00:51first to use your hands and he just reacted so he was really acting in self-defense which is your

02:41doing personal matters i wasn't scheduled to work that day okay so you got back at 12 30 when you got
02:47back at 12 30 what happened i had asked chris how the day was going it was his first day i'd ask him
02:53first day as working as an employee for the store you're chris yes ma'am step up so you said to chris
03:01that's you raise your hand you said to chris who was a new employee this gentleman was a yes new
03:08employee you said how are things going exactly how you liking it are you picking things up is nick and
03:15the other girl showing you stuff okay and chris said nothing positive toward nick they're not
03:22getting along nick's telling me he's not doing stuff right he's ready to walk out you mean chris

03:32nick having an attitude toward customers i knew there was something on his chest i figured it would just
03:36shake it off as the day went on but obviously it didn't it progressed so what happened next i asked
03:41the other girl who was working there what has she seen well what have you what's going on i don't
03:46want you to tell me what she said exactly well anyway i asked another staff member what they
03:49thought of the situation they shook their head walked away they didn't want no part of any of the
03:54nonsense i had then walked started to walk up to the register i noticed that nick was being rudely
04:00toward an elderly lady he was cashing out i asked what was he saying to her just the tone in the voice
04:05not a typical friendly restaurant attitude that you'd want someone to have at this particular
04:10establishment we up talk friendly courteous smile being short to say the least okay well i have to
04:20envision what you're saying so because you're not being more articulate you want to try to explain
04:24better what you observed with regard to this elderly just his body language and his tone of his voice
04:31okay so what happened next i asked him to leave the restaurant i said nick please leave get out
04:36i wasn't firing him i just wanted him out the restaurant that day obviously there was something
04:40bothering him that day he was causing friction among the other staff members he was also okay being
04:48short with the customers having an attitude i thought it was the best business decision for the
04:53establishment to remove nick from operations that particular day and at that time he had been
04:57working for the place for about four months yes ma'am and had you had trouble with him before
05:02no so this was an unusual occurrence that's what i was telling you something was obviously bothering
05:07that day okay good so you told him to leave good idea what happened i continued to cash somebody out
05:13just as i closed her cash register door turned my back he punches me in the mouth didn't see it coming
05:19it was over my shoulder it was a sucker punch she drilled me in the mouth pretty hard uh he began to
05:25start to swing other hands at me i was able to block him i eventually we somehow we got into a stance
05:30of wrestle i my first instance was to get him away from the glass away from the knives away from the
05:35customers because meanwhile the lines out the door there's all these people in the establishment
05:38and this is what they're saying they're saying nick attacking the manager i got nick out into the lobby
05:43i let up as i let him up i had blood going down i went like this try to get my bearings straight what's
05:48going on why am i bleeding and next thing you know nick and chris were running down the street like
05:54two little girls okay judge judy continues in a moment what happened after you pushed him in the
06:00back he turned around and scratched me like a girl well didn't you report it to the police sir

07:10day mr baum because christopher stress was not up to date on his job he wasn't doing it properly
07:17but he was a new employee mr i know that's the whole thing you know friends can't work together
07:22so he was your friend yes we are friends before that the whole thing we had picked him up from

08:18for the weekend okay fine so now he's back at the shop mr baum so now tell me what happened with mr
08:24bar when he had come in me and christopher confronted him about what we were talking about
08:27him not doing his job right he didn't want to hear it he ignored it he walked straight up and down
08:32the line then come to me while i'm proceeding to help a customer not no old woman a gentleman
08:37he then smacked my hand pushed in front of me told me to get the hell out how did he do that sir

09:45back he turned around and scratched me like a girl how did he scratch you from the left top corner of
09:50my forehead across to my bottom right eye with his nails nails and all i still got a faint scar

15:19fully paid is that right correct you say well i paid him 650 and i can't use the music and record it
15:28because he has the copyright we agreed upon 650 as the agreement we changed the agreement because he
15:36continued to move and not and he wasn't doing a professional job so 650 was the new agreement just
15:42to use the tracks well but what you're suing for here before me is your 650 right you want your
15:50money back because you didn't get what you bargained for right that's correct he wants to be able to
15:56record the music because he's copyrighted it already correct you've copyrighted the music already
16:02they're copywritten through my machine when she comes i don't care whether they're copywritten through
16:06a machine she can't do it without your permission and you have already executed something through
16:12a machine so that you have this music copyrighted according to you no your honor you don't have
16:18copyrights to the music no there's no copyrights with the congress the copyrights is when she comes
16:24into the studio and it records the date and time when she copy comes in and recorded her music it
16:31copyrights it then and then when we finish the uh song she takes it and we sign the agreement for her

26:51phone calls were made asking for money phone calls were made regularly from her to martin and she was

28:29how many days did it take you to move back in with her it was more than a few weeks i got my own
28:34apartment and then we made an agreement with mara and her boyfriend that they could move into my
28:39apartment since they were sleeping in cindy's bed now when she moved out with her boyfriend
28:43where did you move to i moved to the air mattress and the living room floor
28:48you mean you moved out of your apartment where you had a nice comfortable bed you slept on the
28:54floor you want me to believe that the apartment was a rat's nest and that's why she moved in there
28:58because it was a rat's nest that's because she didn't want to live there no more miss clark
29:02i don't believe that there was a contract that was made between you and the plaintiff that i can
29:12characterize as a loan i think that she would call you ask you for money you loved her you gave her
29:19the money because it was your intention that the two of you were going to spend your lives together
29:25that'd be a fair statement i want to build a relationship i don't know how long term but i wanted
29:29you know i was looking out for her and kids and the only reason i did it was only assumption that
29:32she would pay me back she would always tell me she'd pay me listen to my question okay how did
29:38you think she was going to pay you back with what she said wampum she said when she got a job she
29:43started paying me back okay listen this is somebody whose business is making babies she's 27 years old
29:49she has five children she has no money she relies on the largesse of others she finally got herself a
29:54job she's got a boyfriend who can't i was going to say who can't get himself arrested but that
29:59wouldn't be true so you listen to me very carefully sir i don't believe that you had what i would
30:05consider a valid contract with her to repay you this money however i believe that you're entitled to
30:12the money from her because i believe she defrauded you i believe she led you to believe that you were in
30:19a monogamous relationship with her and based on that monogamous relationship that was working
30:25towards something that could have been permanent she was asking you for money and i believe that all
30:31the time she was asking you for money she was making a fool out of you with mr triton so she got that
30:38money from you fraudulently and she has to return it judgment for the plaintiff for the amount of
30:45five thousand dollars that's all thank you no i did not fraudulate him the whole time we were
30:52we were totally together she was cheating on the trade i should have told him she's a lion
