00:10a farmer is found shot to death in what appears to be a planned hit I didn't know the smell
00:18of
00:18gunpowder in your house and that's a smell I will never forget he had extensive trauma to
00:26the left and middle of his face there was a perfect angle from the front porch down to the couch
00:34in the
00:34basement we also found tracks around the house it truly was as much of a hit as I have ever
00:43seen
00:44but in this small Midwest town anyone could be the wolf in sheep's clothing
00:49the investigation reveals a toxic family dynamic and the measures one person would take to conceal
01:10their misdeeds he had been threatening to turn them in for welfare fraud two days before the
01:19homicide he was texting I promise you he will not make it till Monday morning
01:48March 10th 2014 it's just after midnight in
01:53Barron Wisconsin when police receive an urgent 911 call Tiffany Workman called 911 reporting her
02:03boyfriend Daniel Raven had injuries to his shoulder
02:12I remember talking to the emergency lady and she said does he have a heartbeat and I remember putting
02:19my cheek on his forehead and I couldn't feel anything I said he was still warm
02:40our dispatchers immediately sent an ambulance but also officers because the caller was very hysterical
02:47at the time Tiffany tells the deputy she and Dan had an argument that night so he'd gone to sleep
02:55on the couch in their game room
03:01a short while later she was awakened by a loud noise I remember hearing a slam and I walked out
03:10and the glass on the screen door was broke
03:15she said why is there blood everywhere she went downstairs and saw Mr. Raven on the couch and
03:23when she approached him she could see that there was definitely something wrong with him
03:27I'm not a hunter I didn't know the smell of gunpowder in your house and that's a smell I will
03:35never forget
03:41the deputy escorts EMTs inside where they find a bloody scene the first responder determined immediately that Dan Raven was
03:53deceased it was obvious that he had extensive trauma to his upper left bicep and there were also significant injuries
04:03to his face
04:05several more deputies are dispatched to secure the area
04:13on the ground outside the broken glass doors they find two empty shell casings
04:19the spent rounds were obviously from a long rifle versus a pistol or a shotgun
04:27we knew with the casings outside and the victim downstairs it was going to be a homicide investigation
04:35I didn't realize that he was actually dead I didn't know I was under the impression that you guys are
04:44here to help him
04:44you're gonna get him out of here and you're gonna save him and he's gonna be fine
04:54Daniel Raven had lived nearly his entire life in rural Wisconsin
05:00he was born February 16th 1981 the youngest of three children raised on a dairy farm
05:07we were all close we had lots of friends lots of family
05:12we spent many hours in our barn just working playing we'd go camping we'd go fishing we'd play out in
05:21the pasture
05:22we lived on a farm so you made up your own fun
05:26Dan's dad was a hard worker he instilled that in Dan because Dan was an extremely hard worker as well
05:33Dan's first job I believe he was a sophomore in high school and he worked as a dairy's aide
05:40basically milking milking cows
05:47between work and his studies Dan was extremely busy
05:52but he made time for a beautiful young woman named Trista Rayback
05:58like Dan she'd grown up in the area in a close-knit family
06:02Trista was in our social circle in high school
06:06and that's how we all kind of started hanging out together
06:10they eventually started dating
06:13they would go hiking and four wheeling and just they loved to be together
06:19she just had a way about her
06:22she could she could get anything she wanted
06:27a few years later Trista announced that she was pregnant
06:32he was surprised and and very happy his daughter was actually born a couple months before my oldest daughter
06:40and a couple years later then come little boy and Dan was happy he was very happy
06:51after seven years together and two children Dan and Trista decided to make it official in 2005
07:01when I heard they were getting married I went up to Dan and asked him are you sure
07:07from what Dan told me they fought quite a bit and argued and he said yeah I you know wanted
07:13to start a family
07:14but you know he already had kids with her
07:17Dan loved his kids he he would take them hunting and fishing and tried to spend as much time as
07:24he could with them
07:26a few years later Dan and Trista embarked on a new venture together
07:32running a cafe within the local livestock auction building
07:37it was uh the the restaurant's uh bullwhip cafe at the uh sales barn in uh baron wisconsin
07:45i believe they got it from her parents or her mother had ran it and they did good there for
07:52a while
07:58now in their early 30s the stress of running a restaurant and raising a family took a toll on Dan
08:06and Trista's marriage
08:08there were many times he would call upset or i could tell he was upset because he'd struggle
08:16most married people do they all have their their problems but the more he tried the more difficult
08:24everything became it just it wasn't working
08:30them fighting not seeing each other making amends getting back together it was just a cycle off and on
08:39i thought that that was the final straw and Dan would finally be like this this woman doesn't love me
08:44he wasn't happy and then he moved out he got his own place after eight years as a married couple
08:54Dan and Trista divorced in 2013.
09:02they shared custody of their children but Dan was saddened by the limited time he got to spend with
09:08them Dan managed the turkey barns he was up from sun up to sun down that farm was all he
09:15ever did he
09:16didn't get a chance to do a whole lot because he was always at the farm he went through uh
09:22a period of
09:24depression then he went to a period of you know drinking kind of heavily um towards the end of it
09:32but
09:34he was sad about the whole thing
09:40dan's life seemed to take a turn for the better when he met tiffany workman
09:46i met dan through work um we kind of built a friendship through there he kind of grew up in
09:52a
09:53kind of a similar farm background life we just kind of hit it off
09:57when he met tiffany it was nice to see him uh feeling good and you know just being happy with
10:05life
10:06like dan tiffany was divorced with two children of her own
10:13they moved into a house together on the farm where they worked
10:17he was always equal with my kids just the same as he was with his and i think that was
10:22amazing
10:22we kind of blended really well she was doing wonders on him because he was so happy and
10:28i don't know he just seemed to be back in his groove the storm was over
10:39but tiffany has just found dan shot to death and detectives are analyzing the scene to determine what
10:46happened there was a perfect angle from the front porch that you could see down to the couch in the
10:55basement somebody walked up to the outside of the door did not attempt to make entry fired two rounds
11:03through the door making what would be perfect shots at a victim lying defenseless
11:13we also found tracks leading up from the roadway and around the house where the person appeared to be
11:20trying to observe the residence before moving into position and making the shots
11:26it also showed us that the person parked out on the roadway and walked up along a tree line to
11:35conceal their
11:42identity after inspection of the house uh it was our belief there was some sort of connection between
11:47the shooter and the victim it wasn't random it truly was as much of a hit as i have ever
11:54seen
11:55tiffany was the first one on scene the only one awake in the residence
12:06they bring tiffany to the station for further questioning they started asking me all questions
12:13like what happened what did what did you do and it's like what did i do i didn't i didn't
12:20even know
12:20what's going on i informed her that dan was in fact deceased where she began sobbing and crying and
12:30became very emotional and it was quite apparent she was not aware that he had passed away
12:38i just wish this was a dream sometimes people can be pretty good actors but in her case she was
12:45really distraught and based on her reaction to what happened it really didn't seem like
12:50she was the person who was involved or had anything to do with it but she never really know
12:58coming up police question tiffany about the events leading up to dan's murder who do you think is
13:07capable of this and evidence surfaces of a scheme at play shortly before he got killed
13:17dan showed me a stack of papers about this thick that he had on her
13:39the baron county sheriff's department is investigating the murder of 33 year old turkey farmer daniel raven
13:47with his girlfriend tiffany ruled out as a suspect they hope she can offer further leads
13:57they ask her to describe what happened the evening before the shooting
14:04tiffany said on sunday evening around 6 30 7 pm she had picked up her two children from her ex
14:13-husband who
14:14had visitation over the weekend when she came back to the residence daniel is downstairs watching
14:21television
14:24he had a few drinks we'd had an argument earlier that day which was wild because we never argued before
14:31and i remember thinking this is just weird like something weird is going on
14:35and he's like i'm not coming down yet
14:41she reported that was the last time she's seen him alive
14:50the evidence appears to support tiffany's claims
14:56we could not find a gun in the residence nor were there tracks that would indicate
15:01it may have been taken somewhere and dumped if it wasn't her who could it be what has been going
15:08on
15:24him and i had a lot of rough patches i guess would be the best way to say it
15:32We had domestic issues. I was scared of him.
15:36She stated that he was working typically out of state
15:40and stated that he had been in Barron County
15:43on the weekend of this homicide.
15:48But Tiffany says she isn't the only one
15:51who has a disgruntled ex.
16:04She described the contentious divorce
16:06and child support hearings between Dan Raven
16:08and Trista Rabeck.
16:11November of 2013, his attorney had sent a letter
16:16in a court hearing to requesting a change in support
16:21because Dan was paying, I think, $256 a month
16:25and wanted it reduced because Trista
16:28had been making more money than she reported.
16:33The plan was, is he was supposed to go to court
16:35with Trista that week.
16:37And they were going to bring that all forward
16:39because he had talked to a lawyer.
16:41He had everything all lined up.
16:43And that was upsetting Trista.
16:47When Dan had brought Trista to court,
16:49he had told me, you know, Tiff, if anything ever happens,
16:53it's her. It's Trista.
16:59Following the interview,
17:00police find plenty of evidence
17:02to back up Tiffany's claims.
17:06Dan and Trista had a lot of ongoing small complaints
17:11about each other, violations of the child custody,
17:17and contacting each other in a negative sense.
17:21He had custody, 50-50 custody of the kids with Trista.
17:26He also paid child support.
17:29But Dan claimed Trista went to extreme lengths to get more.
17:35Dan had told me she was falsifying records
17:38to make it look like she wasn't making any income
17:41to continue to try to bleed him as much as she could.
17:45Shortly before he got killed,
17:48Dan came up and showed me a stack of papers
17:51about this thick that he had on her.
17:53Food stamps,
17:55lying on taxes.
17:58He was accusing her of
18:00underreporting and non-reporting income
18:03to the court,
18:04which forced Dan Raven to get an attorney
18:06and hold more hearings.
18:09Daniel was killed before the issue could go to court,
18:12and Trista was never charged with any crime.
18:19Daniel's loved ones are devastated to learn of his death,
18:23and they all agree with Tiffany.
18:26Everyone consistently kept mentioning Trista's name
18:30and Trista having something to do with this crime.
18:34But before speaking with Trista,
18:37detectives first want to rule out Tiffany's ex-husband.
18:43Tiffany's ex told us that
18:45he had the kids on the day prior to the homicide,
18:49and he had dropped the kids off with Tiffany in the afternoon,
18:52and then from there, just out drinking.
18:53We were around 2, 2.30 in the morning.
18:55He turned in for the night.
18:57He was adamant that he had no involvement.
19:01We then followed up with
19:02all the names and establishments
19:05that the ex-husband provided,
19:06and all of the leads that he gave us
19:09panned out for him.
19:14Tiffany's ex is officially ruled out,
19:16and of their three possible suspects,
19:19detectives are now left with one.
19:23And what Tiffany said
19:24and the history that officers already knew,
19:28we definitely believed
19:29we knew we had to look at Trista very closely.
19:50Before approaching Trista Rayback
19:53about her conflict with Dan Raven over child support,
19:57investigators speak with his family
19:59to learn more about their history.
20:02Dan had called me up,
20:04and he was cleaning out his blazer,
20:07and he found a sawed-off shotgun under the seat
20:10that he believes and I believe
20:12that she planted there
20:14to try to get him into trouble.
20:16Dan had a felony in his past,
20:18so he would get caught
20:20for a felon in possession of a firearm,
20:22which could have easily sent him
20:24to prison for two years.
20:30The incident wasn't reported formally,
20:33so no charges were pressed against Trista.
20:36However, Dan had responded
20:39by threatening to turn Trista in
20:41for what he claimed was criminal fraud
20:44regarding the misapplication of food stamps.
20:48He told me she was using food stamps,
20:52Wisconsin food stamps,
20:53to pay for food for the restaurant
20:55after they had broken up,
20:57and that's the only way she couldn't afford
20:59to keep the restaurant going.
21:03Daniel claimed Trista
21:04had not been reporting that income.
21:08I think a lot of it was just empty,
21:10empty threats about turning her in for that stuff.
21:13It was just kind of his way
21:15to kind of get back at her.
21:21Detectives soon receive a new lead.
21:24The Barron County Sheriff's Department
21:25was contacted by a caseworker
21:28from the Department of Health and Human Services.
21:29She told the communications center
21:32that she had important information
21:34that might be relevant to the case.
21:36The social worker says
21:38she was asked to interview Trista Rayback
21:40and her new live-in boyfriend, Ian Shirley,
21:43after a complaint filed by Ian's ex-wife.
21:48I had made a report
21:51against Ian and Trista
21:53shortly before everything happened,
21:56just from things that my girls were saying.
21:59Trista kind of ignored them
22:01when they were there,
22:02like acted like they didn't exist.
22:04I know that the girls had to sleep on the floor.
22:09I was happy for my dad at first
22:11because he was really hung up on my mom
22:13for a long time afterwards,
22:15so I was glad he was kind of moving on.
22:18Later on, she started to, I don't know,
22:21really show that she didn't really like me and my sister.
22:25Trista is very manipulative
22:26because your feelings aren't important to her, really.
22:30It's her way or not way.
22:32She would try to hit my dad.
22:34He wasn't allowed to defend himself.
22:36She would come wake us up in the middle of the night
22:38and drag us into their fights.
22:44It seems Ian and Trista's fights
22:47were about her ex-husband, Dan.
22:50And during the interviews,
22:52Ian said something alarming.
22:54As she was interviewing Ian Shirley
22:58about his actions of living with Trista Rayback,
23:02Shirley made an off-handed comment
23:04that the quickest and easiest way
23:06to end this conflict is to kill Dan Rayman.
23:13Armed with this new information,
23:16detectives subpoena phone records
23:18for both Ian and Trista.
23:21While the request is being processed,
23:23investigators track down the couple
23:25at a local restaurant two days after the shooting.
23:29They pull Ian outside to question him.
23:34How did you guys get along
23:35with either Tiffany or Dan?
23:38I talked, the only time I ever talked to Dan
23:42was the very first time I ever met Trista.
23:45Okay.
23:45A little more than two years ago.
23:47Do you have anything to do
23:48with the murder of Dan Rayman?
23:50They all know.
23:51They have better things to do.
23:56Ian claims he and Trista were out together
23:59the night Dan was killed.
24:02On March 9th, he and Trista had went to a local bar.
24:06He said at what I recall to be 8.30, 9 p.m. at night,
24:10they were planning on traveling to rural New Auburn,
24:13which is approximately 20 miles away.
24:18You might go there and get somebody to eat.
24:20We just walked out there and realized
24:22it's about serving at 9.
24:23So we turn on one hour.
24:25Don't wait.
24:26Order after 10 hours.
24:29He told us if we check their cameras,
24:30we could see that he had not left the residence.
24:34Ian also told us that he had only learned
24:37of Dan Rayman's death at approximately 6 a.m.
24:40the next morning when he said his phone blew up
24:43by everybody asking what happened.
24:49After speaking with Ian in the parking lot,
24:52we went inside the cafe
24:53and met with Trista in the back.
24:57Who all went out?
24:58Just the two of you?
24:59Just me and him.
25:00We ran into one.
25:01We flew to the home.
25:02And then you go home?
25:04Yeah.
25:06And then what?
25:08No, we stayed up talking for a while.
25:11That was good.
25:13Trista downplays any recent tension
25:16between herself and Dan.
25:19When we first evaporated,
25:22it wasn't prison.
25:24For me, we were at each other
25:26like a lot.
25:28We got along after all that.
25:31When asked directly
25:32if she was involved with Dan's death,
25:35she indicated there was no way
25:37that she would be responsible.
25:42But detectives aren't convinced.
25:46The story was too rehearsed.
25:49If the story wasn't as rehearsed,
25:51it would have made it more believable,
25:53which did not take them off the suspect list.
25:56It actually pushed them higher.
26:00What should happen personally?
26:02Convention caught.
26:04They were caught.
26:05I think they should go down
26:09the same way he did.
26:15However, investigators need more
26:17to be able to press any charges.
26:20We didn't have the physical evidence
26:22to tie Trista in
26:23without a confession at this time.
26:25We needed more.
26:27So when the cell phone records came in,
26:30detectives immediately
26:31started combing through them.
26:33We noticed immediately text messages
26:36between Trista Raybeck and Ian Shirley
26:38that were relevant to this case.
26:40They were chilling.
26:42It was something I had never seen before.
26:49Coming up,
26:50a murder plot unfolds.
26:53The persuasion,
26:56threats,
26:57violence,
26:58it was all spelled out.
27:00And one of the co-conspirators
27:02decides to come clean.
27:05All right.
27:07I'm screwed.
27:27Within 48 hours of Dan Raven's murder,
27:31Barron County detectives
27:32have uncovered cell phone records
27:34implicating his ex-wife,
27:36Trista Raybeck,
27:37and her boyfriend,
27:38Ian Shirley.
27:41The text records indicated
27:44that there had been
27:44multiple previous attempts
27:47where Ian had went
27:49to the turkey farm
27:51to murder Dan Raven,
27:53but it backed out.
27:56With every failed attempt,
27:59Trista turned up the heat.
28:01She was very upset
28:03to the point where
28:04she was threatening
28:05to leave him
28:06if he didn't go through
28:07with killing Dan Raven.
28:09Two days before the homicide,
28:12Ian was texting Trista,
28:14saying,
28:15I promise you
28:16he will not make it
28:17till Monday morning.
28:19And Trista replied by saying,
28:21don't make me promises
28:23you can't keep.
28:24The persuasion,
28:28threats,
28:29violence,
28:30it was all spelled out
28:32in text messages
28:33that I've never seen before.
28:38The texts are chilling,
28:40but they also reveal
28:42another co-conspirator.
28:44While we're analyzing
28:46the text messages,
28:47we identify a third suspect,
28:50what we presume
28:52to be a driver.
28:54The text message said,
28:56tell RB
28:57that we'll give him
28:58an extra $100
28:59if we can get this done tonight.
29:03Ian had received
29:05a text message from RB
29:06at approximately 10.54 p.m.
29:10the night of the murder
29:11that he was on his way.
29:13Less than an hour and a half
29:15after this text message
29:16is received,
29:17Daniel is dead.
29:20We take steps
29:21to try and identify
29:21who he is
29:22through his phone number.
29:23Ultimately,
29:23he's identified
29:24as Robert McBain.
29:28With no apparent connection
29:30to the current suspects,
29:32investigators track him down.
29:35Detectives went
29:35and located him
29:36at his place of work
29:37in the village of Cameron
29:38in Barron County.
29:40And initially,
29:41Robert McBain denies
29:42being involved
29:44in the homicide,
29:44but, you know,
29:46we're holding
29:46some pretty good cards
29:47with the text messages.
29:48And so we start revealing
29:50some of that information
29:51to basically indicate
29:52that he's lying.
29:54And so he starts
29:55to give a little bit
29:56more information back.
29:59He stated that
30:00he was friends
30:01with Ian Shirley
30:02and Trista Rayback.
30:04He described
30:05how they would hang out
30:06together and have
30:06a few beers and drinks
30:07after work
30:08and on the weekends.
30:10He recalled Ian
30:13commenting several times
30:15while they were drinking,
30:15that they wished
30:16Dan was dead.
30:37Robert says
30:38he didn't think
30:39they were serious,
30:40but eventually agreed
30:41to act as Ian's driver.
30:45He stated that
30:46he had actually
30:47went with Ian Shirley
30:48on at least
30:49six previous attempts
30:50to the turkey farm
30:52with intent
30:52to kill Dan Raven.
30:54He said typically
30:55Ian would back out.
30:58But the night
30:59of March 10th
31:00when Ian got out
31:01of the car,
31:02Robert says
31:02he looked determined.
31:07What did Ian do
31:08when you let him
31:08out there?
31:10I went up to Charlie.
31:11Okay.
31:12What did he have with him?
31:16What kind of gun?
31:18It looked like
31:18an outside.
31:20He admitted
31:21to hearing two gunshots.
31:24I was like,
31:25what the hell?
31:27Because I already
31:27realized he did it.
31:28Yeah.
31:29I was like,
31:29holy ****.
31:30I never thought
31:31in a million years
31:31he'd actually
31:32do it.
31:36After the shooting,
31:37he had followed
31:38Ian's directions
31:39where they stopped
31:40at a nearby bridge
31:41and had hid
31:43and concealed
31:43the rifle used
31:45in this murder.
31:47McBain told the story
31:49very believably
31:51about hiding
31:52the murder weapon
31:53underneath the bridge
31:55which detectives
31:56later found.
32:00How much did you get paid
32:01and who paid you?
32:04No bull****
32:05aside.
32:05No bull****
32:06aside.
32:07Ian gave me
32:10about $120.
32:12Were you supposed
32:13to get more
32:14after it was done?
32:17Yeah.
32:18How much?
32:20It wasn't
32:20less than $2,500.
32:22At the end
32:23of the interview,
32:25McBain was
32:26arrested
32:27and taken
32:28to the
32:28Barron County
32:28Jail
32:29for party
32:30to a crime
32:31of homicide.
32:33After
32:34McBain
32:35basically verified
32:36what we knew
32:37but was able
32:38to put himself
32:39at the scene
32:40and not just himself
32:41but Ian Shirley
32:42as the man
32:44who truly
32:44pulled the trigger,
32:45it was then
32:46time to go back
32:47and meet with
32:48Ian Shirley again.
33:08After damning text messages
33:10and a confession
33:11from the getaway driver,
33:13detectives confront
33:14Ian Shirley
33:15about killing
33:16Dan Raven.
33:19He knew he was
33:20he was done,
33:21he knew that
33:21he was caught.
33:23You gotta understand
33:24for us to be able
33:25to help you,
33:27you gotta
33:28be straight up
33:28with us.
33:30Okay,
33:30well there ain't
33:31no help.
33:32Um,
33:33yeah I did.
33:34I'm
33:35screwed.
33:38Ian says
33:39Trista was
33:40desperate
33:41to get rid
33:41of Dan.
33:43Ian told us
33:44Dan had been
33:45threatening
33:45to turn them in
33:46for food stamp
33:47and welfare fraud
33:49and Trista
33:50was afraid
33:51she was going
33:52to go
33:52to federal prison.
33:54So if Dan
33:56is out of the picture,
33:57that stuff stops
33:58is what you're saying?
34:00It's because
34:00Cortez is dropped.
34:04He described
34:05several different times
34:07of McBain
34:08driving him
34:09to the residence,
34:10getting dropped off,
34:11but never actually
34:12pulled the trigger.
34:15and go back home
34:16with some piss
34:16for an excuse
34:17of why I couldn't
34:18do it or whatever
34:19because I didn't
34:20want to.
34:21But Ian says
34:23Trista didn't
34:24give him much
34:25choice.
34:26Um,
34:28it was either
34:29that or
34:30she committed
34:31suicide.
34:32She jumped
34:33all over me
34:33and said,
34:35yeah,
34:36you know what,
34:36I ain't done
34:37by the morning,
34:37I ain't going to work
34:38and by the time
34:39you get done,
34:40I won't be here.
34:42It was kill Dan
34:43or lose her
34:45and he didn't
34:46want to lose her.
34:52According to Ian,
34:53March 10th
34:54would be his last chance
34:55to get the job done.
34:57Trista knew
34:58her children
34:59wouldn't be there,
35:00so he didn't have
35:00to worry about them.
35:03He took a .30-06 rifle
35:05with open sights
35:06and they drove
35:07to the turkey farm.
35:09Shirley goes
35:10to the residence
35:11and sees Raven
35:12sitting on a couch
35:14in the lower level.
35:16I'm like,
35:17still weighing options
35:18and what the hell
35:18do I do?
35:19Well,
35:20I actually
35:21pull the turkey
35:22and jam me.
35:26Ian says
35:27he went back
35:28to the car
35:28but knew
35:30he couldn't
35:30fail Trista
35:31again.
35:33This was his chance
35:34to say it didn't work
35:35but they went
35:36down the road.
35:37He cleared
35:38what appeared
35:39to be a jam,
35:40got the rifle
35:41ready to go
35:42and had McBain
35:43drive him back.
35:45After I reloaded
35:47and I went back up there
35:47I stood out
35:48the side of the door
35:49for a little bit
35:51and I didn't know
35:52what to do there.
35:53So I just
35:54left him,
35:55shut my eye
35:56and let it fly.
35:57He was unsure
35:59of where he struck Daniel
36:00or if he struck Daniel
36:02because of how nervous
36:03he was.
36:08As they drove away
36:10Ian says
36:11Trista texted them
36:12updates
36:13as she listened
36:14to a police scanner.
36:16So she basically
36:18knew based off
36:18the scanner
36:19that he was deceased.
36:21Yeah.
36:22Oh, asshole.
36:23I didn't.
36:25I didn't.
36:27He said once
36:28back at his house
36:29he went through
36:31the woods
36:31and walked in
36:32this rear door
36:33that was out of view
36:33of the cameras.
36:35He said that
36:36the surveillance cameras
36:38that he and Trista
36:39had installed
36:40were actually a ruse.
36:41He said they planned
36:43the installation
36:43and this walkway
36:45being out of view
36:46as part of their ruse
36:48so that it would
36:49support their alibi
36:50as to being home.
36:52After hearing
36:53Ian's confession
36:54he matched
36:55the crime scene.
36:56Caliber of the rifle
36:57recovered
36:58and the two bullet
36:58casings matched.
37:00It matched footprints
37:01that originally
37:02we noticed
37:03in the snow
37:04along the edge
37:04of the driveway
37:05and where a vehicle
37:05had parked
37:06on the roadway
37:07alongside the driveway.
37:10He was placed
37:11under arrest
37:11and subsequently charged
37:14with first degree
37:15intentional homicide
37:16of Dan Raven.
37:19After the full confessions
37:20of Robert McBain
37:21and Ian Shirley
37:22Trista Braybeck
37:23was arrested
37:24and transported
37:25to the Barron County Jail.
37:29She didn't know
37:30why I could say
37:30bye to her first.
37:32She was already
37:33in the office.
37:34Trista Braybeck
37:35was also charged
37:37with first degree
37:38intentional homicide
37:39of Dan Raven
37:39as party to the crime.
37:42Trista's initial response
37:43to officers
37:44when being arrested
37:45was
37:45why am I being arrested?
37:47I didn't do anything.
37:50but even with
37:52confessions
37:53from her co-conspirators
37:54prosecutors know
37:56holding Trista
37:57accountable
37:57could be
37:58an uphill battle.
38:01Trista
38:01had her right
38:02to an attorney
38:03and had not confessed.
38:05She believes
38:06because she didn't
38:18following their confessions
38:20Ian Shirley
38:21and Robert McBain
38:23plead guilty
38:24to second degree
38:25intentional homicide.
38:27Ian is sentenced
38:28to 20 years in prison
38:30and Robert receives
38:3115 years.
38:34As we continue
38:35to interview
38:36the outlying people
38:38that were involved
38:39from bar patrons
38:40to friends
38:41to family
38:42the most consistent
38:43word I think
38:44I heard
38:45in interviews
38:46was evil
38:47and that's the word
38:49that people use
38:50to describe
38:51Trista
38:52was evil.
38:58Ian's family
38:59provides some
39:00scathing testimony.
39:02She was behind this.
39:05You know
39:05Ian pulled the trigger
39:06and he needs
39:07to be in trouble
39:08for that
39:08but this was not
39:09his idea.
39:10Never.
39:11Before I even knew
39:12who Dan was
39:13and her kids
39:15knew it too
39:15that she hated
39:16their dad.
39:17She was pretty
39:18manipulative.
39:19She had just
39:21changed who he was
39:22as a person.
39:23Anyone who knows
39:24him knows
39:25that he would have
39:26never done
39:27something like this.
39:29He had moved
39:30out of his house.
39:31He had sold
39:32everything that
39:33he owned
39:34and pretty much
39:35gave himself
39:36to Trista.
39:37It had gotten
39:38bad to her.
39:39I don't think
39:40he seen much
39:41of a way out.
39:43You know.
39:44I've heard her
39:45threaten suicide
39:46a few times
39:47during their fights.
39:49I think that's
39:49another manipulation
39:50tactic too.
39:53Both Ian Shirley
39:55and Robert McBain
39:56were easily
39:57manipulated.
39:59Ian had described
40:01Dan Raven
40:01as being a nice guy
40:02but was aware
40:04that Trista
40:04did not like him
40:05and wanted him
40:06out of the picture.
40:07Robert McBain
40:09said he had never
40:10even met
40:10Dan Raven personally
40:12but simply knew
40:13of Trista Rayback's
40:15hatred toward him.
40:16It was apparent
40:17that Trista Rayback
40:19was actually
40:20the mastermind.
40:24But without
40:25any direct
40:26evidence
40:26of Trista's
40:27involvement
40:28prosecutors
40:28are worried
40:29she might
40:30be exonerated.
40:31So
40:32they make
40:33a difficult
40:34decision.
40:35There are
40:36always fears
40:37of taking
40:38your case
40:39to a jury
40:39trial
40:39especially
40:40since Trista
40:41had not
40:42confessed
40:43and was
40:44blaming Ian
40:45for his actions
40:46and McBain
40:47just going
40:48along with it.
40:52Trista's
40:53attorneys
40:53seem equally
40:54concerned
40:54about risking
40:55a jury
40:56trial
40:56so they
40:57accept
40:57a plea
40:58deal.
41:00In February
41:01of 2015
41:02Trista
41:03was sentenced
41:03to 15 years
41:05of initial
41:05confinement
41:06with 10 years
41:07on extended
41:07supervision.
41:11When I heard
41:12my dad's
41:13sentence
41:13I wasn't
41:14surprised
41:14by 20 years
41:16but I think
41:17Trista should have
41:18gotten at least
41:18the same
41:18as my dad
41:19at minimum.
41:21The fact
41:22that you can
41:22plan
41:23and I can
41:24say that
41:24plan
41:25a murder
41:26like that
41:27and get
41:27people involved
41:28not just
41:29once
41:30but to try
41:30it multiple
41:31times
41:31and then
41:32you get
41:3315 years
41:34in jail
41:34I mean
41:35what kind
41:36of joke
41:36is that?
41:38I don't
41:38think any
41:39sentence
41:39would have
41:39been fair
41:40enough
41:40for me
41:40honestly
41:41it's not
41:42for me
41:42to judge
41:43it's not
41:44really even
41:44a judge
41:45to judge
41:45but
41:46I don't
41:46think
41:50it was
41:51Every year
41:52me and
41:53you know
41:54my cousins
41:55my friends
41:55we get
41:56together
41:57we have
41:57a guys
41:57camping
41:58weekend
41:58where Dan's
41:59ashes are
41:59spread
42:00and just
42:01hang out
42:01with Dan
42:02you know
42:02and talk
42:03about old
42:03times
42:04there's
42:05a memorial
42:05out there
42:06for Dan
42:07and we
42:07go out
42:08there
42:08every year
42:08camping
42:09just to
42:10kind of
42:10spend
42:11time
42:11with
42:11them
42:12I feel
42:13like
42:13Dan's
42:13been there
42:14for me
42:14a few
42:15times
42:15and I
42:16try to
42:17live
42:17as best
42:17as I
42:18can
42:18for him
42:19I feel
42:20like he's
42:20watching
42:20over me
42:21still
42:23I just
42:23want him
42:24to be
42:24remembered
42:24for
42:25not the
42:26hard times
42:27that him
42:27and Trista
42:28went through
42:28but the
42:30good times
42:31I remember
42:32him
42:32and I
42:33will always
42:33remember
42:33him
42:34I
42:35I
42:37I
42:51I
