00:00This is Judge Judy.
00:03All parties on Moriarty versus Peter Fay. Step forward, please.
00:07Twenty-eight-year-old student pilot Elliot Moriarty claims flight instructor
00:12Laszlo Peter Fay is responsible for his plane running out of gas,
00:16forcing him to land on a California freeway.
00:19Elliot says he now suffers from fear of flying.
00:25Order. All rise.
00:30The Honest's case number 648 on the calendar,
00:33the matter of Moriarty versus Peter Fay.
00:35Why has it been sworn in, Judge? You may be seated.
00:37Gentlemen, have seats, please.
00:39Mr. Moriarty, I really, after all these years on the bench,
00:42thought that I had seen everything until I read your complaint.
00:46You were taking flying lessons.
00:49Yes, Your Honor.
00:50From him?
00:51Yes, Your Honor.
00:53How long did you take flying lessons from him?
00:56I believe it was approximately three months.
01:01Had you taken flying lessons from anyone else?
01:04Not flying lessons, but a thrill ride at Torrance Airport.
01:07What, what?
01:08A thrill ride.
01:09Thrill ride?
01:10Right.
01:11What do you do for a living, sir?
01:12I'm an assistant manager.
01:14What kind of company?
01:15A restaurant.
01:16You get to the restaurant by driving your car?
01:19Bike.
01:21You don't have a car?
01:22No, Your Honor.
01:23No, Your Honor.
01:24How old are you?
01:25Twenty-eight now.
01:26So, you were taking flying lessons and then there came a time when you were flying solo,
01:29is that right?
01:30Yes, Your Honor.
01:31And you ran out of gas?
01:33Yes, Your Honor.
01:34And you landed on a freeway?
01:36Yes, Your Honor.
01:37And you're suing him?
01:38Yes, Your Honor.
01:42Now you can explain that to me.
01:44The explanation is this, Your Honor, that upon my entire training I was never trained
01:48or taught on how to fuel an airplane.
01:51It's not like a car.
01:52I've asked him one time before, how do you fuel up?
01:54He told me, don't worry about it and I'll show you later.
01:56Fuel up.
01:57Now what do you have to do to fuel up?
01:59When you're driving a car, you pull into either one of two lanes.
02:03Either it says full service, the one that I like, or self-service, the one that I don't
02:08understand at all.
02:09And then you get out and I've seen people, they open up the thing and they put the thing
02:14in the thing and you fill up your car with gas.
02:16I understand.
02:17Does it work the same way with the plane?
02:18No, Your Honor.
02:19Do you put the gas in the plane?
02:21No, Your Honor.
02:22So somebody else puts the gas in a plane.
02:24Yes, Your Honor.
02:25So you go to a plane gasoline station.
02:29No, what happens is I guess you call somebody, either a frequency or by phone.
02:34Yes.
02:35And I was never included in-
02:39You don't want me to think you're stupid, do you?
02:41So just answer my question.
02:44Periodically, a plane needs gasoline because it doesn't fly on dreams.
02:49Right.
02:50Now is there a gauge in the plane that says fuel?
02:54Yes, there is, Your Honor.
02:55And it has a little stick?
02:56Of course, I know about that stick.
02:58With the cars today, they even talk to you.
03:00You're out of gas.
03:01You're out of gas.
03:02But I assume that they don't have that in planes.
03:04You know, they have a gauge.
03:05You do know how to look at the gauge.
03:07Yes, Your Honor.
03:08And when it starts to get on empty.
03:11Well, I can give you the explanation.
03:13Then you say to yourself, hmm, I think I need gas.
03:17Well, here it is, Your Honor.
03:19Upon my solo cross country, I have to perform a dual cross country.
03:23Throughout that dual cross country, we did not fuel up at Santa Barbara or Santa Ynez.
03:28So, just a second.
03:29You went together?
03:30Yes.
03:31On a dual cross country?
03:32Beforehand.
03:33Before you went solo?
03:34Yes, Your Honor.
03:35And during that trip, you didn't fuel?
03:38No, Your Honor.
03:39We fueled up at Van Nuys.
03:41And when I made my flight plan, I put four and a half hours, which is a direct reflection
03:45of a full tank for the type of aircraft I was flying.
03:49Now, his job as an instructor is to review my flight plan and to make sure there is no
03:55mistakes on it whatsoever.
03:57Upon his evaluation of my, reviewing my flight plan, he just, I don't know, totally missed
04:03it.
04:04And we together went down, did a check, checked the airplane.
04:07I checked the fuel on the wings to make sure that it corresponds with the amount of
04:11fuel on the needle, which was approximately, if I remember correctly, about two thirds.
04:16I told him what it was in there.
04:18It was fine with him.
04:19So, I'm the student, and he's an instructor.
04:23If it's fine with him, I felt, okay, then his judgment is correct.
04:27Before I got in a plane, to a plane, there'd be a full tank of gas, that's for sure.
04:30I mean, if I were ever stupid enough to get in a plane and this, I had to go someplace.
04:33Right, but he was totally aware of how much fuel I had.
04:35He didn't say anything about it.
04:36You have no responsibility for this.
04:38I understand from here, from your papers, that you have footage of you landing on the freeway?
04:43Yes, Your Honor.
04:44I'm dying to see that.
04:45Very lucky, Your Honor.
05:02Look at that plane.
05:05Looks like something you put together with those little sticks.
05:08You know?
05:09One fits in, you know what I'm talking about, Bert?
05:11Right.
05:12Remember those things we used to have as kids?
05:14You put balsam wood.
05:15That's right.
05:16Right?
05:17Flat thing, and you put one in the other, and you rubber band, and you go?
05:19A little glider.
05:20I wouldn't trust my life to one of those things.
05:22Your Honor?
05:23What?
05:24Okay, well, first of all, see, all this started over him refusing to pay me my unused fee.
05:29After the incident, I basically induced naturally this fear of flying.
05:33I discontinued it.
05:34So is this what it's about?
05:35You discontinued, you're flying, and you want your money back for what you didn't use?
05:40No.
05:41Let me clarify that really good.
05:42Okay, when I discontinued, I wanted the remainder of my unused fees.
05:45Right.
05:46Now, he sent me a check the first time for $90.
05:49How much do you think it is?
05:51$147.
05:52$147?
05:53Yes, Your Honor.
05:55All right.
05:56So why are you suing him for $3,100?
05:59That's what I would like to get into.
06:01This basically escalated up to this point because when he decided to keep my money, as if that
06:08wasn't enough experience for me, it made me rethink everything over again.
06:13And this is what I concluded that.
06:15Okay.
06:16I ran out of fuel.
06:17I landed on the freeway.
06:18Okay.
06:19Whose fault is it?
06:20Was it really my fault or was it his fault?
06:22When I rethought everything over, throughout my training, I've been given inadequate training
06:26and lack of supervision.
06:27His lack of supervision is not reviewing my flight plan correctly as he is responsible
06:32to do so by the Federal Aviation Regulations.
06:35And in one of his letters, he stated to me, without dispute, he will refund my money back.
06:40As of today, he has not.
06:42Refund how much money?
06:43The $147.
06:44Fine.
06:45I have no problem with giving you back $147.
06:47No.
06:48I have no problem with $3,100.
06:49Well, if I can establish...
06:52If you don't like, sir, the kind of instruction that you're getting from a pilot, then you
06:58say, I'm not satisfied with the quality of the training that you're giving me.
07:02What you're saying to me is a 28-year-old man who lands his plane on a freeway and walks
07:09away without a scratch, instead of getting down on the floor and thanking God that you
07:15landed on the freeway, decided to sue somebody.
07:19That's America.
07:20That's America.
07:21No, Your Honor.
07:22That's America.
07:23Not only decide to sue him for the remainder of your outstanding fees that you had already
07:27prepaid, that even I could understand, but sue him for everything else because we're
07:33a country of a lot of naval gazers.
07:34You know, you sit down here and say, now let me see, $147.
07:37But I really think that he gave me a fear of flying and he didn't train me right all
07:41the three months I was a student.
07:43And you had a lot of time to think about it.
07:45You're lucky you weren't thinking about it with all of your appendages and casts.
07:49No.
07:50It would be ridiculous.
07:51Judge Judy continues in a moment.
07:53When you wrote him a letter, you should have said, here's the check for $147.
07:56I'm very sorry you're not using my services anymore.
07:59Goodbye and good luck.
08:00And next time, try an airport.
08:01And later today...
08:02You used her library card and you took out 23 books.
08:05And then she starts getting billed for $1,000 because you didn't return the books.
08:10Baloney.
08:15Real cases.
08:16Real people.
08:17Judge Judy.
08:19Elliot Moriarty says his flight instructor, Laszlo Peterfay, is responsible for his plane
08:24running out of gas, forcing him to land on a California freeway.
08:28Laszlo is countersuing for a loss of work.
08:31Now, let's get to your ridiculous counterclaim.
08:34You want to tell me about it or you just want to say, I'm sorry I'm withdrawing it?
08:37Um, actually no ma'am.
08:39All right.
08:40So now, I'm ready for you.
08:44The counterclaim is, I wrote Mr. Moriarty a letter stating that I don't want to dispute
08:49the $147.
08:50And, um, several days after this, I got a letter from the FAA.
08:56And based on the information that Mr. Moriarty provided the FAA, they wrote me a letter saying
09:03that if I don't respond within 10 days, my pilot certificates will be suspended.
09:10Mm-hmm.
09:11My livelihood is flying.
09:14So this jeopardized my career.
09:16But they did not remove your certification.
09:18Well, I had to go for a reexamination.
09:20Just a second.
09:21You had a hearing and had to go for a recertification.
09:23Is that right?
09:24Now, what you're suggesting, sir, is that he does not have the right to complain about
09:32what he believes is inadequate training to the appropriate authority, which in this case
09:38was the FAA.
09:39Well, the First Amendment to the Constitution says you can complain to anybody about anybody
09:46else as long as you are not doing it out of malice.
09:49And I believe that even though he's wrong, he believes, after looking at his bellybutton
09:58for a long time, that you didn't give him adequate training.
10:01Because if you were giving him adequate training, he wouldn't have taken off in a plane that
10:05didn't have a full tank of gas.
10:07Well, I can prove that I gave him adequate training.
10:10Listen to me.
10:11He says, he showed you the flight plan when he was going solo, that there was three-quarters
10:15of a tank of gas there.
10:16And he says he landed on the freeway.
10:18All right?
10:19So he said he didn't get adequate training.
10:21He's allowed to complain to you.
10:22I am not going to give him $3,100 that he's asking for because as far as I'm concerned,
10:26he's a grown man.
10:27And a grown man who drives a car and who drives a plane ought to know that when the needle
10:31goes to empty, you've got to get gas.
10:35So I'm going to give him $147.
10:37And I tell you, sir, that it would have been wiser for you instead of responding to him
10:42and saying to him, I will not dispute your $147.
10:46When you wrote him the letter, should have sent him a check.
10:49Should have said, here's the check for $147.
10:51I'm very sorry you're not using my services anymore.
10:54Goodbye and good luck.
10:55And next time, try an airport.
10:56Your Honor.
10:57Your Honor, I have a witness here who is a certified flying instructor.
11:02He also has an airline transport pilot rating.
11:05He has come to me on his own because he evaluated me and he would like to provide some expert
11:10testimony on my training.
11:11About what?
11:12About my inadequate training and lack of supervision I was provided.
11:15Listen to me.
11:16Do you tap dance?
11:17No, Your Honor.
11:18No, Your Honor.
11:19If you take tap dancing lessons and you don't like the instructor, then you don't use the
11:24instructor, you go someplace else.
11:26Your Honor, but when I'm the student, how do I know if I'm being provided with good training?
11:30You mean you had to land on the freeway to figure out that you weren't getting good training?
11:35Come on.
11:36Wake up.
11:37Start taking some response.
11:38I mean, you have to laugh at this.
11:39No, Your Honor.
11:40Do you have to laugh at this?
11:41Yeah, there's some things that are missing.
11:43There are things that are missing there.
11:44There are holes in my training.
11:45One thing that are missing are your eyes.
11:46Just a second.
11:47Don't get them missing are your eyes.
11:48If you're a big enough boy to get behind the wheel of a plane and you're riding along
11:53and it starts to turn on empty, what you do is you pick up a phone and you say, help.
11:58You don't fly until you fly all the way on empty.
12:01How many of us have driven with our husbands and we say, it's on empty?
12:06Don't tell me it's on empty.
12:07I have plenty of gas.
12:08Well, Your Honor, there's clear violations here.
12:11I suggest you stay on your bike.
12:14It's on empty for the plates.
12:15It's on the amount of $147.
12:16Count the plates.
12:17Parties are excused.
12:18You may step out.
12:19There's two things I knew.
12:22I knew at what age I'm going to die and I knew how I was going to die.
12:26He flew over 10 airports where he had a chance to fuel.
12:31I also told him to fuel during the flight.
12:33He reminded me about refueling in Santa Barbara.
12:36Before I left on my solo, he reminded me again to refueling in Santa Barbara.
12:41Duh.
12:42I don't know.
12:43I mean, there's basically pirates in the sea.
12:45I never met a pirate in the sky before.
12:47And now, the next case.
12:49All parties on Bethesden versus Barajas Beckley.
12:54Step forward, please.
12:55Twenty-two-year-old newspaper reporter Victoria Besseden claims 21-year-olds Rosie Barajas
13:01and Minta Beckley used her library card to check out 23 books.
13:06They didn't return them, leaving Victoria with a $1,000 library fine.
13:11Ms. Besseden, did you go to college?
13:13I just finished.
13:14Where did you go to college?
13:16Cal State University, San Bernardino.
13:18And you ladies go to school?
13:19Not right now.
13:20Well, you did a while ago.
13:22Is that right?
13:23Where were you going to school?
13:24San Bernardino Valley College.
13:25And you?
13:26San Bernardino Valley College.
13:28For some reason, these two ladies wanted to use your library in your school.
13:34Yes.
13:35And you could take books out.
13:37Take your hands out of your pockets.
13:40And you could take books out of your library.
13:43These young ladies said, could we take some books out on your card?
13:48You said okay?
13:49That is not what happened.
13:51Fine.
13:52Tell me what happened.
13:53Okay.
13:54We had a report to do for a class.
13:56What happened was that we were all friends at the time.
13:58She knew we had a report to do.
14:00She offered her library card because we could not find the books in our library.
14:05She offered for us to use her library card.
14:08So that's come close.
14:09She offered or you asked whatever it was.
14:11It doesn't make any difference.
14:12You used her library card and you took out 23 books.
14:15And then she starts getting billed for $1,000.
14:19Because you didn't return the books.
14:21We did return the books.
14:23Judge Judy continues in a moment.
14:26I can understand maybe one book turning up missing.
14:29But for all 23 books to turn up missing, there lacks statistical probability for that.
14:34You know, you're looking at me smiling like an idiot.
14:36You know that.
14:37Closed Captioning sponsored in part by...
14:42Real Cases.
14:43Real People.
14:44Judge Judy.
14:46Victoria Bessadin loaned her library card to Rosie Barajas and Minta Beckley.
14:51They checked out 23 books and didn't return them.
14:54Victoria wants her $1,000 library fine paid.
14:58Tell me how you returned the books.
15:01What happened was the books had not been turned in.
15:04She was notified.
15:05She called me.
15:06I think the books had been due like three days before.
15:10I remember that I had not turned in the books.
15:12Called her.
15:13And it was during the evening.
15:14We did not turn in the books that same day that she called me.
15:17But we did go the next day to turn them in.
15:19I had called her to tell her that if she wanted me to take the books to her, she can turn them in.
15:24She said...
15:25Why should she do that?
15:26You used the books.
15:27Because I had no...
15:28Why should she carry back 23 books in the library that you used?
15:31I just said if she wanted to turn them in or does she want me to turn them in.
15:34So you didn't turn them in for three days.
15:36Is that right?
15:37Yeah.
15:38Well, four days because it was the next day.
15:40Now when you turned them in, where did you turn them in?
15:42Into a box.
15:43A drop box.
15:44Baloney.
15:45You want me to tell you why it's baloney?
15:51Because I can understand maybe one book turning up missing.
15:56Maybe two books turning up missing.
15:59But for all 23 books to turn up missing, there lacks statistical probability for that if you return the books.
16:09So you didn't return the books.
16:12We did return the books.
16:14Even if you say you return the books, this bill is your responsibility.
16:20Not hers.
16:21She didn't take them out.
16:23She didn't use them.
16:24She didn't return them late.
16:26You did.
16:27Why should she have to pay?
16:29It was her library card.
16:30What?
16:31And we did turn it.
16:32Just a second.
16:33Say that one more time for me.
16:35One more time.
16:36Because it's her library card.
16:37And we did turn in the books.
16:38It's not our fault that the library did say that we did not turn the books in.
16:42I just said to you, I'm assuming for the purpose of this, that you did return the books, which you did not.
16:48But assuming that you did.
16:50And assuming that the library lost them.
16:53But she not only received a bill for them, but according to you, you couldn't get your diploma.
16:58Is that right?
16:59Yes.
17:00Is that right?
17:01Why should she suffer because of the fact that you took out these books?
17:05You.
17:06Did you report from them?
17:07You used them?
17:08You did not act responsibly and not returning them on time?
17:11You know, you're looking at me smiling like an idiot.
17:13You know that.
17:14How much did this cost you in the library?
17:17One thousand dollars and seventy cents, your honor.
17:19And that's just for the cost of the books, replacing them, and the overdue fees.
17:23I'm not asking for anything more.
17:24I had to go to college an extra term.
17:26I'm not asking to get that money refunded.
17:28I want to tell you something.
17:29If you did, I might have given it to you because I know what happens.
17:33Let me see the letters from the library.
17:36Yes.
17:37Fools.
17:38That's the original one.
17:39That's the current one.
17:40Two fools.
17:41The pink one, your honor, is the current list that shows that the books have still not been found as of almost two years ago.
17:51Did you ever get your diploma?
17:54No, ma'am.
17:55And I'm trying to apply to my master's program at Cal State Fullerton and I can't go.
17:59Is the reason that you can't get your degree because of the outstanding books?
18:02Yes.
18:03Judge Judy continues in a moment.
18:10Want justice?
18:12Call 1-888-800-JUDY.
18:14On the internet, judgejudy.com.
18:18When she told you that she was having this problem, what did you say to her?
18:24We had agreed to go to the library together to talk about this twice.
18:29She never, she would always change the date.
18:31Why didn't you just go to the library?
18:33I did go to the library once.
18:34And what happened?
18:35And they told me that I needed to know exactly the books and I had no way of contacting her to know what,
18:41because they needed to know the titles of the books so they can look for them.
18:45How would she know the titles?
18:47You used the books.
18:48Well, how would I know them?
18:49They're 23 books.
18:50I know what they were about, but I didn't know the title.
18:52Just listen to me.
18:53How would she know the titles if you took out the books?
18:55You had them.
18:56Because they were under her library card, so it would show up on there what books were checked out.
19:02You have to be a little more diligent, madam.
19:10I know that you have a very busy schedule here.
19:12I can see that you have a very busy schedule, but you have to be more diligent.
19:15Judgment for the plaintiff in the amount of $1,000.70.
19:19That's all.
19:20Parties are excused.
19:21You may step out.
19:22Judge Judy continues in a moment.
19:27It's Judge Judy.
19:29All parties on Titus versus Zarrus.
19:32Step forward, please.
19:3341-year-old paralegal Tracy Titus is suing her former fiancé, 42-year-old shoe salesman Eugene Zarrus,
19:41for half the cost of their canceled wedding and for assault and false arrest.
19:45He says Tracy came at him with a knife.
19:50Order.
19:51All rise.
19:52The Honest is case number 658 on the calendar in the matter of Titus versus Zarrus.
20:01Parties have been sworn in, Judge.
20:02You may be seated.
20:03Ma'am, have a seat, please.
20:05Ms. Titus, you are suing the defendant over two things.
20:09He was your former fiancé.
20:11Yes.
20:12You were planning to be married.
20:14That didn't happen.
20:15You want to be compensated for half of the amount that you spent towards planning the wedding.
20:20Correct.
20:21The other part of your lawsuit, which is the main part of your lawsuit, is for having you falsely arrested,
20:26which caused you to spend some three nights in jail.
20:29Yes, ma'am.
20:30All right.
20:31Let's start with the wedding first, because I think that that's probably the easiest part of the lawsuit.
20:35How long were you planning this wedding?
20:38I started planning the wedding in April of 1998, and I canceled the wedding right after the incident in October of 1998.
20:49And that was your arrangement, that you were going to be married, and you understood that these wedding plans were going forward.
20:54Yes, they were.
20:55Okay.
20:56How much did you spend towards the wedding?
20:58I spent $368.05 for the ring.
21:04I spent $49.80 for the shoes, $535.98 for the dress.
21:12Okay.
21:13Do you want to keep this ring?
21:14Sure, I'll keep it.
21:15Okay.
21:16Okay.
21:17So let's take off the ring.
21:18Okay.
21:19Would you add that up?
21:20Divide it in half, please.
21:21And $250 for the church, non-refundable deposit.
21:28There's also an additional $130 for marriage counseling that I paid for.
21:33$482.50.
21:34$482.50, a half of your out-of-pocket expenses for the wedding.
21:38Is that right?
21:39Yes, ma'am.
21:40Okay.
21:41You have a problem with that, sir?
21:43Well, no.
21:44Okay.
21:45Now let's get to this false arrest.
21:47How did that come about?
21:49We had gone to an appointment that morning on Monday, October 19, 1998.
21:56We had got into an argument after that.
21:59He wanted to talk about it.
22:00I said, no, I don't want to talk about it.
22:02I just want to go home.
22:03We got into the car.
22:05He grabbed my keys and took my keys away from me and said, we are going to talk about it.
22:09And he hit me.
22:10I said, no, we are not.
22:11Where did he hit you?
22:12That's incorrect.
22:13Shh.
22:14Where did he hit you?
22:15He hit me in the chest.
22:16Madam, you didn't say that in your answer.
22:18That would have been a very important thing for you to say.
22:20Don't make things up as you go along.
22:21Let's go.
22:22Let's finish it.
22:23He would not get out of the car.
22:24I did not want him going with me.
22:26He refused to get out of the car.
22:28I drove home.
22:29I dropped him off outside and then I left.
22:32And I returned home approximately between 5.30 and 6 o'clock.
22:37When I came in, I took his key ring and I took what I thought was my car key off of his key
22:46ring.
22:47And I put his key ring back down where it was.
22:51I went into the bedroom.
22:52He was laying down.
22:53I decided I was going to lay down.
22:56He got up and he left.
22:57And when he did, I locked the bedroom door.
22:59And then later in the evening, I realized that I had taken his key off the key ring instead
23:05of my own.
23:06A little while later, he had gone into the bathroom.
23:09So I went, I got his key ring to take my key off of his key ring.
23:14I set his key on the kitchen counter, which he saw.
23:18I went to the drawer.
23:19I took out a butter knife, which is this.
23:24And I put the butter knife in my hand to pry the key ring apart.
23:29And I had it like this.
23:30This is what I was doing.
23:31He said, give me back my key ring.
23:32I said, well, in just a minute, I'm just taking my key off your key ring.
23:35I walked into the bedroom.
23:36I asked him to get the stuff that he needed for work the next day and take it out of the
23:40bedroom because I'd prefer that he not be in there.
23:43And he started to do that.
23:44And then he got mad and he lunged after me.
23:46And I ran into the bathroom and I locked the door.
23:49I was sitting on the floor up against the bathroom door.
23:52He was pushing it.
23:53And I got it pushed and I locked it.
23:54Where are his car keys at this point?
23:56They were in my hand.
23:57So you still had his car keys.
23:58Right.
23:59I was still trying to get the key off the key ring.
24:01And he threatened to kick the bathroom door in.
24:04Because you had his keys.
24:05Because I had his key ring, but I actually did not have his car keys.
24:10I came out of the bathroom.
24:12I had his car keys and I had my key and the knife exactly like this in my hand.
24:17And I was just holding them.
24:18He grabbed his keys.
24:20He knocked me down.
24:21He took his hand and he whammed me like this.
24:24He knocked me into the closet door and knocking the closet door off the track.
24:29He grabbed the knife out of my hand this way and he threw it across the room to the other
24:34side of the bedroom over by the window.
24:36And he screamed at me, don't you ever threaten me with a knife.
24:39He then took his arm like this.
24:41He had me on the floor and he pushed on me like this on my throat choking me.
24:46I wiggled around.
24:48I tried to get him off.
24:49I pushed him off.
24:50He backed up.
24:51I got up.
24:52I jumped across the bed, picked up the phone.
24:54I said, you're going to jail.
24:55Nobody's hitting me.
24:56I called 911.
24:58I was talking to the dispatcher.
25:00He kept coming at me.
25:01I kept telling him to stay away from me, get away from me.
25:04I started to walk out of the bedroom.
25:06He went over to my drawer where he knew I kept my money and he was going to take my money.
25:09Only it wasn't there anymore.
25:10I had already taken it out earlier in the day.
25:12So then he starts to get my son's money and I told him that was a pretty low thing to do.
25:17I walked out of the bedroom door.
25:18I was going to go out the front door and he ran from the bedroom to the living room next
25:24to the front door where I was standing.
25:26When I saw him running at me, he ducked like that and I leaned across the sofa.
25:31He came up on top of me.
25:34He pulled me up.
25:35He hit me again.
25:36He took his right arm and he put me in a chill cold like this.
25:41He flipped me over, slammed my head onto the floor and was hitting me.
25:45I started kicking my feet to try and get him to loosen the grip around my neck because
25:49I could not breathe at all.
25:52He got up finally and he backed away and he came at me again and I kicked my foot in that
25:58direction to keep him from charging me again.
26:00He backed up.
26:01I ran out the front door.
26:02I still had my car key in my hand.
26:04I went.
26:05I got in my car.
26:06I locked the doors and he started bringing stuff out of the apartment and putting it
26:10in his truck like he was going to leave.
26:11So I pulled my car behind his truck so that he could not leave before the police got there.
26:15Judge Judy will continue in a moment.
26:18She did.
26:19She hit me and picked up a shoe and she hit me in the back of the head with a shoe.
26:22That's where the confrontation took place in the living room.
26:24She's violent.
26:25And later today.
26:26What were you arrested for?
26:27Trafficking.
26:28Cocaine.
26:29Diced office.
26:30And family.
26:31Oy.
26:32Real cases.
26:33Real people.
26:34Judge Judy.
26:35Tracy Titus is suing former fiance Eugene Zares for half the cost of their canceled wedding
26:48and for assault.
26:50He says Tracy threatened him with a knife.
26:52Let's hear your side of the story.
26:53Okay.
26:55Well, first of all, I'd kind of like to talk a little bit about the appointment.
27:00She was there to see her therapist that she's had for over eight years.
27:05And I was invited to come into the session with her and to talk to her about her drinking
27:13and her suicide attempts.
27:15And in the conversation, she shut down, wouldn't talk to me at all.
27:22Her therapist wanted her to start attend some alcoholic anonymous classes because she would
27:28get angry and she would get in the car.
27:31She would take off.
27:32She'd drive at high speeds, reckless speeds, and would get drunk.
27:35And then call me on the phone and tell me on her cell phone that she was going to commit
27:40suicide.
27:41Okay, so that's why you were there with the therapist.
27:43Right.
27:44So what happened was she got angry.
27:45She got very upset about this.
27:47She turned on me in the car and hit me grabbing for the keys.
27:51She called me every name in the book.
27:53Now, I knew that she was going to have a tendency to drive reckless.
27:57So I held onto the keys.
27:58I told her, you need to calm down.
27:59We need to talk about this.
28:01She did not want to do that.
28:02She yelled and screamed and hit me.
28:04I got out of the car.
28:05I walked down to the corner with the keys in my hand to try to take a break from this and
28:11hope that she would calm down and think about it.
28:13When I came back to the car, she was not going to cooperate.
28:16I had no money.
28:17I had no way else to get home.
28:19So I took a chance.
28:21She started the car up.
28:22She took off.
28:23She was driving 100 miles an hour down the freeway.
28:26I told her that if she does not calm down, if she does not slow down, I will call the police.
28:31She wouldn't even slow down until I started dialing a number and waiting for the 911 to
28:36come on board.
28:37Anyway, I was so happy just to get home in one piece.
28:40I was scared to death.
28:41When I got into the house, she split.
28:45And I did wake up to find out that I did not have the keys to my vehicle.
28:50She had them.
28:51She had mistaken her key for my key.
28:54So she did have that.
28:56And when I tried to help her get the keys off the thing, when she had the knife, she
29:00did run into the bathroom.
29:01She did close herself in the bathroom, and I wanted her to give me my key.
29:04And I didn't know what was on the counter.
29:06When I was in the drawer, and I knew that if I opened the door where she had kept the money,
29:10she would come out.
29:11So that was my way to get her out.
29:13And then the scuffle occurred.
29:14She came with me.
29:15She had the knife.
29:16I flipped her around.
29:17I took her down.
29:18I restrained her.
29:19That's what happened.
29:20The police came.
29:21I have the police report right here.
29:24This explains what happened that night.
29:27She was in the hospital, and then her friends called me to tell me not to press charges.
29:32Okay, you dropped the charges, whatever.
29:34I did drop the charges.
29:35I did not pursue it because I know that she needs to get some help.
29:38Okay, let me just read what the police officer says in his narrative.
29:50Did she hit you on the back of the head with a shoe?
29:52Yep.
29:53Why didn't you tell me that?
29:54Because it's not true.
29:55It is.
29:56It is true.
29:57It's my turn to talk.
29:58Okay?
29:59I'm not talking to her.
30:00She did.
30:01She picked up a shoe, and she hit me in the back of the head with a shoe.
30:04That's where the confrontation took place in the living room.
30:07She's violent.
30:08Shh.
30:09I'm going to deal with your part of the claim right now that deals with false arrest.
30:13In your complaint, you are suing him for false arrest.
30:17And I'm referring specifically to one line in the police report.
30:20The officer reports as follows.
30:22And they refer in the report to the defendant, Mr. Zares, as the victim.
30:29That's him.
30:30Did not want Titus arrested.
30:34That's what the officer says in his report.
30:36He said, Zares, he said that there have never been any incidents of domestic violence while they lived together.
30:44Okay?
30:47So he did not cause you to be arrested, madam.
30:50He did not cause you to be arrested.
30:52The two officers at the scene made a judgment that they were required under the current laws in this jurisdiction to effectuate an arrest.
31:02I realize that it was the officers that made the decision, but it was based on the statement.
31:05I don't find anything that he said.
31:06I don't find anything in the narrative that he gave to the police officers, madam, inconsistent with what probably happened that day.
31:13So your lawsuit with regard to a false arrest is dismissed.
31:16I'm giving you one half of the expenses for the wedding.
31:19$482 judgment for the plaintiff, that's all.
31:21Why does I excuse you?
31:22Let's step out.
31:23He wouldn't know the truth if I bit him in the butt.
31:26He's a car salesman.
31:27He always will be.
31:28And he knows nothing about the truth.
31:30He is a liar.
31:31I think that she needs to get some help.
31:33And I don't think it's fair to incarcerate somebody for that incident when I think that therapy is probably a better solution.
31:41They took me to jails.
31:43They took me to the city jail.
31:46Then they took me to the county jail.
31:48I was strip searched.
31:50I was searched in places that I didn't even know you could hide anything.
31:53And now the next case.
31:55All parties on Peterson versus White.
31:58Step forward, please.
31:59Seventeen-year-old secretary, Jessica Peterson, is suing her boyfriend's ex, 24-year-old bank teller, Keisha White, for keeping her possessions after she was released from prison.
32:10All right, Ms. Peterson, let me understand this lawsuit, which is kind of strange.
32:14Yes.
32:15You and your boyfriend were arrested for trafficking and narcotics, is that right?
32:19Yes, ma'am.
32:20Your boyfriend's still in jail.
32:23Yes, ma'am.
32:25The defendant used to be the girlfriend of your boyfriend.
32:29Yes, Your Honor.
32:31And you have two children with him.
32:33Yes, Your Honor.
32:34Never married to him.
32:35No.
32:37You claim that when the boyfriend and you were incarcerated, she went and took the property from the house that you were sharing
32:48with the boyfriend.
32:51Yes, ma'am.
32:52What were you arrested for?
32:53Trafficking cocaine.
32:54They stopped us and found it.
32:57How much?
32:59About three ounces.
33:01Did he go to trial yet in his case?
33:03Mm-mm.
33:04He's in jail right now.
33:05He's got five years sentenced for another charge, and he goes to court in April for that, for the trafficking cocaine.
33:12Your trial is not pending?
33:13No.
33:14I've already pled guilty.
33:15It's over.
33:17Oy.
33:20Judge Judy will continue in a moment.
33:23Who's going to get her a copy of my second book?
33:26Beauty Fades, Dumbest Forever.
33:28Closed Captioning, sponsored in part by...
33:34Real Cases.
33:35Real People.
33:36Judge Judy.
33:38Jessica Peterson is suing her boyfriend's ex, Keisha White, for keeping her things after she was released from prison.
33:46What stuff do you claim she has that belongs to you?
33:50Okay, all of it is both of ours.
33:52We all...
33:53We got it together within our relationship.
33:55A TV, a VCR, the two gold chains that she has are his, and then a face to the CD player of a car.
34:02Ms. Peterson, how long were you with this character?
34:07A year and a half, as of today.
34:11And were you working during that time?
34:13No, ma'am.
34:14Well, if you weren't working during that time, then you had absolutely no way of putting together any money to buy this stuff, right?
34:23Yeah.
34:25Right.
34:30So that I don't see how you can claim that any of this stuff was yours.
34:33But we did buy it.
34:35I mean, I still had money even though I wasn't working.
34:38You have a trust fund?
34:40No.
34:41I just had money.
34:44Okay.
34:49Now, you say you have a release for this stuff?
34:53Yes, I have the release that he released to jail to my witness, Troy Osborne.
35:00He went and picked it up, and we both went to Thrifty Rental Truck and got the stuff, his stuff.
35:14Mr. Brian Grintano.
35:16Are you Troy?
35:17Yes, ma'am.
35:18Stand up, you please.
35:23This is the most inartfully written thing that I ever saw.
35:26Ms. Peterson.
35:27Yes, ma'am.
35:29Let's understand this so that we're perfectly clear.
35:32I don't like to have to be in a position of turning over property to somebody when I know that that property was purchased with drug money.
35:44Do you understand what I'm saying?
35:45Yes, ma'am.
35:46I understand.
35:47Very good.
35:48Very good.
35:49Very good.
35:50Because I don't intend to have anybody who is culpable, that means guilty, profit from drug money.
36:00Clearly, you contributed not to sue to this from any legitimate source.
36:05But it doesn't give her the right to keep stuff that does not belong to her, either.
36:09I have his two children.
36:10Well, just a second.
36:11Just a second.
36:12Just a second.
36:13Well, so I'm going to respond to you.
36:14All right?
36:16Maybe, Ryan, if he came in here and said, listen, I worked, this is my property, and I want it back, I might listen to him.
36:29Maybe he could tell me where he got this money from to buy this stuff, and maybe he can establish that it's his stuff.
36:34But as between you and her, she's got two kids.
36:40She says he's in jail.
36:41He's going to do five years.
36:42What her answer says is, whatever stuff is there that is of any value, she plans to sell to support her children.
36:49Because he certainly isn't going to pay a penny in child support for the next five years.
36:54He's supposed to be getting out within the three weeks.
36:56Ms. Peterson, if that's true, if you say that he's going to get out in three weeks,
37:03I'm just dying to see him.
37:07Well, that's why I had a notarized letter, because he can't come.
37:09Well, but you say, listen to me, you say that he's going to be out in three weeks.
37:14But it's our property, it's not hers. How can she keep our stuff?
37:16No, it's not ours.
37:17Listen, let me explain something to you.
37:18Ours means that you're married to somebody, and that whatever property there is, is joint property.
37:27You are not married to him, right?
37:31Not yet.
37:32Oh, and if you're going to be, that means that, you know...
37:36We're going to get her a copy of my second book, Beauty Fades, Dumb as Forever.
37:41Ms. Peterson, you have no claim as against this property.
37:46So she illegally can go get something that's not hers?
37:48It's not illegal.
37:49It's not illegal.
37:50Just a second.
37:51Just a second.
37:52I have a letter of release with his signature.
37:53It's not notarized.
37:54Listen to me, Ms. White.
37:55It has his signature.
37:56Ms. White, listen to me.
37:58You seem to be winning.
37:59What are you arguing with her for?
38:00Judge Judy will continue in a moment.
38:09Want justice?
38:10Call 1-888-800-JUDY.
38:13On the internet, JudgeJudy.com.
38:16Okay, from a legal perspective, I'm not satisfied that this property is yours.
38:21It may be Brian's.
38:22You say he's going to be out in three weeks.
38:24She says five years.
38:25Well, I know where I'm going to be in three weeks.
38:27I'm not exactly sure where I'm going to be in five years.
38:29But if Brian wants his property and he can establish to me that it's his property and
38:34it was gained from some lawful enterprise, I'd be more than happy to entertain his claim.
38:40That's one.
38:42So your lawsuit has to be dismissed.
38:44And if there's any property left once Brian gets out of jail, I'd certainly be delighted
38:50and I look forward to seeing him.
38:52Your lawsuit's dismissed.
38:53That's all.
38:54If I do not excuse, you may step out.
38:56Judge Judy.
38:57Judge Judy.
38:59Parties on Graham versus Vitaly.
39:01Step forward, please.
39:0228-year-old school bus driver, Myra Graham, claims ex-husband, 29-year-old Carl Vitaly slashed
39:10her tires.
39:11He says he still loves her and he didn't do it.
39:13Order.
39:14All rise.
39:15Quiet in the courtroom.
39:16John, this is case number 670 on the calendar in the matter of Graham versus Vitaly.
39:27Parties have been sworn in, Judge.
39:28You may be seated.
39:29Ma'am, have a seat.
39:31Were you married to the defendant?
39:32I was.
39:33For how long?
39:34Three years.
39:35Are you currently divorced?
39:36Yes.
39:37When were you divorced?
39:381997 of December.
39:41Your lawsuit isn't for a lot of money, but you claim that your former husband slashed
39:46your tires.
39:47Yes.
39:48He says he wouldn't dream of doing such a thing.
39:51When did this happen?
39:53February 4th.
39:54Tell me about it.
39:56He was mad about a ruling and a prior case.
40:02What kind of ruling?
40:03Paternity.
40:04Of a child that was born during your marriage?
40:07Sometime after the divorce.
40:09That has to be a motive?
40:12Because I read your papers.
40:13You didn't actually see him slash your tire.
40:15Is that right?
40:16No, I saw him.
40:17You saw him bend down.
40:18I saw him with a box cutter cutting my tires.
40:20That's not what you say, Ms. Graham.
40:22You say that you saw him bending down and then you saw your tire slashed?
40:26Yes.
40:27So, I want to go back to see if there was a motive for him to slash the tire.
40:31Do you understand?
40:32Yes.
40:33So, that was a paternity case?
40:35Yes.
40:36Was he adjudicated the father of the child?
40:39No.
40:40The judge asked him, did he have money to pay for a paternity or a blood test?
40:44And he said, no, he didn't have any money to pay for it.
40:47So, there was never a blood test on this child?
40:49No.
40:50Okay, but did he take you to court or did you take him to court?
40:54He took me to court.
40:55So, he wanted to be adjudicated the father of this child?
40:58Yes.
40:59Okay, you said he was not the father of this child.
41:01Yes.
41:02Now, I understand.
41:03And the judge did not order blood tests because he did not have any money?
41:06Yes.
41:07Okay.
41:08Now, how much after this ruling did this incident occur with your tire?
41:12A month and a half.
41:14Now, tell me about it.
41:15Okay.
41:16When I came from, I drive a school bus.
41:19And when I got done, I walked up the parking lot and I saw him bending down.
41:24He had a box cutter and he was cutting the tires.
41:26He saw me and he took off.
41:28Could you see him?
41:29Were you on the side of the car where the tire was slashed?
41:32Or was the car blocking your view?
41:35Where my car was parked, there was no other cars there.
41:38So, I could see him as I was walking up.
41:40Did you actually see a box cutter in his hand?
41:42Yes.
41:43Did you report this to the police?
41:45Yes, I did.
41:46Do you have the police report?
41:48Yes.
41:49Can I see it, please?
41:50Ms. Graham, you have an order of protection against him?
42:06Mm-hmm.
42:07Yes, I do.
42:08When was that issued?
42:10In December.
42:12Of 98?
42:13Yes.
42:14And what was the basis for that order of protection?
42:17Um, he was stalking me.
42:19May I say something?
42:20Yes.
42:21Um, this whole business about stalking is totally irrelevant.
42:25It wasn't stalking.
42:26She had been coming over and the reason why we have a son together is because she kept
42:32coming by.
42:33Um, I was invited.
42:35I would go and see her.
42:36She would come see me.
42:37It was ongoing.
42:38It's been ongoing.
42:39Recently, for the past about a year and a half, nothing's gone on.
42:42I have not been around her place of work.
42:45I do have an affidavit that's, uh, signed by me and my hairdresser.
42:48When I was there all day, uh, with him, you know, uh, he had, uh, many people ahead
42:53of me, uh, appointments.
42:55Uh, I just walked in, so I was actually the one to wait.
42:59Uh, I have this affidavit right here.
43:02He signed it.
43:03I signed it.
43:04Is that admissible?
43:05No.
43:06Um, one thing I'd like to point out here is she says I did this two different times.
43:10Okay?
43:11She says the same offense that she's blaming me for.
43:13She said I did it on the 5th.
43:15I don't know where she got the 4th, because on here it says the 5th that I did it.
43:19And then on this one, just recently, the 22nd she filed of March, says that I did it
43:24the 28th of January.
43:25So now I'm kind of questioning, which day was it?
43:28Well, I'm going to ask the same question of you, Ms. Graham, because on this police report
43:32you gave me, it said date occurred 129.99.
43:35Um, it occurred February 4th.
43:39That's not what I have here.
43:41Shh, shh, shh.
43:42Ms. Graham.
43:43Mm-hmm.
43:44Are you sure it occurred February 4th?
43:47I'm sure.
43:48I had got the dates mixed up because I had an accident, and I just kind of wrote it on
43:53my calendar wrong, but it was February 4th.
43:56Well, you told the police in the police report that it occurred January 29th.
44:03When did you report it to the police?
44:05As soon as it happened.
44:06You mean that day?
44:07Yes.
44:08Listen to me.
44:11January comes before February.
44:14Mm-hmm.
44:15Do you understand?
44:17You just told me, madam, that the same day that this happened, you reported it to the police.
44:24Right?
44:25Mm-hmm.
44:26So you reported it on January 29th, and it happened January 29th.
44:31Then you told me it happened February 4th.
44:33Right?
44:34Yes.
44:35So you mean you reported it to the police before it happened?
44:38No.
44:39Do you understand your problem?
44:41Yes.
44:42You just told me that you're absolutely positive that it happened February 4th.
44:45The police took the report, said date occurrence January 29th.
44:48They would have said to you, madam, how could it have occurred on February 4th?
44:51We didn't come to February 4th yet.
44:55Judge Judy continues in a moment.
44:57She kicked a hole through my door, and then she's saying that I'm stalking her.
45:01Give me a break, please.
45:03And later today...
45:04When you travel like we did...
45:05Stop!
45:06This is really important for me to say here.
45:09Is what you're going to tell me that the CDs were all scratched before you took them?
45:12That's correct.
45:13When you travel like we did...
45:14Shut up!
45:20Real cases.
45:21Real people.
45:22Judge Judy.
45:23Myra Graham is suing ex-husband Carl Vitale for her slashed tires.
45:28All right.
45:29Judge?
45:30What?
45:31I would like to be able to, you know, state that this is a case of false decimation.
45:37She also destroyed property that belonged to me.
45:40She came over to my apartment.
45:42She kicked a hole through my door.
45:44I mean, it's just ridiculous.
45:46And then she's saying that I'm stalking her.
45:48Give me a break, please.
45:49Okay?
45:50Because I would not do that.
45:51I have better things to do with my time.
45:53I love her.
45:54We have a son together.
45:55I wouldn't do nothing to her car because I want my son to have proper transportation.
45:59I would not do this to her.
46:01Mr. Vitale, let me suggest this to you, sir.
46:05Ms. Graham says that you are not the father of this child.
46:09You seem to be convinced that you are the father of this child.
46:12I can understand why you would be angry with her if she, in fact, denied that you were the
46:18father of a child that was conceived during the time you were married.
46:22Now, that doesn't mean she can prove to me that you slashed her tire because she's given,
46:29to me, conflicting testimony.
46:31She swore, she's absolutely positive, that this incident occurred on February 4th.
46:35Yet she went to the police on January 29th and told them about it.
46:38Yeah.
46:39So that's impossible.
46:40Case dismissed.
46:41Why is our excuse?
46:42You may step out.
46:43Out the back door to your right, please.
46:44Thank you, Your Honor.
46:45Honey keeps harassing and stalking me and saying we're still married by God's law and just,
46:54he doesn't want to let it go.
46:55She knows it's our son.
46:56She's with nobody before or after but me.
47:01Whether we're going to be together, her and I, in the end, only God knows that.
47:05And, uh, he's in control.
47:07And now, the next case.
47:09All parties on Fallon versus Sherman.
47:12Step forward, please.
47:1321-year-old sales clerk, Cassandra Fallon, claims former boyfriend, 24-year-old store supervisor,
47:19Dean Sherman, borrowed and ruined her CDs.
47:22Dean is countersuing for the cost of their weekend getaways.
47:26What kind of business were the two of you involved in?
47:29Traveling sales.
47:30And you travel together?
47:32With a company, yes.
47:34And you were also involved in a relationship with the defendant.
47:38Yes.
47:39Is that right?
47:40According to you, you made a series of loans to him on your credit card.
47:45Yes.
47:46Is that right?
47:47And in addition, he borrowed some CDs from you.
47:50He didn't borrow them.
47:51He took them.
47:52Took them and returned them scratched.
47:54Yes.
47:55All right.
47:56Let's take the CDs first.
47:58Okay.
47:59You took these CDs on the road with you to play?
48:02Yes.
48:03He was on the road and we had gone for a vacation to stay with his parents for a week.
48:08And so the first night we were there, we went and played bingo with his mother, had a good
48:11time, and she said she goes on Wednesdays also.
48:13So we had made plans to go with her on that Wednesday.
48:16Well, I'm getting ready to go with her.
48:18He tells me, well, he was going out with his friends.
48:21So I go play bingo with her.
48:22I come back.
48:23He's gone.
48:24My CDs are gone.
48:25The next morning when I got out of the shower, he was gone.
48:27He went to his friend's house to pick up my CDs.
48:29When...
48:30You got him back.
48:31I got him back.
48:32Yes.
48:33I listened to him.
48:34Every single one of them is scratched, skips, don't play.
48:36Okay.
48:37So what did you do after that?
48:39Well, I told him, I said, every single one of these is scratched.
48:42I pulled them all out and looked at him and he said, I said, what happened?
48:46At first he went and tell me.
48:47He said, I'll replace them.
48:49When finally, every time I asked him, he went and tell me.
48:51And finally he said, well, we were drinking in a field and they all ended up all over the
48:55ground.
48:56Does that sound right?
48:57No, that doesn't sound correct.
48:58When you, um, when you travel like much as, this is really important.
49:01Just Judy, this is really important.
49:02Just a second.
49:03Okay.
49:08Did you take her CDs when you were going out that evening?
49:10I sure did.
49:11And you went out with your friends?
49:13That's correct.
49:14You were partying, having some drinks?
49:17That's correct.
49:18Did you say to her, the CDs ended up on the ground?
49:23I did not say they ended up on the ground.
49:25Did they end up on the ground?
49:27They did not end up on the ground.
49:28That's a lie.
49:29Shh.
49:30Where did they end up?
49:31They ended up in a car.
49:32They were just in a car with the rest of us.
49:35And, um, when you travel like we did, like a...
49:38Stop!
49:39This is really important for me to say here.
49:42You took the CDs and you would listen to the CDs before, is that right?
49:50And there was nothing wrong with the CDs, is that right?
49:53Yes, ma'am.
49:54That's not right.
49:55Now, is what you're going to tell me that the CDs were all scratched before you took them?
49:59That's correct.
50:00When you travel like we did...
50:01Shut up!
50:02This is really important for me, Judge Judy.
50:05I want to really explain.
50:06She lent a lot of her CDs out to a lot of different people, all the time.
50:09I want you to be quiet.
50:10Okay.
50:11I don't care whether she lent it out to half the civilized world.
50:14Okay.
50:15The point is, you wouldn't have borrowed these CDs, Mr. Sherman, if they were all scratched
50:21and skipped.
50:22So the day you borrowed them, they were okay.
50:25The day you returned them, they were not okay.
50:27No, that's not true.
50:28Did you have a conversation with her after she listened to the CDs and said to you they're
50:34all scratched and skipped?
50:35Do you remember that conversation?
50:36That's kind of ludicrous because basically she didn't have a CD player with her at the
50:40time, so I don't see how she could have.
50:41And her CD player was also broken at the time.
50:43Go ahead.
50:44Actually, at the time we were using his CD player and I did have a CD player at the
50:49time.
50:50I didn't have a CD player at the time.
50:52Mr. Sherman, so if you didn't have a CD player and she didn't have a CD player, is
50:57that what you're telling me?
50:58That's correct.
50:59How did you play the CDs?
51:01We had it out back on the road because we didn't have it.
51:04How did you play the CDs?
51:05I didn't take my CD player out with me.
51:06I did not take it with me.
51:07How?
51:08So let me ask you a question.
51:09Did you borrow the CDs that night to look at them?
51:12No.
51:13I borrowed them.
51:14So you played them?
51:15Of course.
51:16In a car.
51:17On what?
51:18On a CD player in a car.
51:19Whose car?
51:20My friend Laura.
51:21Okay.
51:22Now, how much are the CDs?
51:25Well, there's 31 of them.
51:27Just give me a figure.
51:30$408.
51:32Let me have them, please.
51:33It actually costs more.
51:34If you look on this side here, there's one on the end and then there's one that I slipped
51:38in the center that is a good CD so you can compare what a damaged and a good CD.
51:42Look like.
51:43Yeah, 75% of those CDs were previously scratched.
51:45Then you shouldn't have taken them, sir.
51:46Judge Judy continues in a moment.
51:47If I had to spend eight months on the road with you, I think I would deserve every single
51:48penny for every moment that I spent over a dinner table with you.

52:12Judge Judy.
52:14Cassandra Fallon is suing former boyfriend Dean Sherman for ruining her CDs.
52:20All right.
52:25Court believes that you said you were going to replace them, Mr. Sherman.
52:28Now, let's get on with the next thing.
52:30Tell me about these credit cards.
52:31Credit cards?
52:32We had gone because he needed a pair of pants.
52:35We went to go buy one and, you know, they said, if you fill out an application, then you'll
52:39get 10% off.
52:40So I said, okay.
52:41I did it.
52:42I was approved.
52:43And then he went nuts just picking out things.
52:44I said, well, we're only going to get the pants that you came for.
52:47And he said, well, you know, I have a good job now.
52:49I'm going to pay for these.
52:50Let's get all this stuff.
52:52So I went ahead in the end and agreed to it.
52:55And then about a month later, he wanted to apply for one.
52:58He was denied, but then they said that if I co-sign, then he would get approved.
53:04So I have the bills from that card and receipts that he signed with his name.
53:08And I have it all right here for what was his and what was mine.
53:11All right.
53:12Now, Mr. Sherman, you seem to acknowledge, sir, that you used a credit card.
53:15That's correct.
53:16That you paid off what was yours on the credit card.
53:19And at most, you owe her $126.72.
53:23To my figures.
53:25I have a letter right here from him where he itemizes everything he owes me.
53:29Let me see it.
53:30And it has a payment plan to when he's going to pay it.
53:34And he has paid me $150 towards this, what is not in this lawsuit.
53:39That is separate.
53:40$255 is the remaining balance.
53:43$254.21.
53:44Correct.
53:45Does that sound right to you, sir?
53:47It's not so different from $126.72 that you indicate you were still lower.
53:51Well, I have signatures on my cards right here that I signed to.
53:54So I paid off $150 of that.
53:56That leaves a balance of $126.72.
53:58Now, also, if you look at this piece of paper right here, it also says Cassandra J. Fallon and Dean Fallon.
54:03Obviously, my name's not Fallon.
54:04And I did sign a Dean Sherman.
54:05I have right here a letter.
54:07I tried to get the application.
54:08And I have more paperwork from when I went back.
54:11I called them.
54:12They fixed the mistake.
54:13They put his last name in there.
54:15I mean, I paid for my stuff.
54:16I paid for the clothes he's wearing today.
54:18I feel that I should be reimbursed for this.
54:20Let me see your bills.
54:21I have this letter.
54:22Shh.
54:23Where?
54:24You two deserve each other.
54:25Let me tell you.
54:28All the time when we used to travel, this lady did absolutely nothing.
54:33Nothing.
54:34Basically, she's lazy.
54:36She really went out and spent loads of money on credit cards.
54:40What does that have to do with you?
54:41I supported her for six months out on when I worked.
54:43Aren't you a nice fellow?
54:44What?
54:45Aren't you a nice fellow?
54:46Yeah, I know.
54:47I'm a really nice guy.
54:48All right.
54:49Mr. Sherman, why did you stop paying her?
54:59You were paying her for a period of time.
55:00Because I was getting harassment, one by her father.
55:03I mean, to give you a rough description, I was dropped down in the middle of Houston
55:07with $25 in my pocket and told bluntly, find your own way home.
55:10Is that why you stopped paying her?
55:12Because you got angry with her?
55:13No.
55:14Basically, the concept was, it's just, I consulted several people, even a lawyer,
55:18and they told me, what you signed for is what you deserve and what she deserves.
55:22And after the fact, I started getting harassing phone calls.
55:25It was just totally ludicrous.
55:27But you acknowledged, sir, that you owed her, according to you, $126.
55:31So my question is...
55:32I owe her $126.
55:34Why did you stop paying her?
55:37Harassment would have stopped if you paid her.
55:40So why'd you stop for?
55:41Well, like I said, it was all going to be worked out.
55:45But it was going to be worked out in a different agreement.
55:47And this is basically the way it was going to be worked out right here.
55:50And I was going to sign it and date it and everything else along those lines
55:53and make a contract with her to pay this amount, X amount of $126 that I still owe her left.
55:58But blatantly, you know, harassing phone calls, you know, it was just...
56:02Shh!
56:03You're giving me a headache.
56:04I got one.
56:05All right.
56:06Let me resolve this counterclaim of yours, which I can resolve in 30 seconds, 20 seconds.
56:14You filed a ridiculous counterclaim for $2,000 because you say while you were on the road working,
56:20I paid well over the above amount in supporting Jennifer's wishes.
56:24This includes four-star meals, hotels, shopping trips, weekend excursions.
56:29I feel she should pay her share.
56:31After all, we were only boyfriend and girlfriend.
56:34Is that the nature of your complaint?
56:36Yeah, yeah, it is.
56:38When, you know, when you're on the road...
56:40I've been asked numerous times to chip in.
56:42And blatantly, she even quoted, why should I pay anything?
56:45You make enough money for both of us.
56:47Well, so then it wasn't a loan.
56:48That's really not a lie.
56:49So then it wasn't a loan.
56:50That's really not a lie.
56:51That's actually a blatant truth.
56:52I mean, it's...
56:53Shh!
56:54Mr. Chairman, I want to say one whole sentence without the word blatant.

57:12Listen to me, sir.
57:14This is a court.
57:15Okay.
57:16This is not a feelings place.
57:17Not what you feel she should be responsible for, what you would like her to be responsible
57:21for.
57:22When there is an agreement, either written or verbal, to repay, that is a contract.
57:27You didn't say to her, I'm taking you out for dinner, here's the bill, you owe me half.
57:31Right?
57:32No, I didn't say that.
57:33Of course not.
57:34All right.
57:35Mary.
57:36Just the thing is, I mean, I paid so much for this.
57:39I gave this girl everything in the world.
57:40I gave her...
57:41I mean, you can even question my witness here.
57:42I gave this girl everything.
57:44I mean, it's so ridiculous.
57:46I mean, it's...
57:47Mr. Sherman?
57:48Yes.
57:49There's a piece of me that feels as if you're probably a very nice person.
57:53Well, thank you.
57:54But if I had to spend eight months on the road with you, I think I would deserve every single
57:59penny for every moment that I spent over at a dinner table with you.
58:03You've got to learn not to be so hyper-serve.
58:05You know, just sort of relax.
58:06Judgment for the plaintiff in the amount of $500, that's all.
58:09Bodies are excused.
58:10You may step out.
