00:13summons to Red Chili, which is owned by Shahrukh Khan and his wife, Gauri Khan, it seems Samir
00:20Vankhle has now chosen to speak and he has chosen to speak exclusively to India today. Vankhle has
00:28said that he has full faith in judiciary. Remember, he has accused the Netflix series of causing
00:36trolling of not just him, but also his wife. So, Samir Vankhle had filed a defamation suit
00:42and he had demanded two crore rupees as compensation, which he said he intends to give to Tata Memorial
00:49Hospital.
00:50Mr. Samir Vankhle now joins us on the phone line. Mr. Samir Vankhle, do you see the Delhi
01:03High Court's summons which have been issued to the Netflix, perhaps the first step towards
01:09a vindication in your petition?
01:11Mr. Samir Vankhle, I have a complete faith and trust in the honourable judiciary of the nation. And especially,
01:20officers like us who have been, you know, fighting for the right cause. So, we have complete trust
01:27faith on the national system and as well as on the judiciary.
01:31Mr. Samir Vankhle, in your petition, Mr. Vankhle, you claim that your sister and wife have been trolled
01:39after the Netflix series. Many would say that the Netflix series, the bads of Bollywood has
01:46only parodied you.
01:47Mr. Samir Vankhle, Maria, see my, as you mentioned, you know, my wife, my sister, my
01:53family, they have nothing to do with some kind of incidents, what I do, what I don't do,
01:57basically.
01:58Mr. Samir Vankhle, they are woman, and nothing related to my jobs. But unfortunately, not even
02:02trolls, they are facing hate-mails, threats from even countries like Pakistan from countries
02:08like Ui. And surprisingly I mean, anything absolutely has to do with my job of his why with anything
02:14but why are they facing one basically but nonetheless this is a bad to be issues
02:21this is a very smaller issue but here I'm fighting for the right of the law
02:26enforcement officers who are giving the life to the nation they are fighting
02:30against a serious issues like drugs they are giving blood to the nation they
02:34cannot be mocked they cannot be lampoon they cannot be humiliated like that so
02:39do you see the bads of Bollywood perhaps humiliating or lampooned the
02:44two words that you have used right now the law enforcement agencies see see
02:50whatever my whatever my standards I have mentioned that before the Honorable High
02:55Court and whatever evidence is whatever is there I will produce that before the
02:59Honorable High Court might say let them do what I mean let them come up with their
03:03say or something like that for the Honorable Judiciary to decide Mr. Vankare what is
03:09your response to those who defend the entire Netflix series they say that
03:15satire is a form of art you know in the sense that it's art for art sake it's
03:22freedom of artistic the choice or expression
03:26see that that's up to them that for the court to decide what claim what they do but
03:30here there is an honor of the national emblem regarding satyem vijate I mean you
03:35just at the you know behest or at the expense of the national emblem there cannot be
03:40any satire about basically any national any you might be thinking like that I
03:44might be thinking like that nobody can make fun of the national emblem also be at cost of
03:50any second or anything like that yes there is an honor of a family here there is honor of the
03:55law enforcement agencies of the officers who have been fighting here there is an
03:59honor of the national emblem of the word like that so that cannot be taken lightly
04:02and rightly the Honorable Court will take a decision in that okay and how much will
04:07you be pursuing this case because of course the notices have been issued as I said as I said to
04:13the hilt and I have full faith on the judiciary and I stated earlier also I stand by it is there a
04:21possibility of some kind of out of court settlement I cannot say anything like that I'm fighting here
04:28for the right cause for the justice it is for the Honorable Court to provide justice and give you know
04:33give the you know outcome for that whatever I am you know claiming for Mr. Vankhadeh the other side
04:41please go ahead and one more thing Maria ji also one more thing I would like to say here the department
04:47is you know where we have been serving I mean the department like who are fighting the apex agencies
04:54like NCB like CBIC board so all are fighting drugs and that to own a very senior connotation you know
05:00so the department also cannot be taken for granted like that in nearly in the name of satire I mean
05:07what you know explanations have been provided given care it has been going on since then but it cannot be
05:13taken for granted you know I've seen the officers I've seen the NCB staff the constabulary who have
05:19been you know beaten up properly you know badly having been injured on the line of duty badly so that
05:25can be that cannot be mocked or be part of the satire maria ji but my last question then would be
05:31shouldn't the bureau take this up the anti-drugs bureau take this up rather than you as an officer
05:37see I'm an officer I'm a loyal servant of the government of India whatever I feel whatever I stand for
05:45I'm doing the thing what you know what my principles and what I stand for I cannot comment on other things
05:50but again I'm a serving officer you know I'm an IRS officer so whatever you know the wrong things have
05:59happened or whatever kind of satire whatever kind of thing that happened definitely I will take it up
06:04I won't you know be sitting quite on these kind of things all right Samir Vankadeh thank you for
06:09speaking to India today thank you now the Delhi High Court has issued summons in a defamation suit
06:18filed by the IRS officer Samir Vankadeh as we told you against Red Chili's entertainment the suit
06:23concerns Vankadeh's alleged defamatory portrayal in the Netflix series Bats of Bollywood directed by
06:30Aryan Khan so the judge also issued notice on Vankadeh's application for interim relief with the
06:37next hearing scheduled for October 30th Vankadeh's lawyer said an amendment application was filed
06:43and the case falls under Delhi's jurisdiction he added that the series caused defamatory online
06:49trolling of Vankadeh and his wife the court acknowledged the concerns but stressed that
06:55legal procedures must be followed before granting relief remember Vankadeh is seeking two crore rupees
07:01in damages which he intends to donate to Tata Memorial Cancer Hospital the suit requests
07:07permanent injunctions against the production house and others to stop the alleged false and
07:13malicious content in the series Vankadeh contends that the show was deliberately created to damage
07:19his reputation particularly since the related legal case involving him and Aryan Khan is still ongoing
07:25in the Bombay High Court and NDPS special court now joining us live is India today's Srishti Oja Srishti
07:34do tell us what happened in the court today
07:37well Anjali as we know Samir Vankadeh has filed his defamation suit against Aryan Khan's series
07:44The Bats of Bollywood which has been released on Netflix now on the first occasion when the high court
07:51had heard this matter for the first time they had raised questions regarding the maintainability of this
07:56case in Delhi saying that the suit in its present form is not maintainable in Delhi so following that
08:01today we saw Vankadeh's lawyer telling court that they have filed an application to amend the suit and he also argued
08:08that the territorial jurisdiction of this particular case does lie in Delhi he had earlier also told court
08:14that the series is being watched by viewers in Delhi and therefore there is a cause of action here not just that we also saw his lawyer raise concerns over the trolling that is being faced by not just Samir Vankadeh
08:24but also his wife he's claimed that these trolling there are several social media posts which are making extremely shocking and deprimatory allegations against him and therefore an injunction should be granted by the court
08:39Now we saw the court remark that everything cannot be injuncted in general because that will have wider ramifications and a due procedure needs to be followed
08:47The court said that it understands that he has a cause of action to come before court but there is a certain procedure in place which needs to be followed
08:54So therefore we have seen the high court today issue summons to the respondents in this case including Red Chillies and Netflix
08:59Court has also issued notice on the interim application through which Vankadeh has sought an interim injunction
09:03Now whether or not Samir Vankadeh would be able to get any interim relief in the form of any interim injunction whatsoever is something that the High Court will consider next on 30th October
