00:00Delores Black is suing former driver David Hamilton for a loan.
00:04David wants Delores to pay for his designer uniforms.
00:08Now, was there any time set for the repayment of this loan, Ms. Black?
00:12Yes, there was.
00:13What was the time?
00:14By the end of the month.
00:15By the end of the month?
00:16July of 98, that's correct.
00:17Does that sound right to you?
00:18No.
00:19So, you disagree on that, but it's not particularly relevant.
00:24Now, what I loved about your response was your counterclaim.
00:28You say that as part of your job, you were required to look nice.
00:34Expected.
00:35And that there was an agreement that the plaintiff would reimburse you 50% for your employee uniforms.
00:46That's true.
00:47Is that correct?
00:49To a certain amount, that is correct.
00:52Did he ever furnish you with bills for his uniforms?
00:57No, he did not.
00:57And, in fact, the employment contract states up to $150, which he signed.
01:02And Lonnie, an employee of the company, is the witness to that.
01:05So, here we go.
01:06And this is the best part.
01:09This is what your countersuit is.
01:12By the way, you drive a limousine, which means you're supposed to be in a dark suit.
01:16Right?
01:17Correct.
01:17Right.
01:18Nice black suit.
01:19And a white shirt.
01:22And a tie.
01:23Any color that you like, as long as it's conservative and it doesn't have a picture of Pluto on the front.
01:29Right?
01:30It depends who you're driving that week.
01:31Bought yourself an Armani suit?
01:37Yes, ma'am.
01:38For $1,200?
01:40Got good taste.
01:41Brooks Brothers suit, $700.
01:44This guy's got quite a sense of humor.
01:46A Canale suit for $700.
01:48How much money did you earn?
01:52Average was probably $8 an hour.
01:54Gratuities could exceed $10 an hour on top of that.
01:57So, the grand total of $18 an hour, that doesn't require an Armani suit for $1,200.
02:05Then we've got white shirts.
02:08Ten shirts you bought at $40 a shirt.
02:12Perry Ellis.
02:15Love it.
02:16Now, this one would really send my husband into a tailspin.
02:23You know, he likes those ties.
02:24Three for $10 that you buy, you know.
02:28Six ties at $45 a piece.
02:32$270.
02:34And here we go.
02:35This is almost my favorite.
02:37Two pairs of shoes at $210 a pair.
02:39You don't even walk around as a limousine driver.
02:44Judge Judy continues in a moment.
02:46Want justice?
02:53Call 1-888-800-JUDY.
02:55On the Internet, JudgeJudy.com.
02:59The lawsuit's the most ridiculous thing I ever saw.
03:03I mean, I think you're probably almost embarrassed when you had to sign it.
03:06Now, why didn't you pay it back $1,500?
03:08Financial difficulties.
03:17How'd you pay for your Armani suit?
03:20You gotta look nice.
03:22How did you pay for your Armani suit?
03:25Paid for it in full.
03:27How?
03:28Cash or check?
03:29I can't deal with him.
03:31Judgment for the plaintiff in the amount of $1,500.
03:33That's all.
03:33Potties are excused.
03:34You may step out.
03:38Judge Judy continues in a moment.
03:41All parties on Fleming versus Bradburn.
03:45Step forward, please.
03:45Bar owner Robert Fleming is suing his former bartender, 24-year-old Brandy Bradburn, for not repaying a loan.
03:53Brandy is countersuing for her last paycheck.
03:57Order.
03:58All rise.
03:59Judge, this is case number 605 on the count of the matter of Fleming versus Bradburn.
04:08Parties have been sworn in.
04:09Judge, you may be seated.
04:10Folks, have seats, please.
04:12Mr. Fleming, I've read your complaint.
04:14It indicates that the defendant was an employee of yours in your bar.
04:17That's correct, Your Honor.
04:18And she was there for how long?
04:20About 10 months.
04:21What kind of work did she do?
04:22She was a bartender.
04:24According to you, you made a loan to her of some money.
04:26That's correct.
04:27And she didn't repay that loan?
04:30Not yet, no.
04:31What was the money for?
04:33Well, it was to pay off a speeding fine, which had gone to a warrant.
04:37It was for minor repairs to her car, which she couldn't get insurance on.
04:42It needed smogging, and she wanted to pay the licensing for it, too.
04:47And how did the loan come about?
04:50Well, one evening she was closing up after the day's trading, and I noticed she was crying.
04:55She was pretty upset, and I assumed that one of the customers or something had happened
04:59to upset her.
04:59When I inquired as to what was wrong, she was a bit reluctant to tell me at the start,
05:04but finally I said, look, leave the money alone, because if you're not counting it properly,
05:07she couldn't concentrate, and sit down and tell me what the problem is.
05:12Finally, she did, and she said that this speeding fine had gone to a warrant.
05:17She was concerned, very worried that she was going to be arrested, et cetera, et cetera.
05:22She had an estimate for the repairs and approximate for everything, and it came to about $650.
05:29So I said, look, I'll lend you the money.
05:31Don't worry about it anymore.
05:33Concentrate on your job.
05:34You're no good to me if you can't concentrate, and we'll get this matter sorted out.
05:40You can pay me monthly.
05:41She said, Bob, if you lend me the money, I'll pay you weekly.
05:44I said, fine, not a problem.
05:45I paid the speeding fine the very next day, and then later, it was two days later or something,
05:55I gave her the money for the repairs, for the smoke, for the insurance, and the licensing of the vehicle.
06:00Did you personally pay the speeding ticket?
06:03Yes, I did.
06:03And how did you go about doing that?
06:05On a credit card over the telephone.
06:07Had she given you the ticket?
06:09No, she gave me the details, and I called the Riverside Police Station.
06:13They had it on file, of course.
06:15When you say she gave you the information, how did she give you the information which enabled you to call the Riverside Police?
06:21She gave me her name, date of birth, license number of the vehicle, the date that the booking occurred.
06:29Okay.
06:30You clearly acknowledged that he paid this ticket.
06:33Yes, ma'am.
06:33Let's start with the ticket.
06:34Tell me your version of the events about the ticket.
06:37I did get the slip.
06:39I got it in the mail, and I took it to work with me that day,
06:42so it wasn't that night when I was counting my money out.
06:45And I was upset about it, but I wasn't hysterical.
06:48And I did talk to Bob about it.
06:50We were friends at one point, and I did talk to him about it.
06:52And he did tell me not to worry about it, and I had left the slip there that I'd gotten in the mail.
06:57The next day when I came in, Bob handed it to me, and he said, I've paid this for you.
07:02I told him that I would have to pay him back, and he told me not to worry about it.
07:07And then we went through this forever about me asking to pay it back, and he telling me not to worry about it.
07:12Let's get to the other money that you borrowed from him.
07:15What did you borrow that for?
07:17Ma'am, I did not.
07:18Bob had given me a check one time for $1,500 that I ripped and promptly gave back to him.
07:24Smogging your car, insurance on your car, license plates for your car.
07:29He didn't pay for any of that for you?
07:31No, he didn't.
07:32Do you have any proof, sir, that you gave her money other than paying this ticket?
07:35Yeah, Mr. McCarthy was there when I gave it to her.
07:37It was in the morning.
07:38Is this your partner?
07:40Yes.
07:40Step up, sir.
07:43Mr. McCarthy?
07:44Yes, ma'am.
07:45Were you present when he gave her the other $400?
07:49Yes, ma'am.
07:49Did he give it to her in check or cash?
07:51Cash.
07:53You saw her accept it in her hand?
07:55That's correct.
07:56Bob never, ever, ever, at any given point, ever gave me cash in my hand.
08:01Ever.
08:02And about the loan that he says it's a loan, Bob pulled me aside numerous times.
08:07I mean, we have this whole sexual harassment thing going on.
08:10You're going to tell me about your counterclaim in a minute.
08:13Right now I'm talking about his lawsuit.
08:15Which, I find a couple of things suspect about your answer.
08:19Let me read you a few things from your answer.
08:22First of all, you just told me that this was a gift.
08:24He said to you, don't worry about paying me back.
08:27Don't worry about anything else.
08:28But in your answer, which is your sworn statement, you say,
08:31Bob told me that if I did his books at work,
08:34he would pay me $50 a week in cash and deduct $50 a week from the ticket he paid for me.
08:40Right, Your Honor.
08:41But in my defense, I kept, I was after him all the time.
08:44My mother even offered to pay that money to him.
08:46I offered to pay it.
08:47Finally, he said, if it really means that much to you, you can help me out doing my books,
08:51and I'll take $50 off and pay you $50.
08:53Good.
08:54So, then there was an agreement that you would do his books and he would deduct $50 a week.
08:58Right.
08:58How long did you do his books?
09:00Approximately a month and a half.
09:02Did she do your books?
09:04Yeah, she was helping with the paperwork.
09:05About how long?
09:07Like she said, about a month and a half.
09:08Okay, so that's six weeks.
09:10And did you pay her?
09:10Six weeks.
09:11Did you pay her for doing that?
09:13For doing that?
09:13Or did you actually deduct the $50 a week?
09:16No, not to my recollection, I didn't.
09:17So, six weeks, $50 is?
09:20$300.
09:22Okay.
09:23So that we're clear.
09:25I believe that he gave you this other money, and including the parking ticket, you owe him $650.
09:30I'm deducting the $300 that you should have got for doing the books, because you should get credit for that.
09:35That was your agreement.
09:36That leaves $350 left.
09:37Now let's get to your counterclaim.
09:39Ms. Bradburn, you're saying your counterclaim that he refused to give you your last paycheck.
09:46Correct.
09:46Tell me about it.
09:48Okay.
09:48The night that I left work, I left really upset, and I'd quit, and I'd walked out.
09:53Two days later, I'd called him and asked him if I could pick up my check.
09:56He was at the bar.
09:58He told me, yeah, fine, whatever.
09:59It was a real short conversation.
10:01So, I went down there that evening with Rich, who was my boyfriend at the time.
10:06I went down there that evening to pick up my check.
10:08The bartender that was working told me that my check was not there.
10:11I asked her if she would get Bob on the phone.
10:13She got Bob on the phone.
10:14I talked to him.
10:15By the time I got off the phone with him, I was in tears.
10:17He called me all sorts of things, told me I wasn't getting the money.
10:21How much money did he owe you at that point?
10:23Approximately $300 is the minimum I should have got for the time I'd worked.
10:28How many days' pay was that?
10:29A week and a half.
10:31When she left, was there money outstanding?
10:34She had a paycheck to pick up.
10:37Yes, there was.
10:38How much?
10:39I think it was from memory.
10:40I think it was $160.
10:43That's all.
10:44Did she pick it up?
10:45No, she didn't.
10:46I haven't seen her since the time she left.
10:49This is the first time I've laid eyes on her.
10:51And I haven't spoken to her in the meantime.
10:53I tried on several occasions to contact her.
10:56Her telephone had been disconnected.
10:58I called, I talked with friends of hers who said that she had moved back home with her parents
11:02into some house that they'd just recently rented.
11:05Nobody knew where it was.
11:06I finished up calling her grandmother on three occasions and left messages there.
11:10What were you calling her for?
11:11To find out what to do with her paycheck, where to send it to.
11:14I had no address.
11:15I had nothing.
11:16Your Honor.
11:17Yes.
11:17Your Honor, that's all a crack of.
11:19If he had my grandmother's number, he obviously had my mother's number.
11:22He never once tried to call them.
11:24Judge Judy will continue in a moment.
11:26I, quite frankly, Mr. Fleming, don't think that somebody who's in business like you are
11:29is Santa Claus.
11:31And later today.
11:32Everybody has one life to live.
11:34Unless you think you're going to come back as an Eskimo pie.
11:37You have one life to live.
11:41Real cases.
11:42Real people.
11:43Judge Judy.
11:45Bar owner Robert Fleming claims former bartender Brandi Bradburn owes him for a loan.
11:51Brandi says Robert owes her for her last paycheck.
11:54Mr. Fleming, let me tell you something.
11:56You know, sometimes a little bit of truth on this side and a little bit of truth on this
11:59side, sir.
12:00I don't know of an employer who was acting reasonably that would make as many phone calls and
12:07contacts, as you just told me you did, to try to give her $160.
12:11Maybe my boss would do that if I moved.
12:15No, he would.
12:19But I don't know of any normal person who would do that that ran a business establishment.
12:23Now, if you told me that you called her to find out whether you were going to get your
12:26money back, huh, that I could understand.
12:28I didn't call her for that purpose.
12:30Why not?
12:32I wrote it off, to be honest, really.
12:33I thought, well, that's the end of that.
12:35You see, my problem is.
12:36Let me tell you what doesn't make sense, Mr. Fleming.
12:39What doesn't make sense is you're prepared to write off the money that she owes you.
12:44Right.
12:45But you're not prepared to write off money that you owe her.
12:49Well, that doesn't make sense to me.
12:52It was her wages.
12:53Does that make sense to you?
12:54Not at all.
12:55What is it?
12:56You say it's her wages.
12:57She does.
12:58Well, yes, shh, Mr. Fleming.
13:02Look at your partner over there.
13:04He's got it.
13:05You see?
13:07If somebody owed me money and walked out and quit in a huff over whatever reason, right,
13:12I would say I'm going to get stiffed from the money she borrowed from me.
13:18What you're saying is you owed her at most $160.
13:23So if I were a person, I would use my math and I would say to myself, I'm still in the
13:28hole 70 bucks, right?
13:29But at least I'm going to write off her pay for what she owes me.
13:35Because I, quite frankly, Mr. Fleming, don't think that somebody who's in business like
13:38you are is Santa Claus.
13:40Your Honor, can I say something?
13:41Sure.
13:42Step up.
13:42Who are you?
13:43I'm Brandi's mother.
13:44Go ahead.
13:45I know for a fact that she did not borrow $400 for Miss Mann.
13:50We knew that there was a ticket.
13:51She'd gotten the notice.
13:53She'd taken it to work.
13:54She'd left it there.
13:55She came back the next day.
13:56It was paid.
13:57I went up to this gentleman.
13:58Just a second.
13:59You don't know any of that.
14:01You don't know any of that.
14:03That's what your daughter told you.
14:04That's what I told her.
14:05Shh.
14:06That's what your daughter told you.
14:08What are you looking at me like that for?
14:09What am I saying to you that you don't understand?
14:12What I'm saying to you is you don't know that.
14:15You know what your daughter told me.
14:16She's already told me the story.
14:18The fact that she repeated the story to you doesn't make it true.
14:22Your Honor.
14:22Why are you looking so confused?
14:24Are you confused about what I said?
14:26Well, it's very simple.
14:28I know for a fact that she didn't take the money.
14:33How do you know that?
14:33I know my daughter.
14:34Just because you know your daughter.
14:36Period.
14:36I know my daughter.
14:37Sit down.
14:38All right.
14:41$650 less $300, which you should have gotten for taking care of his books, leaves $350.
14:45Now, since neither one of you can tell me exactly how much your last paycheck was, because you
14:51don't have a clue.
14:52You have...
14:53I can give you the last three paychecks prior to it, Your Honor.
14:56Fine.
14:57What were they?
14:57You can strike an average.
14:58And I've also...
14:58One was for $160.
15:02One was for $110.
15:04Mm-hmm.
15:05One was for $177.50.
15:08Mm-hmm.
15:08And the other one was $205.
15:13And part of that...
15:13And that's a week.
15:15Is that right?
15:15Right.
15:15That's right.
15:16That's a week.
15:17That's $5 an hour.
15:17So, just a second.
15:18So, all of a sudden...
15:19All of a sudden, you made twice as much?
15:22No, no, no.
15:23I didn't say that.
15:25I didn't say that.
15:26I was just adding in the fact that he said he was going to pay me on top of that.
15:30So, I just added the $50 for that week.
15:32I'm just looking at your last four paychecks, madam.
15:34Understood.
15:35They didn't get to $300.
15:36Judgment in this case is for the plaintiff and the amount of $200.
15:39I'm averaging the last paycheck at $150.
15:41Thank you very much.
15:41That's all.
15:42As I excuse, you may step out.
15:44I think he's a big liar.
15:45He always has been.
15:46And a cheat and a thief.
15:48Don't lend money out to people.
15:49They only end up screwing you.
15:50He's asking me to marry him and have his children and dump my boyfriend and change my life and
15:55touching me and grabbing me and keeping me and irritating me.
15:57So, I love.
15:58There's never been any harassment.
16:01And now, the next case.
16:02All parties on Redding versus Ullman.
16:05Step forward, please.
16:0636-year-old Carlene Redding claims her ex-husband, 41-year-old Thayer Ullman, owes her for a credit
16:12card bill.
16:14Thayer says that bill was covered in the divorce.
16:17How long are you folks divorced?
16:18It's been approximately two years.
16:23Is that correct?
16:24Two and a half.
16:25Did you have an attorney?
16:27Yes.
16:28Did you have an attorney?
16:29Yes, I did.
16:31This lawsuit, Ms. Redding says that your former husband caused you to have a credit card bill
16:37that you think he should pay for.
16:39Yes.
16:40He says that that was all resolved in the divorce.
16:44Right?
16:45Yes, ma'am.
16:46Let me see the judgment of divorce while I'm asking you some questions.
16:50Can you see it, please?
16:52It's on page three of the property, so...
16:55Now, Ms. Redding, what credit card is this?
16:58City Bank Visa.
16:59City Bank Visa.
16:59When were you separated?
17:11Probably six months before that.
17:14Six months before the divorce?
17:16Is that right?
17:17Yes.
17:18September of 96 is the date of your divorce.
17:20On page two, which is an important part, you directed me to page three, but on page two,
17:25it says the petitioner and respondent shall each indemnify the other.
17:30That means that you'll cover the other for any, for court costs.
17:35And it further says that any other debts or obligations incurred in his name, as your name,
17:44since the separation, are yours.
17:47Right?
17:48That's right.
17:49That's what it says.
17:49So, six months prior to your divorce would be March of 96.
17:55So, show me these bills that you have from City Bank Visa that you claim he is responsible for.
18:02This card was run up way before she even left anyway, because it was already maxed out.
18:08I just want to see, sir, if there were any charges there after March of 1996.
18:14If there weren't any charges on that card that were yours after 1996, then Ms. Redding is responsible because she agreed to pay the City Bank card in the divorce.
18:30Judge Judy continues in a moment.
18:34You're the one who's ultimately going to suffer.
18:36You put a period to the end of this relationship, you put a period to the end of this relationship, you got a divorce, move on with it.
18:41So, Ms. Redding, what I want to see are those charges that were made after March of 1996.
18:59All right.
19:23So, this City Bank Visa card you agreed to pay for in the judgment of divorce, you were represented by an attorney?
19:29Yes.
19:29Fine.
19:31So, this card had a substantial balance on it.
19:34I did not run it up.
19:36Listen to me.
19:38Matt, let me take care of this business my way first.
19:42What is Klepper's Corner?
19:44That's a gas station, Your Honor.
19:46Do you use that?
19:47I put probably four or five charges in the gas.
19:50We both did.
19:51I'm talking about after March of 1996.
19:54I didn't think there was any charges after.
19:56March of 1996, I have a Klepper's Corner, $19.
20:01Another Klepper's Corner, and that's gas.
20:03Is that right?
20:05Yes, ma'am.
20:06For $23.
20:08And another, what's Phillips?
20:11It's a gas station, too.
20:13It's a gas station.
20:14Well, who fills up there?
20:16Not me.
20:18I pay cash.
20:21Do you still live in the same area?
20:23No, I live in Salina, Kansas.
20:25And where do you live?
20:26I live in Fallon, Kansas, which is a small town outside Salina.
20:30But you live in Salina.
20:32Yes.
20:32When did you move there?
20:34Shortly after our divorce.
20:36After your divorce or after your separation?
20:38Separation.
20:39Well, then these are all your bills.
20:41That's right.
20:42Because this is all from Salina, Kansas.
20:44All of these gas cards are from Salina, Kansas.
20:48And they're not very much to begin with.
20:50Let me tell you what they are.
20:52Talking about $100.
20:52Period.
20:55The rest of the bills are yours, madam.
20:57I mean, so what did you bring him here for?
21:00Come on, talk to me.
21:01Because I can't afford to pay this.
21:03Well, but that's not his fault.
21:05And the judgment of divorce clearly says that any bills
21:08that were incurred after the party separated
21:12are their own individual bills.
21:15Now, you understood this, right?
21:17To a certain extent, yeah.
21:19Yeah, but you can't come back two years later
21:21and say, I just can't afford to pay it
21:22and they want to do a do-over.
21:24Your Honor, Cassie.
21:24What?
21:25When we separated, she had the choice
21:27of what bill she was going to pay.
21:30For two years, she has done nothing but harass me,
21:34harass my family.
21:35My daughter has gone to a counselor for over six months
21:38because of this woman.
21:40I don't belong here.
21:41Judge Judy will continue in a moment.
21:43Are you in a family dispute?
21:51Call 1-888-800-JUDY
21:53on the Internet, judgejudy.com.
21:57Ms. Redding.
21:58Yes, ma'am.
22:00This marriage is over.
22:01Yes.
22:02You have no children together?
22:03No.
22:04Good.
22:05You had a divorce.
22:07You had counsel.
22:09It's finished.
22:10And I'm just going to say to you
22:12that everybody has one life to live
22:14unless you think you're going to come back
22:17as an Eskimo pie, right?
22:19You have one life to live.
22:20And if you're going to spend your life
22:22on a lot of negative energy,
22:24you're the one who's ultimately going to suffer.
22:27You put a period to the end of this relationship.
22:30You got a divorce.
22:31Move on with it.
22:32These are your responsibilities.
22:33You have to take care of them.
22:35You got to leave him alone
22:36because if you don't have children together,
22:38there is absolutely no reason for you
22:40to have any contact with this man or his family.
22:44And if you do, one of these days,
22:47he's going to file a lawsuit with you civilly
22:50for harassment,
22:51or he's going to have you arrested criminally
22:53for harassment.
22:54Do you understand?
22:55Yes, ma'am.
22:55That's going to be very unpleasant.
22:57This case is dismissed.
22:58If I'm excused, you may step out.
23:00Judge Judy will continue in a moment.
23:02All parties on Sewell versus Ware.
23:07Step forward, please.
23:0840-year-old clerk Carol Sewell
23:10is suing former boyfriend,
23:1229-year-old James Ware,
23:14for keying her car
23:15and ripping a gold chain from her neck.
23:18James is countersuing
23:19for damage to his car and harassment.
23:24Order.
23:24All rise.
23:25Yeah, this is case number 674
23:33on the calendar
23:34in a matter of Sewell versus Ware.
23:36Parties have been sworn in, Judge.
23:37You may be seated.
23:38Folks, have seats, please.
23:40All right, Ms. Sewell,
23:42you and the defendant
23:43had been involved
23:44in some sort of a relationship.
23:47He went to jail,
23:48according to your complaint.
23:50When he got out of jail,
23:53he keyed your car.
23:54Is that right?
23:55Yes, he did.
23:56Did you see him do it?
23:58I seen him do it the second time.
24:00The first time,
24:00my sister saw him do it.
24:02Step up, you.
24:03What was he in jail for, by the way?
24:05What were you in jail for, sir?
24:07She sent me to jail for a...
24:09Well, it wasn't jail.
24:10I caught a parole violation.
24:12The way the parole system works is
24:13all she has to do is make a complaint
24:16and they put me back in prison.
24:17How long were you on parole?
24:19I was on parole for four years.
24:21What were you originally incarcerated for?
24:24Involunteering manslaughter.
24:25And during that parole period,
24:27she called and registered
24:28a complaint about you?
24:29Yes.
24:30Was her complaint domestic violence?
24:33More or less.
24:33I have her charges here.
24:36Let me see.
24:38And when you went back to jail,
24:39how long did you serve, sir?
24:40Uh, she did it a couple times.
24:43The first time was six months
24:46and the second time was two years.
24:53You did six months,
24:55but that wasn't on a parole violation.
24:57Well, yeah, it was on a parole violation
25:00and I did a six-month violation
25:02because she said that I had, uh,
25:04stole her gold chains
25:05and she's done this a couple times.
25:08She's a,
25:08it's like a failed attraction
25:10that she has for me.
25:11All right.
25:12Listen to me.
25:14Did you ever witness him keying her car?
25:16Yes, I did.
25:17The first scratch.
25:17What's your name?
25:18Sandra Massal.
25:19Ms. Massal, when was that?
25:21It was the end of October.
25:22He came to my house on a Saturday.
25:23October of 98?
25:2498.
25:25Came to my house
25:25about eight o'clock on a Saturday morning,
25:27knocked on the door.
25:28I got up because she was asleep
25:30and I asked who it is.
25:31He said, Jamie,
25:32and he looked in my window,
25:34the top of the door,
25:35and I said, just a minute.
25:36I went and woke her up
25:37and I said, Carol, Jamie's out there
25:39and I told you I don't want him
25:40on my property anymore.
25:41So she gets up,
25:42she goes outside,
25:42stayed out there about 20 minutes.
25:44She came back in
25:45and I was watching out my bedroom window
25:47and he walked over to the car with his key
25:48and went right down the side of her car.
25:51Jamie.
25:51Jamie, this lady is telling me the truth.
25:56When did you get out of jail?
25:58I got out of jail August 29, 1998.
26:008, 29.
26:01So a month later, you were at her house.
26:03No, I live with my fiance.
26:05No, no, a month later,
26:06you went to her house.
26:07No, I didn't.
26:08You mean to tell me she's lying
26:09when she says you even came to the house
26:11to talk to her?
26:11That's very true.
26:12In October?
26:13I haven't been allowed at her house,
26:14your honor, for a couple years.
26:17Jamie.
26:20Jamie.
26:21You have to be careful
26:22because then I won't believe anything
26:23that you tell me.
26:25Now, tell me about the gold chains.
26:28Well done.
26:29You say you have the receipts
26:31for the gold chains.
26:32She says you ripped them off her neck.
26:34Yes, your honor.
26:34She's made malicious stories up
26:36on several occasions.
26:37Well, I understand that.
26:38Your defense is not that it didn't happen.
26:39You said they're my chains
26:40and I have the receipts for them.
26:42Yeah, here's the receipt.
26:43All right, so there you go.
26:45Let me see the receipt, please.
26:47Sure.
26:47I'm unsure of what chains she's talking about.
26:49Just a minute, Jamie, Jamie.
26:55Jewelry.
27:00Where'd you get this from?
27:01She, this was...
27:03Where'd you get...
27:03Shh, shh, shh.
27:05Where'd you get this from, Jamie?
27:07From Grand Discount Store.
27:09No, where did you get it from
27:10in order to bring it to court today?
27:12Uh, this was part of my parole packet.
27:14These were the letters that she had sent.
27:15This was stuff that I'd saved
27:17while I was incarcerated.
27:18Where did you get this receipt from?
27:20Where did I buy the chain, your honor?
27:22This Grand Discount.
27:24Jamie, we're gonna go over this one more time.
27:27Otherwise, I'm gonna send you outside,
27:29give you a copy of my first book.
27:32You know what the title is?
27:33What is it, your honor?
27:34Tell him, Bert.
27:35Don't pee on my leg and tell me it's raining.
27:37So, I'm gonna ask you again, Jamie.
27:44Where did you get this piece of paper
27:46with the date 11-4-96?
27:49Okay, that goes with the copy of the report
27:51that I handed to you.
27:51She said that I had sold her chain in 96.
27:53I'm unsure of what chain she's talking about.
27:55She's talking about the one you ripped off her neck.
27:58Well, see, she said that I had stole...
28:00Oh, I don't know.
28:01Oh, okay.
28:01I'm sorry.
28:02She said, I don't know, your honor.
28:04Well, tell me about how he ripped
28:05this gold chain off your neck.
28:06I bought them gold chains
28:08at the grand discount over there by my job
28:10two years, a year while he was locked up.
28:14When did he rip them off your neck
28:16is what I want to know.
28:17November 12th, 1998 at my job
28:21when he brought the hatchet up to my job,
28:24which is on the police report that I have
28:26charging him with a felony of robbery.
28:31Okay.
28:36That's what she says, sir.
28:38She said you came up to her job.
28:40You ripped the gold chains off her neck.
28:41Police report was filed on that date.
28:44November 12th, 1998.
28:47Are you telling me, Jamie,
28:48that you were never in her office?
28:50No.
28:51That's her birthday, my, your honor, my fiance.
28:55Happy birthday.
28:57Are you telling me
28:59that you were not in her office on that day?
29:02Yes, your honor.
29:02That's what I'm saying.
29:03Is that what you're telling me?
29:04Yes, I was with my fiance on her birthday.
29:06I have a witness
29:07that he was with them that day
29:09after he went to my job.
29:11Name?
29:14Donald Souters.
29:16I've just gotten off that work that day, your honor,
29:19and he stopped by.
29:20Well, actually, he called me first.
29:21Were you friends?
29:22Yeah, we were friends until, you know, some mishaps.
29:25But he called me.
29:25We were supposed to go to the gym that night.
29:27So, you know...
29:28On November 12th?
29:29Yes, your honor.
29:30Well, it was his girlfriend's birthday.
29:32How come he wasn't with her?
29:33I don't know.
29:34He was with us.
29:34He was with me, my cousin, and my brother.
29:36Yeah, go ahead.
29:37As we were getting ready to leave,
29:38we've gotten a page with the 911
29:40saying the police were looking for him.
29:42So we didn't know nothing, you know, about it
29:44until when we got home.
29:46And that's when he handed us the chain
29:48and said, give them back to Carol.
29:50We asked him why.
29:51He said because he went down there to get his pager,
29:53and she wouldn't give it.
29:54He took a hatchet,
29:56was going to smash in her car
29:57if he didn't give the pager back.
29:59Then he snatched the chain.
30:00I told him he should have went about it,
30:01a legal way to get that pager back.
30:04And he said it was too late,
30:05and they'd give the chains back, and he left.
30:08And what did you do with the chains?
30:09I tried to call Carol up
30:10and see if she wanted them back
30:11because I didn't really want to get involved,
30:13but she was upset.
30:14Where are the chains now?
30:15She has them in the car.
30:17Well, why didn't you bring them in
30:18so I could see them?
30:19They're in the car.
30:20I forgot to bring them.
30:21All right.
30:22I got the half in the car.
30:24Show me the bill for the paint job
30:26on your car where he keyed it.
30:29Your Honor?
30:29What?
30:30I was in Oregon on November 12th
30:33with my fiancée.
30:34So you mean he's lying and she's lying?
30:36They're lying completely.
30:37I wasn't even in California on the 12th.
30:39That was her birthday, Your Honor.
30:40Show me.
30:42Show me.
30:42I was completely unprepared for that.
30:44You mean to tell me the police
30:45never tried to contact you?
30:46They never contacted you.
30:48Jamie, listen to me carefully, sir.
30:51Are you telling me that the police officer,
30:54in this case,
30:55never tried to contact you
30:57or never contacted you
30:59with regard to this complaint?
31:01Is that what you're telling me?
31:03Your Honor, I cannot recall.
31:04I do recall, however...
31:05No, no, no.
31:06Don't tell me that you were in Oregon.
31:09Honestly, Honor, I don't recall.
31:10Well, you better recall, sir.
31:12I'm going to tell you why.
31:12Because if I were facing 25 years to life
31:15as a predicate felon,
31:16I would be very well aware of the fact
31:18that the police department contacted me
31:20on another violation.
31:23So I want you to think about it.
31:24I would be more aware of that
31:25than I would be whether or not
31:26I spent my girlfriend's birthday with her.
31:28Judge Judy continues in a moment.
31:31What's something wrong with you?
31:33You had him put in jail
31:35because he raped you and violated you.
31:37Then you sent him nude pictures of yourself.
31:39What are you, Coco?
31:43Real cases, real people.
31:45Judge Judy.
31:47Carol Sewell claims former boyfriend James Ware
31:50keyed her car and stole her gold chains.
31:53James says he paid for the chains
31:55and is countersuing for damage to his car
31:58and harassment.
31:59Mr. Ware,
32:00on your best day,
32:02you're not as smart as I am on my worst day.
32:04Do you understand?
32:05And I understand.
32:06Ah, okay.
32:07Do you have an estimate on keying the car?
32:10I have the estimates, the picture.
32:11Let me see it.
32:13To my car.
32:15The IOUs, the cancel checks he owes me for.
32:25All right.
32:38The lowest estimate is $1,200.
32:42Now, you have a counterclaim.
32:44Yes, ma'am.
32:44You say she keyed your car.
32:46Yes, she did, and I have.
32:46And she's been harassing you.
32:48Yes, she has.
32:48Okay.
32:49Let me hear, Mr. Ware.
32:50Well, she did key my car, all right?
32:53She has, she drives by my house
32:55yelling out malicious statements.
32:58She calls my phone and hangs up.
33:01She calls your phone and hangs up?
33:02How do you know it's her?
33:03Well, because when my mother answers,
33:05she won't say anything.
33:06And if I say hello, she'll respond.
33:09Just a minute.
33:10So when you answer the phone, she talks?
33:12Yes.
33:13Okay, well, that's not a hang-up.
33:14But when everybody else answers, she hangs up.
33:16So how do you know it's her?
33:18Because she might have to call several times
33:19before I answer.
33:20Okay.
33:21What's next?
33:21Uh, she threw new, she threw new pictures
33:24of herself in my girlfriend's,
33:26in my fiance's car.
33:28Let me see.
33:36I have a witness to the, uh,
33:39keying of my car.
33:40Listen to me.
33:40Listen to me.
33:41Shh, shh, shh.
33:42Did you ever put pictures of yourself
33:44undressed in his girlfriend's car?
33:47No, I didn't.
33:48Well, how did he get these pictures?
33:50I was out in front of his house
33:51talking to his girlfriend.
33:53Yeah?
33:54He took the picture of me sitting in the car
33:56and then he took,
33:57that's not his car,
33:58that's his father's car, by the way.
33:59Shh.
34:00Just do me a favor.
34:01Sure.
34:03Show her these pictures.
34:05Well, them pictures?
34:10Hey!
34:11Oh.
34:11What?
34:12These pictures, I sent them to him in prison.
34:16That's how he got the pictures.
34:17You're allowed to send nude pictures to prison.
34:19Just a, shh, just a second.
34:20When did you send them?
34:22It was when he was in Avenal.
34:24She knew, Avenal.
34:25That's when you had him put in jail?
34:27Yeah, when I put him in jail.
34:28There's something wrong with you.
34:30I know.
34:30You had him put in jail according to you
34:32because he raped you and violated you.
34:34That's what you said in the air.
34:35And then you sent him nude pictures of yourself.
34:37Your Honor.
34:37What are you, Coco?
34:39Jay, Wiz.
34:40I just changed my mind.
34:43I'm kind of nut.
34:44Do you understand what I'm talking about?
34:46I understand what you're talking about.
34:48I've told her.
34:49Keep going, Mr. Ware.
34:50You're getting to look better and better to me.
34:54Order.
34:55Quiet.
34:56Oh, I'll clear the courtroom.
35:00Now you understand.
35:01She drives by my house.
35:03There's pictures of her yelling at my fiancée.
35:06We're asking her, Your Honor.
35:08I suggest you move, Mr. Ware.
35:09I did, Your Honor.
35:10I was living with her,
35:12and she was driving by harassing her,
35:13and she found, she called my house,
35:16and, uh,
35:17it's just nice.
35:20It's just funny, right?
35:21Nice.
35:25It was two years of my life, Your Honor,
35:27that I spent in prison
35:28because of the things she does.
35:31Here's letters that I just like to submit.
35:34Yeah, but you went up to her office
35:36and you took your gold chains back.
35:37You know, I try to get to the truth, sir.
35:39I try to get to the truth.
35:40If you tell me the truth all the time,
35:42I'll listen to you,
35:43but you've got to tell me the truth all the time, sir.
35:45She knows, Your Honor,
35:46she knows a lot of it.
35:47I can't even say it.
35:48It really hurts me to say things like this.
35:51Just a second.
35:54He witnessed the keying of my car.
35:56Those pictures were taken just this Sunday.
35:59Gary was out there.
36:00He saw her drive up.
36:01She was yelling.
36:02She was upping up her lawsuit to $2,000.
36:05Step up here, sir.
36:06Judge Judy continues in a moment.
36:12Well, you better see to it
36:13that she gets some psychiatric help, madam.
36:16She's nuts.
36:17She's nuts.
36:18Your sister.
36:19Right.
36:20Closed captioning.
36:20Sponsored in part by...
36:22Real cases.
36:25Real people.
36:26Judge Judy.
36:28Carol Sewell is suing former boyfriend James Ware
36:32for keying her car
36:33and ripping gold chains from her neck.
36:36When did you observe her driving by his house?
36:39Sunday just past, Your Honor.
36:40Did you drive by his house this last Sunday?
36:43Yes, I did.
36:43For what?
36:45Well, last week he came up to me
36:47and he called me and he wanted money.
36:49So to feed his dogs, I wrote him a check
36:51because I didn't have the cash on him.
36:53Then he brought his father up to my job
36:55and said that I didn't have no money,
36:57so I told him to return me the check then.
36:59But I had money.
37:00Did you take a check from her?
37:01No.
37:02What is she talking about?
37:04I don't even know, Your Honor.
37:06She sat in front of my mother's house.
37:07One time I had got out of prison for three days
37:09waiting for me to show up.
37:11She's witness to that.
37:12She came, she followed me to my job.
37:14Stopped me.
37:14I lost my job.
37:16Letter of termination
37:17because she's yelling, cricking, screaming, yelling,
37:19how could I cheat on you at my job?
37:22It wasn't the best job, Your Honor.
37:24I'm not proud to say I was making pornos.
37:27Shh.
37:32Something is wrong with you, Madam.
37:33You better go to see a psychiatrist.
37:36For what?
37:36You better go see a psychiatrist.
37:38For what?
37:39Because you can't leave him alone.
37:41Leave him alone?
37:42I work 13 hours a day.
37:43I don't have time to be bothered.
37:44You can't.
37:44Listen to me.
37:45You can't leave him alone.
37:46You want to know why I know that that's true?
37:48Because no person in their right mind
37:50who says somebody violated them
37:52the way you say he violated you
37:54would turn around and send nude pictures of themselves
37:58to prison.
37:59That was two years ago.
38:00I don't care.
38:00You had him sent to jail.
38:02I did.
38:03For sexually violating you.
38:05And then you turn around
38:06and send him nude pictures of yourself?
38:08There's something wrong with you.
38:10Big time.
38:13Big time.
38:15Are you a friend of hers?
38:16No, I'm her sister.
38:17Well, you better see to it
38:18that she gets some psychiatric help, Madam.
38:20We try.
38:21What?
38:22We tell her.
38:22Well, stand up here.
38:23Stand up here.
38:25You tell her?
38:26Yeah, she don't listen.
38:27And then he's just as bad as she is.
38:30He does the same thing to her.
38:31Just a second.
38:32He may.
38:33He may.
38:34She's your sister.
38:35She's coming here and telling me.
38:37She filed a complaint.
38:38She said she had him sent to jail.
38:40She had him sent to jail for raping
38:42and violating her.
38:43That's true.
38:44Right?
38:45Yeah.
38:45And then, when he's in jail for violating her,
38:49she sends him provocative pictures.
38:51And when I asked her why,
38:52she said,
38:52because you're allowed to send nude pictures
38:54to people in jail.
38:56She's nuts.
38:57I'm afraid of him.
38:58You're her sister.
38:59Yeah.
39:00Right.
39:00Listen to me.
39:01I'm afraid of him.
39:02That's what I am.
39:02You're afraid of him?
39:03I'm afraid of him.
39:03People who are afraid,
39:04don't do this, madam.
39:05People who are afraid,
39:06don't do that.
39:07Believe me, it's out of fear.
39:08He's threatened to kill me before,
39:09and I'm afraid.
39:10Then you shouldn't go by his house.
39:11You shouldn't go by his house for anything.
39:13Nothing.
39:14Who saw her key his car?
39:17Step, I don't believe the fiancé.
39:19She was about to lie about a birthday,
39:21so I'm not listening to her.
39:22Who are you?
39:24His neighbor.
39:25His neighbor?
39:26Yes, ma'am.
39:27Your name?
39:27Antonio Elisalovas.
39:29Last name?
39:30Elisalovas.
39:31That's a hard one.
39:32Antonio, right?
39:33Yes.
39:34Tell me what you saw her do,
39:35if anything, to his car.
39:37My window's right here,
39:38like, right in back,
39:40and I seen, like, around 11, 1115.
39:43When was this?
39:44On the 8th of Monday, March.
39:46On the 8th of March of this year?
39:48Yes, ma'am.
39:49Go ahead.
39:49And her and another young man got off the car,
39:53off her car,
39:54and started hitting his car with a bat
39:56and breaking the windows and everything like that.
39:59You saw that?
40:00Yes, ma'am.
40:00Here's a police report.
40:01I don't know.
40:02Let me see.
40:021115 in the morning.
40:03And then asked me to the car.
40:06Sir, are you positive it was her?
40:08Yes, ma'am.
40:08How do you know it was her?
40:09Because she drives a purple Thunderbird.
40:12And it was the purple Thunderbird?
40:14And almost every day,
40:15she passes with her lights off,
40:16going down, up and down the streets.
40:18How do you know that?
40:20Because it's her.
40:21She works in Burger King.
40:22And you've seen it?
40:23I always go to Burger King.
40:24I see her every day.
40:25Judge Judy continues in a moment.
40:33Want justice?
40:34Call 1-888-800-JUDY
40:36on the Internet, judgejudy.com.
40:41Mr. Ware, listen to me, sir.
40:45You've convinced me.
40:46Okay.
40:47How's that?
40:48Thank you, ma'am.
40:49Thank you, Your Honor.
40:50How are you related to her?
40:52I'm her nephew.
40:53Well, you better all work on her
40:54to get some help.
40:55We try, Your Honor.
40:57Has she ever been
40:58psychiatrically hospitalized?
41:00Nope.
41:00Well, she's going to find herself
41:02in a very, very difficult situation
41:04because this man is going to be tested.
41:07You know, I'm not saying
41:08he did everything right.
41:09I believe that he probably
41:10did a key on her car
41:11because I believe you
41:12that he keyed her car.
41:14I believe that you keyed her car, sir.
41:16Trust me.
41:17I believe that she's telling me the truth
41:18because she has told me
41:19that her sister's crazy.
41:20Why would she tell me
41:21that her sister's crazy
41:22and lie about you?
41:23Do you understand?
41:24Yes, ma'am.
41:25All right.
41:26So I believe you keyed her car
41:27and the estimate for the car
41:29is $1,200, right?
41:32Now, I also believe
41:34that she's made your life
41:34a holy hell.
41:36I don't believe
41:36that you're mentally unbalanced,
41:38but I believe
41:38that she's mentally unbalanced.
41:40The last two years
41:41that you did in prison,
41:43was that violation
41:44based solely on her complaint?
41:45She said I stole her gold chains,
41:49threatened harassing her.
41:52She said I sodomized her.
41:54There's, what, five complaints?
41:55Sodomized her.
41:56Okay.
41:57Forget about your gold chains.
41:58They're in the car.
41:59He keyed your car.
42:01To fix your car is $1,200.
42:03He says you've been harassing him,
42:06keying his car,
42:07and torturing him.
42:09I believe him.
42:11He's suing you for $5,000.
42:13I'm giving him $5,000.
42:15That means you get nothing,
42:17and he gets $3,800.
42:19Judgment for the defendant.
42:20I do so excuse.
42:21You may step out.
42:25Judge Judy continues in a moment.
