00:19Dapat ibalik sa PhilHealth ang pinalipat na 60 billion pesos na pondo nito sa National Treasury.

00:25The Supreme Court, through the ponensya of Associate Justice,

00:31Ami C. Lazaro Javier, unanimously ordered the return of PhilHealth funds.

00:37Matatandaang noong 2024, pinare-remit sa PhilHealth ang halos 90 billion pesos

00:43na sobra umanong pondo na hindi ginagamit ng ahensya.

00:47Na-i-remit sa National Treasury ang naunang 60 billion pesos.

00:50Pero ang balanseng halos 30 billion pesos hindi natuloy

00:54dahil nag-issue na ang Supreme Court ng temporary restraining order

00:58ng kwestionin ito sa Korte Suprema.

01:00Sa desisyon ngayon ng Supreme Court Unbank,

01:03idineklara nitong walang visa ang special provision

01:06sa 2024 General Appropriations Act

01:09at ang circular ng Department of Finance

01:11na ginamit na basihan ng gobyerno

01:12para sa paglipat ng pondo ng PhilHealth sa National Treasury

01:16dahil nakitaan nila ng grave abuse of discretion

01:19ang pagpapatupad nito.

01:21Kontra rin daw ang mga utos sa dalawang batas

01:24ang Syntax Law at Universal Healthcare Act.

01:26Bukod sa pagbabalik sa PhilHealth ng 60 billion pesos,

01:30tuluyan din itong ipinagbawal ang paglipat

01:32ng natitirapang halos 30 billion pesos mula sa PhilHealth.

01:36Sabi ng Korte Suprema,

01:37immediately executory ito o agad-agad dapat ipatupad.

01:41Tinanggihan naman ang Korte ang hiling ng mga petitioner

01:44na tukuyin ang criminal liability o pananagutan

01:47ni dating finance secretary at ngayon yung executive secretary Ralf Recto

01:51para sa technical malversation o kaya ay plunder.

01:53Wala po ang criminal liability determination in this case.

01:58The Supreme Court said that this was not the proper proceeding

02:01to determine the criminal liability of the secretary of finance

02:07because this is a petition for certiorari under Rule 65

02:11which deals with determining whether there is grave abuse of discretion.

02:17Sabi ni Recto, ginagalang nila ang desisyon ng Korte

02:21at susunod daw ang ehekutibo sa utos ng SC

02:23na pagbabalik ng pondo sa PhilHealth.

02:26Guit pa ni Recto, sumunod lang ang ehekutibo sa direktiba ng Kongreso

02:30at naniniwala sila noon na isa itong paraan

02:33para sulitin ang paggamit sa kaban ng gobyerno

02:35ng hindi nangungutang o nagpapataw ng bagong buwis.

02:39Iginagalang din ang Malacanang ang desisyon ng Korte Suprema.

02:44ang ruling at saka magdidesisyon sa susunod na akbang

02:47kabilang ang paghahain ng motion for reconsideration.
