00:07High Court enforcement agents Brian O'Shaughnessy and Del Anglin are in Kent with a writ to collect
00:13just over £2,000 owed by a business selling novelty globes Globie Limited. But first they
00:22must find the right address for its director. So what we've got here is an individual very
00:27difficult to track down. It's got numerous addresses, prior residencies, just messy, evasive.
00:34The business owner David Sinclair seems to be linked to several addresses so Brian does
00:40some research. A 46 year old David Sinclair, an accountant, his idea was to put a city
00:45map onto a globe, something he realised had not been done before. The result is the globie
00:52and it is now selling in thousands across the UK and around the world. A father of four
00:57sold two properties to allow him to invest £400,000 in the project, but yet can't pay
01:01an original debt of £2,000 to the claimant. It's a bloody joke, isn't it?
01:05Brian finds the globes are being sold through another company, Globie International, but
01:10with no address, Del returns detected.
01:14Yeah, so good afternoon. Do you, can you put collages on, on, on, on, on globes?
01:21Collage, I, I think what? What, pictures, pictures? We can do, yes.
01:27Um, where could I come to see, um, see, uh, your works?
01:31Uh, well, you can see them all online. I mean, we don't actually have a shop ourselves.
01:35So, if I wanted to, where would I send the details to? If I wanted to, um, send you, um,
01:40an order or something, just for, it might be a one-off, because it's a present for my mum's
01:44birthday. It's her 80th, so. Well, you could, I mean, by all means,
01:48if you drop me an email of, of what you want, and I'll get a costing for you.
01:51Okie dokie, thanks very much. That's all right. Okay, cheers.
01:55Thank you, bye-bye.
01:58He didn't give anything away there, did he? That was a bit clever.
02:02Mr. Sinclair still seems to be in business,
02:05but with no confirmed address, Brian calls the office.
02:09Yeah. Okay, we're off to Globie Limited.
02:11Just spoken to him on the phone. After a search, a colleague unearths an address.
02:18After all this time.
02:21You just made my day, so the office is handy sometimes.
02:25Very much.
02:25Let's get down there, come on, let's do it.
02:27Okay, chocks away.
02:29The plot thickens.
02:39The agents arrive at what they hope is Mr. Sinclair's home.
02:43Let's get in the yard.
02:44Brian and Dell are allowed to enter the property through an open door to deliver the writ.
02:48Hello?
02:51Hello?
02:52High Court Enforcement.
02:55Hello, is Mum in?
02:57Hello.
02:58Mrs. Sinclair?
03:00Yeah.
03:00High Court Enforcement agent, sir.
03:02Hi.
03:02I'm here on behalf of DCBL.
03:04Yeah.
03:04We've got a high court writ, which I'm, you're obviously aware about.
03:09Yeah, that's it.
03:10Here to collect 2,323 pounds and 20 pence.
03:14That's all in dispute.
03:16So the amount does need to be paid.
03:17Well, it can't be paid because there's nothing belong, the company has ceased to trade.
03:21That's it?
03:22What are you trading us now then?
03:23I'm not trading us anything.
03:24If you check on the website...
03:26It's still showing...
03:27It's still showing on their active proposed...
03:29Proposed to strike off, correct.
03:31Well, it's still trading then as well.
03:32It's not trading.
03:33Mr. Sinclair claims that because Globy Limited has ceased to trade and is about to be dissolved,
03:40he's not liable for the debt.
03:42The agents want to find out more about the company Dell called earlier, Globy International.
03:48Well, Globy International as well.
03:50Globy International was a company that my wife set up at the beginning of 2012,
03:56when my wife and I temporarily separated.
03:58She got money to set up a business, which she did.
04:02My business, Globy Limited, I lost my father, I lost my house.
04:06We then decided we're going to try and give it another go because we've got the children.
04:10But Globy Limited has gone.
04:12I understand that, sir.
04:13Look, I just want to cut to the chase, okay?
04:16When I phoned you, we spoke about whether or not you could provide me with something,
04:20right?
04:21And the indication was yes.
04:22So let us cut the nonsense, get down to the nitty-gritty, right?
04:27Because you would have been quite happy to have done business with me.
04:30Was it you?
04:31Yes, it wasn't it.
04:32Yes.
04:33So therefore, all this nonsense about it, not trading and all this, is rubbish.
04:38No, it's not.
04:38Look, if I'd put an order in, I'd have got one from you.
04:42Globy Limited has gone.
04:44Well, that's how you answered it, Globy Limited.
04:45Because Globy is the logo.
04:48I prefer to have a look around your house and see if there is anything here belonging to the
04:51company.
04:51Is that okay?
04:52Yeah, you can.
04:53You can get around through the back.
04:54Let's have a look then, sir, because we're wasting time really in turn.
04:57Feel free to have a look.
04:58I'll leave the door.
04:59Thank you very much, Tom.
05:03I'm just going to phone my wife.
05:04No problem.
05:05That's fine.
05:06Del believes that David Sinclair is still trading.
05:10If he can't or won't pay, the agents can seize business assets to the value of the debt.
05:16He's got globes here.
05:18What do they sell for, do you think?
05:20No.
05:21You should need receipts for the stuff then, that's it.
05:24Well, I don't know how you want to do it.
05:25There's a few bits and pieces of a Globy there.
05:28The agents find some leftover stock, the result of a business venture gone wrong.
05:33Well, I had a prototype of our first Globe back in 2009, I think.
05:38And I went to John Lewis and I badgered to get into John Lewis to see me for ages.
05:46And eventually they let me in.
05:47And I remember the guy and he said, we'll probably place a first order for about 10,000 units.
05:53And I remember walking back to Victoria train station.
05:56I was walking on air, I thought, fabulous.
06:00And then the economy imploded.
06:02They did order, they ordered 500.
06:04I probably got carried along with it a bit too much.
06:06Which subconsciously, I suppose, was greedy thinking, you know,
06:11we're going to make a few million quid overnight here.
06:13But the unused stock is not enough to cover the debt.
06:18Mr. Sinclair, is there a reason why you don't want to pay this woman no money?
06:21She had invoiced me over the course of a couple of years, roughly, I guess, 20 grand.
06:27And she got paid about 18 of it.
06:29The reason, as I said, the rest, the other two grand or whatever it was, didn't get paid
06:33was because the company had ceased.
06:34And the reason it had ceased was, A, because, you know, I lost my house.
06:38If I had funds, I would have paid in it.
06:40You know, I lost my house.
06:42Yeah.
06:43The personal problems I had, the company had ceased to trade.
06:47Mr. Sinclair's wife and children arrive home.
06:49Hello.
06:51Nice job.
06:52What's your financial situation at the moment?
06:54I've got a pop.
06:55Right.
06:55I've got one.
06:56I don't disbelieve you.
06:58I've got no reason, I've got no reason to disbelieve you.
07:00I don't disbelieve you.
07:04Can I just have a quick moment with my colleague?
07:07If you could just go in there, that'd be great.
07:09Yeah, whatever you want.
07:09Yeah, that'd be great.
07:10Thank you so much.
07:11Cheers.
07:17What's your thoughts?
07:20Yeah.
07:21Because of the company issue.
07:24Yeah.
07:25He's paid 18,000 pounds from a 20,000 pounds debt.
07:27So he's not, he's not an evader.
07:29He's paid 20 grand, he's paid 18.
07:30So he's not an evader, the company just ceased to trade.
07:34With Mr. Sinclair's company, Globee Limited, close to being dissolved,
07:38and not enough company assets to pay off the debt,
07:42Brian and Dell decide not to pursue it.
07:45There's a couple of Globes in here, there's a couple in there.
07:47It's not going to reach two and a half thousand pounds.
07:50The failure of the business has had a major effect on Mr. Sinclair.
07:55Six, seven years ago, I probably had an 81 credit rating.
07:58Had a lovely house, swimming pool, five bedrooms, acre of land.
08:04Very pleasant, very comfortable.
08:06Probably worked about three and a half days a week.
08:09Then this idea took over, and obviously the whole thing's imploded.
08:15My wife and I were basically working 25 hours a day, eight days a week to resurrect things.
08:21Unfortunately, they claim it on this one.
08:22It's going to be difficult for them to get their money, because the company's not trading anymore.
08:26You can't get a blow out of a stone sometimes, so it's just unfortunate.
08:29But you know, he's a nice chap.
08:30He's tried, he's paid the majority of the debt, and he just can't pay the last amount,
08:33because, you know, the company wasn't trading.
08:35I was an accountant. I know people that they try and close companies down,
08:39and then set another one up, and with the stock and all this sort of thing.
08:42I know that goes on, but it was us.
08:45You know, I've lost virtually, well, I have lost everything.
08:47The only thing I haven't lost is my family.
08:51Despite their determination, Brian and Dell have come away empty-handed.
08:56But their next case will test their talents for investigation to the limit.
09:01If you can't pay this today, we're going to look to take control of goods,
09:04get some trucks in and remove them.
09:05I'd have exhausted my channels.
09:07The bank might help you, though.
09:09No.
09:10Now we can't trust anything he says.
