00:00up and we were still in the holiday spirit. Everybody was celebrating. I had a two-month
00:08old and we were taking the opportunity to have a night out while my parents were watching
00:13my son. We went to the restaurant that I worked at. I remember having a good time.
00:21About 11 o'clock, somebody at the restaurant had said they heard over the scanner that
00:26there was a stabbing. We figured it was just some drunk idiot got in a fight and pulled
00:33out a knife and we'll find out who it is later because it's small town, Massachusetts. We're
00:39going to hear about it. But while we were heading home to my parents' house on Elm Street, we
00:47saw about five or six police cars on the road, which is not normal. I never thought that I
00:54would be sucked into this nightmare.
00:55I never thought that I would be sucked into this nightmare.
01:24I was the on-call investigator. So I was the on-call investigator. So I was the on-call
01:43investigator. So I was just at home with the family. It was New Year's Eve and we were
01:59waiting for the ball to drop when I got that phone call.
02:04I got a call from the Middleborough Police Department reporting an apparent homicide on Old Center
02:15Street in Middleborough, Massachusetts. The residence is located in a very rural part of
02:22Middleborough. It's across from a cranberry bog and it's surrounded by woods.
02:28When I first arrived at the scene, it was cold outside. There had been a light snowfall. It
02:41was an inch or less. I was introduced to Mr. Gillen, who had discovered his oldest daughter,
02:47Tara, inside of the den with stab wounds. She was covered in blood.
02:58When I first saw Tara, you could immediately see the brutality that was involved in this crime.
03:07It was overkill. Tara was stabbed at least 21 times.
03:1514 times in the upper back. Three times in the neck. Leaving a gaping injury. Mr. Gillen was needless
03:42needless to say, very upset. But he was able to provide the details we needed.
03:51Tara was 20 years old at the time. She was a sophomore from Indiana University and was an English major.
04:00And she was home for the Christmas break between semesters.
04:08That evening, December 31st, was he and his wife's anniversary. So they had chosen to make plans to go out for dinner to celebrate.
04:16They had invited Tara to go with them, but she had declined and chose to stay home.
04:24They returned about 11 p.m. And as he pulled up the driveway, he saw an open door.
04:31He immediately ran into the house.
04:48Entered the den area, which is right off of the kitchen.
04:50And he saw his daughter, Tara, lying on her back, naked from the waist down, covered in blood, with a gaping wound to her neck.
05:10And she was unresponsive.
05:11He approaches Tara.
05:22He hears a noise out in this hot tub room that is adjacent to the den.
05:27He immediately yelled out, I'll kill you, you bastard.
05:30When he got out into that room, there was nobody there.
05:47But he felt a blast of cold air, and that oriented him to realize that the window had been open.
05:53He also heard noises in the woods that were consistent with somebody fleeing.
06:03The breaking of branches, the squashing of snow.
06:08Footprints were leading away from his home.
06:16Mr. Gillen advised us that he located a blanket, and he placed it over his daughter.
06:23Mr. Gillen remained by his daughter's side until the police arrived.
06:33As a person, and as a parent, and as the father of a daughter, I just cannot imagine what that felt like to make that discovery.
06:43Neither then, or frankly, today, how you would even go on and deal with that.
06:48It's just tragic, tragic.
06:53But any homicide, you look at various factors.
06:58She could have been targeted by a spurring lover or boyfriend.
07:02Her pants and her underwear had been pulled down to the ankle area.
07:07So you would assume that you may have a sexual assault involved as well?
07:15Did she have an old acquaintance that knew she was in town, and maybe they knew that the parents went out and she was going to be alone?
07:21It was very difficult to make a determination whether the terror was targeted or if this was just a random crime.
07:30As we entered the house, things were tipped over, it was just an absolute mess.
07:50It could have been part of a burglary or somebody looking for valuables.
07:54We noted a cigarette butt in the middle of the carpeted hallway or the upstairs portion of the house.
08:02That was strange to us.
08:09I inspected the area that Mr. Gillen described from which he chased the assailant out of the house.
08:15The room contained a hot tub.
08:19There was a window that had opened up.
08:21Observations of that window indicated a forced exit.
08:26When processing the scene, they also found a partial footwear impression on the hot tub cover.
08:34It was pointed in the direction away from the home.
08:38So that gave investigators the indication that that was a point of exit.
08:43And then we had a second set of matching shoe prints that went around the side of the house.
08:51The footwear impression had this wavy tread and it had a circle in the ball of the foot area.
08:59We take photographs of the impression to give to investigating officers.
09:04It was a tread pattern that was, to me, easily recognizable as a casual sneaker.
09:09It's virgin snow, so this likely was from the assailant leaving the scene.
09:16That's why that one shoe imprint impression is so important, because it's just absolutely pristine.
09:22So based on that information, we began an initial tracking of the suspect.
09:29There was no murder weapon discovered at the scene, so one would have to believe that the suspect was still armed.
09:34Officers were looking for footprints in the snow, the broken branches, property that he might have stolen and discarded.
09:45Things that didn't belong there.
09:49Additionally, a safe police helicopter was put in the air.
09:52All patrols were on the lookout in this area.
09:54And we had canines to find the assailant.
10:00Investigators had followed the trail, starting where he exited through the broken window.
10:09Ultimately, where they lost the trail in the cranberry block.
10:12After seeing what he did to the victim, I would say that there was a good possibility if he encountered someone, he would repeat his actions.
10:27What's this killing personally, given the brutality that was involved in this crime?
10:37Or was it just a total random act of violence?
10:41Someone who was out for blood.
10:42We didn't know what we were up against with this killer who had fled the scene.
11:01If he was bold enough to kill Tara Gillen on New Year's Eve, he could do it again.
11:05It was a heavy police presence, cruises going up and down the streets.
11:11There were helicopters up and canines.
11:14Living in a small town, word travels very fast.
11:18Everywhere we went, that's all everybody was talking about.
11:24I didn't think that something like that would be possible, just because of the atmosphere in our town being so peaceful.
11:35A lot of time was spent with families and friends and cookouts and backyard parties and, of course, rooting for all the Boston sports teams that might have been playing at the time.
11:46It's a small town, a lot of working people, cranberry bogs.
11:49Middivore would not be the type of town where you'd find a vicious murder.
11:56One of the things that investigators will look at is the neighbors within the immediate area.
12:01So when detectives were advised that there was a registered sex offender living in the home immediately behind the victim's house,
12:12we raced to the house hoping that this could be the break we needed.
12:16There's the belief that this person could have been watching her while she was home for the holidays.
12:29Stalking her, watching her every move.
12:36This was a slam dunk.
12:37A sex offender living directly behind the victim.
12:47But the resident advised them that the sexual offender was no longer there because he was currently incarcerated.
13:17Whenever you have an investigation or homicide, your chances of solving it within the first 48 hours are 80%.
13:27From there, it begins to go down quickly with each ensuing day.
13:32So you flood the neighborhood with investigators.
13:36You're talking to neighbors.
13:37You're talking to friends.
13:39You're trying to get as much information as you can.
13:41We were working down the street, knocking on doors, trying to get information, when we were approached by a neighbor.
13:52This neighbor advised detectives he found that door was open to his hayloft.
13:57Once detectives were told that the door to this hayloft was always kept shut.
14:18They figured it would be a good thing to check it out to see if someone was possibly hiding up there.
14:23One of the detectives was shown the open door by the owner of the property.
14:31The detective went up into the loft to check it out.
14:33The detective went down thehetto.
14:34The detective went up into the factory.
14:35The detective went up into the field, and he premia himself, and tried to check it out in the traffic window.
14:36The detective is 뭐ified in it.
15:11There was nothing.
15:31It was just full of cobwebs up in the haylock.
15:41While detectives went to a house a few doors down from the scene of the crime,
15:50the resident stated that something odd did happen earlier in the week.
15:55She stated that when she was sleeping, she heard a noise.
16:10She pulled back the curtain, didn't see anything, and went back to sleep.
16:27But it did make her feel uncomfortable, as she felt that someone could be watching her.
16:38This is a lead that had to be considered because the neighbor lived so close to the victim
16:44that it was a possibility that she could have been watched by the perpetrator,
16:48and he was just hunting for his perfect victim.
16:55The local detective was asked who in this neighborhood could be involved in something like this.
17:00The detective talked about one individual who, in the past, had committed some vandalism.
17:06It was a rumor, although never confirmed, that he actually pulled a knife out on his parents at some particular point in time.
17:16One of the things that I do is footwear comparisons between shoes and impressions left behind at the scene.
17:44And my goal is to identify the shoe, not only the manufacturer, but the actual model of the shoe.
17:52In this particular case, it was made by Puma, which is an athletic shoe company.
17:58I contacted the factory, and ironically, it was located here in Massachusetts.
18:06So right away, they were able to get back to me and said,
18:09Hey, listen, this was a very unique shoe.
18:12This is a prototype. This didn't even make production.
18:16There's one shoe. There's one killer.
18:18Find the shoe. Find the killer.
18:29During those initial hours of that search for Tara's killer,
18:33We learned about a young man, Jonas Fell.
18:39This is a kid that, according to the police, it had repeated interactions with.
18:45He was well known to them, and he lived less than a mile from Tara Gill.
18:49We had shoe prints at the crime scene that matched shoe prints that brought us nearly to the fell house in that direction and very close to it.
19:02When detectives hear that type of information, right away, they perk up.
19:07Here we have a troubled kid.
19:09The vandalism, potentially rumor that he's pulled a knife.
19:12And here we have a stabbing that's occurred to Tara.
19:19We decided to immediately go over to this individual's house and conduct an interview.
19:28As we arrived at that house, it was early morning.
19:31It was obvious that a party had taken place the evening before.
19:35Evidence of bottles and cans from a get-together.
19:37During an interview with Mr. Fell, Jonas' father,
19:45We learned that his son had hosted a New Year's Eve party at the house in the basement the night before.
19:52As far as he knew, it was just a regular party with the kids.
19:55He had said that he, the father, had gone out the night before with his wife.
20:03They ultimately come home around 9 o'clock or so, and they found Jonas at the house.
20:09And there was nothing out of sorts or caused any reason for concern by him.
20:15Jonas had stayed there the entire time.
20:17But one of the things investigators still had questions about was,
20:24Did Jonas pull a knife out on them in any particular time at all?
20:31He told them that that was just a rumor that was going around the town.
20:35It had never happened.
20:36So when following the footprints from the Gillen house to Jonas' house,
20:45We had to be concerned with the fact that the killer could be one of the partygoers.
20:52Could the assailant be somewhere in the neighborhood, perhaps even watching us?
20:57We just didn't know.
21:06What we were told is this group of individuals met up at the local McDonald's.
21:10They got together around the 7 o'clock hour and then returned to Jonas' house for a planned New Year's Eve party.
21:21We know from our interviews that these partygoers drank beer.
21:25They had Goldschlager, that they played the games that these youngsters would play in terms of drinking games.
21:31But nothing ever got out of hand.
21:36We stopped by the party around 9.
21:46It was pretty early on in the night because we had plans to go out afterwards.
21:51There was about 20 or so kids there when we stopped there.
21:57Jonas was a friend of my brother's.
21:59It was more so my brother's group of friends.
22:03Seemed like they were having fun.
22:04Everybody was in good spirits.
22:06But it was just a crowded group of younger kids.
22:11So we left.
22:13I absolutely did not think anything that was going on was unusual at all.
22:24During the course of talking with these partygoers, a common theme started to develop.
22:29Several individuals indicated one particular individual got into an argument and ended up leaving the party early.
22:38This individual was intimately involved with his girlfriend at the party.
22:48And at some point in time before he finished, she went to use the restroom and then never returned.
22:55And this is around the time that that altercation or that verbal confrontation occurred.
23:12So whether he was upset and got into it with his girlfriend or just was being an ass because he was upset.
23:19It was not clear to us, but he was asked to leave the party by Jonas.
23:23So he left the house upset.
23:29His girlfriend went with him trying to talk him into coming back to the party, but was unsuccessful.
23:35It was a cold evening.
23:36She got cold and she returned to the party and actually remained there the rest of the night.
23:40We didn't know if this was just some angry kid who ended up going home or if this was our actual killer.
23:58Less than 24 hours after Tara's murder.
24:01The name Ryan Burgess was given to us as an individual who had attended the party partially.
24:13In between the 9 and 10 p.m. hour, he'd gotten into the fight with a host and had left the party in the direction of the Gillen home.
24:22On his way home, a short amount of time before Tara Gillen was brutally murdered.
24:32And frankly, it had been the biggest great outside of that initial shoe impression that we had gotten.
24:38As investigators talked to various individuals who had attended the party,
24:43they described Mr. Burgess as an 18-year-old, was a quiet individual, kept to himself, had been bullied in the past.
24:50He wasn't an individual that had really gotten into trouble, wasn't an individual to start trouble.
24:57Investigators were able to get in contact with Ryan's girlfriend.
25:01She certainly did admit that they were together that night.
25:04She went back to the party and he went off on his own,
25:06but she just didn't think that he was the type of guy that could have committed that type of crime.
25:15Investigators started to check into Mr. Burgess' background.
25:18And they found out that he didn't live that far down the road from the Gillen residence.
25:25So right away again, another indicator that certainly they needed to talk to Mr. Burgess.
25:32Detectives found out that Ryan Burgess was living with the Shelley family on Elm Street.
25:37My mom was a big heart.
25:44And she had no problem opening her home to anybody that needed it.
25:49And when my brother said, Ryan needs a bed to sleep in, she said, absolutely.
25:57Ryan actually grew really close with my family.
26:00He would do anything for anybody.
26:03There were some kids in town that kind of felt like Ryan was a target.
26:13My brother would fight some of his battles for him when he needed to.
26:18Ryan was just more of a passive kind of kid.
26:21Ryan came from a tough background,
26:23but he was just the kind of kid that needed a break and needed someone to love him.
26:27The night of the party, I'd only seen him for an instant.
26:35When we were leaving, Ryan seemed like he had been feeling pretty good.
26:45That night, we had got back to my parents' house.
26:48It was just before midnight.
26:49And my son was already sleeping.
26:58And we were just sitting in the living room,
27:01waiting for the ball to drop.
27:02Ryan had walked in the door.
27:21He was soaking wet from his waist down.
27:36And I remember looking at him like, for lack of better words,
27:40can you do it?
27:41You know, and he looked at me and he's like,
27:43oh, just, you know, I walked home and this and that.
27:46I made a comment about him being an idiot
27:50because he walked all the way home
27:52and we would have went and picked him up if he needed a ride.
28:05Ryan went into the bedroom that he was sharing with my brother,
28:09changed, got some sweatpants on,
28:11and came out and sat on the couch
28:13and just talked to us.
28:19And I said, you know,
28:21we heard somebody got stabbed up on Old Center Street.
28:25You know, she wrote that way.
28:26You stabbed anybody tonight?
28:29No, no, no, yeah, just in his normal way.
28:32He was a fairly quiet kid.
28:35He didn't talk to you, like, face to face
28:37because he was always, like, head down, like, you know,
28:40no, no, no, I wasn't.
28:55He just laughed it off and said,
28:58no, I have no idea.
29:04We left, he went to bed,
29:06and the night kind of just ended.
29:07When we had woken up,
29:21my dad called.
29:22I need you guys to come over here.
29:25He just said the state police were there
29:27on Elm Street.
29:30Obviously, it was a frantic drive over there
29:32because we had to know what was going on.
29:34We were going through every scenario in our head,
29:39you know, what we thought had happened.
29:45When we got there,
29:46there were reporters wanting to speak with us
29:49and it seemed a little bit chaotic.
29:54With all of the chaos going on,
29:56detectives in the house
29:57getting various bits of information,
30:00it was pretty confusing
30:03and emotional at that time.
30:06And my dad said,
30:08Ryan has been talked to about
30:10a break-in and a murder.
30:16He's going to help
30:17because he can get an accusation
30:19of something he didn't do.
30:20How do you know he didn't do it?
30:22Well, I know he didn't do it.
30:24I can just help.
30:25I was thinking
30:27that they must have had the wrong person.
30:32Oh, I didn't want to cry.
30:36There's no way
30:37he had the capability
30:39of doing that.
30:40He's harmless.
30:41He's a good soul.
30:43He's got such a big heart.
30:44How could he possibly
30:46kill somebody?
30:47And I remember talking
30:48to the state troopers
30:49and saying,
30:50there's no way he did this.
30:52He got the wrong person.
30:53When we announced ourselves
31:03at the Elm Street residence,
31:06Mrs. Shelley was surprised
31:07that we were there.
31:09We indicated to her
31:10that we had interest
31:11in speaking with Ryan Burgess.
31:14She indicated that Ryan
31:15was currently taking a shower.
31:23When Ryan came out
31:27of the shower,
31:28we introduced ourselves
31:30to him.
31:32We immediately observed
31:34that he had a cut
31:35to his left upper lip.
31:42In addition,
31:43he had several random scratches
31:45on both of his forearms.
31:47when they asked him
31:49how he got these marks,
31:51he stated he was
31:52in a fight with somebody
31:53but he couldn't remember
31:54who it was.
31:57And we asked him
31:58if we might be able
31:59to see the clothing
32:00that he was wearing
32:00the night before.
32:03He consented to that
32:04and actually let us
32:05into his bedroom.
32:09As investigators
32:10are going through his room
32:12and they asked Mr. Burgess
32:14for the shoes
32:14he had been wearing
32:15the night before,
32:16He reached under the bed,
32:25pulled out a pair
32:26of pumas,
32:27blue pumas.
32:33They looked at the shoes
32:34but immediately
32:35their attention
32:36was drawn to the outsole.
32:39And what they noted
32:40was the same wavy pattern
32:42with the circle
32:43that they had seen
32:44the night before.
32:46That was the golden ticket.
32:48Those shoes matched
32:50exactly what we saw
32:51at the Gilling crime scene.
32:54This is when I knew
32:56we had our suspect.
33:00We left the residence
33:02and began driving
33:03to the state police barracks
33:05which was actually
33:06very close
33:06to the Elm Street location.
33:08We said to him,
33:11Ryan,
33:11we know what happened
33:12last night.
33:13And he said to us,
33:14I don't know
33:15what you're talking about.
33:17It's Ryan,
33:18did you enter
33:19a house
33:20on Old Center Street
33:21maybe to get warm?
33:24He denied that.
33:27And we said,
33:27Ryan,
33:28maybe the person
33:28even let you in.
33:31Maybe they even
33:32came on to you.
33:33And to our amazement,
33:35he said,
33:35yeah,
33:36she came on to me.
33:37She led me on.
33:42That was the first
33:43indication from him,
33:44almost a soft admission,
33:45that's putting him
33:46at the residence
33:48with Tara.
33:48This was big.
33:54But we pressed it
33:55a little bit more.
33:57We said,
33:58Ryan,
33:59we think something
33:59bad happened
34:00in that house.
34:03And that's when
34:04Mr. Burgess
34:05started to come around
34:06and talk about
34:08what had actually happened.
34:11He said after
34:12a fight with his girlfriend,
34:14he left the fell house
34:15at around 9 p.m.
34:18He actually sees
34:31a car back out
34:32of a driveway
34:33at the Gillen residence.
34:41He went around
34:42the side of the house.
34:48He entered a screened
34:56porch area
34:56through a storm door
34:57that was unlocked.
35:01He could see
35:02a young female
35:03watching TV.
35:05He was surprised
35:18that all of a sudden
35:19she showed up
35:19right at the door.
35:22Face to face with him
35:23just through the glass.
35:28She asked him
35:29who he was
35:30and what he wanted
35:31and his response was,
35:32I'm friends
35:33with your sister.
35:35Somehow,
35:50the door
35:50ends up opening
35:51and she tried
35:52to run away from him.
35:53and he caught up
36:08with her.
36:12Tara screamed.
36:16And when she screamed,
36:18he reached out
36:18with both hands
36:19and began strangling her.
36:21He continued
36:26to squeeze
36:28and strangle her.
36:33She fell to the floor.
36:41And while she
36:42laid there
36:43gasping for breath,
36:44trying to breathe
36:45according to him,
36:46he went out
36:47into the kitchen
36:48and retrieved
36:51a steak knife
36:52and as Tara
36:53continued
36:53to try to breathe,
36:56she saw him coming
37:01and tried
37:02to run away
37:03from him.
37:07But she fell
37:07down on the ground.
37:08And that's when
37:24he began
37:25to stab her.
37:28At least
37:2921 times.
37:30He had removed
37:38her pants
37:39and he stated
37:41to us
37:41that he
37:42had intercourse
37:43with her.
37:46Ryan stated
37:47after ransacking
37:48the house
37:49and had his cigarette,
37:51he heard
37:51a car approaching
37:52and at this time
37:54he knew
37:54he had to get
37:55out of the house.
37:55That's when
37:58Worcester Gillen
37:59had come home
38:00and found her.
38:04Horribly horrific.
38:07It's just
38:08the total
38:09randomness
38:09of that evening
38:11to put all
38:11these pieces
38:12in place
38:13with the ultimate
38:14loss of Tara's life.
38:16It's just
38:16incomprehensible.
38:21When I found out
38:22what had transpired
38:24and how brutal
38:25everything was,
38:27that was a tough
38:27moment.
38:34Several days
38:35later,
38:35with Ryan's help,
38:36he was able
38:37to guide us
38:38to the location
38:39of the murder
38:40weapon.
38:42Ryan stated
38:42that while he
38:43was running,
38:44he threw
38:44the knife
38:45in the darkness
38:46into what
38:48he believed
38:48was a cranberry
38:50bug.
38:51And we started
38:52walking along
38:53the edge
38:53of the cranberry
38:54bug.
38:56And somebody
38:57found it.
39:01We found out
39:02that Ryan
39:03dropped out
39:03of school
39:03in the ninth
39:05grade,
39:05got involved
39:06with drugs,
39:08and had a history
39:09of breaking
39:10and entering.
39:11By 1996,
39:12his parents
39:13had actually
39:13put him out
39:14of the house,
39:14and that's
39:15when he met
39:15the Shelleys,
39:16and the Shelleys
39:17took him in
39:18and gave him
39:19a place to stay
39:20at their home.
39:25Ryan Burgess
39:26was ultimately
39:26found guilty
39:27of murder
39:28in the first
39:28degree,
39:29which amounted
39:30to life
39:31in prison
39:32without the
39:33opportunity
39:34of parole.
39:36It does make
39:37him a monster,
39:37but I think
39:38that monster
39:38was buried
39:39down deep
39:40inside,
39:41and something
39:42happened that
39:42night,
39:43and that all
39:43came out.
39:44I don't think
39:47that Ryan
39:47was able
39:48to digest
39:49what he did.
39:52I think
39:52the guilt
39:53and the remorse
39:54for what he
39:55had done
39:55was just
39:56unbearable.
39:58He destroyed
39:59not just
40:00Tara's life,
40:02but her
40:03parents,
40:04the rest
40:04of her family.
40:07That is
40:07something you
40:07can't come
40:08back from.
40:10It was only
40:11a couple
40:11years after
40:12he was
40:13incarcerated
40:13that he
40:14took his
40:14own life.
40:17Tara had
40:18her whole
40:19life in
40:19front of
40:19her.
40:21The 20
40:21year old,
40:22she had
40:22barely begun
40:23to live it,
40:24and her
40:24life is
40:25just wiped
40:26out for
40:27no reason
40:27at all,
40:28and that's
40:28it.
40:30There's no
40:31replay,
40:31there's no
40:32pause,
40:32there's no
40:33rewind.
40:41That house
40:42on Elm Street
40:42was a
40:43horror scene.
40:43Somebody
40:44died in
40:44my house.
40:45Somebody
40:46what?
40:46Die.
40:47Toothpished
40:47up the
40:48nose and
40:48shampoo in
40:49the eyes.
40:50I've never
40:50seen a scene
40:51like this
40:51before.
40:53They only
40:53left a
40:54three-year-old
40:54alive.
40:55His mom
40:56had always
40:56told him
40:56that monsters
40:57aren't real.
40:58She was
40:59wrong.
40:59go.
