00:00Criteria for a valid marriage, the role of a guardian.

00:04Marriages in the UAE are governed by the UAE family laws,

00:08which include the personal status law and the civil status laws.

00:12The civil status laws include Federal Decree Law No. 41 of 2022,

00:17governing non-Muslims in the UAE, except in the Emirate of Abu Dhabi,

00:22and the Abu Dhabi Law No. 14 of 2021, applicable to non-Muslim in Abu Dhabi.

00:27The personal status law is stipulated under Federal Decree Law No. 41 of 2024

00:34and governs all Muslims in the UAE, both nationals and expatriates.

00:39The law also covers any family matter that is not covered by the civil status laws.

00:45Under Article 16 of the personal status law,

00:48marriage is a contract between a man and a woman

00:50with the intention of perpetuating the marital relationship to establish a stable family.

00:55For a valid marriage, the following criteria must be met.

01:001. Offer an acceptance by the spouses.

01:042. Presence of a guardian.

01:073. Both parties must have attained 18 years of age.

01:114. Free consent.

01:14Can a father withhold approval for the marriage of his daughter?

01:16Article 24 states that the rule applies even if the guardian is the father of the woman.

01:24The marriage shall be organized by the court upon the woman's request or another interested party.

01:30Moreover, the court may transfer the woman's guardianship to another guardian

01:33or delegate it to someone else,

01:36should the court deem such actions appropriate and beneficial.

01:38Is a guardian required under a civil marriage?

01:42As the presence of a guardian is an Islamic requirement,

01:46marriages under the civil law do not require the presence of a guardian.

01:49Thus, non-Muslim couples marrying in the UAE

01:52do not need the presence of a guardian to validate their marriage.
