00:00:29Welcome to the Iowa blog. Here we are in the rainbow studio. I think we need to chill out just a moment. However, a number of you have read my introduction to this afternoon's program and know that I was volunteering as a witness in a trial that involved an aviation injury based upon a pilot doing some really, really foolish things.
00:00:52And I've come back from that. It took a day of prep and three quarters of a day yesterday of nothingness. And today was just absolutely horrendous.
00:01:07It is frustrating to be in a situation where you're donating your time. I wasn't charging anybody for anything. I didn't know the plaintiff, didn't know the defendant.
00:01:16And so I'm there because somebody was injured and somebody did something really reckless with an airplane. And I was in a position to explain exactly why the accident occurred and who was responsible throughout the entire process.
00:01:33And yet the judge did not allow the attorney that had invited me to testify to ask even general questions about my experience in an aircraft that were absolutely allowable under any circumstance.
00:01:54But the judge ruled against that. But then on cross, the defendant's attorneys, two of them, were able to ask all manner of questions based strictly on aviation knowledge, where the plaintiff's attorney wasn't able to ask any.
00:02:18And they got to say, and they got to say, and they got to say, and they got to be rude. They were finger pointing. They were yelling. And you're, I don't know if you've all seen My Cousin Vinny, one of the great movies of all time.
00:02:28And remember when she is asked, Melissa Torme is the character, and she is asked a question about the skid marks and the carburetor of the car at a particular time.
00:02:46And she calls it a yes or no and a question. Well, I was asked yes or no questions. And her response was, no one can answer that question. It's a bogus question. Recall that?
00:02:56Oh, yeah.
00:02:57Well, that was all I got was bogus questions requesting a yes and no answer. And every time you say, I can't responsibly answer the question, yes or no.
00:03:07You are making a comparison here between penguins and the Sahara, where they don't belong, or eagles and their natural habitat. There is no correlation other than they're both birds.
00:03:18And yet the judge didn't have any concept of this or why a bogus question couldn't be answered, yes or no. It was so frustrating because here you are, there's a panel of jurors that have been there for a week or more hearing this case where the testimony and affidavits by the pilot are clear as to what he did that was dangerous and wrong.
00:03:47Somebody got injured and the judge will not allow testimony that would explain the entire process to the jury so they could make an informed decision.
00:03:56It is the opposite of what Yawa wants. It is the opposite of how we, I'm just looking over here, we've moved all of these panels so that we have no acoustic control.
00:04:09Can we put them all back so that we don't have two parallel walls echoing off of each other? Thank you, Rich.
00:04:17So Yawa wants all of the evidence laid face up on the table. He wants you to know what there is to be known and to be conveyed by the most experienced people in terms of conveying his testimony as accurately, as completely as is possible.
00:04:37And then to have an intelligent discussion about it. And you can tell people, this is what I know, this is what I don't know, this is what I've got right, this is what I've got wrong and needed to correct.
00:04:49You can have an open and honest discussion that puts everybody in a position to make an intelligent decision.
00:04:56Not in a court of law apparently. Very frustrating that that is what's happened to our society and that judges will allow that kind of behavior to occur in their courtrooms and that we're just wasting our energy on spinning our wheels by having people render verdicts where they have absolutely no basis to make an informed decision.
00:05:26Besides that, it was really fun. Next time I want a root canal, I'll be sure to ask this judge for a recommendation.
00:05:38All right. By the way, that was my second experience in that same courtroom. You know that? I had all but adopted two young men here on the island who were, I had taught a trade how to work.
00:05:50One of them was in jail when I first met him. I was thrown in jail for eight months without any evidence, without a hearing, without anything. The judge threw him in jail for that long and wouldn't even review the case.
00:06:03Completely illegal. And then when the judge finally let the young man out, the young man had to stay at home with an ankle brace, couldn't even work.
00:06:12I found this out. I wrote the judge a letter, said I'll be responsible for the young man. I've heard this is what's happened to him. I'll teach him a trade. I'll supervise him. Release him to my recognizance.
00:06:23The judge did. I had very strict rules that I had to apply with a young man. I did. He worked here for a couple of years.
00:06:33And during that process, he had a hearing because cops acted badly. They lied.
00:06:39And I knew they had lied because I had done the research. I had combined compared the the affidavits of the police on the scene and I had gone to the scene and I had interviewed all of the witnesses.
00:06:52I took the time to do a thorough job and actually provided the judge with affidavits that were signed by all of the witnesses.
00:07:01And then I went to the attorney of the of one kid. I hired the attorney for the other kid.
00:07:07The affected attorney is so good. He is now the the district attorney for the Virgin Islands.
00:07:13He's argued cases in front of the Supreme Court. He's brilliant.
00:07:18But this other kid had a real dunderhead. And I went with the affidavits, all the research I've done to help the young man and help this attorney with the case.
00:07:26It was the same attorney that was one of the two that was belligerent and got sanctioned by the court twice for being belligerent.
00:07:34The other one got sanctioned twice also for being belligerent.
00:07:37And he wouldn't even consider the affidavits until I said, I don't care what you want to do or what you don't want to do.
00:07:44I don't care if you try to physically throw me out of the office.
00:07:46You're going to read these things and you're going to read them in my presence or I'm going to read them to you.
00:07:51The kid's life is at stake.
00:07:52And he realized I wasn't kidding around.
00:07:57Oh, you what you have found is I will bow my back for my friends.
00:08:02If somebody that deserves to be supported or I think they have been wronged, I will always bow my back to defend them.
00:08:09I did on this kid's case.
00:08:11And by the time I was halfway through, he said, give me a copy of that.
00:08:15I want to read along with you.
00:08:16He just said, that's the answer for our case, obviously.
00:08:19And then he made a mistake on the hearing, was not prepared for the hearing, yelled at the judge, was held in contempt by the judge.
00:08:29The judge hadn't read any of the affidavits, not by the cops, not by the ones that I wrote and that were signed.
00:08:35And he then proceeded to reject his own prior testimony.
00:08:42And he allowed a cop to testify that wasn't even on the scene saying that he was there.
00:08:47It was so frustrating that since I knew the governor personally, I spent a lot of time with him, I wrote, came back and immediately drafted a letter and sent it off to the governor and said, this is what happened in your courtroom today.
00:09:01This was the judge.
00:09:02This is what happened.
00:09:03And the judge was dismissed.
00:09:05So, fun.
00:09:12Fun, fun.
00:09:13You know, it's, you know, you're, and listening to these programs.
00:09:16And for those of you who have known me over the past, anywhere from 10 to 24 years, depending on who you might be and when we first met, you know, I'm real serious about right and wrong, truth and lies, productive and counterproductive, conveying what you know as honestly and as accurately as you possibly can.
00:09:38Standing up for people when they have been wronged and being extremely antagonistic when someone does like Dee Powers has done, where she claims that she is the victim when she has been nothing but a repute of just an absolute repulsive victimizer.
00:09:57So, when people do that kind of stuff, yeah, I have backbone.
00:10:02I have courage.
00:10:03I have character.
00:10:03I will stand up to them 100% of the time.
00:10:08And if that bothers you, then you don't belong in Yahweh's family.
00:10:13If holding people accountable when they are wrong, when they are demeaning people, when they shouldn't.
00:10:18Let me give you another example.
00:10:20When Paul wrote the Christian New Testament and he elicited Peter and they claimed that Jews crucified their man God.
00:10:30And I was able to prove conclusively that their man God never existed and that that did not happen.
00:10:35What do I do?
00:10:36I say, oh, it's a religion.
00:10:38You two billion people.
00:10:40You ought not be confrontational.
00:10:43Let bygones be bygones.
00:10:44Just because they demonized and dehumanized Jews and persecuted and subjugated them and terrorized them and plundered them for 18 centuries, let's just look past the cause of it all.
00:10:58And let's pretend we can all get along.
00:11:00Let's pretend we can all get along.
00:11:01No.
00:11:02I know he wrote 14 books of the Christian New Testament.
00:11:07And I went after him tooth and nail because he was wrong, because he victimized people that he should not have treated that way.
00:11:15Because he stole the identity of my beloved king, our Messiah, and the very son of God.
00:11:21That is what God requires of us.
00:11:25That is what he does.
00:11:27That is what he wants.
00:11:30If you're sensitive and timid and you don't like that, then get out of the way.
00:11:35Seriously.
00:11:36Just go.
00:11:37But please leave quietly.
00:11:40That's your thing.
00:11:41We should just all get along.
00:11:43Be tolerant.
00:11:44Be even tolerant of...
00:11:45Why not be tolerant of Islam?
00:11:46Let's be tolerant of Judaism.
00:11:48Let's be tolerant of Christianity.
00:11:50Who cares that it's a pile of lies and all of the damage they have done to humanity.
00:11:54Let's be tolerant of Marxism.
00:11:56Just because Hitler and Mussolini were Marxists before they thought that the branding of a fascist suited their fancy.
