00:03My name is Tim Schmoyer.
00:04And just like we do every Thursday,
00:06I'm going to take a question from one of you guys
00:08and do my best to answer it to help you out
00:09with the audiences and the channels that you are growing
00:11here on YouTube.
00:12This question is from Christine Does Drama on Twitter.
00:15And she tweeted me and asked this.
00:17You probably get this question a lot,
00:18but is it true that you can use 30 seconds of any song
00:21in your YouTube video?
00:23Christine, I know that is like a common thing
00:25that a lot of people talk about and believe to be true.
00:27But it is absolutely 100% not true.
00:30Whoever tells you that is clearly not
00:32familiar with copyright law.
00:34And you can definitely get into trouble,
00:36even just for using one second of a copyrighted music
00:40or sound effect or anything that doesn't actually belong to you.
00:43However, instead of just leaving you hanging
00:44without a big disappointment, someone from the video creators
00:47community here, Bea Chambers from the Alloy7 video YouTube
00:51channel, is here with us to tell you
00:53how you can use copyrighted content,
00:56whether it's music or gaming footage or movie clips,
01:01whatever the case may be, how you can actually
01:02use those legally and be in the clear on your YouTube channel.
01:06Here he is.
01:07Hey, what's up, fellow creators?
01:09My name is Bea Chambers from Alloy7 video.
01:11And I'm mostly known for doing gaming reviews, gaming editorials,
01:15and also tutorials for people on how to run a gaming channel
01:18here on YouTube.
01:19So the first step in monetizing the videos
01:21that you create that use material that's copyrighted by someone
01:25else is very simply to determine who the copyright owner is.
01:28And in the realm of games, movies, and TV, that's usually pretty easy.
01:32With games, it's usually the game's developer or the game's publisher
01:36that owns the copyright.
01:37When it's not, usually a Google search will figure that out for you
01:40or even Wikipedia.
01:41I've also done some legwork on Alloy7.com.
01:44I'll have a link to the specific page in the video description that shows you
01:48all of the copyright owners that I reached out to and what their answers were.
01:51When it comes to movies and TV shows, it's usually very easy to determine that
01:56because the people that own the movie or the TV show, it's found on their website.
02:00When you step into the realm of music, it gets a little bit more complicated.
02:04And this is actually why I don't recommend trying to use other people's copyrighted music
02:08in your videos.
02:09Let's say a bunch of artists came together and made the song that you're trying to use
02:14in your video.
02:15Who owns the copyright?
02:16Is it the record label?
02:17Both artists may come from a different record label.
02:19Do the writers, do the composers, do the people performing the song own the rights?
02:23A lot of times, that's nigh impossible to determine.
02:26And to take it a step further when you start talking about content ID matches, take for instance
02:30the album that I put out about two years ago.
02:32Even if I gave you written permission today, signed by me, that said you could use every song
02:37on my album in your video.
02:38I can guarantee you that you would get a content ID match from CDbaby.com.
02:43That's who I went through to publish and to distribute my album.
02:47You'd have permission from me, but then you'd still have to deal with CDbaby in your back
02:50end, which means you'd have to get in touch with me and then get me to deal with CDbaby.
02:54It's a pain.
02:55So unless you're just really brave or for whatever reason just can't get away from using somebody's
02:59music in your video, I'd recommend that you just leave it alone.
03:02Okay, now that you've determined who the copyright owner is, the second step, and I'll admit
03:07that this second step is more related to gaming video creators than anyone else, but the second
03:12step is to go to the copyright owner's website, look to see if they have a terms of use that
03:17gives you permission to make and monetize YouTube videos.
03:20A great example of this is Microsoft and Activision Blizzard.
03:23Microsoft in their terms of use online gives you permission to make videos using their content
03:28as long as they're not offensive, but not to monetize the content.
03:32Activision Blizzard's website, on the other hand, gives you permission not only to make
03:35the videos, but also to monetize it.
03:37So if you're a gaming video creator that's trying to do something with an Activision Blizzard
03:40game, your work's done.
03:42It's right there online.
03:43I actually have links where you can find that on the Alloy7.com website.
03:48But look around.
03:49If you found a game that maybe isn't on my website that you want to use, see if there's
03:52a terms of use out there that answers the mail.
03:55Okay, so you've determined who your copyright owner is.
03:58And in step two, let's say you were not able to find any terms of use that gave you the
04:02permission you were looking for.
04:03Your third step in that case is going to be to find the best way to contact the copyright
04:08owner.
04:09And this is usually going to be through their website.
04:11They'll either have an email address to their PR or legal teams.
04:14That's the one you'll want to look for.
04:15Or they'll have an online form that you can fill out and direct to their legal or PR team.
04:20Or maybe it's just a generic form that you fill out and send off to them.
04:23That's usually what happens in the gaming world.
04:25I've found that with movies and TV shows, say like Universal Studios.
04:28If you go to Universal Studios, they actually have a website dedicated to people like us
04:33who are trying to use their footage for commercial means.
04:36And you'd sign up on that website.
04:38You'd fill out the necessary forms, get access, and it's almost like a shopping, an Amazon
04:42shopping cart where you can go in and pick, I'd like to get permission to use JAWS footage
04:46in my video.
04:47And you'd check out.
04:48And that's where I started talking about things like it may cost money.
04:51I've not gone all the way through that process, so I don't know if it costs or how much it
04:55costs.
04:56And that's the way a lot of the movie studios do it.
04:58And once you have all that knocked out, your next step is to actually contact your copyright
05:02owner via email, via the online form, or via the a la carte shopping line on UniversalStudios.com.
05:09And tell them that you'd like to use footage in your videos to put on YouTube and potentially
05:14to monetize that video using YouTube's partner program.
05:17I will have a link where you can find the email that I actually use to reach out to copyright
05:23users.
05:24It's been very successful over the course of time that I've been using it.
05:27And you can take that email and you can slice it and dice it, do whatever you need to do
05:31with it to make it appropriate to the person that you're requesting a copyright from.
05:36Okay, brief side note.
05:38Understand that most of what I've been talking about here thus far centers around asking copyright
05:43owners for permission to use their materials via email.
05:47Understand that YouTube's automated system will not accept an email as proof of permission
05:51should you get a content ID match or a copyright strike.
05:55So here's what I suggest you do.
05:57When you request permission from the copyright owners, ask them to do one of two things.
06:02One, to post the permission on their websites.
06:06Get them to put something in a public space that YouTube system can go out and search and
06:10say, Roger that, good to go.
06:12Or ask them to send you actual signed documentation via email.
06:17Having not gone through the process with movie production companies, I'm going to assume
06:21that that a la carte shopping line that I was telling you about probably doze out some
06:26type of documentation.
06:28For those of you out there who have been through that process, be sure to leave us some commentary
06:32in the comments section confirming or denying that.
06:35Okay, and the fifth and final step is follow-up.
06:37I think a lot of you are going to be surprised by just how responsive some of these companies
06:42that you reach out to are.
06:43I know I was.
06:44Getting emails from people at Square Enix and a lot of the big name game producing companies
06:50out there was a surprise to me.
06:51But every once in a while, you're going to run into a company where they either don't
06:55get right back to you or they'll get back to you and say, hey, we need more information.
06:58And when you give them that information, they may not get back to you.
07:01So the next thing to do is just simple, good old-fashioned follow-up via email or via the
07:06online form that they have available to you.
07:09And that's pretty much it, friends.
07:10That's how I usually walk people through how to monetize their channels.
07:14Again, I'm mostly focused on the gaming world.
