00:00I'm at 1400 South Louis.
00:30I was flagged down by a homeless individual about his buddy being sick, and his buddy is ten-seven, coming to homicide.
01:00What's up, Jason?
01:02Hey.
01:03Who is he doing now?
01:07I don't know yet.
01:09He's probably been here a minute.
01:13When I first got here, the shoe had dew on it, so that indicates the shoe's been sitting in that position overnight.
01:20It looks like there could be some blood right there.
01:34Look at that.
01:37Yeah, that's a weapon.
01:42That's good.
01:43That's real good.
01:46I swab everything I can on the cane, so...
01:50Look at that.
01:51See it?
01:54There's a tooth on top of that blue blanket.
01:58It may be from a suspect if they got into a fight.
02:01Yeah.
02:02The guy that flagged officers down, he's got some kind of wounds on him, so they transported him.
02:09And then Severus just happened to do some kind of pet check before this, and saw all this guy with marks on him.
02:16So he went and re-acquired him, so you're gonna have two people downtown.
02:21All right.
02:22I'm gonna head downtown.
02:23I'm gonna start talking to these guys.
02:25We've got two guys up here right now.
02:37One of them's got blood all over him.
02:40It's possible that he could have tried to help his friend after he'd already been attacked.
02:46And then the other guy just happened to be walking in the neighborhood of where this happened,
02:51and he also has a hand injury.
02:54We'll probably start with him first.
02:56I don't know who the victim is yet.
02:58Hopefully, I can learn about that as well.
03:05Hey, buddy.
03:09I didn't even see a little bit.
03:12Well, first off, I appreciate you coming down here.
03:16I'm Detective White, Jason White.
03:19Let me make sure that I've got your correct information.
03:21It's Craig Evan Burton.
03:23Yes, sir.
03:24Where were you last night?
03:26St. John's Hospital.
03:28Where were you doing in the hospital?
03:30I had an accident.
03:32I banged my head pretty freaking hard, man.
03:37I mean, it wasn't because of a fight or anything like that.
03:43I mean, it was...
03:44I haven't said anything about a fight.
03:45Well, I'm just saying, I just wanted to let you know that it wasn't about a fight.
03:50We're investigating a situation where a guy got assaulted, okay?
03:53Oh, no.
03:54No.
03:55Okay.
03:56Then how did you hurt?
03:57I'm noticing your hand, it looks like it got hurt.
03:59What's this from?
04:00My hand is tore up.
04:02From what?
04:03Not from a fight.
04:04Not from a fight, sir.
04:08Do you ever use a cane?
04:10Yeah.
04:11Where is it?
04:12I don't have a clue.
04:16Perfect.
04:17I'll be back shortly.
04:24I don't know.
04:25He's got a fresh injury.
04:27He's got some blood on him.
04:29We'll see.
04:30I don't want to just rip into him because, quite frankly, he could be telling me the truth.
04:37All right.
04:39Is it Mickey?
04:40Tell me about your night last night.
04:46Who's we?
04:47I'm Craig.
04:50So you were hanging out with Craig?
04:52Uh-huh.
04:53Okay.
04:55Did anything happen?
04:56Was there any kind of altercation?
04:59Not that I know of.
05:00Not that you know of.
05:03You have, I want you to look down at your arms.
05:05What is that?
05:07Blood.
05:08That's blood.
05:09Lots of blood.
05:10The injuries that you have on you right this minute, to me, look like from a fight.
05:16Is that fair to say?
05:17Yes, sir.
05:18Okay.
05:20Did you get into a fight last night?
05:22No.
05:24Did somebody hurt you last night?
05:26I don't know.
05:27No.
05:28No.
05:29Are you and Craig pretty good friends?
05:30Yeah.
05:32Are you good enough friends with Craig that where you would lie for him?
05:34Well.
05:35I don't know.
05:36I've spent some circumstances.
05:37If it's a big enough crime, I wouldn't want to put myself involved in it.
05:41Would you lie to me if it's a big crime?
05:42Yeah, I would.
05:43Okay, well let's not do that today.
05:44Okay.
05:45Let me show you this picture of this guy.
05:46Who's this?
05:47White shows Mickey a picture of Craig, the other man found near the scene.
05:49Recognize that guy?
05:52No, he's gone.
05:54And I saw him because of his family.
05:55He's gone.
05:56I know.
05:57Right?
05:58He's back.
05:59Yeah.
06:00I'll know.
06:01I'll know.
06:02Would you lie to me if it's a big crime?
06:03Yeah, I would.
06:04Okay, well let's not do that today.
06:05No.
06:06Let me show you this picture of this guy.
06:09Who's this?
06:12White shows Mickey a picture of Craig, the other man found near the scene.
06:16Recognize that guy?
06:19Uh-uh.
06:21I don't.
06:25All right.
06:26Let me holler at him right quick.
06:34He's saying, Craig, Craig was with us.
06:36Well, that's contestant number one.
06:38I show him a picture of him.
06:39I said, you know this guy?
06:40No, never seen him before.
06:42That's not Craig.
06:42Mickey has already said that he would lie
06:46to protect himself and somebody else.
06:49Could he be lying for this guy?
06:51I don't know.
06:56OK.
06:57We have a name for somebody else.
07:00Craig Henderson.
07:03Investigators still at the crime scene
07:05find an ID card.
07:07A little bit of work.
07:09They're going to make me work for it a little bit.
07:10That's OK.
07:12Oh, that might be my victim.
07:16Hang on a minute.
07:17All right.
07:17Hey, that's going to be the victim.
07:22The victim's going to be Craig Henderson.
07:27That's an ID card of the victim.
07:29They said it looks consistent with him.
07:31So that kind of clears up the mystery of the Craig.
07:34All right.
07:40Now we're cooking.
07:44Who's that?
07:46Mr. Craig.
07:47OK.
07:49Did you lose any teeth last night?
07:51No.
07:53I'm going to shine my light in there just to make sure, OK?
07:57Now, I'm not a dentist, but it looks like you have a tooth
07:59that's broke off on the bottom part of your jaw.
08:03I don't remember that.
08:05Was Craig hurting you?
08:09Yeah.
08:10How did he hurt you?
08:13It was like with a cane.
08:14He hit you with the cane.
08:16Craig uses a cane.
08:18Yeah.
08:19Who started the fight last night?
08:21I don't know.
08:22OK.
08:23Would you consider it one of those things
08:26where it just happened because of out of anger?
08:29Yeah.
08:30Just kind of a fight that went too far?
08:33OK.
08:34So it was just the two of you that were fighting.
08:36Is that right?
08:36Yeah.
08:37What made you decide to tell me the truth?
08:40I don't want to get nobody in trouble.
08:43All right.
08:44Well, that takes a man to do that, so I appreciate it.
08:46Good for you.
08:47OK?
08:48I'm going to get rid of this other guy then.
08:53So it just so happens we have a guy that's up here
08:59whose name happens to be Craig with a huge black eye
09:03who actually walks with a cane on occasion.
09:06So that's a totally different Craig
09:07that just happened to be walking along?
09:09Yeah.
09:09Yeah.
09:10With blood on him as well.
09:11You know, what are the odds?
09:13Nothing to do with it.
09:16Absolute coincidence.
09:17OK, buddy, I'm going to tell these officers
09:25that I'm good to go with you, and they'll
09:27take you anywhere you need to go.
09:30Mickey's been very cooperative at this point.
09:33And I believe, I think that he really doesn't really remember
09:36a lot of what had happened last night.
09:38He just knows that they were fighting,
09:39and it went too far.
09:42We're going to go with first-degree manslaughter.
09:44I think it's good that he came around.
09:46Do you happen to know any of his relatives?
10:09I know I'm racking your brain, probably,
10:10because that's a long time ago you guys were married.
10:12I'm sorry for this kind of a phone call,
10:16but I appreciate your time.
10:19Bye-bye.
10:22We did get in touch with the ex-wife.
10:24They've been divorced forever.
10:26What we're learning about him is that
10:27he just didn't have any relatives around.
10:29So, I mean, usually there's somebody you can find.
10:33For the most part, everybody's got somebody out there
10:35that loves them.
10:35And I'm just not, I'm not hearing that
10:37in this particular case.
10:38It's sad.
10:42The city of Tulsa saw a violent year in 2016
10:56with record-breaking homicides,
10:58armed robberies, and assaults.
11:00The Tulsa County District Attorney's Office says
11:02most of those crimes involved a person
11:05who was affiliated with a gang.
11:06It's this fear that has the Tulsa Police gang unit
11:10out in full force.
11:12The gang's unit recovered both guns and ammo
11:15after they served nearly a dozen search warrants.
11:19It's a lot like street terrorism.
11:21Police say what makes this so frightening
11:23is that there's no specific geographic boundaries
11:26for this gang violence.
11:28Did you see anything?
11:36No, I just see a couple of guys who were on.
11:48Yeah, this dude's bleeding.
11:49The crime scene's going to be over at the car wash
11:59where they have caught at.
12:00The victim is Elon Shaw.
12:1928-year-old Elon Shaw worked at a popular barbecue restaurant
12:24and was the loving father of two daughters.
12:27The victim's friend, who was unharmed,
12:40has been taken to homicide for questioning.
12:47There's one there.
12:52There's some out here.
12:57The gentleman said blackmail, white shirt, black shorts.
13:08Run that way, holding his waistband.
13:10I'm going to hit Boston, the other north.
13:13Over here.
13:15You ready?
13:17While detectives searched the neighborhood for the runner...
13:21You ready?
13:22Brown and Schilling head to homicide
13:24to interview the victim's friend.
13:27With the recent events that we've had,
13:31people just randomly shooting,
13:33it sounds like it fits in
13:35with the rest of this garbage that's going on
13:37in the last few weeks.
13:39Bright daylight in the car wash.
13:42You know, the gang lifestyle,
13:45friend after friend gets locked up,
13:48but you have to still keep just randomly shooting
13:50at each other over nothing.
13:51Well, hopefully he's got some information
14:04about who the shooter is.
14:06That would be nice.
14:14What happened?
14:14I was washing my car.
14:19It was up there for about an hour.
14:22You know, I was sitting in the back seat.
14:25You know what I mean?
14:26I thought it was fireworks.
14:28I'm not paying nobody no attention.
14:30I'm not even thinking about nobody's shooting.
14:33So then when I looked,
14:35there was a dude standing there shooting.
14:36He had on a white T-shirt
14:41and a little sailor hat.
14:51You getting that?
14:52Yeah.
14:54You got to strike while the iron's hot, man.
14:57Because if you don't, forget it.
14:59Nobody's going to care about this thing.
15:02You got to get them
15:02before they've been intimidated.
15:07Babe, we already had white T-shirts
15:09on the cigarette.
15:11Now he's banging on the windows.
15:14We may want to try to talk to him.
15:18I'm right there.
15:19Yeah, we need to check in before we shizzle.
15:21Okay, stop, stop.
15:25Come here, man.
15:26False police, come here.
15:27We want to talk to you.
15:32Yeah, we need to check that guy.
15:43He's got that door cracked, Ronnie.
15:47He's looking out the windows.
15:59Well, here we go.
16:00Come on back here.
16:08Relax.
16:11Why didn't you just come talk to me?
16:13Because he was drunk.
16:15He is not the man
16:16detectives are looking for.
16:19He did the right thing
16:20by coming out and talking to me.
16:21If you hear something,
16:22would you please call me?
16:22He sure will.
16:23We should win.
16:25Let's go.
16:30Do you know who this guy was?
16:33I haven't seen his man before.
16:35Why are they shooting at you guys?
16:37You claiming anything?
16:38I'm claiming nothing, man.
16:39I got two little kids.
16:41The victim's friend
16:42says he and Elon
16:43have nothing to do
16:44with the local warring gangs.
16:48Yeah, and it just
16:49entered the chamber.
16:50That's when I realized
16:51that I saw my chance to run.
16:53And I seen Elon.
16:56I ain't seen no blood,
16:57no nothing.
16:59He didn't look like
16:59he was shot
17:00when we ran across the street.
17:06I don't know if you know
17:08Elon
17:09has died.
17:14No, he didn't.
17:17No, he hasn't, man.
17:18This is no longer about you.
17:21It's your man.
17:23This is about
17:24what happened to Elon.
17:26And you are a part of that
17:28because they're shooting at you.
17:37Yes, I'm from 27th Street.
17:39I have not been active since 07.
17:43Okay, so what about Elon?
17:44Has he done something?
17:46He's never been in trouble.
17:48Other than tickets.
17:49You won't find him
17:50in the system for nothing.
17:53He's not a target.
17:55Why do you assume
17:55he's not a target?
17:57He was aiming.
17:58He was aiming at me.
18:00But you don't know why?
18:01I don't know why.
18:02If you did know,
18:03would you tell me?
18:04Yes, because he's dead.
18:07Ain't nothing I can do, man.
18:09I can't bring him back
18:10no matter what I do.
18:13I can't bring him back.
18:14Mm-hmm.
18:18I think 27 is a Hoover set.
18:28The Hoover Crips
18:29is the big daddy group,
18:31and then there's a bunch
18:32of little siblings running around.
18:34You know, there's the 107 Hoovers,
18:35the 5-4th Street Hoovers,
18:37the 29th Street Hoovers,
18:39or 27th Street Hoovers.
18:40But they don't get along
18:42all the time.
18:44Any one of those kids
18:45can grab a gun
18:46and shoot it up,
18:47and then they have
18:48their street cred.
18:49So the Elon Shaw case
18:51was going to be
18:52a tough one to crack.
18:55It is frustrating
18:57when you're dealing
18:57with gang shootings.
18:59Always the possibility
19:00of retaliation.
19:02Different sets
19:03keeping their mouths closed,
19:04not saying anything,
19:05and believing that they will
19:06take care of the issues
19:07themselves.
19:08Detectives say
19:13our entire community
19:15is at risk
19:15with the recent surge
19:16in gang violence.
19:18When is enough enough?
19:20And many of them,
19:21including last week's
19:23murder of an innocent bystander,
19:25have gone unsolved.
19:26I asked Sergeant Walker
19:27why.
19:28It's going to take people
19:29putting those gang members
19:30in prison.
19:31And unless those people
19:33step up to give police
19:34what they need,
19:35Walker says
19:36the killings
19:37will not stop,
19:38and any of us
19:39could be next.
19:41six months later,
19:51Elon Shaw's friend
19:52is back at homicide.
19:54Okay.
19:56It has come to my attention
19:57that you can talk
19:58to a couple of detectives
19:59this morning.
20:00He has been arrested
20:01and is in jail
20:02on an unrelated charge.
20:04I actually
20:06seen the person
20:07that did it.
20:09I'm on the same part as him.
20:12Look,
20:12he gave me
20:13when I seen him,
20:15and I'm looking,
20:16figuring out,
20:17you know,
20:17like,
20:18damn,
20:18that's the dude
20:18that was shooting at me.
20:20I ain't never had no work.
20:22That man never did
20:22nothing.
20:23I don't even know him.
20:24I mean,
20:26I understand
20:27rival gangs,
20:28but typically,
20:29don't you kind of know who?
20:30Nothing necessarily.
20:32It's on some gangbangers,
20:33though.
20:34They know you
20:35from another side,
20:35they'll shoot at you.
20:36That's just,
20:37that's how it is.
20:39You know what
20:40he's locked up for?
20:41Murder.
20:43He tell you that,
20:44or you find out by...
20:45He said it.
20:50We've got a little bit
20:51of homework to do on that
20:52to confirm
20:53whether or not
20:54that guy is out
20:54on the streets
20:55or if he's locked up.
20:56It's just a matter
20:57of proving it to be true.
21:18Hey, Lillard,
21:18do you need
21:18to require medical?
21:20Run!
21:20Now he has my gun.
21:22Okay,
21:22what's going on there?
21:23My girlfriend's in there.
21:24I came home
21:25on my lunch break.
21:26He was in there.
21:28He came up behind me.
21:29Who is that?
21:31Our neighbor.
21:32Your neighbor?
21:33Does he have the weapons?
21:35He has my gun.
21:36Do you need
21:37medical attention?
21:39I don't,
21:39but I don't know
21:40if she does.
21:41My girlfriend's in there.
21:42Okay,
21:43I'll get officers
21:43on the way.
21:43Hey, Diana,
21:55do you have
21:55any more information?
21:57Once we came home
21:58and found
21:59a chair
22:00with her girlfriend,
22:03she's got
22:03stimulation,
22:04stuff going on.
22:06Does it look like
22:07she's going to go
22:0710-7?
22:09All right.
22:12The boyfriend
22:15came home
22:15and caught
22:16an intruder
22:17in the house
22:18that was assaulting
22:19the victim
22:19down there
22:19with a strangulation.
22:21They got a pulse
22:23back,
22:23but she's
22:23incredible.
22:2419-year-old Kelsey Tennant
22:44is a sophomore
22:45at Tulsa Community College
22:47training to help people
22:48with special needs.
22:50She recently became
22:52engaged to her boyfriend,
22:54Riley Allen.
23:00Boyfriend was
23:00sitting in the officer's car
23:01and he said,
23:02that's the same.
23:02Well, we need to get him
23:03down there.
23:05Suspect is in that
23:05police car
23:06and patrol car
23:06and face it to the east,
23:07right?
23:09Suspect is?
23:10Yes.
23:11Richard,
23:11y'all called suspect
23:12out of that apartment,
23:13right?
23:13Yeah, we got him
23:14out of there.
23:14The suspect
23:15was hiding in the bathroom
23:16in the apartment
23:17next door.
23:19He ran out of the apartment
23:20and went right
23:20into that apartment.
23:21Right.
23:22He doesn't stay there
23:22like that.
23:23He's pissed him.
23:31That was unreal.
23:32The suspect,
23:4441-year-old Greg Epperson,
23:46was a person of interest
23:47in two other investigations.
23:49I look at him
24:01and I'm going,
24:01that's Greg Epperson.
24:04Unbelievable.
24:05What are the odds?
24:09Yeah, we probably need
24:11to talk to her too.
24:12The owner of the apartment
24:14that Greg fled to
24:15is also taken to homicide.
24:17All right, thanks guys.

24:37some water?
24:38Can you need some water or something?
24:41He brought me something.
24:42I appreciate it.
24:43We'll just take you back to this room today, and then I'll start you.
25:13So I turned the key and opened the door, and I saw my rifle case laying on the stairs.
25:21It all happened so fast, I saw it, and then I saw him.
25:25Where was he?
25:26He was standing behind the door.
25:29He punched me in the face, and then I kind of stumbled backwards, and then he put me in a hold.
25:36And he's whispering stuff in my ear.
25:39I can't.
25:41I couldn't make any of it out.
25:45And so I punched him in the face.
25:48I slipped out of him and ran outside.
25:51And I ran into the lady that lives in this door.
25:55At this point, you have no idea with Kelsey?
25:57No, I didn't.
26:00Do you know if Kelsey's okay?
26:02She's critical. She's pretty bad.
26:04Yeah.
26:05I brought her back up.
26:11Yeah.
26:12She's technically brain dead.
26:13They just don't want to talk that way just yet, but that's basically what they're looking at.
26:30She's not going to make it.
26:37If we could have gotten him put away.
26:39This apartment where Epperson come out of, it belongs to the lady in there.
26:47That's who rents the apartment.
26:49I'll start on her.

28:03upstairs getting ready for work she says greg epperson suddenly showed up this morning
28:08because i'm really really hungry is it okay if i eat i was already dressed i was walking
28:13you're walking out the door she let greg stay as she left for work before returning in the afternoon
28:19i'm coming back and that's when my neighbor came out and he had blood all over him he said
28:25help me help me he's in my apartment he goes he has a gun and i was like what
28:31he was like i don't know if she's okay please please and i opened the door and there was greg
28:38in in the apartment in the kids apartment yes i said greg give me the gun and he said they're
28:44trying to kill me they're trying to kill me they're trying to hurt me and i said greg look at me
28:48give me the gun no one's gonna hurt you please just give me the gun and so i got the gun
28:54and i walked up the stairs and that's when i saw her right there and when i turned around to say
29:02something to him she was gone greg was he was gone okay but i just left 15 minutes earlier
29:10good witness i mean she puts him in the apartment right after the kid comes out of it so he's been
29:25attacked so how did he get in the sliding glass door detective mike zanoni gets new information
29:33from the crime scene
29:34she walked in on a burglary you probably went in the sliding glass door they went around a corner
29:41and found a bag of clothing and a cord with blonde hair on it right next to the victim's apartment
29:47she goes to work at 10 and she said she usually comes home two-ish she came home for lunch
29:52she walked in on a burglary
29:53wake up we gotta talk i have a seat in the back there
30:04gregory mike zanoni how you doing
30:15okay do you want to talk about the incident that happened at the apartment
30:22well see we haven't had any rest either so we're sitting here and we're ready to talk now
30:44now you can either do that or not that's your choice
30:47okay we'll be back with you
31:00all right
31:01this is a sad one this hurts this murder here
31:12that should never happen to that girl
31:17boy it's terrible
31:20baby yeah can be it's okay
31:33yeah can be it's okay
31:41Brian just be truthful about everything yeah we're pretty good at detecting when people are
31:57lying I want you to just be truthful start off with the incident what happened on the incident
32:03yeah on the instant incident yeah I was in the backseat playing with his gun he was playing around
32:15playing around keep playing it around and like I guess a shot fired that's it that's a really good
32:23version I don't like it because it's bull because there's things called forensic evidence at the
32:31scene and like I said we've been doing this for years so why don't you tell me the truth this time
32:37let me look see what it looks like
32:55the victim's 16 years old guy shot man
33:03godly young octavio serrano yeah 16 year old octavio tavo serrano was a student at mclean high school
33:17in Tulsa the witnesses in the back of our cars a friend who called 9-1-1 was with the victim when
33:28patrol arrived oh Brian that's the witness the victims in the passenger seat playing with the gun
33:37the gun goes off so they pull over and he calls 911 and starts CPR and all that stuff
33:43they have a lawnmower hanging out of the trunk that he couldn't explain why it was back there
33:50acted like he didn't know it was there was he acting a little suspicious at all or uh yeah what he said
33:56wasn't adding up weird area for something like this this is probably the highest in neighborhood in the
34:03entire city I mean you've got million dollar homes over here so this is not a neighborhood that we
34:08deal with this kind of stuff we're in
34:10hey what's up man oh not much what's up got a uh I mean the story's messy the scene's pretty contained
34:22it looks like these two guys were out here probably burglaring they're wearing little gloves
34:27there's like nothing in the car to suggest that he was shot inside the car
34:36we have not found a single drop of blood inside the car um but he's got yeah he's got down drops on
34:43the curb on his shoes on the bottom of his pants which you wouldn't have if you were in a seated
34:50position so guns right there and uh that's going to be your casing right there that's not supposed
35:01to be out there right especially with the windows up yeah when you have the windows up it's not going
35:08to do that no this don't make any damn sense hey john thanks for coming in do you know if there's a
35:17butthole in the deck of the trunk no I didn't on the driver's side sorry
35:22looks fresh they're in an odd spot that is weird but if the trunk is open due to the lawnmower
35:35yeah that goes through he didn't get shot in this car detectives believe the victim was standing
35:47behind the car and was shot through the open trunk but he didn't shoot himself no this guy's standing
35:54back here messing with the lawnmower trying to get it into the trunk and this guy's over here
35:58messing with the gun shoots his friend through the trunk the angles all look right right now it does
36:04the casing would be over there there's no blood so that means that he would have had to stumble over
36:13here we'll talk to this kid and see what he's got to say it could have been somewhat of an accidental
36:20situation I can promise you this it didn't happen while they were driving down the street
36:25why were you guys over in that neighborhood we were just cruising
36:38octavio he was in the back he was playing with his gun back here and like I guess it just boom
36:51all right listen I'm gonna give you a fresh time to do this again because that's that's a bunch of
37:04nonsense would you agree with that all right here's the deal okay he's he is dead octavio
37:16he's dead yeah he's dead that's why this is a very very serious matter
37:21hold up hold up
37:23you want some water
37:28yeah
37:29I know it's horrible for you okay
37:36there's no doubt that you guys were friends this is why it's important
37:41to tell me everything I just need to know what happened and how he got shot
37:48based on where the gun is and where other things are I don't think he shot himself okay
37:58we're gonna meet up so like you know we can hang out he wanted his gun I'm like for what bro we're
38:09going to the store like who you had problems with bro you just want to look cool you know
38:15I'm like give me that gun bro like you're 16 years old well like I took it away from him
38:21like you know I took it away from him later on we got out the car and he was just like trying to
38:28like take it away you know and I was like bro stop bro like I know you you're crazy and I'm not here
38:36bro I just went like that like and when he caught it like I guess like the the thing you know like
38:45I'm gonna show you a couple of things here's a view of the car okay this is the driver's side of
39:00the car your friend is laying over here by this driver's side you see this bullet hole right here
39:07this is straight on gunshot to the trunk of the car right here you claim that you're standing over
39:15there on the front of the car that you throw the gun over to him over here that's not possible
39:20so I we need you to be honest it's either an accident or it was an intentional situation
39:27intentional means like wanting to kill somebody yeah I don't think you would have done that to your
39:33friend intention like this happened look that was back there he threw it at me and when I caught it
39:43like you know okay so when you caught it it just accidentally went off fired yeah okay so just so I'm
39:52clear you were holding the gun and the gun went off basically
39:56the physical evidence was everything in this case everything when we confronted him with the
40:14pictures of what we were talking about it went from his minimizing to this is what happened
40:19the gun went off while in his hands thus striking him at the back of the car it's a death resulting in his negligence
40:49we're going to head to the victim's mother's and notify her of her son's death which is going to be
40:59miserable because he's 16 years old
41:01hello Irma do you mind if we step in
41:31they were very gracious to us we had Brian's family showing up as well his dad showed up just
41:51beside himself devastated Brian's brother arrived he was super upset and you could tell that they're
41:59close with this family and that they were really good friends they were like best of friends and such
42:03running around in the streets late at night with a gun it's not a good idea
