00:00massachusetts wants cal she and these prediction markets out and this is a big state to take that
00:08leap here and thus far i know cal she wants to fight back they want to stay alive in this state
00:13and the reason why dan probably isn't so much about massachusetts it's that they probably think
00:17everybody else is going to follow suit if they end up winning this so what's the very latest
00:21well we're up to 12 lawsuits now but the trend line is now favoring the state governments the
00:26last six decisions that have been issued by federal courts as to whether these prediction
00:31markets are allowed under federal law they've all gone in favor of the states and it all began back
00:36on on august 1st when the maryland federal court uh denied cal she a request for a preliminary
00:42injunction several other states have since followed suit nevada but massachusetts is the latest one but
00:47it is the first state in which an injunction has been entered against cal she to bar cal she from
00:53offering event contracts in in massachusetts going forward and i think this is the uh this could be
00:59the pivotal decision because it provides other states now with a roadmap with what the other states
01:04have been doing neglectfully has been giving cal she an advance notice a cease and desist letter
01:09which has allowed cal she to jump the gun file lawsuits in federal court and frame the issue around
01:15jurisdiction whereas massachusetts just went for the jugular no advance notice no cease and desist letter
01:22filed the lawsuit in state court and focused on the legality of the underlying contracts under state
01:29law and that was the secret to the success in massachusetts and i think it may provide
01:34a blueprint for other states going forward
