03:00T was, she was the glue, she was the natural nurturer for the entire family.
03:08T's fierce loyalty is strengthened by a traumatic family split.
03:13My divorce was hard on them, but I would always make sure they had what they needed.
03:21As a teacher, Ms. Archie instills the importance of education in her daughters.
03:27T was a phenomenal student.
03:28She was very determined to have straight A's.
03:33T ended up graduating high school and going to the University of Mississippi, Ole Miss.
03:40T thrives in the college town of Oxford, and her time there is filled with happiness.
03:45T graduated from the University of Mississippi in 2008.
03:50And she told me, she said, Mama, I'm going to catch the first train coming.
03:55So, she took the first job that she was offered, and it was in Yazoo City as a teacher, third grade.
04:05I was very proud.
04:11Not long after moving to Yazoo City, 22-year-old T reconnects with an old acquaintance, 27-year-old David Swims.
04:19I taught David in sixth grade math.
04:25He was a good student, but he was a student that thought he knew it all, but he didn't.
04:33David had quite a reputation within our hometown.
04:38He was labeled as a bad boy.
04:42T and David start dating.
04:44She learns he has two children with two different partners and is in the midst of a divorce.
04:49As an adult, I heard David was a jealous person.
04:56I know that he and his first wife have major issues.
05:03Hearing things around town about what he was doing made me very uncomfortable.
05:11On the day that T brought David to my house, she came in and he was behind her.
05:18She said, Mama David and I are dating now.
05:20I said, oh, really?
05:23He walked in with pride, you know, like, chest out.
05:27He knew what a gem he was getting.
05:29David was offering her a lifestyle that she was not used to.
05:38The streets, the clubs, the partying.
05:42This was all new to her.
05:45This was like a lifestyle that Mama tried to keep me away from.
05:50This is not a relationship that I want her to be in.
05:55But she was an adult now.
05:58I think the bad side is what she was attracted to the most.
06:02And in her mind, she would be able to love this person and allow them to find the good side within themselves.
06:09David claims he wants to marry T.
06:16But in March 2009, one year into the relationship, his life takes an unexpected turn.
06:27T called me and she said, Mama David has been in an accident.
06:33He was hit by a truck.
06:36My mom, she said that David may not live.
06:45She told me to come on.
06:46We're going to get in the car.
06:47And then we got there.
06:48My sister was right by his bedside.
06:54He was going to be in a wheelchair for the rest of his life.
06:58I wanted him to go for care from his mom or other family members.
07:05But T told me, David is going to go home with me.
07:08She said, Mama, I love him.
07:12I could tell instantly that she was determined to make that relationship work.
07:19But that was the kind of person T was.
07:21She just couldn't walk away from something that she started.
07:24I think after David's accident, it was a blow to his ego because he had to ask for help.
07:42And that's really what he did not like, asking for help.
07:49With T's unwavering care, David slowly regains his confidence.
08:18This is David when he wanted to try to regain strength and help him be able to walk again.
08:29He seemed to put aside his disability and began making it an ability.
08:36Once David's divorce is finalized, he and T set a wedding date for the winter of 2010.
08:47My heart dropped.
08:50I did not want her to stay in that relationship.
08:54Not because of the paralysis, but because he was who he was.
08:59He said that I'm going to love her, and I refused to ever leave.
09:06In the months before the wedding, T and David regularly visit Miss Archie.
09:13T had come to the house, she and David, with a little baby.
09:19And I'm like, T, whose baby is this?
09:22So she pointed at David, and I said, T, you all were together when this baby was conceived.
09:35We realized that he had had a daughter while they were dating.
09:41T was very hurt that he chose someone else over her.
09:46So I'm shocked.
09:50I'm thinking, what had she done to him that would make him do that to her?
09:58It was like he was saying, okay, it's my baby, so what?
10:04You know that he stepped out before, and he just won't stop.
10:09My heart was telling me to tell her, you know, get out of this.
10:14Take it and run.
10:15You don't have any obligations to him yet.
10:19I feel that she thought she was getting a husband.
10:27In actuality, he was not what he appeared to be.
10:39T marries David Swims on November 20th, 2010.
10:51She wanted him to just be a better person.
10:55She said, honestly, I don't feel like it's a problem.
10:57It's still our decision.
10:59I said, okay.
11:00After T and David were married, T seemed happy.
11:04I felt like, okay, everything is going along.
11:08Maybe I just need to stop feeling how I was feeling
11:12and accept what had happened.
11:15The couple still faced challenges.
11:18David was not working,
11:21but T took care of pretty much everything.
11:26The stress behind keeping the bills was definitely major for T,
11:31but she felt like, I have to go ahead
11:34and just be the person to stand up and do it.
11:38T's determination never wavers.
11:42T ended up going to university to get her master's.
11:46Everything was done online.
11:49Then she pushed David to go back to school.
11:54He started going to this IT tech building.
11:57He enjoyed, like, fixing computers or fixing phones
12:02and things like that.
12:05T pushed for him to be able to get that degree.
12:08That way he could actually apply in his skill set to any job.
12:13He graduated and did very well.
12:15I was so happy for them.
12:17But three years into their marriage,
12:21T hit Shalanda with another bombshell.
12:24He called me and she just said he was still being unfaithful.
12:30There was one incident where she said
12:33that there was someone at her house while she was at work.
12:36She was honestly very upset with that
12:39because he promised her that once they're married
12:43it will never happen and she's at work
12:45and she's still trying to make sure he's taken care of.
12:48I think she had gotten to a point to where she's like,
12:52well, if he's going to choose to entertain,
12:56then I'm going to do the same thing.
12:58And she said they discussed to have just an open relationship.
13:03I said, are you sure?
13:05Are you doing it to fix the situation of him not changing
13:10or are you doing this for you?
13:12And she said, honestly, I feel like both of them.
13:16But I'm going to make sure I stay
13:19to make sure I take care of him.
13:23T had dreams about going back to Ole Miss,
13:27University of Mississippi, to work on her PhD.
13:31So she told me, she said,
13:32Mama, I still want to move back to Oxford.
13:38In August 2014, T lands a position
13:42teaching third grade in Batesville,
13:4425 miles from Oxford.
13:46And David finds a job
13:49in a phone and computer repair shop.
13:53Having two steady incomes helped a lot
13:55and it took a lot of the burden off of tea.
13:59I could see a little bit of relief.
14:04The couple move into a home
14:06adapted for David's wheelchair
14:08on the outskirts of Oxford.
14:10Their lakeside street is known locally as the Cove.
14:14My husband and my family, we moved to the Cove in 2016.
14:21Some of the couples that had been living in the Cove for a while did block party.
14:27And that was the first time I got to meet T and David.
14:29They seemed like a very sweet couple.
14:33David was in the wheelchair.
14:35He seemed like it didn't slow him down.
14:38Even from a distance, you could tell T was just warm and there was just something so special and beautiful about her.
14:46It just seemed like it was going to be great to have a friend who's a neighbor instead of a neighbor who's a friend.
14:53As the months pass, more new families moved to the Cove.
15:01The ladies who were new in town,
15:05we started exchanging phone numbers
15:07and started a group text.
15:09T actually named the group The Cove Queens.
15:14We started going out for each other's birthdays.
15:18Kind of became a monthly thing after that.
15:21This was one of our Cove Queen nights.
15:26T learned a TikTok dance and she was showing it all.
15:32She was so proud of herself for learning how to do that dance.
15:37T was the party.
15:39T was absolutely the party.
15:42If she was there, you already knew it was going to be a good night.
15:44But beneath the smiles, there are growing cracks in T's relationship.
15:51Basically, it is the 13 stars around, but the conservative...
15:56My dems.
15:58My dems.
15:59My dems.
16:00My dems.
16:01I'm listening to you.
16:02Baby, I'm listening to what you're saying.
16:04I know.
16:04I hear you.
16:06Baby, I hear you.
16:07Seems like T is working on a paper
16:10and she's probably trying to get some serious business taken care of
16:15and he's being silly.
16:16My dems put it off.
16:18Being a comedian.
16:21T looks genuinely upset.
16:23My dems.
16:25I feel like he expected her to do certain things,
16:29but he didn't have the respect
16:32that I would feel a man should have for his wife.
16:36My dems put it off, yo.
16:39Eh?
16:41T confides in her sister
16:43that David is not respecting their personal agreement either.
16:47Having the open relationship did not work.
16:50He was just extremely jealous.
16:54T said he could do pretty much anything,
16:58but he wanted to make sure he kept the control
17:00over whatever she did.
17:03She had no privacy.
17:06He would call from her phone
17:08people that he would assume would be a male,
17:12even if it's a co-worker,
17:13saying things like,
17:14oh, that's my wife, I don't want you calling her.
17:17It was definitely a way that he could manipulate
17:20and maneuver to have his infidelities
17:22and just take, really.
17:26He's very good at not showing that dark side
17:31that she would see.
17:33The cruelty with his words.
17:36We were talking every day.
17:38She just, like, burst out to cry.
17:42And I didn't know what to do.
17:46I think she realized that she wanted better.
17:50And she didn't want to be her words.
17:53She didn't want to feel like she was in prison anymore.
17:55Six years into their marriage,
18:07David and T's relationship problems persist.
18:11Unaware, Miss Archie continues to visit her daughter
18:14on weekends.
18:15I would go and stay with them.
18:19So that particular Friday, I made it up there,
18:21and I noticed all of David's clothes
18:24was in the back bedroom.
18:26That's the room I always stayed in.
18:29She didn't let on that they were having
18:31marital problems,
18:32but I started paying attention a little bit more.
18:35It definitely became more apparent
18:40that they were having issues,
18:42whereas normally she was there
18:44for every Cove Queen's dinner.
18:46There was a few where she would miss.
18:48That was definitely something noticed
18:52because she was the party.
18:54I know there were things that she held back.
18:58She was just always part of the support system,
19:01but very rarely was she one that would come out
19:06and say, I have a problem with something
19:09that's going on in my life.
19:11Despite David's controlling behavior,
19:16he never stops striving.
19:18And in April of 2021,
19:21she completes a lifetime goal.
19:23She did send us a group text
19:25to let us know that she was just waiting to hear
19:27if she got her PhD or not.
19:30We just started calling her Dr. T
19:32just to kind of boost her confidence
19:35because we knew she had it.
19:37I knew she had been undergoing a lot of stress
19:42with everything, and I said,
19:43hey, we're going out.
19:46We're going to relax and enjoy it.
19:49And so the next day,
19:51we went to go get our nails done,
19:55happy and laughing and kind of calm and relaxed.
20:00And then she got a text from David,
20:03and she just immediately started tensing up.
20:07And from that point on,
20:09he was constantly texting her.
20:11Who are you with?
20:12What are you doing?
20:13Why are you there?
20:15That was the moment where I saw
20:17exactly how jealous
20:19and kind of possessive he could be.
20:24I would say it was almost like
20:26the higher she climbed,
20:27the actions got a lot more controlling.
20:31It was so much tension,
20:35you could cut it.
20:38T would come and spend more time at my house
20:40by herself,
20:42come on a Friday
20:43and go back home on a Sunday.
20:45She was always saying,
20:46everything fine, everything fine,
20:48but it wasn't fine.
20:50With T spending more time away,
20:55David often takes sole charge of his children,
20:58spending time at a local gun range.
21:02But his mood deteriorates.
21:04The fact that David's kids were there
21:16and T was not
21:17is very telling.
21:19She said that it had gotten
21:25to a point to where things were unbearable
21:27and he would say things
21:29that you shouldn't just say
21:31to someone that you love.
21:33She had enough
21:35and she was tired of being watched
21:3724 hours, like a day.
21:40So she made the decision
21:42to get a divorce.
21:43She decided
21:47he would have
21:48one half of the house
21:49and she would have
21:50the other portions.
21:53He returns
21:54to her mother's house
21:55on the weekend
21:56of June 4th, 2021.
21:59We sat in the kitchen
22:01and we talked.
22:02She said,
22:03Mom,
22:04it's over
22:05between David and I.
22:07She said,
22:08I'm tired of David's arrogance
22:09and I'm tired of him
22:10telling me
22:12what I can
22:12and cannot do.
22:13T finally admitted
22:15that maybe
22:16she should have
22:16listened to Mom.
22:18I was very relieved.
22:20T deserved
22:21so much more.
22:24And then that Sunday
22:26before we left the house
22:28David drove up
22:29and the look in her eyes
22:31was fear.
22:33It was pure fear.
22:36I went to the door
22:37walked on out
22:38to his truck.
22:39I said,
22:40Hey David,
22:40what's going on?
22:42Is T here?
22:43I said,
22:44Yeah.
22:45He was telling her,
22:46T,
22:46I just want to talk to you.
22:47She said,
22:47David,
22:48I'm done.
22:49I am done with you
22:50and I am done
22:51with this situation.
22:53David drove on off.
22:55The first thing
22:56that came to my mind
22:57was maybe he ain't
22:58coming back.
22:59I'm like,
23:00Wow,
23:01that was good to me.
23:02We went to fishing
23:05and Shalonda came
23:07on up there.
23:08She and T
23:08were sitting out
23:09on the bank.
23:10I said,
23:10Hey, y'all,
23:11look at me.
23:12And I snapped
23:13their picture.
23:14T felt relieved.
23:16She dedicated
23:16pretty much everything
23:18and she put everything
23:19on hold.
23:21It was almost like
23:22I could just
23:22see the light
23:23coming back
23:24into her eyes.
23:25and she felt safe.
23:33At the end
23:34of the weekend,
23:34T returns to Oxford
23:36with plans
23:37to put the house
23:37up for sale.
23:39She got in the truck
23:40and left that Sunday.
23:43The realtor
23:45was supposed
23:45to be there
23:46that Thursday
23:47at 2 o'clock.
23:55That Tuesday night,
23:57she called me back.
23:59She said,
23:59Hey, mama,
23:59what you doing?
24:00I said,
24:00Nothing.
24:01And so I said,
24:02You got a glass?
24:03Let me go get a glass.
24:04So I went and got a glass
24:05and I poured some wine
24:07in there.
24:08I said,
24:08Where's David?
24:10And she said,
24:10He up in there somewhere.
24:12That was her exact word
24:13to me.
24:14He up in there somewhere.
24:19We were sitting there
24:20just talking
24:21and then
24:22when we get ready
24:23to get off,
24:23we tapped the screen.
24:25She tapped hers
24:26and I tapped mine.
24:28Good night.
24:28I said,
24:29I love you.
24:30She said,
24:30I love you too.
24:35That Wednesday morning,
24:37she was supposed
24:38to call me.
24:39I didn't get that call.
24:41So that Wednesday afternoon,
24:44about 1.30,
24:46I called her phone.
24:47Went straight to voicemail.
24:48I said,
24:49That's not like T.
24:51And then I didn't
24:52get a call back.
24:53Definitely not like her.
24:55So I waited
24:57and waited.
25:00Then I got a text message
25:02on my phone.
25:04Just said,
25:05Hey mom,
25:06I'll talk to you later.
25:08All of the words
25:09was jammed up together.
25:11No punctuation.
25:13When T was sent a message,
25:15you better know
25:16it was going to be correct.
25:18It didn't make sense.
25:20I called her phone
25:23that Thursday
25:23before she left school.
25:25I got a message saying,
25:27Hey mom,
25:28in a meeting,
25:29I'll call you later.
25:30No punctuation.
25:32Mom was lowercase.
25:34I just felt something
25:35was wrong.
25:37So that Friday morning,
25:39I left
25:39to go to Oxford.
25:41There's now a church department.
25:49Oh yes,
25:50we need to make a report
25:51in regards to a very serious matter.
25:54One of our coworkers called
25:55and basically said that
25:57he was involved in a murder.
26:09One of our coworkers called
26:10and basically said that
26:12he was involved in a murder
26:13a few days ago
26:15and it's like apparently
26:15everything's still like
26:16it was at the house.
26:17Like he hasn't come in to work.
26:18Dispatch had a male subject
26:26on the line
26:27saying that he had
26:29shot his wife.
26:30He was currently
26:31still inside the house.
26:33As I got closer
26:34to the neighborhood,
26:35dispatch did relay information
26:37that the suspect
26:39was possibly in a wheelchair.
26:45Most important thing
26:47when we arrive
26:48on a scene
26:48to a call
26:49of this nature
26:50is safety.
26:51Try to find out
26:52where the suspect's at
26:53and secure the residence
26:55as quickly
26:56and as safely as possible.
27:01I remember the garage door
27:03kind of opening
27:04and I could see
27:06an ale coming outside
27:08in a wheelchair.
27:10My greatest worry
27:10or fear is that
27:11he was still armed
27:12with a weapon.
27:14Appearances can be deceiving.
27:18after we secured
27:26the suspect
27:27we started making
27:28our way
27:28through the residence
27:29room by room.
27:30Sheriff's department!
27:32We're constantly
27:33on high alert.
27:35There could be a threat
27:35that pop out
27:36behind a corner.
27:37Sheriff's department!
27:39As I was making
27:40my way through
27:41the kitchen
27:41I do remember
27:42seeing a couple
27:43firearms on the bar
27:44in the kitchen.
27:45At this point
27:46we just bypassed them
27:47because this is Mississippi.
27:49Nothing unusual
27:50to see a gun
27:51laying on a counter.
27:52Hi sir.
27:53What's up?
27:54No, I remember
27:54it was around the lights.
27:56Hi.
27:58Careful.
27:59Once I got
28:00to the bedroom
28:00I could see
28:01a comforter
28:02laid on the floor.
28:04Here's the floor.
28:05Yeah, she's cold.
28:07It appeared
28:07that she had been there
28:09for a period of time.
28:10So at this point
28:11I've asked the deputies
28:12to exit the residence
28:13with me
28:14because this has now
28:15become an active crime scene.
28:18What's your wife's name?
28:20Anteada.
28:21A-N-T.
28:23E-E-A-T-T-A.
28:26You really never
28:27know what you're
28:29going to get
28:29when it comes
28:29to a murder suspect.
28:31You know her date
28:31of birth?
28:32November
28:331885.
28:37I would say
28:38that the suspect's
28:39demeanor was
28:40was very calm.
28:41He didn't really
28:41say much.
28:43He was very
28:44nonchalant.
28:47The suspect
28:48was placed
28:49in a patrol vehicle.
28:51I followed
28:52that vehicle
28:52back to my office
28:54at the Lafayette
28:55County Criminal
28:55Investigations
28:56Building.
28:57Still on the road
28:59Miss Archie
29:00remains unaware
29:01of what has
29:02happened to her
29:02daughter.
29:04I called
29:05David's phone.
29:06He didn't answer.
29:07The number
29:08cannot be reached.
29:09So I called
29:09Dave's mom's phone.
29:11She didn't answer.
29:13I said,
29:13somebody need
29:14to call me.
29:15What is going on?
29:18She called
29:19my phone
29:20and said,
29:21Auntie Ada
29:21is dead
29:22and hung up.
29:23and I just
29:25lost it.
29:28When I made it
29:30to the home,
29:31yellow tape
29:31all the way
29:32around the house
29:33and that policeman
29:35walked up to the car
29:36and he said,
29:38I said,
29:38what's going on?
29:39He said,
29:40well, ma'am,
29:41there was a deceased
29:43female
29:43in the house.
29:45All I could think
29:48about was,
29:49I know this
29:49ain't true.
29:50I know this
29:51is not true.
29:52But it was true.
29:58It's like a gut
29:59wrenching.
30:00It's just a hurt
30:01that just won't
30:03stop.
30:03David Swims
30:12was placed
30:13in our interview room.
30:15The only thing
30:16I was aware of
30:17is the 911 call
30:18that he had made
30:19claiming that
30:19he had shot his wife.
30:21So I went
30:22into the interview
30:23trying to figure out
30:25exactly what happened.
30:27But once he was read
30:28as Miranda writes,
30:29he invoked his rights.
30:30So unfortunately,
30:32we had to end
30:32the interview
30:33at that point.
30:35Officers obtain
30:36a search warrant
30:37for the property.
30:41A knife was recovered
30:42on the scene
30:43towards the back
30:44of the bathroom
30:45where T was found.
30:48T had three entrants
30:49in the exit wounds
30:50indicating that
30:51she had been shot
30:52three times.
30:53There were three
30:54bullet holes
30:55in the wall
30:56behind where
30:57she would have been.
30:58Those bullet holes
30:59weren't in a tight group.
31:01They actually moved
31:02the way that
31:03I perceived it
31:04from left to right.
31:06The bathroom
31:07where T was found
31:08clearly had been cleaned.
31:10It should have had
31:11more blood in it.
31:13Something that struck me
31:15very odd
31:16written in the very center
31:17of the kitchen counter
31:18by the firearms
31:19with a black Sharpie
31:20were the words
31:21pain, lies,
31:22and deceit.
31:23We also noticed
31:27the picture frames
31:28from the bookshelf.
31:31They were turned
31:31face down.
31:34And then I started
31:35looking around
31:35the residence
31:36and I noticed
31:36that all the other
31:37photographs
31:38were turned over.
31:39I picked one up.
31:41I saw that it was
31:42David Swims
31:43and what appeared
31:44to be the
31:45deceased female.
31:46It was like
31:47the suspect
31:48couldn't look
31:49at the victim
31:50after what he had done.
32:05David Swims
32:06is charged
32:07with first-degree murder
32:08and a secondary count
32:09of felonious possession
32:11of a firearm.
32:12Bell was set
32:13at $100,000.
32:17David was able
32:19to hire
32:20a bail bondsman.
32:22Generally speaking,
32:24that bail bondsman
32:25only requires
32:2510% of that payment
32:28to sign on
32:29to that bond.
32:32The next day,
32:34David posts
32:35$10,000 bail
32:36and is free
32:37to leave.
32:39$10,000
32:41for my daughter's life.
32:42I go out
32:43in the yard
32:44and dig up
32:44$10,000.
32:46I still don't
32:47understand it.
32:49But he was released
32:50extremely quickly.
32:52I really had to pray
32:54so that I wouldn't
32:55do anything
32:55that would take me
32:56away from my kids.
33:00Those were
33:01the hardest days
33:03because everybody,
33:05it's like everybody
33:06was frozen,
33:08like, wondering
33:08if, like,
33:09are we really
33:10going to get justice?
33:12They were clearly
33:14very emotional.
33:16However,
33:16I needed them
33:17to be strong.
33:19My goal
33:20is to get a conviction
33:21first and foremost.
33:23Second of all,
33:24send Mr. Swimps
33:26to prison
33:26for as long
33:27as possible.
33:29David did come
33:30back to the cove.
33:31He moved right
33:32back into the house.
33:34That was a very,
33:35very hard time.
33:37There was all
33:38the anger I had
33:39towards him
33:39for what he did.
33:41There was
33:42a certain amount
33:43of fear.
33:46Somewhat,
33:46in a way,
33:47became a recluse
33:48because any time
33:51I stepped outside,
33:52that was the chance
33:53I was going to see him.
33:57He went back to work.
33:59He was an arrogant person.
34:01He was going on
34:02living his life.
34:03But he took
34:06my daughter's life.
34:11Somebody sent me
34:12the video of him
34:13out at a club
34:14two weeks
34:14after he
34:15murdered my daughter.
34:18It just
34:19turns my stomach.
34:20On Monday,
34:27September 19th,
34:282023,
34:30the trial
34:30finally begins.
34:32When David
34:33testifies,
34:34it's the first time
34:35he gives his
34:36full version
34:37of events.
34:38David Swimps'
34:39defense was
34:40that he
34:41came into
34:43the bedroom
34:43where T was,
34:45that they had
34:45a confrontation
34:46with one another,
34:49that T picked
34:50up a knife.
34:52David testified
34:53that T lunged
34:54at him sideways
34:55with the knife.
34:58He picked up
34:59the gun
35:00that T had
35:01in the bedroom,
35:03and that's
35:03where he shot her.
35:05He describes
35:06himself as
35:07firing blindly
35:08at somebody
35:09who was attacking
35:10him,
35:11covering his eyes
35:12when he shoots her.
35:14I argued
35:14in this particular
35:15case to the jury
35:16that it was
35:18not self-defense.
35:21It was clear,
35:23speaking to witnesses
35:24and looking
35:25at the forensic data
35:27that was recovered
35:27from both cell phones,
35:29that the relationship
35:30was dissolving.
35:33In a case like this,
35:34the motive
35:35often becomes
35:36very clear.
35:37The defendant
35:38did not want her
35:39to go and would
35:40do anything
35:40to prevent her
35:41from going.
35:44The argument
35:45that I made
35:46to the jury
35:46was that Mr. Swims
35:48entered that room
35:50where T was.
35:53That he brought
35:55the firearm
35:56with him
35:56with a deliberate
35:58design
35:58to kill T.
36:03T had three
36:04entrance and exit wounds
36:05indicating that
36:06she had been shot
36:07three times.
36:08There were three
36:09bullet holes
36:10in the wall
36:11behind where
36:12she would have been.
36:13and those bullet holes
36:14weren't in a tight group
36:16indicated not that T
36:18was coming
36:19at David,
36:20but that T
36:21was trying to get
36:22away from David
36:23and that he knew
36:24exactly how to aim.
36:27If T was coming
36:29at him
36:30with the knife,
36:31the knife would
36:32have dropped
36:33somewhere
36:33in the center
36:34of the room
36:35where he shot her,
36:36as opposed to
36:38in the back
36:38of the bathroom
36:39where it was
36:39ultimately recovered
36:41that indicated
36:42that the knife
36:44clearly appeared
36:45to have been placed.
36:49Ms. Archie
36:50brought the information
36:51to law enforcement
36:53indicating that
36:54the text messages
36:55that she received
36:56from T's cell phone
36:58clearly was not
36:58from her,
37:00that David Swims
37:01being the only
37:01other person
37:02who had access
37:03to that cell phone
37:04sent those text messages
37:05indicated that
37:07he was trying
37:07to cover up
37:08for his crime.
37:13The length of time
37:14between when
37:15T was murdered
37:16and when David Swims
37:18called law enforcement
37:20gave Mr. David Swims
37:22two days roughly
37:24to clean up,
37:25to come up
37:26with a story.
37:28He was very intelligent
37:29and physically fit
37:31from the waist up,
37:33but I believe
37:35he was unable
37:36to completely clean up
37:38the crime scene
37:39and he had no choice
37:41but to say
37:42that he had shot her
37:44in self-defense.
37:48When we finally
37:49made it to court,
37:50I learned
37:52the gruesome details
37:54of how my daughter died.
37:57When I got up on stand
37:59to give my victim impact statement,
38:01I looked dead
38:03in his eyes.
38:04I said,
38:06David Swims,
38:08do you hear me?
38:10This will hurt me
38:12until the day
38:14God calls me home.
38:17And he just sat there.
38:20He never responded.
38:23He never acknowledged.
38:25He showed no remorse.
38:27The trial lasts
38:29three days.
38:31On Thursday,
38:31September 21st,
38:33the jury returned
38:34with their verdict.
38:36When the judge
38:37asked for the verdict
38:38to be read,
38:40the foreman stood up.
38:42He said,
38:44guilty.
38:49Despite the prosecution
38:51working for a first-degree
38:52murder conviction,
38:53the jury remained unconvinced
38:56the crime was premeditated.
38:58The jury accepted
38:59that his actions,
39:00instead of being deliberate
39:01in nature,
39:02were depraved in nature,
39:04which is second-degree murder.
39:07I'm satisfied
39:07with that verdict.
39:09The jury also find
39:10David guilty
39:11of felonious possession
39:12of a firearm.
39:14Mr. Swims received
39:15a sentence of 40 years
39:16to serve,
39:17two of those years
39:18suspended,
39:1938 years in the custody
39:21of the Mississippi
39:22Department of Corrections.
39:23I don't know
39:25if I'd say
39:26I'm satisfied with that,
39:28but I'm happy with that
39:29because that's just
39:32like a lifetime for him.
39:34When they heard the truth,
39:37they knew what a monster
39:38he was.
39:40And he was one
39:41of a person
39:43that could not be changed.
39:45It was his way
39:46or no way.
39:48He had a big hand
39:49in assisting him,
39:52helping him,
39:52and nursing him back
39:53from that accident.
39:56She sacrificed.
39:58She gave everything
39:59for his life.
40:01And then he took hers.
40:03I remember my sister
40:09as the peaceful dove,
40:11the helper,
40:14the nurturer,
40:15the leader.
40:17That was my one person
40:19that knew everything
40:21about me,
40:23and I knew everything
40:24about her.
40:25I like to remember
40:27my daughter
40:28as the vibrant young woman
40:30that she was.
40:32And she would always tell me,
40:35Mama,
40:35just do it.
40:36If it's something
40:37you want to do,
40:39just do it.
40:41Smile like you're happy,
40:43happy.
40:43I know it.
40:48My daughter was loved.
40:51She was very much loved.
40:54But I'll never be the same.
40:56Vicky's love for Ryan
41:09was pretty intense.
41:11Are you getting
41:11the hang of us?
41:13But her fear
41:14was awesome.
41:16There's no other word
41:18to describe him
41:19than as a monster.
41:19You're welcome.
