The new report details Harvey Weinstein's pervasive use of lifetime nondisclosure agreements, as signed by Filipina-Italian model Ambra Battilana Gutierrez and former assistant Zelda Perkins.
Transcript
00:00When the many allegations of sexual harassment, assault and rape against Harvey
00:03Weinstein came to the public's attention last month, the mogul's brother,
00:06Bob Weinstein, said he was unaware of Harvey's harmful behavior.
00:24However, a new expose from The New Yorker by Ronan Farrow points out that some of
00:27the payments underwriting Harvey Weinstein's settlements with accusers came from Bob's
00:31personal bank account in order to hide the move from Miramax, Disney and Harvey's wife
00:36Georgina Chapman. One example? A 1990s case involving Harvey's former assistant
00:41Zelda Perkins saw Bob pay £250,000 to be split between two female employees in England
00:47who accused Harvey of sexual harassment and assault.
00:49Bob Weinstein acknowledged the personal payout to The New Yorker but said he was
00:53misled about how the money was being handled.
00:55Regarding that payment, I only know what Harvey told me and basically what he said was
00:59he was fooling around with two women and they were asking for money, he explained.
01:04And he didn't want his wife to find out, so he asked me if I could write a check,
01:07and so I did, but there was nothing to indicate any kind of sexual harassment.
01:12The report outlines Harvey Weinstein's pervasive use of lifetime non-disclosure agreements
01:16as detailed with Filipina-Italian model Ambra Bataliana Gutierrez and former assistant Perkins.
01:22Both spoke to Farrow in violation of their NDAs and noted how they felt pressured by lawyers
01:27on both sides to sign their settlements after hopes for criminal justice were dimmed.
01:31The story also shows how the use of such agreements perpetuates the behavior of repeat offenders
01:35while silenced victims are left to suffer. For example, Rose McGowan, who has publicly claimed
01:40that Weinstein raped her in 1997 at the Sundance Film Festival, reached a $100,000 settlement
01:45with Weinstein. It did not include a non-disclosure provision, but removed her right to sue Weinstein.
01:50She told The New Yorker that though she wanted to pursue charges at the time,
01:54her lawyer instead convinced her to sign the agreement.
01:56That was very painful, she said. I thought $100,000 was a lot of money at the time
02:01because I was just a kid.
02:03Farrow's expose additionally details the participation of Erwin Reiter, a longtime employee of Weinstein's,
02:08who said he spoke out to combat the company's culture of silence.
02:11Weinstein was so dominant that I think a lot of people were afraid of him, afraid to confront him
02:15or question him, and that was the environment, he said.
02:18A forever NDA should not be legal. People should not be made to live with that.
02:22He's created so many victims that have been burdened for so many years, and it's just not right.
