that other $75,000 because she was going to the casino, which I also
19:16believe that she did do and then subsequently wasn't sure she did or not.
19:20But it was after that second $75,000 that she refused to give her, that she believes that she went
19:26in her pocket or wallet and took the money.
19:29I think it's all convoluted as well.
19:31With regard to the $700 for the trip, I think the plaintiff really did want to see something, and I'm
19:37inclined to give her that additional $700 that she put out for them to go on the trip and not
19:43take a big hit, just take a smaller hit.
19:46So that's where I am on this.
19:48I think the $50, even though money-wise, amount-wise, it's not a big deal, and the complaint, the plaintiff
19:55said how hurt she was and how upset she was that she took that money, and the fact that you
19:59omitted that important information from a prior sworn document does not bode well for your credibility.
20:05That's how I started this off.
20:06And then we go to the plaintiff's complaint about how much were the rooms.
20:10She could not have been any more clear.
20:12The plaintiff is suing for $1,035.
20:15Correct.
20:15Second trip, that money is made up of $700 that the plaintiff says the defendant owes her for a hotel
20:23room that the evidence that the plaintiff herself provided us with only cost her $1,100, not $1,400.
20:31That's a major oversight, and the explanation that there were fees that the Dominican Republic charge fell to me on
20:37deaf ears.
20:38So we know that she fails to meet her burden with respect to that $700, the one-half cost of
20:43the room.
20:44But what the defendant was saying is, she put the first trip on a credit card.
20:49That's what she told me.
20:50And then the plaintiff decides, wait a minute.
20:53They tell me that I'm going to get a discount if I pay by cash or by check.
20:59I'm just going to write a check.
21:01That's what the plaintiff told us she did.
21:03Well, the defendant says, she never told me that I was getting a discount.
21:07The reason that I gave her the cash was because she was paying with a credit card, and with a
21:11credit card, we get protections.
21:13But the evidence in this record is that even people who paid with credit cards didn't necessarily—
21:18Correct.
21:18They weren't reimbursed.
21:19But I sort of reflexively had a much more innocuous explanation in my head for why she went from credit
21:26card to check, because this promoter was doing what a lot of people do, which is what—like, I just had
21:33to deal with this with a business yesterday.
21:35She went to go do it however, and then they were like, credit cards, we add 3%.
21:40And she said, heck no.
21:42And then maybe at the time, it just didn't seem like a material distinction.
21:45Well, I went to where you were with that, because if there was reimbursement, then she would have been in
21:50a bad place.
21:50But that's not where we are in this case.
21:52We don't know that.
21:53And I don't want—but we do know it because nobody—we had an expert who came in here and said no
21:57one got anything back.
21:58He has no direct knowledge how many people got refunds, who got refunds, credit cards, or what have you.
22:03He said, generally speaking, and whether or not the plaintiff decided to write a check because she didn't want to
22:09pay a 2% fee or a special discount that they gave, what her decision, unilateral decision cost, theoretically to
22:17the defendant, was half of her cash.
22:19I just don't—with the initial premise, which is that paying by credit card was a material term of the deal.
22:26Because I think you fed her that information.
22:28I don't think they put—I don't either.

22:31They're not thinking about what's going to happen if they cancel on us the night before.
